ADJOURNMENT RM82492 The Regular Meeting of the Town Board of the Town of Wappinger was held on August 24, 1992, at the Town Hall, 20 Middlebush Road, Wappingers Falls, Dutchess County, New York. Supervisor Smith opened the Meeting at 7:20 P.M. Present: Constance Smith, Supervisor James Mills, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Robert Wallace, Councilman Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney Joseph E. Paggi, Jr. Engineer Graham Foster, Highway Superintendent Herbert Levenson, Zoning Administrator Supervisor Smith invited all to join in the Pledge of Allegiance to our Flag. The Minutes of the Regular Meeting of July 27, 1992, having previously been forwarded to the Board Members, were placed before them for their consideration. MRS. VISCONTI moved that the Minutes of the Regular Meeting of July 27, 1992, be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mr. Wallace Motion Unanimously Carried Reports for the month of July were received from Supervisor/ Comptroller, Town Justices, Receiver of Taxes, Building Inspector, Zoning Administrator, Dog Control Officer and Highway Department. MRS. VISCONTI moved to accept the above stated Reports and place them on file. Seconded by Mr. Valdati Motion Unanimously Carried RM82492 PETITIONS & COMMUNICATIONS --- A request was received from Irene Monitto, Rosewood Road, for "School Bus Stop Ahead" and "Hidden Driveway" signs due to heavy traffic from Pine Ridge Drive onto Rosewood Drive. Her driveway is not visible and drivers are not aware of it until they are on top of it driving at a speed way beyond the existing sign of "Curve 15 M.P.H.". The problem is that her young daughter enters and exits the bus at the driveway and she feels, from past incidences of speeding cars that barely missed hitting her, that further protection is needed and the signs will help. young girl. Since Mrs. Monitto indicated that the Highway Department had instructed her to write to the Supervisor, Mrs. Smith assumed that she had spoken to Mr. Foster on the problem and asked him how he felt about the request. Mr. Foster stated that he was very reluctant to start putting signs all over the Town. These requests seem to come up at a number of meetings and once they put it at one bus stop there will be more and more requests for additional ones and they then become unnoticed and fail to accomplish what they were intended for. Mrs. Smith agreed and stated that she would call the Sheriff's Department and inform them that they do not see much of the deputies on duty in the Town, also the State Troopers. Mr. Mills offered his suggestion that they should publicize the 30MPH speed limit, put it in the papers more often so people are more and more aware of it. Since the media was present, Mrs. Smith called their attention to the point made by Mr. Mills. It was pointed out that official approval for this townwide 30 MPH has not been received but the Board felt they should stress it since it would be forthcoming. MRS. VISCONTI moved to authorize the Highway Superintendent to send a letter to Mrs. Monitto explaining the Town's position on the requested signs and state the actions they were taking to RM82492 help alleviate the problem she stated in her communication to the Supervisor. Seconded by Mr. Mills Motion Unanimously Carried The following Certorari Tax Reviews were served on the Town: Conifer Development Inc, Vinco Realty Corp., Cedar Hill Development Corp., Three Co. Inc., Sunset Crest Association, T.H. Baker & Chas. F. Gilbride, KER Assoc, Wappinger Pine Tree Development Corp. and Friendly Acura, Inc. MRS. VISCONTI moved to refer the above stated Tax Certioraris to Emanuel Saris, Attorney to the Town appointed to handle Tax Reviews, to answer and defend on behalf on the Town. Seconded by Mr. Valdati Motion Unanimously Carried Several correspondences were received from Matthew D. Rudikoff Associates, Inc. regarding Revolving Loan Fund and Permits for SRF Project No. 5306-02. Mrs. Smith noted that these were informational reports to keep the Town abreast of what was going on. MRS. VISCONTI moved to accept these reports from Rudikoff Associates, Inc. and place them on file. Seconded by Mr. Wallace Motion Unanimously Carried Arthur Waddle, Secretary to the Hughsonville Fire District informed the Town Board that they recommended the appointment of Leonard Supple as replacement for Jon Wilson on the Fire Prevention Bureau. MR. MILLS moved to approve Leonard Supple, the designee of the Hughsonville Fire District, to replace Jon Wilson as a member of the Town of Wappinger Fire Prevention Bureau for a one year term which will expire in July of 1993. Seconded by Mr. Wallace Motion Unanimously Carried RM82492 A Report was received from Rudolph Lapar re Section II Engineers Report for Tri -Municipal Sewer Commission facility expansion (Town of Wappinger Phase I&II). Mrs. Smith noted that this was a report on a meeting regarding the odor problem which has existed since day 1 and the Town of Wappinger has