2010-2812010-281 Resolution Declaring Parks and Maintenance Equipment Surplus and Authorizing Its Sale by Public Bid At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on September 13, 2010. The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmembers ABSENT: Christopher J. Colsey William H. Beale (Departed 8:28 PM) Vincent F. Bettina Ismay Czarniecki Joseph P. Paoloni The following Resolution was introduced by Councilman Bettina and seconded by Councilman Beale. WHEREAS, the Town of Wappinger owns a 1987 GMC Diesel bucket truck for use by the Parks and Maintenance Department, as purchased through Resolution 2006-189; and WHEREAS, the Supervisor of Buildings and Grounds has evaluated the equipment and has deemed such inappropriate for use by Town of Wappinger employees; and WHEREAS, the bucket truck was designed for use on level pavement and by certified personnel; and WHEREAS, the annual cost to inspect and maintain the underutilized equipment exceeds $1,000.00; and WHEREAS, the Supervisor of Buildings and Grounds has recommended that the above item is surplus and should be sold by public bid. NOW, THEREFORE, BE IT RESOLVED: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby determines that the 1987 GMC Diesel bucket truck has no further use by the Town and is a surplus item. 3. The Supervisor of Buildings and Grounds, the Town Supervisor and the Town Clerk are hereby authorized to solicit bids from the public, or to hold a public auction for the above noted surplus items; said surplus items shall be sold in AS IS CONDITION without any warranty as to condition. 4. Proceeds from the sale of the items shall be first used to pay debt service that is outstanding for the item, if any; and any balance that remains shall be paid into the Parks and Maintenance operating fund. Padoni Supervisor Office SEP 0'2 2010 Received As you may know, the Recreation Department has a bucket truck among the vehicles in our fleet. This truck has not been used since my hiring, and I've looked the truck over to evaluate it's condition.. There are no stabilizers presW on the truck, leading me to believe that it was designed to be used on level pavement only. it would not be suitable for use off paved areas which is the bulk of the work we xoight need it for. Theme is a substantial amount of rust on the truck which will only worsen over faun. In addition, this truck is wired to be certified safe for use annually at a cost of nearly $1000, and any prospective operator is required to undergo traivaa g for use every two ymn. I've been. told kiorraally that a past employee was injured in a fall froom this ttl CL It is my opinion, due to the limited use we experience, the unsuitability of the ftwk to our needs, certification costs and overall liability exposure than the Town offer this vehicle for auction at the next surplus equipment auction at the Dutchess County Motor Compound.
