The Regular Meeting of the Town Board of the Town of Wappinger
was held on December 16th, 1991, at the Town Hall, 20 Middlebush
Road, Wappingers Falls, Dutchess County, New York.
Supervisor Smith opened the Meeting at 7:30 P.M.
Present:

The Meeting started with all joining in the Pledge of Allegiance
to the Flag.
The Minutes of the Regular Meeting of November 25, 1991, having
been previously forwarded to all Board Members, were placed
before them for their consideration.
MRS. VISCONTI moved that the Minutes of November 25, 1991, be
and they are herey approved, as submitted by the Town Clerk.

Mrs. Smith mentioned that at the November 25th, 1991 meeting,
Mr. Paggi recommended that the Subdivision Regulations should
include a requirement that provides for a street lamp to be
placed at new roads intersecting with State and County Roads
which she would address under Unfinished Business.
MRS. VISCONTI moved that the Minutes of November 25th, 1991,
be and they are hereby approved, as submitted by the Town Clerk.

Officer for November, Highway Department for October and
November and the Receiver of Taxes for October, 1991.

Petitions & Communications ---
Mr. Logan wrote to the Board informing them that as a result
of a meeting with the Attorney representing Leemilts Petroleum,
he has obtained a stipulation for discontinuance from them and
recommended that the Board authorize the Town. Atorney to sign
said discontinuance.
MRS. VISCONTI moved to authorize the Attorney to the Town to
sign the discontinuance of the Tax Certiorari brought by
Leemilts Petroleum against the Town, as recommended by Assessor
Thomas Logan.

Application for a Peddler's License was received from Robert.
Milner for a food service truck; Mr. Milner is a Veteran and
resides in the Town of Wappinger.
MRS. VISCONTI moved to approve the Peddler's License for
Robert Milner to operate a food service truck in the Town
of Wappi_nger. .

A Memo was received from the Recreation Commission recommending
that the following fees be charged for the recreation programs

Mr. Holt, Chairman of the Recreation Commission recommended
these fees which he felt would cover their budget needs.
Mrs. Smith thought they should try this for a year to see how
it works out.
MR. VALDATI moved to approve the fees set up by the Recreation
Commission for their various programs, as recommended by the
Recreation Chairman.

The Town Board received a Memo from Mr. Levenson, Clerk to
the Planning Board informing them that the Planning Board voted
not to grant the request of Contrail Associates to amend the
Zoning Ordinance to provide for the addition of a place of
worship as a permitted use or special permit use within the
Planned Industry zone.
MRS. VISCONTI moved to table action on this matter pending a
joint work shop with the Planning Board to discuss same.

The motion was seconded by Mr.Incoronato for the purpose of
discussion --it was his understanding that there would be a
school involved housing at least 40 students; the average cost
to educate a student in primary or secondary grades is at least
$7 or $8,000 which would amount to at least $280,000 that the
school districts would save; at least 7 of these students come
from the Wappinger Central School District which would mean a
saving of about $56,000. Mrs. Smith reminded him that this
property would be coming off the tax rolls "forever", so would
this saving to the School District last "forever". He thought
it could increase depending upon the future of the Church. This
could be a good trade-off for the taxpayers, if we pick up a
saving of $56,000 and waive the $20,000 tax by taking it off
the Tax Roll. Also it is a far less intense use of the land
than having an industrial customer buy the land. Another point
was that he did not see anyone breaking down our doors to buy

commercial land in the Town to start a business. The economy
will sputter along and we have a bonafide tangible customer
waiting to convert the property and he saw lots of advantages
to this.
Pastor Ken Stevenson of the Everlasting Covenant Church, the
party who is pursuing the purchase of the property owned by
Contrail Associates asked to speak and told the Board that he
felt that they have been very cooperative with everything that
had been suggested by them but there are some issues that have
to be further clarified. According to the press, this project
sounds like a big planned industry zone, but actually it's an
island in the middle of a residential zone. They do have a
number of students from the Wappinger School District and he
believed that they would double that number when they occupy
the building. He's had many inquiries about the school and
that is why he predicted that the number would double or even
more which would also change the figure that was quoted earlier
on the savings that the School District would realize. He was
very enthused and really wanted to see this happen. They will
continue to pursue the project, he told the Board, because he
believes it's the best thing for them, for Contrail and for the
Town.
Mr. Valdati felt that the cost quoted for educating a student
was not an accurate one since other items had to be included
such as fuel, electricity, teacher's salaries and benefits, etc.
so, actually the $56,000 saving that was mentioned is not a
true figure. At this point, Mrs. Smith interrupted and
requested that further discussion be tabled to a work shop.
A Notice of Intent to renew a liquor license was received from
A Touch of Manhattan Deli, Chelsea Ridge Mall, in the Town of
Wappinger.
MRS. VISCONTI moved to accept the correspondence and place it
on file with no comment.

