M Supervisor Constance O. Smith called the Meeting to order at 7:03 P.M. Present: Constance Smith, Supervisor James Mills, Councilman Robert Valdati, Councilman Robert Wallace, Councilman June Visconti, Councilwoman Elaine Snowden, Town Clerk Others Present: Albert Roberts, Attorney to the Town Joseph E. Paggi, Jr., Engineer to the Town Herbert Levenson, Zoning Administrator Tom Logan, Assessor Graham Foster, Highway Superintendent Ann Buckley, Comptroller rr The Supervisor asked all to join in the Pledge of Allegiance to the Flag at the commencement of the Meeting. MINUTES Councilwoman Visconti stated that there was an error which needed correcting in the Minutes of the Regular Meeting of September 29, 1993, on page 2, second paragraph under the section of Reports. The Supervisor's Report in referring to the "Budget", the word physically was used in error and should have read fiscally. MRS. VISCONTI moved that the above stated Minutes, be and they are hereby approved as corrected submitted by the Town Clerk. Seconded by Mr. Mills Motion Unanimously Carried Page 1 "04 931025.RGM REPORTS Reports for the month of September were received from the Town Justices, Supervisor/Comptroller, Receiver of Taxes, Building Inspector, Zoning Administrator Dog Control Officer. MRS. VISCONTI moved to accept the above stated reports and place them on file. Seconded by Mr. Wallace Motion Unanimously Carried PETITIONS & COMMUNICATIONS Correspondence was received from Frank Montegari, 134 Van Voorhis Terrace, Wappingers Falls, New York, 12590, requesting that the road Van Voorhis Terrace be changed to Rosewood Drive and also that a portion of Pine Ridge Drive connecting Hopewell Road to Van Voorhis Terrace also be changed to Rosewood Drive because of confusion by some people new to the area. Supervisor Smith stated that the other residents do not want to go through the inconvenience of changing the name. MR. MILLS moved to not change the name of Van Voorhis Terrace. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence was received from Mr. & Mrs. McLaughlin of Wappingers Falls, asking that the Town of Wappinger do something about the flooding of their property and home by heavy rains. Supervisor Smith stated that the problem had been turned over to both Graham Foster, Highway Superintendent, and Jay Paggi, Engineer to the Town, for evaluation. Mr. Foster stated that something would be done, possibly a catch basin, this year. Mr. Foster further remarked that the Town of Page 2 931025.RGM Wappinger is not responsible for severe rain storms, but are for 25 year storms and normal storm flooding. MR. MILLS moved that a letter be sent to the McLaughlins explaining the situation to them and that the Town will do what they can to relieve the problem. Seconded by Mr. Wallace Motion Unanimously Carried A letter was received from Graham Foster, Highway Superintendent, regarding the cleanup of the pond on Old Hopewell Road. Over the years, Mr. Kowalsky's pond has become badly silted as a direct result of the storm water drainage from the Wappinger Park subdivision. Mr. Foster agrees that the silt should be removed but he will have to rent an excavator for the day. MR. MILLS MOVED to allot $2500 for the job. Seconded by MR. VALDATI Motion Unanimously Carried A letter was received from New York State Disaster Preparedness Commission informing the Town that they will be receiving a check in the amount of $6,463.00 which is payment for 75% of the eligible costs as approved by FEMA. This is for the emergency snow plowing assistance provided through the Federal Emergency Management Agency. MRS. VISCONTI MOVED to accept this correspondence and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried Page 3 931025.RGM A letter was received from Mr. Earl Ferguson, 29 Pellbridge Drive regarding a penalty on his water/sewer bill. Mr. Ferguson says that the payment was made on time and that his check may have been misplaced at our end causing him to receive a penalty. The Supervisor stated that since there have been several calls such as this one, they will make up a motion saying that Debbie Brown, Water & Sewer Clerk, can automatically write them a letter to say "No, it is not our policy to do this." There is a policy in place according to Mr. Roberts, Attorney to the Town. The supervisor will