ADJOURNMENT REMINDER: Public Hearings start at 6:15 P.M. 304 The Regular Meeting of the Town Board of the Town of Wappinger was held on November 7, 1988, at flap Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the meeting at 7:30 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Constance Smith, Councilwoman Robert Valdati, Councilman Elaine H. Snowden, Town Clerk Others Present: Thomas Wood, Attorney Joseph E. Paggi, Jr., Engineer Those present joined in the Pledge of Allegiance to the Flag, followed by a moment of silent prayer for the Town of Wappinger and its residents. The Minutes of the Regular Meetings of September 19th and October 3rd, the Adjourned Meeting of September 22nd, and the Special Meetings of October 13th and 27th, having previously been forwarded to the Board Members, were now placed before them for their consideration. MRS. SMITH moved that the above stated Minutes be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mr. Reis Motion Unanimously Carried Reports were received from Town Justices (October), Receiver of Taxes, (September and October), Zoning Administrator (September) Building Inspector (August, September, October), and Hydrant Report for the months of September and October, also Supervisor/Comptroller, September. MR. VALDATI moved to accept the above stated reports and place them on file. Seconded by Mrs. Smith Motion Unanimously Carried Petitions & Communications --- Correspondence was received from the Planning Board relative to Administrative Regulation with the Establishment of Escrow Funds for Subdivision and Site Plans Pursuant to Section #272 of the Town Law. The Planning Board passed the amendment of these regulations at their October 12th, 1988 meeting and requested the Town Board to review and approve same. 305 The Chairman of the Planning Board, Edward Hawksley, was present and explained that it was the position of the Planning Board that applicants before the Board should bear the cost of some of the Administrative Reviews, such as consultants who might be hired by the Board or engineering fees, etc., rather than have such expense borne by the Town. A fee schedule was also included with this correspondence which specified the number of lots in the subdivision and the amount which the applicant should deposit as an escrow fund with the Town. The Attorney thought it to be an excellent regulation to establish. He explained that the Planning Board had approved these regulations, however it did need Town Board approval for it to be official. MRS. PAINO moved to approve the Administrative Regulation with the Establishment of Escrow Funds for Subdivision and Site Plans, as set forth by the Planning Board. Seconded by Mr. Reis Motion Unanimously Carried Correspondence was received from Julius Gerzof concerning a lot on Russet Lane and extending the water and sewer lines. Mr. Paggi had reviewed the letter but without a history on the matter, he did not understand what he was trying to convey. MRS. PAINO moved to hold a work shop with the Attorney and Engineer to the Town and the resident involved. Seconded by Mr. Farina Motion Unanimously Carried Mrs. Paino introduced Assemblyman Stephen Saland who stopped by to visit with the Town Board and discuss items of interest to the Town that have occurred in the State Assembly. Mr. Saland has made this an annual visit ever since he became our Assemblyman. As was expected the Federal Revenue Sharing Funds will show no increase this year. There has been much talk about a revenue deficit in the state budget so there will be no extra funds around. As a result of the budget crunch, the Office of Local Government was scheduled to be demolished, but as a result of the objection of the local municipalities, such as our Town, they did manage to salvage about one third of this department. Also the Board of Equalization and Assessment is now charging for some of their services that they previously had not charged for. 306 Ambulance Districts will now be established the same way improve- ment districts are established; fire companies will now be able to form joint village and town districts. One more item mentioned by Assemblyman Saland was the Transportation Bond that will be a proposition on the ballot for. tomorrow, Election Day. He has come out in the news media as opposed to this Bond and since this has been mentioned many times lately, he did not go into his reason for his objection. He thanked the Board for their time and invited questions from the public and the residents. Since there were none, Supervisor Paino thanked Assemblyman Saland for his presence at the meeting and the information he offered. Arthur