RNINKOV&SOXI
A Report was received from the Engineer regarding a drainage
complaint from Settembrino at 16 Scott Drive. He and the
Highway Superintendent were authorized by the Board at the last
meeting to inspect the area. It involves all the homes on Scott
Drive between Granger Place and All Angels Hill Road due to
flooding from an open stream that traverses all of Rockingham
Subdivision; they did find that the stream gets very large and
wide in the lower regions. There is a legal Town easement in
area which is very wide -- up to 100ft. in some areas. In order
to stabilize the banks of this stream, it would require place-
ment of heavy stone to prevent erosion from the flood waters.
He informed the Board that a detailed engineering study would
have to be done and he would require authorization from the
Board. He also informed them that there were funds remaining
in the 1990 Storm Drain Bond Issue since less than half the
amount allocated for the Rockingham Project was spent on that
area, so possibly this work could be done with these remaining
funds.
MR. INCORONATO moved to authorize the Engineer to the Town to
prepare a detailed engineering study on the proposed project
to determine the construction estimates.

The next report was also on a drainage problem at the Levine
property, 9 Helen Drive. This was an old dry well adjacent to
the property, built sometime in the late fifties which overflows
on to Mr. Levine's property. This can be connected to a series
of catch basins which exist just beyond the site, however in
order to determine the work involved and the cost, he will have
to do survey work.
MRS. VISCONTI moved to authorize the Engineer to the Town to
to do the necessary field work to correct the drainage problem
at the Levine property at 9 Helen Drive, to determine the cost
of the project.

Mr. Foster noted that the Highway Department responded to Mr.
Levine's calls when his property flooded and he suggested that
they offer an easement to the Town due to the amount of piping
that will have to be put along the road or maybe the Engineer
can come up with an alternate when he does the field work.
Mr. Foster forwarded a Memo to the Town Board indicating that
the following stop signs should be added to the existing Local
Law Regulating Traffic Within the Town of Wappinger.
1. Baldwin at MacIntosh
2. Applesauce at MacIntosh
3. Smith Crossing Road at Maloney Road
4. HiView Road at Valley Road approaching from south
5. Cooper Road at Smithtown approaching from south
6. Smithtown at Cooper approaching from the East
MRS. VISCONTI moved to authorize the Attorney to the Town to
prepare a Local Law to Amend Local Law #6 of 1991 Regulating
Traffic Within the Town of Wappinger, as requested by the
Highway Superintendent.

The Highway Superintendent received three estimates for the
repair of two roofs on the Garage; they are the cleaning and
recoating of the metal roof on the Pole Barn and removing the
old metal roof on Shop I and replacing it with 90 lb. paper.
The estimates were as follows: Hawthorne Restoration, $4860.
Fishkill Roofing & Siding, $4,640. and Ron Ventresca Const. Co.,
$3,870.
MR. INCORONATO moved to authorize the Highway Superintendent
to accept the bid from Ron Ventresca Const. Co., low bidder, in
the amount of $3,870.00 for the roof repair on the Highway
Garage.

A second Memo was received from the Highway Superintendent

with price quotes from three electrical companies for Project I
and Project II to do electrical work at the Garage.
MRS. VISCONTI moved to authorize the Highway Superintendent
to take the lowest bid on the two projects for the electrical
work at the Highway Garage.

Frank Buyakowski, Satellite Investments, wrote to the Board
requesting that the Town take over Airport Drive as a Town Road.
A Memo from Highway Superintendent Graham Foster stated that he
had inspected the road and found it to be acceptable for the
Town to take it over.
MR. VALDATI moved that Airport Drive be accepted as and for a
Town Road, based on the recommendations of the Department Heads.

A request was received from Donald and Linda Grossman for the
return of escrow in the amount of $102.83 for planning and
engineering fees. The Zoning Administrator noted that the
proper documents were submitted and he recommended release of
the escrow.
MRS. VISCONTI moved to approve release of escrow money in the
amount of $102.83 to Donald and Linda Grossman, as recommended
by the Zoning Administrator and Highway Superintendent.

