RESOLUTION APPROVING RETAINER FOR ALBERT P. ROBERTS
AS ATTORNEY TO THE TOWN OF WAPPINGER
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 9th day
of February, 2004, at 7:30 P.M.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:
PRESENT: Supervisor - Joseph Ruggiero
Council Members - Robert L. Valdati
Vincent F. Bettina
Joseph P. Paoloni
Maureen McCarthy
ABSENT:
The following Resolution was introduced by
M. McCARTHY
V. BETTINA
and seconded by
WHEREAS, the Town Board has heretofore appointed Albert P. Roberts as Attorney to
the Town, to supply all legal services needed by the Town Board, the Planning Board and the
Town's various administrative departments, including the prosecution and defense of any legal
actions, lawsuits or other proceedings before any court or tribunal brought by or against the
Town and as authorized by the Town Board; and
WHEREAS, the Town and Albert P. Roberts have agreed on the fees to be paid to Albert
P. Roberts as more particularly set forth in the attached retainer letter dated February 4, 2004;

WHEREAS, the appointment of legal counsel is exempt from competitive bidding
otherwise required by General Municipal Law § 103.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby confirms the appointment of Albert P. Roberts of the
firm Vergilis, Stenger, Roberts, Pergament & Viglotti, LLP, 1136 Route 9, Wappingers Falls,
New York, as Attorney to the Town.
3. Albert P. Roberts, and the members of his firm, shall be paid in accordance with
the Schedule of Fees set forth in letter dated February 4, 2004, attached hereto and made part
hereof.
4. Supervisor Joseph Ruggiero is hereby authorized and directed to confirm the
Retainer Arrangement set forth in Albert P. Roberts' letter of February 4, 2004.
The foregoing was put to a vote which resulted as follows:

Re: Contract for Legal Services
Dear Joe:
This letter will confirm the terms of my employment as attorney to the Town of
Wappinger. My firm will provide all legal services required by the Town of Wappinger
for the period January 1, 2004 through December 31, 2005. This will include all legal
services needed by any of the Town's departments including the Town Board, the
Planning Board, and the various town administrative departments as well as the
prosecution and defense of any legal actions, lawsuits or other proceedings before any
tribunal as authorized by the Town Board. Legal services will not be provided to the
Zoning Board of Appeals, except on special appointment.
My firm will bill the Town at the following rates:
Attorneys - $150.00 per hour
Paralegals - $ 90.00 per hour
Legal Assistants - $65.00 per hour
Costs and disbursements - as incurred
All billings will be on a per hour basis with minimum billing as follows:
.2 hour - telephone calls
correspondence received
.3 hour - correspondence drafted and forwarded
2.00 Hours - Opinion letters issued in connection with Bonds and other financing
requirements.
1.5 Hours - Preparation of Deeds, Easements, together with accompanying recording
papers
All billings will be submitted on a monthly basis on vouchers provided by the Town.