Waddle, District Secretary of the Hughsonville Fire District, wrote to the Town Board requesting the use of one voting machine for their annual Fire District Election on December 13, 1988. MRS. SMITH moved to grant permission to the Hughsonville Fire District to use one of the Town's Voting Machine for their annual election on December 13, 1988 Seconded by Mr. Farina Motion Unanimously Carried The Association for Retarded Citizens in Dutchess County indicated in correspondence to the Supervisor that it is their intent to accept property located at 21 Roberts Road as an acceptable alternate site to replace 5 Drew Court. MRS. PAINO moved to accept this correspondence and place it on file. Seconded by Mr. Reis Motion Unanimously Carried Supervisor James Tanner of the Town of Pawling wrote to Supervisor Paino enclosing a copy of a resolution before the County Legislature regarding health insurance for local and county employees. Neither Mrs. Smith nor Mr. Valdati had received a copy of this correspondence. Mrs. Paino explained that Mr. Tanner was asking the other Boards to support this resolution as it will be a big benefit, financially, since they may be able to get assistance through the County to obtain health insurance much more reasonably than they are now paying. MR. VALDATI moved to table this matter to the December 5, 1988 pending receipt and review of the material not received by other Town Board Members. Seconded by Mrs. Paino Motion Unanimously Carried 307 Larry McKinnon, Congregation Secretary to the Jehovah's Witnesses on All Angels Hill Road, wrote to the Board requesting an exemption from the Recreation Fee and the Downstream Drainage Fee since they are a religious organization. MRS. PAINO moved to table this matter and refer it to the Attorney to the Town for review and recommendation. Seconded by Mrs. Smith Motion Unanimously Carried A memo was received from our Fire Inspector, Mark Liebermann, enclosing copy of Certificate for Course 44 - Administration and Enforcement of the State Code. MRS. SMITH moved to receive this correspondence and place it on file. Seconded by Mr. Farina Motion Unanimously Carried Thomas Logan, Assessor wrote to the Board requesting to attend the State Division of Equalization and Valuation Course at Millbrook Farm and Home Center from October 24 thru the 28th, and for Marlene Mills to attend a State Division of Equalization and Assessment in Goshen, New York from December 5th thru the 9th, 1988. Also, Mr. Logan would like to attend the Exemption Administration course at Millbrook Farm and Home Center the week of November 14th for 3i days. These courses are at no cost to the Town. MRS. SMITH moved to allow Mr. Logan and Mrs. Mills to attend their respective courses and allow a mileage reimbursement of $.22i per mile. Seconded by Mr. Farina Motion Unanimously Carried Since Mr. Logan is already attending the one conference, Mrs. Smith requested that in the future these requests be forwarded to the Town Board earlier. A request for a Peddler's License was received from Tracy Perrotta to serve coffee to the workers with Felix Construction whose head- quarters is now at the old Mancini building on Route 9 near the Lake. They have been working on the Route 9 reconstruction and Ms. Perrotta has been serving them food in Poughkeepsie. Now that they are in Wappinger, they have requested that she continue this service. She has signed the agreement that she will move 1,000 yards every half hour. 308 MR. VALDATI moved to grant a Peddler's License to Tracy Perrotta. Seconded by Mrs. Smith Roll Call Vote: 4 Ayes Mr. Farina ---Abstain Ralph Holt, Chairman of the Recreation Commission wrote to the Board indicating that it has come to his attention that the Planning and Zoning Boards are paid a stipend for attending monthly meetings. He was requesting such pay for the Recreation Commission, noting that it would amount to $1,800 and could be planned in either the A or B of their budget. MRS. PAINO moved to discuss this at a work shop meeting when they were going through the budgetary process. Seconded by Mr. Reis Motion Unanimously Carried Frank Masci, President of the Wappingers United Football Club which sponsors the Soccer Club, wrote to the Chairman of the Recreation Commission, requesting the use of the Rockingham ball park for most of the Spring of 1989, due to the growing number of children in the program. Mr. Holt was present and was invited to comment on this request. He noted that the Soccer Season runs along with the Softball Season and there are teams who want to use that location. There are 440 men between the ages of 18 and 50 participating and they too are