An opinion letter was received from the Attorney regarding
coverage to the Village of Wappingers Falls of services of the
Dog Control Officer. Mrs. Smith explained that the Town can
have their DCO service the Village within the Town of Wappinger,
however we can only enforce the Agriculture and Market regula-
tions, not their Dog Ordinance. The Attorney added that the
Village may contract with the Town for the services of the Dog
Control Officer in which case the Officer would have the juris-

diction to enforce the Village Dog Ordinance. Mr. Valdati
pointed out that the Village residents pay taxes to the Town,
they also pay the full dog license fee to the Town and based
on this there is no reason why they should not be entitled to
the services of the Dog Control Officer to take care of their
dog problems. It was agreed that the matter should be discussed
at a work shop but in the interim, Mr. Valdati felt the Village
should receive the services per the Agriculture and Market
regulations but they should eventually receive full service as
well as any Town resident.
MR. INCORONATO moved to table action pending a work shop
discussion.

COMMITTEE REPORTS ---
Neither Mr. Valdati nor Mr. Incoronato had reports for this
meeting.
Mrs. Visconti, Dial -A -Ride, Town of Wappinger expanding their
service to five days a week effective January, 1992, also this
service will be available to Castle Point on Tuesdays and Thurs-
days effective January 1992.
BONDING ---
A new category has been added to the Agenda which will assist
the Town Board to keep track of the bonds for various projects
and when they expire.
The first item was an Amendment to Letter of Credit No. 332,
1/91 to reduce the credit amount by $32,478.35 for a new total
of $188,386.00.
MRS. VISCONTI moved to approve a reduction of the Letter of
Credit No. 332-1/91 to $188,386.00 for Wyndham Crossing
(Lawrence Subdivision), based on the recommendation of the
Engineer.

In the matter of the Letter of Credit for the Noto Subdivision
a Memo was received from the Zoning Administrator enclosing a
recommendation from the Engineer to the Town to reduce the
Letter of Credit from $500,724.00 to $250,722.00.

for their concurrence.

A Public Hearing having been previously held on a proposed
Local Law Amending Local Law #6 of 1991, Regulating Traffic and
Parking Within the Town of Wappinger, the matter was placed
before the Town Board for their consideration.
COUNCILMAN INCORONATO moved to approve Local Law #11 of 1991
as follows;
A LOCAL LAW AMENDING LOCAL LAW #6 OF
1991, REGULATING TRAFFIC AND PARKING
WITHIN THE TOWN OF WAPPINGER
Section 1. Additional Full Stop Streets
Section 3 of Local Law #6 of 1991, a Local Law Regulating
Traffic and Parking Within the Town of Wappinger is hereby
amended by the adoption of the following additions, revisions
and amendments, to wit: the addition of the following
designated full stop streets and intersections:
Northeast intersection of Dennis Road and the
Southbound land of Wildwood Drive;
Northeast intersection of Dennis Road and the
northbound land of Wildwood Drive;
Southwest intersection of Dennis Road and the
northbound lane of Wildwood Drive;
Balfour Drive at the northwest corner of the
intersection of Balfour Drive and Carroll Drive;
Balfour Drive at the southeast corner of the
intersection of Balfour Drive and Carroll Drive.
Section 2. Ratification.
Except as specifically modified and amended by the
adoption of the additions, revisions, modifications and amend-
ments set forth above, Local Law #6 of 1991, "A Local Law
Regulating Traffic and Parking Within the Town of Wappinger"
is hereby ratified, confirmed and readopted.
Section 3. Severability.

In the event any portion of this Local Law is declared
to be unenforceable by a Court of competent jurisdiction, all
of the remaining portions shall continue in full force and
effect.
Section 4. Effective Date.
This Local Law shall take effect immediately upon adoption
and filing with the Secretary of State as provided by thes
Municipal Home Rule Law.

A request was received from the Chairman of the Recreation
Commission to transfer $200.00 from A-7140.1 to A-7020.1
to add to the current balance of $540.00 which will pay the
Commission Members their stipend for the second half of the
year.

the Chairman to the Recreation Commission.

