1989-12-26 PH268 A Special Meeting of the Town Board of the Town of Wappinger was held on December 26, 1989, at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the Meeting at 7:45 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Constance Smith, Councilwoman Elaine H. Snowden, Town Clerk Notice was sent to all Town Board Members on December 21, 1989, calling said Meeting for December 26, 1989, at 7:40 P.M. Notices were also sent to the news media and posted on the Town Clerk's Bulletin Board on the same day. The purpose of this meeting was to adopt the Bonding Resolutions on several Special Districts, namely, CWWIA, Cranberry, Myers Corners II Wappinger Park Water, Fleetwood Water and Sewer; authorize payment of bills on hand, subject to audit by Town Board; fill vacancy on the Planning Board. The following Resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLUTION MAKING CERTAIN DETERMINATIONS WITH RESPECT TO A PROPOSED INCREASE AND IMPROVEMENT OF THE FACILITIES OF FLEETWOOD WATER DISTRICT IN THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, has caused to be prepared a map, plan and estimate of cost for the increase and improvement of the facilities of Fleetwood Water District, in and for said Town; and WHEREAS, said map, plan and estimate of cost is on file in the office of the Town Clerk and said work having been mandated by the Dutchess County Department of Health; and WHEREAS, such increase and improvement consists of the installa- tion of a water storage system, original furnishings, equipmentd machinery or apparatus required in connection therewith, as more fully described in the aforementioned map, plan and estimate of cost; and WHEREAS, the maximum estimated cost of the aforesaid increase and improvement of such facilities if $99,500.00; and WHEREAS, pursuant to Sections 202-b and 216 of the Town Law, the Town Board has approved the improvements proposed in the Fleetwood Water District and has set a Public Hearing to hear all persons interested in the subject thereof concerning the same; and 269 WHEREAS, notice of such public hearing was duly published and posted in the manner and within the time prescribed by Section 202-b of the Town Law, and proof of such publication and posting have been duly presented to said Town Board; and WHEREAS, a public hearing was duly held at the time and place set forth in said notice, at which all persons desiring to be heard were duly heard; and WHEREAS, said Town Board has duly considered said increase and improvent; NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. Upon the evidence given at the aforesaid public hearing, it is hereby found and determined that it is in the public interest to increase and improve the facilities of Fleetwood Water District in the manner described in the preambles hereof. Section 2, The Town Engineer is hereby ordered to prepare definite plans and specifications and to make a careful estimate of the expense of such joint increase and improvement and to prepare a proposed contract for the execution of the work within the boundaries of said district. Section 3. This resolution shall take effect immediately. Seconded by: Councilman Reis Roll Call Vote: 4 Ayes Councilman Valdati---Absent Resolution Duly Adopted The following Resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLUTION AUTHORIZING THE INCREASE AND IMPROVEMENT OF FACILITIES OF FLEETWOOD WATER DISTRICT AT MAXIMUM ESTIMATED COST OF $99,500.00 AND AUTHORIZING ISSUANCE OF $99,500.00 BONDS TO PAY COST THEREOF. WHEREAS, after all proceedings were duly had and taken by the Town Board of the Town of Wappinger, Dutchess County, New York, pursuant to Sections 202-b and 216 of the Town Law, said Town Board has found it to be in the public interest to increase and improve the facilities of the Fleetwood Water District, in said Town, at a maximum estimated cost of $99,500.00, consisting of the installa- tion of a water storage system, including original furnishings, equipment, machinery or apparatus required in connection therewith, and WHEREAS, It is now desired to authorize said increase and improvement and to provide for the financing thereof, NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. The joint increase and improvement of the facilities of Fleetwood Water District in and for said Town, consisting of the installation of a water storage system, including original furnishings, equipment, machinery or apparatus required in connection therewith, is hereby authorized. Section 2. It is hereby determined that the maximum estimated cost of the aforesaid specific object or purpose, as more fully described in Section 1 hereof, is $99,500.00, of which the issuance of $99,500.00 serial bonds of said Town, is hereby authorized to be issued therefore pursuant to the Local Finance Law to pay the cost thereof. 