1988-08-08 SPM229 A Special Meeting was held by the Town Board of the Town of Wappinger on August 8, 1988, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the meeting at 7:40 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Constance Smith, Councilwoman Robert Valdati, Councilman Elaine H. Snowden, Town Clerk This meeting was set at the Special Meeting of August 1, 1988, for the purpose of taking action on the DCARC proposal for a group home at 5 Drew Court in the Town of Wappinger. The deadline was extended to August 8, 1988 by the DCARC and the Town must act tonight either to approve the site or oppose the site and offer alternate sites. Mrs. Paino asked the residents who were present if they wished to offer the alternate sites and the consensus of opinion was affirmative. The following resolution was offered by COUNCILMAN FARINA who moved its adoption: WHEREAS, the Dutchess County Association of Retarded Citizens has advised the Town of Wappinger of its intent to establish a community residence at 5 Drew Court in the Town of Wappinger; and WHEREAS, the Town Board conducted an informational Public Hearing on Wednesday, July 20, 1988, at which representatives from DCARC and the Town Board and the community participated; and WHEREAS, the Town Board has considered all of the information and comments received at said meeting; and WHEREAS, the Town Board has further considered the flooding conditions in the area as well as rodent infestation; and WHEREAS, it is the intention of the Town Board to make a determination in accordance with law; NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger does hereby object to the location of the community residence at 5 Drew Court on the grounds that the establishment of this home would result in such a concentration of sites that a new one would alter the character and nature of the community; and BE IT FURTHER RESOLVED, that the Town Board does hereby alternatively suggest the alternative sites annexed hereto as Schedule "A"; and BE IT FURTHER RESOLVED that the Town Board does hereby reject this site based upon the concerns raised at the informational Public Hearing with respect to flooding and rodent infestation; and BE IT FURTHER RESOLVED that the Town CLerk and the Town Attorney be and hereby are directed to forward copies of this resolution as the official Town objection to both the DCARC and the Commission of Mental Retardation Services. Seconded by: Supervisor Paino Roll Call Vote: 5 Ayes 0 Nays 230 Mrs. Paino added that she felt it was very obvious that neither the Town nor the residents are opposed to a home of this nature per se, but rather due to the circumstances that exist at this particular site, specifically the rodent infestation and ongoing problem of flooding, they feel this is not the proper location for a home such as this. Mrs. Paino had one communication which should be addressed at this meeting, as follows: July 27, 1988 RE: Town of Wappinger Sewer Alternatives Dear Supervisor Paino: This letter is a formal request for an extension until August 15, 1988, for comments on the Supplemental DGEIS for the Town of Wappinger Wastewater Treatment Facilities Plan. This extension is requested since Dr. John Scott, Commissioner of Health, is on vacation at this time. Your consideration will be appreciated. Very truly yours, s/ John F. Lazarony, Sr. Assistant Commissioner of Health Mrs. Paino had discussed this with the Attorney to the Town and also Saratoga Associates this day and they felt if this period was extended for another week it would impact the schedule that they have set for the SEQR procedure which is an October 5th, 1988 deadline. If the other Town Board Members agreed, she would call Mr. Lazarony in the morning and explain why they could not consider extending the time for another week. The other Town Board Members concurred with this action. There was no other business to come before the Board. MR.