acknowledged all along. At the July* 24, 1992 meeting, it was evident that the Commission members did not want to acknowledge that they have an odor control problem and both she and the Engineer to the Town discussed with Joseph Marcogliese from D.E.C. the fact that if the Town of Wappinger was not going to come aboard would they still have to take care of this problem and the answer is absolutely "yes". The report is for the information of the Town Board so they are aware of what they are doing. The Supervisor wanted to record in the Town Minutes that our Town will not be paying for all of this since it was a problem prior to the Town involvement and we will pay our share only. MRS. VISCONTI moved to authorize the Supervisor to forward a letter to the Tri -Municipal Commission, Michael Sheen, SRF Joseph Margogliese, DEC, Attorney General, informing them of the Town's position on the odor control; if this has to be implemented will the additional cost have any impact upon the bond issue that has already been issued, also if D.E.C. mandates the odor control, it should not interfere with the consent order schedule that the Town is adhering to. Seconded by Mr. Valdati Motion Unanimously Carried Notices were received from the Town of Poughkeepsie of Public Hearings on Amendments to Fire Prevention Code and Zoning, both schedule for August 26, 1992. RM82492 MRS. VISCONTI moved to accept the Notices of Public Hearings from the Town of Poughkeepsie and place them on file. Seconded by Mr. Wallace Motion Unanimously Carried Requests for return of escrow funds were received from: F. Vitiritti, Dandelion Enterprises, $4,901.50, M. Levine, Sterling Homes, Lot #1, Woodland Court, $1,000, Ron Price, $500, H. Redl, Office Plan, $15,365. The proper documents and recommendations were received. Mr. Mills had a problem with Mr. Redl's Office Plan and stated that the escrow should be held until the property was returned to its original state, graded and seeded. Mr. Valdati offered his opinion that the department head had recommended return of the escrow and that was according to the Town policy. Mr. Levenson pointed out that the escrow was being held for the services of the planning consultant, not for the completion of landscaping the property. MRS. VISCONTI moved to approve the release of the escrow funds as requested, upon the recommendation of the respective depart- ment heads. Seconded by Mr. Valdati Roll Call Vote: 4 Ayes Mr. Mills ---Nay (on Redl, Aye on Others) Mr. Levenson noted that a grading permit was issued to Mr. Redl and it is his responsibility to return the site to its original state relating to grading and seeding. There is no escrow involved for the grading permit and if he walks away from this responsibility, the Town has a problem. Although there was no reason to think Mr. Redl would do this, it still presents a concern in other instances and a possibility that the ordinance would have to be amended to require an escrow. They agreed that further discussion would be held on this matter. RM82492 The next item was a request from the Comptroller, Ann Buckley and Bookkeeper, Joyce Benedetto to attend the New York State Conference of Mayors at Ellenvi.11e, New York from September 21st thru the 24th, 1992. They have since withdrawn their request since there was some objection to two people attending the conference at a cost of $400 each plus hotel accommodations. Mrs. Visconti read the literature and felt that it would be beneficial for the Comptroller to attend, but there was not enough benefit for the Bookkeeper at this cost.. They decided to withdraw the request and wait for a less expensive conference that would provide more information for their positions. A letter was received from our Attorney to the Town, Albert Roberts regarding highway takings for road widening purposes on Widmer Road. MR. WALLACE moved to authorize Albert Roberts, Attorney to the Town to proceed with obtaining highway takings from Widmer Inn Restaurant Corp., Pine Clove Hollow Builders parcel, Engley parcel and Armstrong parcel, all located on Widmer Road. Seconded by Mrs. Visconti Motion Unanimously Carried Although the introduction and scheduling of a Public Hearing for the revision of the Ordinance on Peddler's License was on the Agenda, the Supervisor had additional changes to discuss with the Board Members and wished to place it on a work shop. MRS. VISCONTI moved to table action on revision of the Peddler's Ordinance pending further discussion at a future work shop. Seconded by Mr. Wallace Motion Unanimously Carried A request was received from Judge Morse and Judge Wolfson for the fulltime court staff members to attend the Annual Conference of the New York State Association of Magistrates Court Clerks, ,3 RM82492 at Ellenville, New York on October 19th and 20th, 1992. There was no objection to their attendance, however, both Mrs. Visconti and Mr. Mills asked that in the future, the agenda and cost of the conference be included with the request. Mrs. Smith pointed