A second Memo was received from the Recreation Commission

Chairman regarding a previous request for water/sewer hookup
for the trailer at Rockingham.
Mrs. Smith had explained to the Chairman that there is currently
a moratorium on Rockhingham and Oakwood sewer hookups by the
D.E.C. and Department of Health so that will have to be put on
hold, however it may be possible to provide a water hookup to
the trailer.
MR. INCORONATO moved to authorize the Supervisor to have Camo
Pollution Control review the situation and and report to the
Board regarding a water hookup for the trailer at Rockingham.
Seconded by Mrs. Visconti

Mrs. Smith addressed the amendment to the Subdivision
Regulations which she mentioned earlier in the meeting and
called for a motion for this action.
MRS. VISCONTI moved to authorize the Attorney to the Town to
prepare the required documents to amend the Subdivision Regula-
tions to provide for the placement of a street lamp at the
intersections of new roads with State or County Roads, if
warranted.

NEW BUSINESS ---
Mrs. Smith requested the Board to giver her authorization to
sign an Agreement with D.W.I. in regard to the use of their
equipment by our Vandalism Patrol, in particular, signing out
and maintenance of same.
MR. VALDATI moved to authorize the Supervisor to sign the
Agreement with D.W. I. regarding Town use of equipment.

The Supervisor had previously distributed a Safety Manual to
the Town Board for their review and recommendation, which, if

any would be submitted at this meeting. She received one
recommendation from the Highway Superintendent, referring to
Page 34, "change the eye wash solution every month", the vendor
told him it would be perfectly safe to change this every six
months, which would out down the expense.
Mrs. Visconti commended the Supervisor on the work she had put
in compiling this Safety Manual which took several months to
complete.
The Supervisor set the Reorganizational Meeting for January 6th,
1992, at 7 P.M., at the Town Hall.
Richard Swanson, from Greystone House, was recognized by the
Chair and thanked the Town Board for their support in applying
for Community Development Funds for the Greystone Sewer Project.
There was no other business to come before the Board.
MR. INCORONATO moved to adjourn the Meeting, seconded by Mrs.
Visconti, and unanimously carried.

A Public Hearing was held by the Town Board of the Town of Wappinger
on December 16, 1991, at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York, on a proposed Local Law Amending Local Law #6 of 1991
Regulating Traffic and Parking (Tor Road at intersections with Sarah
Drive).
Supervisor Smith opened the Hearing at 7:20 P.M.

Robert Valdati, Councilman
June Visconti, Councilwoman

The Town Clerk offered for the record the AFfidavits of Posting and
Publication duly signed and notarized. (These Affidavits are attached
hereto and made part thereof of the Minutes of this Hearing).
The Local Law would provide authorization for the placement of
Stop Signs on Tor Road at its intersections with Sarah Drive.
The Supervisor asked if there were any comments regarding the intent
of this Local Law. No one spoke for or against the proposed Local
Law.
MRS. VISCONTI moved to close the Public Hearing, seconded by Mr.
Incoronato and unanimously carried.
The Hearing closed at 7:21 P.M.

A Public Hearing was held by the Town Board of the Town of
Wappinger on December 16th, 1991, at the Town Hall, 20 Middlebush
Road, Wappingers Falls, Dutchess County, New York, for the purpose
of hearing all interested persons on the allocation of Community
Development Funds for the year 1992.
Supervisor Smith opened the Hearing at 7:25 P.M.

The Town Clerk offered for the record the Affidavits of Posting
and Publication duly signed and notarized. (These Affidavits are
attached hereto and made part thereof of the Minutes of this Hearing).
The Town's proposed intended use of these funds are as follows:
1) Castle Point Restroom facility with Handicapped
Accessibility at Castle Point Recreation Site. $ 46,000.00
2) Architect Study to enlarge Senior Citizen Room
at the Town Hall Site. $ 30,000.00
3) Greystone House, Wheeler Hill Road -
Sewage Treatment Plant. $150,000.00
The Supervisor asked for comments from those present on the subject
matter.
Peg O'Leary, Executive Director of Wappingers Youth Outreach, d/b/a
Community Services Program, spoke on behalf of the item designated
for Greystone House in the amount of $150,000.00. She felt they
need a Sewage Treatment Plant which will be far more effective
than the system they are now using. It is an eligible community
development activity and the beneficiaries are those who meet the
criteria for this funding. In answer to Mrs. Smith's question on
the Director providing the formal application for the Greystone House
funding, she replied that she would submit the necessary forms to the
Supervisor prior to leaving the Hearing.
The Supervisor asked if there any other residents who wished
to recommend other items for this application, or comment on the
proposed uses for the Community Development Funds.
No one else wished to speak on applying for other items that were
not previously mentioned at the Hearing.
COUNCILWOMAN VISCONTI moved to close the Public Hearing, seconded

by Councilman Incoronato and unanimously carried.
The hearing closed at 7:30 P.M.
