This Meeting nas set at the Regular Meeting of September 23,
1991. for the purpose of accepting a Bond and Letter of Credit
from Mr. Uatanis, developer of Lookout Subdivision and any,
other business that may come before= the Board.
The Supervisor asked for a mot ion to accept the Letter of
Crr-dit from Mr. Gatanis in the amount of $137,000.00 faith an
�_ npirat i.nn date of June 1, 1993.
Mr. lncoponato made a motion to acce.pi:. the Letter of Credit
whinh ,aas seconded by HP. Valdati, and a discussion followed
Lt Mr. lncor'onat;o' s request.
There is one house occupied in the subdivision by Mr. Leonard,
h- ever, no Certificate of Occupancy has been issued for this,
duelling and this was a point raised by Mr. incoronato. Why
was the house occupied if no C .O. was issued and why wasn't: it
issued.
The Engineer elplained that he had two problems with the
issuanue of the t .O. --1. there's a telephone pole in the
middle of the ::street, which he felt. was unsafe and 2. the r ateL-
b" st.,er station has not bwen completed although there is an
`_. _,tiny; booste °` stat.ion that. will: serve the one house that, is
owcupi d so this item could be waived for the issuance of the
C .O. The matter of the telephone pole, however, was a safety

concern and should be taken care of. Be recommenjeO that ri
meeting be set up with Mr. Gatanis to discuss these items and
direct him to put up a barrier around the pole until such time
as the utility company removes it. This could be a prnbl em,
however, since it was a known fact that Mr. Gntanis seems to
ignore directions to comply with regulations; it appears that
he does make an attempt to do the work for maybe two or three
days then that's it, no more work, he walks away from it, Tb( --
Building Inspector noted that he can be given a certain time
frame to do the required work and if he doesn't comply within
the designated time, a court appearance date in set,. TheV rouN
follow this procedure to be assured that the work is complaied.
The occupant of the house is also in violation due to moving in
without a C.O. and he, too, can be served with a summons.
After a lengthy discussion on the procedure to folio" for Fh,-
issuance of a C.O. Mr. Incoronato resoinlej his first motinu
accept the Letter of Credit and Mr. VaIdati rescinded his soronJ
to that motion; two similar motions were made by Mr. Incrrwnnt-�
and the third motion was worded as follows:
MR.INCORONATO moved to accept the fond and Lctfer of Credit
from Mr. Gatanis, developer of Lookout SubVvision, in the
amount of $137,000.00, authorize the Engineer tr the Town qrd
the Highway Superintendent to notify Mr. Gatanis to barrier
the utility pole located in the road and contact the compan-
to remove same; authorize the Building inspectcr Yn fol lois the
proper protocol for the issuance of a Certificate of Orcup9ncy
for the occupied house in the Lookout Subdivision, subject to
the approval of the respective Town Officials.
Seconded by Mr. Fanuele
Motion Unanimously Carried
A Status Report was received from the Building Inspector oil
the proposed demolition of the Pagnone property located at th(7
intersection of Route 9 and Middleb"sh Road. He required
authorization from the Town Board to proceed with the demoli-
tion of the building in accordance with a proposal received
from a contracting firm that provided for on site burial of
all wood material. Metal and contaminated materials would have
to be removed from the site in accordance with regulations from
the proper agency. He has contacted Margaret Duke (D.E.C.) so
she could arrange to check for wetland restrictions on this
property and he is waiting for her response. Mr. Valdati
noted that there is a residence to the north of this dwelling
that is occupied and the residents should be notified b'. letter
of the proposed demolition and precautions should be taken for
their safety.
There was more discussion on this matter and the .Supervisor
interrupted to remind the Board that they were over their time
allotted for this meeting and others were scheduled for a work
shop. Since there were other matters to act on, she requested
a motion to table action on the Dagnone property demolition.
MR. INCORO\ATO moved to table action on this matter.
Seconded by Mrs. Visconti
Motion Unanimously Carried
The Preliminary Budget for 1992, having been worked on by
the Town. Board at several work shops, was now ready to be
approved by them and a Public Hearing scheduled.
The following Resolution was offered by COUNCILWOMAN VISCONT
who moved its adoption:
RESOLVED, that this Town Board does hereby prepare and.
approve as the Preliminary Budget of this Town for the fiscal
year beginning on the 1st day of January, 1992, the iteriized
statement of estimated revenues and e-l-penditures hereto attached
and made a part of this Resolution, and be it
FURTHER RESOLVED, that such Preliminary Budget shall be
filed in the office of the Town Clerk where it shall be avail-
able for inspection by any interested person at all reasonable
hour, and be it
FURTHER RESOLVED, that this Board shall meet at 7:00 o'clock
P.M. on the 28th day of October, 1991, for the purpose of
holding a Public Hearing upon such Preliminary Budget, and 'be it.
FURTHER RESOLVED, that the Town Clerk give notice of such

public hearing in the manner provided in Section 108 of the
Town Law, and that. such notice be published in the official
newspaper of the Town and posted on the Town Bulletin Board.