out that these were mandated courses. MRS. VISCONTI moved to grant permission to the three fulltime court staff members to attend the Conference in Ellenville, New York, on October 19th and 20th, 1992, as requested, and their legitimate expenses would be a Town charge. Seconded by Mr. Valdati Motion Unanimously Carried Mrs. Smith noted that the employees will not stay overnight but will travel back and forth those two days. A Notice of Intent to renew a liquor license was received from Ikhlas Annabi, dba, Robbie's Deli, Old Hopewell Road in the bow Town of Wappinger. MR. WALLACE moved to receive the correspondence and place it on file with no comment. Seconded by Mrs. Visconti Motion Unanimously Carried COMMITTEE REPORTS --- Mrs. Smith introduced County Legislator John Beale who wished to speak on activities at the County level. He noted that he was reporting on the past six months of the County Legislature and they had addressed more than 215 pieces of legislation including quit claim deeds for various pieces of property, memorializing the State to take some action on local laws and resolutions, impact of state mandates, overcrowded jail, domestic violence, etc. He invited questions from the public at the end of his report. Mr. Mills had no reports for this meeting. RM82492 Mr. Valdati visited our Recycling Site and spoke to the personnel regarding the program. They made a request that the items be cleaned before depositing them in the bins. He has observed the Highway Department doing resurfacing of the roads with micropaving which seems to be working out very well. He had a question for the Highway Superintendent --if roads have been paved over for many, many ,years and at a certain point they start to rise above an elevation of driveway thresholds; in the past the Town has had many drainage problems relating to runoff from Town roads, so his question was does he (Mr. Foster) foresee that there are any roads reaching a level where they may have to graded down to alleviate the possibility of additional drainage problems --Mr. Foster responded no. Mrs. Smith added that this has been discussed and it appears that there were several areas in the Town where the road seemed to be higher than the building and some of them were built incorrectly to begin with, the houses were already too low. They will revise the policy governing the building specs and make sure the houses are built higher to avoid this situation. Mr. Paggi, Engineer to the Town, made note of the fact that the revised Highway Specs require that driveways must have for its first 25 foot deep a positive grade of at least six inches and that should work very well to alleviate such a problem. Neither Mr. Wallace nor Mrs. Visconti had reports for this Meeting. Mrs. Smith had a draft of the revised Zoning Ordinance prepared by Rudikoff Associates and a meeting is planned to discuss this document on September 8th, 1992. She has a problem having copies made since it is not the final draft and the cost will be $300 or $400. For this reason she requested the Board Members to bring in their older drafts so they could be reviewed along with the newer draft and make sure all the changes have been RM82492 made. They are all welcome to review the document at their leisure. BONDS & LETTERS OF CREDIT --- Mr. Levenson submitted his monthly report on the schedule of bonds and letters of credit for the various subdivisions, the amounts, expiration date and call up date. MRS. VISCONTI moved to accept the Report submitted by Mr. Levenson and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Levenson submitted documents from Alpine Companies of Poughkeepsie, Inc. for Erosion Control Bonding, from Hartford Fire Insurance Company - Surety Bond #4658205 dated August 5, 1992, expiring August 5, 1993, in the amount of $668,000.00. MRS. VISCONTI moved to accept the Alpine Companies of Poughkeepsie, Inc. Erosion Control Bonding, as submitted by the Zoning Administrator. Seconded by Mr. Wallace Motion Unanimously Carried Mr. Levenson forwarded Letter of Credit No. SB -03326 from Frank's Nursery & Crafts, Inc. Route 9, Wappingers Falls, N.Y. which was approved by Albert Roberts, Attorney to the Town. MRS. VISCONTI moved to accept the Letter of Credit submitted by Frank's Nursery & Crafts, Inc. Seconded by Mr. Wallace Motion Unanimously Carried Mr. Steven Domber, President of Serls Realty Corp. advised the Zoning Administrator that he would be finishing the road at Woodland Court within the next few weeks; his Letter of Credit will be expiring and he requested approval to use a surety RM82492 maintenance bond in lieu of the Letter of Credit. MRS. VISCONTI moved to accept a surety maintenance bond in lieu of the Letter of Credit from Serls Realty for Woodland Court. Seconded by Mr. Wallace Motion Unanimously Carried Assessor Thomas Logan wrote to the Town Board recommending the reappointment of Jerome Cauda as a member of the Town Board of Assessment Review. The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that Jerome Cauda be and he is hereby reappointed as a member of the Town of Wappinger Board of Assessment Review due to the expiration of his term on September 30th, 1992, AND BE IT FURTHER RESOLVED, that Mr. Cauda's term of office on the Board of Assessment Review will expire on September 30, 1997. All property within the benefit area shall be assessed. 