1990-10-09 PHA Public Hearing was held by the Town Board of the Town of Wappinger on October 9, 1990, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York, on a proposed Local Law Prohibiting Parking in Certain Areas of Widmer Road. Supervisor Smith opened the Hearing at 7:15 P.M. Present: Constance Smith, Supervisor Victor Fanuele, Councilman Joseph Incoronato, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). Mrs. Smith explained to the students present that normally, if it is a contraversial subject, there are many residents present to give their comments and ask questions on the subject matter. This specific matter, however, evidently has no opposition, judging by the lack of an audience. She then asked if anyone present wished to speak on the proposed Local Law. Mrs. Visconti questioned the Highway Superintendent as to the status of the required parking spaces at the Villa Borghese Restaurant where the traffic problem existed. He said there was no change from when they had received complaints from residents regarding parking on Widmer Road in that vicinity which was due to the addition to the restaurant, resulting in more activity, more clients, but not the additional parking spaces to relieve the situation on the road. There were no further comments made. MR. INCORONATO moved to close the Public Hearing, seconded by Mrs. Visconti and unanimously carried. The Hearing closed at 7:22 P.M. Elaine H. Since the Local Law was introduced and schedule for Public Hearing, the Highway Superintendent came across further information from the Dutchess County Department of Public Works, prompted by an objection from a Chelsea resident on the correct name of the street where they planned to put a Stop Sign. In the text of the Local Law that this amends, a stop sign was authorized for Bank Street at its intersection with North River Road; the intent for the amended Local Law was to reverse this and have the Stop Sign at North River Road where it intersects with Bank Street. Following the publication in the paper for the Public Hearing, a resident came forth claiming that North River Road is actually Market Street. After delving into this with the County he found that "Market Street", according to the County is North River Road and the other section of Market Street between Bank Street and Chelsea Road is actually a County Road, an extension of Chelsea Road. Apparently there's 280' that belongs to the County although the Town maintains it and after a discussion with one of the County Engineers, he recommends that the Town consider taking over the 280' of the road. At this point, according to the County, this is a County intersection we're talking about putting a Stop Sign on, and it is not under our jurisdiction, so until this is straightened out the Public Hearing is premature and cannot be considered. It was, therefore, agreed that the Public Hearing should be closed and further consideration and action could be taken at a regular meeting of the Town Board. MRS. VISCONTI moved to close the Public Hearing, seconded by Mr. Fanuele and unanimously carried. The Hearing closed at 7:35 P.M. Elaine H.