increasing their number of about 500 men. These men are working to fix the fields for their use, so this presents a problem trying to provide the proper fields for the different organizations. At this time he did not feel they could promise it solely to any of these clubs. MRS. PAINO moved to table action on this matter pending a work shop with representatives of the Soccer Club and the Recreation Commission. Seconded by Mr. Valdati Motion Unanimously Carried Notice of Public Hearing was received from the Town of Poughkeepsie, November 16, 1988 at their Town Hall, to consider an amendment to the Zoning Ordinance and the Code of Ordinances. MR. REIS moved to accept the correspondence and place it on file. Seconded by Mrs. Smith Motion Unanimously Carried 309 Mr. Tanveer Hussain wrote another letter of complaint regarding the noise from the Pondview Pump Station. Mrs. Paino noted that the Board and the Engineer to the Town have tried on many occasions to correct the situation and the Engineer presented a plan to the Health Department which would have helped alleviate the noise, however, it was rejected. Mr. Hussain suggested that some type of rubber padding or insulation be placed on the sides inside the wallor the usage of cover on the motor. Mr. Paggi replied that the ejector station works by taking air in to it and expelling the air so you have to have access to the outside air and that's what is causing the noise. Mr. Paggi could think of no other method other than what was submitted to the Health Department. The fact of the matter is that the machine is only about 20' from his house and it was in that location when Mr. Hussain bought the house. MRS. PAINO moved to authorize Mr. Paggi to inform Mr. Hussain why the noise cannot be softened, as he suggested. Seconded by Mr. Reis Motion Unanimously Carried The Engineer submitted a report to the Board regarding the cul-de-sac on Valley Road which he investigated at the request of the Board. Mrs. Paino explained that although the children have been picked up by the school transportation for many years, they have indicated to the Town that the cul-de-sac is too narrow for the bus to make the turn. Mr. Paggi inspected the site with the Deputy Highway Superin- tendent, John Carlo, and agrees that the diameter of the cul-de-sac is not conducive to the turn -around action of a school bus. He did not feel it was practical to widen the cul-de-sac and recommended that a letter be sent to the School Board stating that the widening is not practical but possibly, smaller vehicles could be used to transport the children in this area. MRS. PAINO moved to forward a copy of Mr. Paggi's report to the School Board and indicate in a cover letter that historically the children have been picked up by the School Transportation and they should continue to do so since it has been deemed by our Town Officials to be impractical to widen the existing cul-de-sac. Seconded by Mr. Reis Motion Unanimously Carried L 310 A second report from the Engineer referenced problems at the intersection of Myers Corners Road and Montfort Road. Residents complained of the site distance and after the County inspected this site and found the road to be too wide in that area. Mr. Paggi and Mr. DeCarlo, Deputy Highway Superintendent made their inspection and agreed that the Montfort Road end of the intersection is too wide and does cause sight distance problems. To determine the proper action to take, a detailed survey of existing conditions would have to be con- ducted. Mr. Paggi estimated that such a project to effectively channel the traffic at that intersection could be in the $25,000 range. Mrs. Smith, Councilperson for the Fourth Ward, suggested that they have a work shop to discuss what they would do before they spend that kind of money. Mr. Paggi replied that they won't know what they will do until they conduct a survey, an analysis of the problem and a design of the new pavement layout; the survey work and preliminary engineering work would probably run about $1,000. MRS. SMITH authorized the Engineer to the Town to prepare the survey as described, for a sum not to exceed $1,000. Seconded by Mr. Farina Motion Unanimously Carried Upon seconding this motion Mr. Farina asked the Attorney if the Town could ask the County for financial assistance since it is a Town and County intersection. Mr. Wood replied that there is a possibility of influencing the County to contribute to the cost of the improvement. It will depend on the survey work, he added, where the actual boundary of the Town road and the County road lies. He would look into this possibility. The third report concerned a Storm Drainage