RESOLUTION AUTHORIZING THE TOWN OF WAPPINGER TO
ENTER INTO AN AGREEMENT WITH THE COUNTY OF DUTCHESS
FOR THE PURPOSE OF UNDERTAKING A COMMUNITY DEVELOPMENT
PROGRAM PURSUANT TO THE HOUSING AND COMMUNITY DEVELOPMENT
ACT OF 1974, AS AMENDED.
COUNCILPERSON VICTOR FANUELE offers the following and moves
its adoption: seconded by Counci.lperson Joseph Incoronato.
WHEREAS, the Secretary of Housing and urban Development
of the United States is authorized, under Title I of the
Housing and Community Development Act of 1971, as amended,
to make grants to states and other units of general local
government to help finance Community Development Programs, and
WHEREAS, Section 99-h of the General Municipal. Law of the
State of New York grants to any municipal corporation the power,
either individually or jointly with one or more other municipal
corporations, to apply for, accept and expend hands made avail-
able by the Federal government, either directly or through
the state, pursuant to the provisions of any Federal lac; c:hi.^_h
is not inconsistent with the statutes or constitution of this
State, in order to administer, conduct or participate with the
Federal government, in programs relating to the general welfare
of the inhabitants of such municipal_ corporation, and
WHEREAS, the Community Development Act of 1974, as amended,
and any "Eligible Activities" thereunder are not inconsistent
with the statutes or Constitution of the State, and
WHEREAS, a number of municipalities have requested Dutchess
County's participation and the Count -.r of Dutchess has determined
that it is desirable and in the public interest that it make
application for Community Development Block Grant funds as an
Urban County, and
WHEREAS, participation by the County of Dutchess as an
Urban County in the Community- Development Program requires that
the Municipality of the Town of Wappinger and the County of
Dutchess cooperate in undertaking, and assist in undertaking,
essential community development and housing activities,
specifically those activities authorized by statutes enacted
pursuant to Article 18 of the Net. York State Constitution, and
WHEREAS, the Board deems it to be in the putli.c interest
for the Municipality of the Town of Wappinger to enter into a
Cooperation Agreement with the County of Dutchess for the
aforesaid purposes, now, therefore, be it
RESOLVED, that Constance Smith be and hereby is authorized
to execute a Cooperation Agreement attached hereto for the three
,year period 1992, 1993 and 1991 between the Municipality of the
Town of Wappinger and the County of Dutchess for the purposes of
undertaking a Community Development Program pui-scant to the
Housing and Community Development Act of 1971, as amended.

There gas no other business to come before the Board.
MRS. VISCONTI moved to close the Special Meeting, seconded by
Mr. Fanuele and unanimously carried.
The Special Meeting closed at 7:40 P.M.

A Public Hearing was held by the Town Board of the Town of Wappinger
on October 28, 1991, at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York, on the Preliminary Budget for the Town of Wappinger
for 1992.
Supervisor Smith opened the Hearing at 7:00 P.M.

The Town Clerk offered for the record the Affidavit of Posting and
Publication duly signed and notarized. (These Affidavits are attached
hereto and made part thereof of the Minutes fo this Hearing).
The Supervisor noted that there was an increase in the budget but
it was down to the bare minimum, however, due to no state aid we
have to allow for some reserve to fall back on. She worked on this
long and hard and could find no other items to remove.
The public was asked if they had comments or questions on the budget
presented.
Jerry Cauda, Ketchamtown Road asked about raises for the employees
which he was in favor of, however, he did not feel any elected
official should get a raise this year.
Rich Collin, Cedar Hill, asked about monies for the Sheriff Department.
The monies are there, the Supervisor said, however the Town Board has
not decided which way to go. They will discuss this further and
are open to other proposals to patrol the Town.
There were no other comments made.
MRS. VISCONTI moved to close the Public Hearing, seconded by Mr.
Fanuele, and unanimously carried.
The Hearing closed at 7:05 P.M.