270 Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years, pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. The Town Board of said Town shall annually apportion and assess upon the several lots and parcels of land within such Fleetwood Water District in accordance with the proceedings authorizing such improvements, an amount sufficient to pay the principal of and interest on said bonds as the same become due and payable. If not paid from such sources, all the taxable real property within said Town shall be subject to the levy of an ad valorem tax, without limitation as to rate or amount, sufficient to pay the principal of and interest on said bonds. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds and bond anticipation notes may be contested only if: 1) such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of publication,or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 7. This resolution, which takes effect immediately, shall be published in full in the Southern Dutchess News, the official newspaper of said Town designated for such purpose, together with a notice of the Town ClErk in substantially the form provided in Section 81.00 of the Local Finance Law. WHEREAS, after all proceedings were duly had and taken by the Town Board of the Town of Wappinger, Dutchess County, New York, pursuant to Sections 202-b and 216 of the Town Law, said Town Board has found it to be in the public interest to jointly increase and improve the facilities of the Fleetwood Sewer District, in and for said Town, at a maximum estimated cost of $34,000.00 consisting of the improvement of a Sewer Treatment, including original furnishings, equipment, machinery or apparatus required in connection therewith, and WHEREAS, it is now desired to authorize said joint increase and improvement and to provide for the financing thereof, NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. The increase and improvement of the facilities of Fleetwood Sewer District in and for said Town, consisting of the improvement of a Sewer Treatment System, including original furnishings, 272 equipment, machinery or apparatus required in connection therewith, is hereby authorized. Section 2. It is hereby determined that the maximum estimated cost of the aforesaid specific object or purpose, as more fully described in Section 1 hereof, is $34,000.00 and that the plan for financing thereof shall consist of the issuance of $34,000.00 serial bonds of said Town, is hereby authorized to be issued therefore pursuant to the Local Finance Law to pay the cost thereof. Seconded by: Councilwoman Smith Roll Call Vote: 4 Ayes 0 Nays Councilman Valdati---Absent The following resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLUTION MAKING DETERMINATION WITH RESPECT TO PROPOSED JOINT INCREASE AND IMPROVEMENT OF FACILITIES OF CENTRAL WAPPINGER WATER IMPROVEMENT AREA, MYERS CORNERS II WATER DISTRICT AND CRANBERRY HILLS WATER IMPROVEMENT AREA. 273 WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, has caused to be prepared a map, plan and estimate of cost for the joint increase and improvement of the facilities of Central Wappinger Water District, Myers Corners II Water District and Cranberry Hills Water Improvement Area, by the purchase of the Atlas Water Company and its well fields, in and for said Town, and WHEREAS, said map, plan and estimate of cost is on file in the office of the Town Clerk, and WHEREAS, such joint increase and improvement consists of the purchase of the Atlas Water Company, a water distribution system, including land or rights of land, original furnishings, equipment, machinery or apparatus required in connection therewith, as more fully described in the aforementioned map, plan and estimate of cost, and WHEREAS, the maximum estimated cost of the aforesaid increase and improvement of such facilities is $525,000.00 with Central Wappinger Water Improvement Area's share of such cost being $413,686.00 and with the Cranberry Hills Water Improvement Area's share being $56,332.00, and with the Myers Corners II Water District's share being $7,927.00, and WHEREAS, pursuant to Sections 202-b and 216 of the Town Law, the Town Board has duly called a public hearing on the question of jointly increasing and improving the facilities of Central Wappinger Water Improvement Area, Cranberry Hills Water Improvement Area and Myers Corners II Water District, in the manner described above to hear all persons interested in the subject thereof concerning the same, and WHEREAS, notice of such public hearing was duly published and posted in the manner and within the time prescribed by Section 202-b of the Town Law, and proof of such publication and posting have been duly presented to said Town Board, and WHEREAS, a public hearing was duly held at the time and place set forth in said notice, at which all persons desiring to be heard were duly heard, and WHEREAS, said Town Board has duly considered said joint increase and improvement, NOW, THEREFORE BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. Seconded by: Councilman Farina Roll Call Vote: 4 Ayes 0 Nays Mr. Valdati---Absent The following resolution was offered by COUNCILMAN REIS who moved its adoption: 274 RESOLUTION AUTHORIZING INCREASE AND IMPROVEMENT OF FACILITEIS OF CENTRAL WAPPINGER WATER IMPROVEMENT AREA, CRANBERRY WATER IMPROVEMENT AREA AND MYERS CORNERS II WATER DISTRICT, AT MAXIMUM ESTIMATED COST OF $477,947.00 AND AUTHORIZING ISSUANCE OF $477,947.00 