amend the policy for the next meeting. MR. MILLS moved to have the Supervisor send Mr. Ferguson a letter saying that we are not going to waive the penalty and therefore discount his claim. Seconded by Ms. Visconti Motion Unanimously Carried An application for a Hawking & Peddling License was received from Mr. Michael D. Hickey, 4 Drew Court, Wappingers Falls, to sell and deliver high quality frozen foods. MS. VISCONTI moved to accept and approve the Hawkers & Peddlers License as requested. Seconded by Mr. Mills Motion Unanimously Carried Correspondence was received from the attorney who is handling our tax reviews, Emanuel F. Saris, in regard to a concomitant Stipulation of Settlement with Wappingers Falls Plaza Associates. S. VISCONTI moved to allow Mr. Saris to continue the settlement based on the input from Mr. Logan and Mr. McGrath. Seconded by Mr. Valdati Motion Unanimously Carried Page 4 931025.RGM Several reports were received from Mr. J. Paggi, Engineer to the Town. The first report is in reference to the All Angels Hill Road & Kent Road Intersection and Route 9D & Old State Road intersection. Mr. Paggi has met with Phil Grealy of John Collins Engineers, who has given a Preliminary Inspection Report of the above, but he is in need of some traffic counts at the Kent Road and All Angels Hill Road intersection. This will be done by J. Paggi. Several traffic warrants must be met before it can be erected. In reference to the intersection plan prepared for Nicole Farms, dated 8/30/88, a letter from Mr. Levenson, Zoning Administrator should be sent to Mr. Klein, stating that although this work is bonded and guaranteed to be done, the Town Board and Planning Board would appreciate that it "get" done. In reference to Route 9D and Old State Road, the only apparent solution is to possibly raise the bottom of the state road so that the cars coming from the north have visibility of that new T Intersection. John Collin Engineers is evaluating in more detail relative to drainage and impacts on adjoining driveways. At this time they are continuing to review these two intersections and will provide more detailed recommendations. The second report from Mr. J. Paggi is in reference to the Salt Shed Change Order from Park Lane Construction in the amount of $5,931.00. All items are accurate and in conformance with the Contract Specifications; therefore, J. Paggi recommends that payment be made in the Change Order amount of $5,931.00 MR. VALDATI moved that we authorize the Change Order in the amount of $5,931.00. Seconded by Mr. Mills Motion Unanimously Carried Page 5 931025.RGM The third report from J. Paggi regarding a letter they received from Cynthia Schunzel, Greer Toyota Ltd., asking if it is possible for the sewer line to be extended prior to completion of the Phase 3A plan. Their answer to this would be negative, as the Town Board does not have the power to extend this line prior to Audit & Control authorization. The next question is whether or not they would have the right to discharge their car wash directly into the sewer collection system assuming that they use a biodegradable soap or would they have to treat the water first. J. Paggi reviewed the sewer use ordinance and it was their opinion that they would be able to discharge it directly into the sewer. They are assuming that the heavy grit particles from the car wash would be settled out in some type of a separator. J. Paggi recommended that the Town Board run this by the Tri -Municipal Engineers for formal concurrence, and then report back to Greer Toyota with their findings and Mr. Paggi's. MS. VISCONTI moved to have the Supervisor answer the letter in writing to Greer Toyota so that it will be part of the file for the next phase. Seconded by Mr. Valdati Motion Unanimously Carried The fourth letter from J. Paggi is in reference to the Wappinger Sewer Transmission/Treatment Improvement Area - Phase 1, Contract No.1 (Pillari Bros.) and Phase 1, Contract No. 2 (G.A.L.S. Inc.) Mr. James Bedore, Project Engineer, states that last month he was given authorization to put a water main within our casing and it is now complete. Page 6 931025.RGM The Wappinger Sewer Transmission/Treatment Improvement Area transmission main would be on the bottom, and an 8" ductile iron water main would be suspended at the top for future use by the Town. Pillari Bros has given a price of $8,300.00 to supply all labor, equipment and material to install 102 linear feet of 8" D.I.P. Class 52 with field lok gaskets within the proposed 60" casing. Mr. Incoronato questioned what water district this would be for and where was the money coming from. Mr. Paggi explained that the funding would come from B Fund - a general town charge outside the village. Mr. Bedore also proposes to install water lines under the 9D crossing at a price of $8300.00. MS. VISCONTI moves to authorize the expenditure of the $8300.00 for the extension of the water line under 9D. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Bedore added that both Contract 1 and Contract 2 came in below their estimated cost. Under Contract 3 they had a tie-in link between G.A.L.s jobs and Pillari's jobs which they were going to do in 1995. They would like to do this now at a cost of $33,500.00 which would come from the SRF Fund. The County has plans within the next two years to straighten out that road and take our sewer which is on the shoulder and put it in their road, therefore, to wait and do it in 1995 would be extremely costly. MR. MILLS moved to have the job done now at the cost of $33,500.00 to come from the State Revolving Fund. Seconded by Ms. Visconti Motion Unanimously Carried Page 7 931025.RGM The latter part of the letter concerns Change Order No. 5 (5A, 5B, & 5C) which involves the use of the Dutchess County Sheriff and Town of Wappinger patrol vehicles for maintenance and protection of traffic as deemed vital by the Dutchess County Department of Public Works. Change Order No. 5A: Credit to Town of Wappinger (decrease of Contract amount) for utilizing one (1) Dutchess County Sheriff and Town Patrol vehicle for maintenance and protection of traffic during construction in lieu of union flagperson: Labor $5,230.40 Town Patrol Vehicle 780.00 (Credit to Town) $6,010.40 Change Order No. 5B: Payment owed to Dutchess County Sheriff for maintenance and protection of traffic during course of construction: $3,215.30 Change Order No. 5C: Payment owed to Town of Wappinger for usage of Town Patrol vehicle by Dutchess County Sheriff during construction to insure maintenance and protection of traffic. $780.00 Change Order 5A, 5B and 5C will result in an overall savings to the Town of Wappinger: G.A.L.'s Inc. Credit $5,230.40 D.C. Sheriff Payment $3,215.30 2,015.10 Town Patrol Vehicle + 780.00 $2,795.10 MR. MILLS moved in favor of the Change Orders. Seconded by Ms. Visconti Page 8 Motion Unanioumsly Carried 931025.RGM The fifth letter was in reference to a letter from Mr. Hindu Samaj of Brown Road, requesting to hook into the Rockingham Water & Sewer district. Mr. Paggi recommends tying in and our records indicate he is located in the water district. MR. VALDATI moved to allow the Central Wappinger Water District line to be extended to accomodate Mr. Samaj to tie into the lines. Seconded by Ms. Visconti Motion Unamiously Carried MR. MILLS moved for Mr. Samaj to become a tenant to the Rockingham Sewer District until such time as Phase 3A of the Sewer Line is completed. MR. MILLS ammends the resolution to include that the rates are to be determined by the Town Board. This will be determined at the next workshop. Seconded by Ms. Visconti Motion Unanioumsly Carried The last letter is in regards to stop signs at Robert Lane and Patti Place. Mr. Paggi comments that with respect to the easterly intersection of Robert Lane and Patti Place, it is felt that a stop sign should be placed on the westerly side of Robert Lane stopping traffic moving in a south bound direction. It was felt that there was no need for signage on the Patti Place leg of the intersection. It was also noted that tree branches located on the westerly side of Robert Lane, north of Patti Place, should be trimmed �■ back to provide for better sight distance. MS. VISCONTI moved for the Attorney to the Town, Mr. Albert Roberts, to draw up a resolution for a local law. Seconded by Mr. Valdati Motion Unanioumsly Carried Page 9 931025.RGM At 7:57 p.m. Mrs. Smith called for a five minute recess in order for the students from Ketcham High School who were attending the meeting for extra credits, could have their papers signed by the Town Officials confirming their presence at the