Easement on Hilltop Drive. A few weeks ago correspondence was received from a resident on Hilltop Drive regarding a reconstructed stream in the rear of her property and she reported that her husband tripped while mowing the lawn and hurt his ankle and she asked if she could receive from the Town some type of hold harmless letter; this was not so much for her family but for someone cutting through the yards. Mr. Paggi advised her to write to the Town Board and they would probably suggest having a work shop meeting to discuss the matter. MRS. PAINO moved to refer this to a work shop agenda. Seconded by Mrs. Smith Motion Unanimously Carried 311 A request was received from the Recreation Commission to use monies from the Schlathaus Fund for the purchase of two new signs for the Park designating the new name "Brexel-Schlathaus Park", at an estimated cost of $750.00, and secondly to replace the oil tank in the house, approximate cost of $210.00 plus installation charges. MRS. SMITH moved to authorize the expenditures from the Schlathaus Fund, as requested by the Recreation Commission. Seconded by Mr. Farina Motion Unanimously Carried A letter was received from Fran Frisina, Secretary to the Highway Superintendent, indicating that she will be retiring November 6, 1988. MRS. PAINO moved to forward a letter to Fran thanking her for her many years of service to the Town. Seconded by Mr. Farina Motion Unanimously Carried A Memo was received from the Zoning Administrator requesting the return of Escrow Funds to N & S Supply Co. in the amount of $4,000.00 since the site is in full compliance and the Building Inspector has issued a Certificate of Occupancy. MR. VALDATI moved to release the Escrow Fund in the amount of $4,000.00 to N & S Supply Co., as recommended by the Zoning Administrator. Seconded by Mr. Farina Motion Unanimously Carried Committee Reports --- Mr. Valdati reported that he is still receiving complaints about dumping at Reese Park and asked that the Deputy Highway Superintendent investigate the matter and take the necessary action to put a stop to this dumping. It was pointed out that this should actually be referred to the Recreation Commission to investigate. Mr. Holt, Chairman of the Recreation Commission was present and noted that the Recreation Maintenance Department has been cleaning this site for the last few weeks and there is repeated dumping going on at this location. They have even moved in boulders to keep people out and they have been plowed out of the way. The gate is torn down every time they put it up. He noted that the problem seems to occur in the early evening. 312 MR. VALDATI moved to authorize the Vandalism Patrol to visit this area in the early evening hours and attempt to stop the violators. Seconded by Mr. Farina Motion Unanimously Carried Mr. Farina had two items on Budget and Finance ---the I.R.S. regulations have changed the mileage to $.24 per mile which will be reflected in the 1989 budget. Under Water and Sewer, when Tall Trees Water Improvement Area had a shortfall of water, CWWIA provided them with water, therefore Tall Trees will be billed a minor amount to pay back CWWIA. Neither Mr. Reis nor Mrs. Smith had reports for this meeting. Resolutions --- Due to the untimely death of Peter H. White, County Legislator for the 15th District, a vacancy now exists and the matter was placed before the Town Board. The following Resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that GORDON HIRT, be and he hereby is appointed as Dutchess County Legislator for District #15 to fill the vacancy created by the untimely death of Peter H. White. Seconded by: Councilman Reis Roll Call Vote: Councilman Farina Aye Councilman Reis Aye Councilwoman Smith Nay Councilman Valdati Aye Supervisor Paino Aye All Board Members agreed when casting their vote that the four candidates from the 15th District who were interviewed by the Town Board were excellent choices. Questions ranging from affordable housing to crime in Dutchess County, water resources, planning etc., were compiled by the Town Board and directed to these candidates. These are matters that our County Legislators need to be concerned with and should have some knowledge of in order to make intelligent decisions. Mr. Hirt was present and was introduced and congratulated by Mrs. Paino. A request was received by James Klein for the Town to take over the roads in the Kendell Farms Subdivision. The Town Clerk noted that 313 required documents had been submitted by Mr. Klein and were in proper form. The Highway Superintendent recommended acceptance of these roads as they were completed to his satisfaction and pursuant to the