SERIAL BONDS TO PAY COST THEREOF. WHEREAS, after all proceedings were duly had and taken by the Town Board of the Town of Wappinger, Dutchess County, New York, pursuant to Sections 202-b and 216 of the Town Law, said Town Board has found it to be in the public interest to jointly increase and improve the facilities of Central Wappinger Water Improvement Area, Cranberry Water Improvement Area and Myers Corners II Water District, in and for said Town, at a maximum estimated cost of $477,947.00, consisting of the purchase of the Atlas Water Company, a water distribution system including land or rights in land, original furnishings, equipment, machinery or apparatus required in connection thereof; and WHEREAS, it is now desired to authorize said joint increase and improvement and to provide for the financing thereof, NOW, THEREFORE BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New YOrk, as follows: Section 1. The joint increase and improvement of the facilities of Central Wappinger Water Improvement Area, Cranberry Hill Water Improvement Area and Myers Corners II Water District, in and for said Town, consisting of the installation of a water distribution system, including land or rights in land, original furnishings, equipment, machinery or apparatus required in connection therewith, is hereby authorized. Section 2. It is hereby determined that the maximum estimated cost of the aforesaid specific object or purpose, as more fully described in Section 1 hereof, is $477,497.00 of which $56,332.00 constitutes Cranberry Water Improvement Area's share and $413,686.00 constitutes the Central Wappinger Water Improvement Area and $7,927.00 constitutes Myers Corners II Water District's share, and that the plan for financing thereof shall consist of the issuance of $477,947.00 serial bonds of said Town, is hereby authorized to be issued therefore pursuant to the Local Finance Law to pay each District's share of the cost thereof. Seconded by: Councilman Farina Roll Call Vote: 4 Ayes 0 Nays Councilman Valdati---Absent A resignation was received from Frank Patterson, member of the Town Planning Board, due to increased work load he was experiencing at his job. Mrs. Smith moved to table consideration of filling this vacancy until the new Town Board was in Office. Motion Failed for Lack of Second MRS. PAINO moved to accept Mr. Patterson's resignation with regret and requested the Town Clerk to forward a letter to him thanking him for the time and effort he has put in to make the planning a better process in the Town by serving on the Planning Board. Seconded by Mr. Farina Motion Unanimously Carried The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that Hugo Musto be appointed to the Town of Wappinger Planning Board to fill the vacancy created due to the resignation of Frank Patterson, and BE IT FURTHER RESOLVED, that the term of said Hugo Musto on the Town Planning Board shall expire on January 4th, 1994. Seconded by: Councilman Reis Roll Call Vote: 3 Ayes Councilwoman Smith ---Nay 276 Mrs. Smith expressed her opinion that this was like a midnight appointment and with only a few days left until a new Board would take office, this matter should be left to them. Mr. Reis, on the other hand, felt that since Mr. Patterson was appointed during this administration, they should have the say on a replacement. If his term had expired, there would be some validity in deferring it to a new Board, but not under these circumstances. Mrs. Paino concurred, noting that this administration should take the responsibility of putting in the best person in that position. This prompted Mrs. Smith to comment that they really had no application or resume from Mr. Musto for them to determine that he right for this position. What he did submit was a generic application, it did not indicate that he was interested in becoming a member of the Planning Board and it appeared that whatever became available, the application would be good for that position. MRS. PAINO moved that the Special Meeting be closed, seconded by Mr. Reis and unanimously carried. The meeting closed at 7:55 P.M. The Special Meeting of the Town Board on December 26, 1989, reconvened at 7:56 P.M. with four Town Board Members present, Mr. Valdati, absent. The purpose for reopening the meeting was to authorize payment of the bills, following audit by the Town Board. Mrs. Smith noted that a bill was submitted by Camo Pollution Control for work done on the Pondview Pump Station in 1987, however, the Town did not formally accept this Pump Station until 1988 so this bill was not the responsibility of the Town and would be pulled before auditing. The bill would be returned to the developer, Jeff Hunt, indicating that the expense should be borne by his company. MRS. SMITH moved to authorize payment of the bills submitted, subject to audit by the Town Board, with the exception of the Camo Pollution Control bill and any others the Board Members may choose to eliminate. Seconded by Mr. Reis Motion Unanimously Carried MRS. PAINO moved to close the Special Meeting, seconded by Mr. Reis and unanimously carried. The meeting closed at 7:57 P.M. Elaine H.