2. The formula for such assessment shall be as follows: a. A single family house on a lot of less than two acres - one benefit unit. Where acreage over two acres - .2 benefit unit for each acre or part thereof over two acres. b. Vacant residential land less than two acres - .8 benefit unit. C. Residential acreage in excess of two acres - .8 benefit unit for the first two acres, .2 benefit unit for each acre in excess of two acres. d. Multi -family residential units - .75 benefit units RM82492 per residential dwelling unit. e. All property within the benefit area shall be assessed. 2. The formula for such assessment shall be as follows: a. A single family house on a lot of less than two acres - one benefit unit. Where acreage over two acres - .2 benefit unit for each acre or part thereof over two acres. b. Vacant residential land less than two acres - .8 benefit unit. c. Mrs. Smith explained that the amount of $240. was for professional services in reference to this grant and had to be paid up front and will be reimbursed to us. Seconded by Mr. Wallace Motion Unanimously Carried A request was received from the Chairman of the Recreation Commission to transfer $395 from A-7110.4 to A-7110.2 to complete the payment of the paint sprayer at a final cost of $1,645. MRS.VISCONTI moved to approve the transfer requested by the Recreation Commission for payment of the paint sprayer, as stated. Seconded by Mr. Wallace Motion Unanimously Carried UNFINISHED BUSINESS --- Correspondence was received from the Engineer referring to previous correspondence between his office and Mr. Foster's office regarding "No Parking" signs on Hackensack Heights which they jointly recommended. They further recommended that the Town Board hold an informational meeting with the residents 4A4 RM82492 who will be affected along that road. MRS. VISCONTI moved to table action on this matter pending further discussion at a workshop. Seconded by Mr. Wallace Motion Unanimously Carried An opinion was received from the Attorney to the Town in regard to a request to the Recreation Commission from the Boots and Bows Square Dance Group for them to sponsor the activities of this Group in their application for the use of school facilities which results in free use of same. Since it has been indicated there is no formal authorization establishing the Commission they do not have the jurisdiction to do this without approval from the Town Board. He also pointed out that this Group is not related to the recreational activities of the Town; their membership includes out of Town and out of County participants. MRS. VISCONTI moved to authorize the Supervisor to notify the Boots and Bows Square Dance Group that the Town Board has denied their request, at the recommendation of the Attorney to the Town. Seconded by Mr. Wallace Motion Unanimously Carried Mr. Incoronato was recognized by the Chair and spoke of his concern on the 240 units planned for the AVR Development on MacFarlane Road which he felt was much too high due to the presence of wetlands, high voltage lines, etc. Let's get a real number from the Planning Board, maybe down to 120 would be more realistic. The Supervisor assured him that the Planning Board will inform the developer of the number of units he will be allowed to apply for in the application. Mr. Incoronato also had a concern on the application of Land of Pacific State and noted that a condition of approval RM82492 included a scoping session and an Environmental Impact Statement on the proposed cluster development. Mrs. Smith said she would research the Minutes on this matter and IYr get back to him. NEW BUSINESS --- Mr. Mills asked that the Town send a commendation to Ken Wilkinson for his heroic efforts in saving a life at the Taconic State Park and it was also brought up that he saved another person's life at the Yorktown Diner. The Supervisor said she would be happy to write to Ken as soon as she had all the pertinent information on these heroic incidences. The Supervisor reported that the March of Dimes will have a Walk-A-Thon between Town of Fishkill and the Town of Wappinger ,. on October 10th, 1992 and both Towns need not only walkers, but also sponsors. There is another interesting side to this event --a challenge to the two Supervisors, Mrs. Smith and Mrs. Pagones, on which Town will bring in the most money, even if it's only a penny more. If Mrs. Pagones wins, Mrs. Smith will pay her membership to B.J's Wholesale Club presently being constructed in Wappinger and since Mrs. Smith is convinced that that Wappinger will win, Mrs. Pagones will be paying Mrs. Smith's membership to Sam's Wholesale Club in Fishkill.