meeting. The meeting was called back to order at 8:04 p.m. and all five Board Members were present. COMMITTEE REPORTS Mrs. Visconti commented that Recreation has changed its meeting time so that she will now be able to attend. Mrs. Smith gave a short report on the recycling schedule for December 25th and January 1st and feels they should close the recycling those two Saturdays. The new schedule for those two days would be December 27th and December 31st. BONDS & LETTERS OF CREDIT Mr. Levinson finally has Suozzo resolved. He received the corrected bond today, and filed it in Mrs. Snowden's office. Correspondence was received from Wyndham Crossing and the bank is drawing a Letter of Credit. MRS. VISCONTI moved to accept the report and place it on file. Seconded by Robert Wallace Motion Unanimously Carried RESOLUTIONS Public Hearings having been held on the Benefit Assessment Rolls for the Water and Sewer Improvement Areas and Districts on October 25, 1993, the matter was placed before the Board for their consideration. MRS. VISCONTI moved to adopt the Benefit Assessment Rolls for 1993 for the following: Wappinger Sewer Improvement Areas #1, Page 10 931025.RGM Wildwood Sewer District, Mid -Point Sewer Improvement Area, Rockingham Farms Sewer District, Wappinger Sewer Treatment/ Transmission Improvement Area #1, Wappinger Sewer Treatment/ Transmission Improvement Area #2, Fleetwood Sewer District, Watch Hill Sewer District, Fleetwood Water District, Oakwood Water District, Central Wappinger Water Improvement Area, Ardmore Water Improvement Area, Tall Trees Water Improvement Area, Wappinger Park Water District, North Wappinger Water District, Wappinger Cranberry Water Improvement Area, Myers Corners II Water District. Seconded by Mr. Mills Motion Unanimously Carried 8b. Bids for Highway Graham Foster, Highway Superintendent, presented the bids which were opened on October 15, 1993, and are as follows: (1) One dump truck with sander and plow; Healey International - $42,319.87, Lazar's - $44,320.00. Mr. Foster recommends that the bid be awarded to Healey International. (2) One -ton double drum vibratory roller: Albany Ladder - $9343.75. Mr. Foster recommends that the bid be awarded to Albany Ladder. (3) One plow: Amthor's - $3600.00, Ralph Herman Co., Inc. - $4,911.00. Mr. Foster recommends that the bid be awarded to Amthor's. (4) Three sanders: Amthors' - $13,332.00, Ralph Herman Co., Inc. - $12,900.00, Dutchess Diesels - $14,997.00. The low bidder did not meet the specifications so Mr. Foster recommends the bid be awarded to Amthor's. MS. VISCONTI moved to accept the Highway Superintendent's recommendations on the bidding and award the bids to: Healey International for one dump truck with sander and plow; Page 11 931025.RGM Albany Ladder for one -ton double drum vibratory roller; and Amthors for the plow and three sanders. The following Resolution was offered by Councilwoman Visconti who moved its adoption: RESOLVED, that this Town Board does hereby prepare and approve as the Preliminary Budget of the Town for the fiscal year beginning on the 1st day of January, 1994, the itemized Statement of estimated revenues and expenditures hereto attached and made part of this resolution, and be it FURTHER RESOLVED, that such preliminary budget shall be filled in the office of the Town Clerk where it shall be available for inspections by any interested persons at all reasonable hours, and be it FURTHER RESOLVED, that this Board shall meet at 7:00 o'clock P.M. on the fourth day of November, 1993, for the purpose of holding a public hearing upon such preliminary budget, and be it FURTHER RESOLVED, that the Town Clerk give notice of such public hearing in the manner provided in Section 108 of the Town Law, and that such notice be published and posted in substantially the following form: NOTICE OF HEARING UPON PRELIMINARY BUDGET NOTICE is hereby given that the preliminary budget of the Town of Wappinger for the fiscal year beginning January 1st, 1994, has been completed and filed in the office of the Town Clerk, at 20 Middlebush Road, Wappingers Falls, New York, where it is available for inspection by any interested persons at all reasonable hours. Original Amount of Contract: $18,800.00 Fee for additional Services 4,480.00 MS. VISCONTI moved to authorize the Supervisor to sign