Town Road Specifications. MR. FARINA moved that the recommendation of the Highway SUperintendent be accepted and the roads in the Kendell Farms Subdivision known as Kendell Drive, Nicole Drive and Lenny Court, be accepted as and for Public Roads in and for the Town of Wappinger. Seconded by Mrs. Paino Motion Unanimously Carried A Resolution for the Maintenance of the Sidewalks on Route 9 at the Wappinger Plaza for the reconstruction of Route 9, was on the Agenda for the consideration of the Town Board. The following Resolution was offered by COUNCILMAN FARINA who moved its adoption: WHEREAS, the New York State Department of Transportation proposed the reconstruction of Route 9, between Myers Corners Road and Cottam Hill Road, S.H. 5154, S.H. 5549, and S.H. 5050 partly in the Town of Wappinger, Dutchess County, and WHEREAS, the State will include as part of the reconstruction of the above mentioned project the construction of sidewalks at bus shelters, pursuant to section 10, subdivision 22 and section 151 of the Highway Law, in the Town of Wappinger, as shown on the contract plans relating to the project, and WHEREAS, the bus shelters will be on both sides of Route 9 at the Wappingers Plaza. NOW, THEREFORE, BE IT RESOLVED, that the Town of Wappinger approves the construction of sidewalks at bus shelters, the above mentioned work performed on the project and shown on the contract plans relating to the project and that the Town of Wappinger will maintain or cause to be maintained the sidewalks as above stated as shown on the contract plans, including the control of snow and ice. BE IT FURTHER RESOLVED, that the Clerk of the Board is hereby directed to transmit five (5) certified copies of the foregoing resolution to the State Department of Transportation. Seconded by: Supervisor Paino Roll Call Vote: 5 Ayes 0 Nays Mrs. Paino requested the Attorney prepare the proper documents for the establishment of a sidewalk district so the Town would not have to bear the cost of the maintenance solely but with those who will benefit by the convenience of the sidewalks. Public Hearings having been held on the Benefit Assessment Rolls for the Town's Water and Sewer Districts and Improvement Areas, the matter was placed before the Town Board for their consideration. 314 MRS. PAINO moved that the adjourned Public Hearing on the Assessment Roll for the Tall Trees Water Improvement Area be held on November 17, 1988, at 7:15 P.M. at the Town Hall, and a Special Meeting be held at 7:20 P.M. to consider the adoption of the Tall Trees Benefit Assessment Roll, and any other business to come before the Board. Seconded by Mr. Farina Motion Unanimously Carried The following resolution was offered by COUNCILMAN FARINA who moved 1111W✓ its adoption: WHEREAS, the Town Assessor did prepare at the direction of the Town Board, the Assessment Roll for the Wappinger Sewer Improvement Area #l, for the assessment to be levied in 1989, and WHEREAS, said Assessment Roll was filed with the Town Clerk of the Town of Wappinger, and WHEREAS, she thereafter gave notice by posting upon the bulletin board of the Town and in the newspaper published within the Town of the time and place when the Town Board would conduct a hearing and hear objections upon or to said roll, and WHEREAS, the Town Board of the Town of Wappinger did meet on the 7th day of November, 1988, to consider and hear objections of said roll, NOW, THEREFORE, BE IT RESOLVED, that the Assessment Roll of 1988, for the Wappinger Sewer Improvement Area #1 for taxes to be collected in 1989, be approved, ratified and confirmed and adopted, and the Supervisor and Town Clerk are hereby authorized and directed to execute the warrant for collection of said taxes in the manner prescribed by Law. Seconded by Mrs. Smith Motion Unanimously Carried A resume was received from John Perillo for the position vacant on the Planning Board. Mrs. Paino noted that a recommendation was received from the Planning stating that they voted unanimously in favor of Mr. Perillo to fill this vacancy. 319 The following resolution was offered by COUNCILWOMAN SMITH who moved its adoption: RESOLVED, that John Perillo, be and he is hereby appointed as a member of the Town of Wappinger Planning Board to fill the vacancy created by the resignation of Peter Howell, and BE IT FURTHER RESOLVED that the term of the said John Perillo to the Planning Board shall expire January 4, 1989. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays The Town Clerk noted that one of the members of the Planning Board had indicated that the vote recommending John Perillo to fill the vacancy on that Board was not a unanimous one but the motion was carried. A Public Hearing was held on a proposed Local Law to Repeal Local Law #6 of 1981, on November 7, 1988; the matter was now placed before the Town Board for their consideration. Mrs. Paino explained that the Town Board is currently pursuing hooking into Tri -Municipal Sewer and they have begun some preliminary dis- cussions with that Commission, however in order to move ahead with this and begin serious negotiations and before they come to a point of signing a contractanlin order to continue pursuing the avenue of Tri -Municipal, the Town is arranging to hold a referendum to repeal Local Law #6 of 1981 which stipulated that the current Town Board and future Town Boards could not participate in Tri -Municipal; the Town is also asking, through the courts, a declaratory judgment as to whether that Local Law was legal. During the Public Hearing held earlier, the Town Attorney informed the Board of the time frames on both the Local Law and a proposed Ambulance District. It is the intent of the Board to hold these referendums at the same time rather than individually and it was recommended by the Attorney that the Board table action on the proposed Local Law until the December 5th, 1988 meeting. MR. VALDATI moved to delay action on the pending Local Law until the December 5th, 1988 meeting. Seconded by Mr. Farina Motion Unanimously Carried A Public Hearing was held on consideration by the Town Board to release a parcel of land owned by Contrail Associates from the Rockingham Farms Sewer District. 320 MRS. PAINO moved that the parcel of land on All Angels Hill Road owned by Contrail Associates, Grid # 6257-02-870864, be removed from the Rockingham Farms Sewer District. Seconded by Mr. Reis Motion Unanimously Carried A proposed agreement for payment in lieu of taxes on property r■ owned by the Power Authority of the State of New York, formerly Charles Palazzo was placed before the Board for their consideration. time MRS. SMITH moved to accept the Agreement and authorize the Supervisor to sign said Agreement. Seconded by Mr. Farina Motion Unanimously Carried Consideration of acceptance of the Hamlet Roads was placed on the Agenda, however, the Town Clerk pointed out that the recommendation of the Highway Superintendent had not been received. Mrs. Paino requested the Attorney and the Engineer to contact the developer and arrange to have the roads completed so they can be dedicated to the Town. There was some minor work, according to the Engineer that required completion. The Town Clerk was requested to contact the Highway Superintendent or his Deputy and request a letter of recommendation. Assuming that this letter is received, this matter will be addressed at the Special Meeting of November 17, 1988. Mrs. Snowden had received all the documents for the acceptance of Carmel Heights with the exception of the title insurance. The Attorney recommended that they accept the road subject to receipt of the title insurance and when that is received, the Board will then formally accept that. MRS. SMITH moved that the recommendation of the Highway Superintendent be accepted and Carmel Heights be accepted as and for a Public Road in and for the Town of Wappinger, subject to the receipt of the title insurance. Seconded by Mr. Farina Motion Unanimously Carried Other roads ready for acceptance were Peel Lane and Schuele Drive and all the required documents were received. MRS. PAINO moved that the recommendations of the Highway Superin- tendent be accepted and Peel Lane and Schuele Drive be accepted as 321 and for Public Roads in and for the Town of Wappinger. Seconded by Mrs. Smith Motion Unanimously Carried Unfinished Business --- Mrs. Paino had one item for discussion relating to a request for Stop Signs at various intersections on Kent Road. Correspondence was received from the Engineer, carbon copied to the Attorney regarding minimum sight distance at some intersections and Mr. Paggi is questioning the liability of the Town if the Stop Signs are installed. The Attorney forwarded the information to the State Department of Transportation and they indicated they could consider a variance if the measurements and design of the interesections were provided. The other problem is that Kent Road is designed as a thru thoroughfare which indicates in the Road Specs that it should be free from any obstruction to flow of traffic. It was agreed by all that a work shop was needed for further discussion. Bernice Mills was recognized by the Chair and complained about the recent paving done in the Wildwood Condos and in doing so paved off street parking and joined it to a Town road. The Zoning Administrator