2010-1902010-190 Resolution Designating Town of Wappinger Parks and Playgrounds as Tobacco Free Zones At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on May 10, 2010. The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmembers ABSENT: Christopher J. Colsey William H. Beale Vincent F. Bettina Ismay Czarniecki Joseph P. Paoloni The following Resolution was introduced by Councilman Beale and seconded by Councilman Bettina. WHEREAS, smoking is responsible for the premature deaths of over 440,000 Americans each year from lung cancer, heart disease, respiratory illness, and other diseases; and WHEREAS, secondhand smoke is responsible for over 50,000 deaths amongst non-smokers each year; and WHEREAS, tobacco kills more Americans each year than alcohol, cocaine, crack, heroin, homicide, suicide, accidents, fires and AIDS combined; and WHEREAS, 80% of smokers started before the age of 18, and the average age of initiation is 12 years old; and WHEREAS, an estimated 3,900 young people under the age of 18 try their first cigarette and one-third of these children will die prematurely from tobacco related illnesses; and WHEREAS, to help role model non-smoking behavior to children and youth, and to provide children, youth and their families with a safe, smoke-free environment, the Town of Wappinger Town Board hereby designates all parks and playgrounds as Tobacco Free Zones. NOW, THEREFORE, BE IT RESOLVED, the Town Board hereby designates all public parks and playgrounds within the Town of Wappinger as Tobacco Free Zones, effective June 1, 2010. BE IT FURTHER RESOLVED, the Town Board authorizes the posting of signage at all public parks and playgrounds within the Town of Wappinger as Tobacco Free Zones. MASTERSON, TOWN CLERK Tobacco Free Parks and Playgrounds Dutchess County Residents Support Tobacco -Free Parks, Playgrounds and Outdoors According to the 2009 Community Tobacco Survey conducted by Baruch College Survey Research: 79% of Dutchess County residents support restricting smoking in parks and playgrounds. 77% of Dutchess County residents support restricting or banning smoking on beaches. 69% of Dutchess County residents favor smoke-free building entryways. 81% of adults in Dutchess County do not smoke. 89% of Dutchess County residents believe that exposure to secondhand smoke is harmful. Why Should Parks and Playgrounds be Tobacco -Free? Secondhand smoke: There is no safe level of exposure • The Environmental Protection Agency (EPA) has classified secondhand smoke, as a class A carcinogen - a substance known to cause cancer in humans. Secondhand smoke contains over 4,000 chemicals; 2,000 are poisons and 67 are cancer-causing agents. The 2006 Surgeon General's report concludes there is no safe level of exposure to secondhand smoke. • Secondhand smoke is responsible for over 50,000 deaths among nonsmokers each year. • Children exposed to secondhand smoke are more likely to suffer from ear infections and reduced lung function. • Secondhand smoke is especially harmful for children and adults with asthma and other chronic conditions. The EPA estimates that between 200,000 and one million asthmatic children have their condition worsened by secondhand smoke. Secondhand smoke is harmful in outdoor settings. • Secondhand smoke levels in outdoor public places can reach levels as high as those found in indoor facilities where smoking is permitted. Cigarette litter is hazardous • Cigarette butts are the most littered item in the world. They are highly toxic and dangerous to children and animals. Small children are at risk of swallowing, choking or burning themselves with discarded butts and suffering nicotine poisoning. Children model adult behavior • When children see adults smoking in family -friendly places such as parks and playgrounds, they see the behavior as acceptable. Smoking where children play is sending the wrong message to our children. • Every year in New York, nearly 36,000 children begin smoking. Everyday an estimated 3,900 young people under the age of 19 try their first cigarette and one-third of these children will die prematurely from tobacco related illness. • Parks are about enjoying clean air, natural beauty and healthy activities. Cigarette butts make parks and playgrounds look dirty and cause lasting damage, while secondhand smoke can cause cancer, asthma and other health problems. Smoking just does not fit in. There is no law that guarantees a person's "right" to smoke in parks and playgrounds. Dutchess residents have a right to protect our children, our community, our environment & our health. "Failure to ban smoking in outdoor public venues may expose non-smokers to levels of environmental tobacco smoke (ETS) as high or higher than received in indoor spaces where smoking is unrestricted." - James Repace, "Banning Outdoor Smoking is Scientifically Justifiable', Tobacco Control Digest, March 2000 "A no smoking policy in playgrounds and parks is important for family health and enjoyment. Playgrounds are a place for kids to enjoy healthy activities and getting good exercise. Allowing smoking sets a bad example and contributes to the growing problem of litter. Our children deserve a safe and clean place to play." - Kevin Giifeather, Superintendent of Parks & Recreation for City of Kingston, which has a tobacco free policy for all playgrounds. "As a parent and a frequent user of the beautiful parks in Dutchess County, I am very much in favor of tobacco free parks and playgrounds. Allowing smoking is a bad example for our children. The parks were designed with thoughts of healthy activities, children playing and bringing the community together. Publicity is Key... 5m*F] • Social norm change is an excellent enforcement tool as evidenced by the success of the compliance with the Clean Indoor Air Act (CIAA). - Enforcement was a frequently expressed concern prior to passage of the CIAA, however widespread media attention and community support quickly alleviated those concerns as the vast majority of people voluntarily complied. • Signage is the best means of promoting self -enforcement- tobacco users look to see if they can smoke and most will respect the rules. - Most community members follow rules and regulations. Most smokers will too. • Publicize the policy in all programs, in rules and regulation booklets for sporting events, etc. - Most municipalities that have gone tobacco -free have simple posted "Tobacco Free" signs and included the information in their park Bulletin, sports association rules and regs, on their websites and in the local media. When the policy is well -communicated... Signage is prominently displayed... And the policy is promoted as being for the health of the community and its children...