the agreement for the additional $4,480.00. Seconded by Mr. Mills Motion Unanimously Carried L-1 The following resolution was offered by Councilwoman VISCONTI, who moved its adoption, seconded by Councilman WALLACE, to -wit: RESOLUTION DATED OCTOBER 25, 1993. A RESOLUTION CALLING A PUBLIC HEARING ON THE ISSUANCE OF SERIAL BONDS BY THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, TO PAY THE COST OF THE CONSTRUCTION OF AN EMERGENCY SERVICES BUILDING ON A PARCEL OF TOWN -OWNED LAND ON MIDDLEBUSH ROAD, IN WAPPINGERS FALLS, NEW YORK INCLUDING ORIGINAL FURNISHINGS, EQUIPMENT, MACHINERY, APPARATUS, APPURTENANCES AND INCIDENTAL IMPROVEMENTS AND EXPENSES IN CONNECTION THEREWITH. WHEREAS, by bond resolution dated and duly adopted July 26, 1993, the Town Board of the Town of Wappinger, Dutchess County, New York (the "Town"), authorized for the issuance of $1,500,000 serial bonds (the "Bonds") of said Town to pay the cost of the construction of an Emergency Services Building on a parcel of Town -owned land on Middlebush Road, in Wappingers Falls, New York, including original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith; and WHEREAS, the Bonds and any bond anticipation notes issued in anticipation thereof would constitute "private activity" bonds within the meaning of Section 141 of the Internal Revenue Code of 1986 (the "Code") due to the proposed use of said building by the Sloper-Willen Community Ambulance Service, in addition to use by the New York State Police; and WHEREAS, Section 147 (f) of the Code requires that bonds or notes which are "private activity" bonds within the meaning of Section 141 of the Code be approved by the governmental unit issuing such bonds or notes after a public hearing following reasonable public notice, in order for interest on the bonds or notes to be excludable from gross income for federal income tax purposes; and WHEREAS, the Town Board now desires to call a public hearing on the issuance of serial bonds pursuant to the July 26, 1993, Page 14 D W111 931025.RGM bond resolution and anticipation notes issued in anticipation of said serial bonds; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. A public hearing will be held at TOWN HALL, 20 Middlebush Road, in Wappingers Falls, New York, in said Town on November 20, 1993, at 6:50 P.M., Prevailing Time, on the question of whether serial bonds, and any bond anticipation notes issued in anticipation thereof, should be issued by the Town of Wappinger, Dutchess County, New York, to finance the cost of the construction of an Emergency Services Building on a parcel of Town -owned land on Middlebush Road, in Wappingers Falls, New York, including original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith, and to hear all persons interested in the subject thereof, concerning the same, and to take such action thereon as is required or authorized by law. The Town Clerk is hereby authorized and directed to cause a copy of the Notice of Public Hearing hereinafter provided to be published one in Southern Dutchess News, the newspaper hereby designated as the official newspaper for this purpose hereby designated as the official newspaper for this purpose and one having general circulation in, and available to residents of, the Town, such publication to be made not less than 14 days before the dated designated for the hearing. The Town Clerk is hereby further authorized and directed to cause a copy of such Notice of Public Hearing to be 1r.. posted in such places as he deems appropriate under the circumstances, such posting to be done not less than 14 days before the date designated for the hearing. Section 3. The maximum estimated cost of said project is $1,500,000, for which the issuance of $1,500,000 serial bonds of the Town have heretofore been authorized. It is proposed that the New York State Police and the Sloper-Willen Community Ambulance Service will occupy said building. The Town will be the owner and operator of said building. The project has been determined to be an Type I Action pursuant to Local Law No. 6 of 1992 of the Town and the regulations of the New York State Department of Environmental Quality Review Act, the implementation of which as proposed, the Page 15 931025.RGM Town Board has determined will not result in any significant environmental effects.