cited them and gave them ten days to respond and she does not believe they have responded. It's after the 1st of November, the Snow Ordinance is in effect and there are cars parked out there. She also stated that they do not have a Fire Lane anywhere in that complex. They did a neat job, but they added more parking and they joined the Town road. The Councilman of that Ward should check it out. They added more parking spaces in the back of the building which interferes with her property, now there's more macadam and less drainage so that runs off into her property. Mr. Wood added that an amended site plan was submitted to Mr. Levenson's office for consideration of the Planning Board, so although they went ahead and did the work, they had maps delivered to the office for review by the Planning Board. Mr. Valdati referred to a recent episode of a member of the Town Vandalism Patrol being utilized at a Town meeting. He questioned who authorized this and for what reason and it was referred to a work shop. A memo was submitted by the Attorney to the effect that there was money allocated in the budget for Town Patrol and absent 322 any special rules or procedures previously established, that the Supervisors general authority under the Town Law would vest the Supervisor with the authority to use the patrol of the Town. Mr. Valdati questioned the justification of the use of this patrol on two occasions and Mrs. Paino replied that she had indicated at the work shop that there might have been a disturbance at that meeting in question she requested the patrol. He was trying to ascertain if the cause was of a personal nature and if so, misuse of Town funds. Mrs. Paino repeated that she sensed a disturbance might happen during a Town Board meeting and if anyone of them called her office to indicate that there might be a disturbance at any Town Board meeting, that would be the course of action that she would take. He then requested that all assignments for the Vandalsim Patrol be mentioned to the full Board so that full knowledge and understanding of any actions that take place would be supplied to all. Mr. Reis had one more item to come before the Board. The Board had placed $10,000.00 in the 1985 budget for a Van for the Dog Control Officer. MR. REIS moved to authorize the Comptroller to go to bid for a Van for the Dog Control Officer. Seconded by Mrs. Paino Motion Unanimously Carried There was no other business to come before the Board MR. The Town Board of the Town of Wappinger faced with a deadline pursuant to a Consent Order between the Town of Wappinger and the Department of Environmental Conservation with respect to resolving certain sewer problems in the Town of Wappinger, deems it to be in the best interest of the people of the Town of Wappinger for the Town Board to be free to negotiate and enter into agreements with Tri -Municipal Sewer Commission. SECTION 2. Repeal. Local Law No. 6 of 1981, which was adopted pursuant to Municipal Home Rule Law Section 23(2), curtailing and limiting the power of the members of the Town Board with respect to their authority to enter into agreements with Tri -Municipal Sewer Commission, be and hereby is repealed. SECTION 3. Effective Date. This Local Law shall be subject to a Mandatory Referendum and shall be submitted for the approval of the Electors at a Special Election to be set by the Town Board in compliance with Article 7 of the Town Law and the proposition to be placed before the Electors at said Special Election shall be stated as follows: "Should Local Law No. 6 of 1981 be repealed?" Approval of such proposition shall result in the adoption of said Local Law; failure to receive a majority of said Electors at said Special Election shall result in the defeat of said proposition. Mrs. Paino had a question regarding the timing of the Mandatory Referendum since consideration of the formation of an Ambulance District will also be put to a vote at a Special Election. Could they coincide the two subjects so they may placed on a ballot for one Election. The Attorney explained the time frame which would result in one matter being approved at one Town Board meeting and the other one would follow at a subsequent meeting. Mrs. Smith asked about the declaratory judgment which was due from the courts regarding the legality of Local Law 6 of 1981. Mr. Wood replied that they should be assigned to a judge this week, will be fully submitted to a judge by Monday or Tuesday and if given a preference, the judge could give a decision by early December. He discussed possible dates with the Board and advised them to wait until the December 5, 1988 meeting to approve this Local Law.
