1991-07-08 SPM151 A Special Meeting of the Town Board of the Town of Wappinger was held on July 8th, 1991, at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Smith opened the Meeting at 6:58 P.M. Present: Constance Smith, Supervisor Victor Fanuele, Councilman Joseph Incoronato, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk This meeting was set at the Regular Meeting of June 24, 1991 for the purpose of authorizing the Supervisor to sign the Agreement with the Tri -Municipal Commission regarding the sewer expansion for the Town. MRS. VISCONTI Moved to go into executive session for further discussion of the Agreement in front of them. Seconded by Mr.Incoronato Motion Unanimously Carried The Board went into Executive Session at 6:59 P.M. The Board returned from Executive Session at 7:08 P.M. and all five members were present. MR. VALDATI moved to authorize the Supervisor to sign the Agreement between the Tri -Municipal Sewer Commission and the Town of Wappinger for the Sewer Expansion Project. Seconded by Mrs. Visconti Motion Unanimously Carried A Memo was received from the Comptroller regarding a Retirement Incentive Program for eligible employees of local governments which required action by August 16, 1991. If the Town Board decided to approve this for certain eligible employees, they would have to enact a local law. The program would provide these employees with an additional amount of service credit up to a maximum amount of three years depending upon the employees length of service. In some cases it would be to the benefit of the municipality as well as the employee, however, it could also cost them too much to allow the benefits to the employees. After research, it was found that five employees were eligible, however, the Town Board did not feel that they would realize any savings by replacing these employees and chose to reject it at this MRS. VISCONTI moved to reject the Retirement Incentive Program offered by the New York State Employees Retirement System. Seconded by Mr. Incoronato Motion Unanimously Carried MRS. Snowden Town Clerk A Public Hearing was held by the Town Board of the Town of Wappinger on July 8th, 1991, at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York, on a proposed Local Law Exempting the Residency Requirements for the position of Deputy Court Clerk in the Town of Wappinger Justice Court. Supervisor Smith opened the Hearing at 6:50 P.M. Present: Constance Smith, Supervisor Victor Fanuele, Councilman Joseph Incoronato, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). Mrs. Smith explained that this position requires the person appointed to be a resident of the Town under the Judicial Law, however, the Town Board can waive this requirement by Local Law following a Public Hearing for the input of the residents. Mrs. Smith asked for comments from the public regarding the purpose of the proposed Local Law. Jerome Cauda, Ketchamtown Road, was against the Law and stated that he felt anyone for works for the Town should be a resident which means they pay taxes which helps pay the salary of the employees. Barbara Otis, New Hackensack Road, was also against the law since it was making an exception for one person. She concurred that those who work for the Town should live in the Town and by making an exception, it was unfair to the others and not good for the morale. There must be people in the Town who could assume the duties of this position so the residency requirement would not be a problem. There were no other comments made for or against the Local Law. MRS. VISCONTI moved to close the Public Hearing, seconded by Mr. Valdati and unanimously carried. The Hearing closed at 6:55 P.M. Elaine H.
