ADJOURNMENT 264 The Regular Bimonthly Meeting of the Town Board of the Town of Wappinger was held on October 5th, 1987, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the meeting at 7:40 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Absent: David Reis, Councilman (In Baltimore Md. preparing for Son's Operation) Others Present: Joseph E. Paggi, Jr., Engineer Herbert Levenson, Zoning Administrator All joined in the Pledge of Allegiance to the Flag and a moment of silent prayer for the Town and its residents. The Minutes of the Regular Meeting of September 21, 1987, having previously been forwarded to all Board Members, were placed before them for their consideration. MRS. VISCONTI moved that the Minutes of September 21, 1987 be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mr. Farina Motion Unanimously Approved The Town Clerk presented the Tentative Budget of 1988 to the Town Board, from the Budget Officer. Reports were received for the month of September from the Town Justices, Supervisor/Comptroller and Zoning Administrator. MR. FARINA moved to accept the above stated reports and place them on file. Seconded by Mrs. Visconti Motion Unanimously Carried Petitions & Communications --- Mr. J. Miller of M & 0 Sanitation wrote to the Board indicating that he would like to withdraw their bid on Sludge Removal due to a mistake in computing and requested the return of their certified check which was required with the submission of the bid. There were no other bids received for this contract. 265 MRS. PAINO moved to refer this communication to the Attorney to the Town for his review and recommendation. Seconded by Mrs. Visconti Motion Unanimously Carried A memo was received from Thomas Classey, Building Inspector, in regard to problems with inspections of electrical work. The problem has existed for many years throughout the County; it appears that the inspections are presently being done by the New York Board of Fire Underwriters and the Inspectors available are responsible for very large areas. Mr. Classey suggested that the Town join with other surrounding towns , possibly Fishkill, East Fishkill, etc. to hire an electrical inspector. The Attorney is investigating the legal ramifications that may be involved and the Town Board will address the cost at their budget work shops to determine if this is a feasible solution. MRS. PAINO moved to receive this correspondence and place it on file for further discussion. Seconded by Mr. Farina Motion Unanimously Carried A request was received from John Railing for water service from Central Wappinger Water Improvement Area for additional stores in the De Garmo Plaza which is presently served by CWWIA. The Engineer explained that the Planning Board is presently reviewing a site plan for the proposed expansion and he assumes that as part of the approval, Dutchess County Health Department will require a letter from the Town giving permission to the applicant to hook the additional stores into the water system. At this point Mr. Paggi had no knowledge of the projected use of the water for the stores and volunteered to obtain this information from Mr. Railing. MRS. PAINO moved to table action on this request pending further information from the Engineer. Seconded by Mrs. Visconti Motion Unanimously Carried Mr. Frank Buyakowski of Contrail Associates wrote to the Town Board requesting permission to withdraw 1.3 acres on All Angels Hill Road from the Rockingham Sewer District, the reason being that he is unable to receive permission to hook a proposed house into the sewer. L 266 Daniel Curtin, Attorney representing Mr. Buyakowski, explained that their intent was to construct a single family dwelling and it is his understanding from the Health Department that they will not entertain a septic system since they are in a sewer district. The district cannot accommodate them, thus the request to withdraw so they can file plans for a septic system. The applicant submitted a map indicating the location of the parcel. thre Mrs. Paino recommended that the Board table the matter to October 19th, L 1987 meeting pending a recommendation from the Attorney to the Town. A communication was received from the DCARC indicating that the alternate sites offered for the 38 Kent Road location were unsuitable and stating, as follows, the procedure now required: "In accordance with Section 41.34 (c) of the New York State Mental Hygiene Law, the Town of Wappinger now has 15 days in which it may offer another alternate site or sites. Should you not come forward with another alternate site or sites, or should such an alternate(s) be deemed unsuitable, we shall then request a commissioner's hearing in accordance with the above referenced law. Of course, should you choose to not propose alternates and wish to withdraw your objection to the 38 Kent Road site, please do so. We would then, of course, not request a commissioner's hearing, but instead proceed with the Kent Road site. In considering alternate sites I would refer you to my prior notification and attachments which include the Community Residential Fact Sheet". MRS. PAINO moved to receive this correspondence and place it on file. Seconded by Mr. Farina Motion Unanimously Carried The following Proclamation was offered by Supervisor Paino: WHEREAS, handicapped persons deserve and need greater accessibility to convenient public and private parking facilites; and WHEREAS, specially marked parking spaces for handicapped persons are identified by the international symbol of access; and WHEREAS, finding an accessible parking place can be very difficult for a handicapped person; and WHEREAS, many non -disabled persons disregard parking spaces reserved and identified for handicapped persons thereby causing unnecessary hardship to the handicapped; and WHEREAS, the 1,000,000 members of the Disabled American Veterans and 120,000 members of the Disabl&American Veterans Auxiliary desire to create a greater awareness of the needs of the people with disabilities. NOW, THEREFORE, I, IRENE M. PAINO, Supervisor of the Town of Wappinger, do hereby proclaim the month of October 1987 as "DAV HANDICAPPED PARKING AWARENESS MONTH" in Wappingers Falls, New YOrk. 267 Notice of Public Hearing was received from the United States Coast Guard indicating a date of September 30, 1987 at the Wappinger Junior High School regarding the opening of the Metro -North's Wappinger Creek Railroad Bridge at New Hamburg. Although the date has past, comments and input can still be forwarded to the Coast Guard. MR. FARINA moved to receive the notification and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried Committee Reports --- Mr. Valdati referred to the area's recent snow and wind storm that created havoc throughout Dutchess County and reported that he had contacted our Highway Superintendent to ascertain the status of our Town relating to damage from fallen trees. Several areas are still without power, including Pine Ridge Drive and Robinson Lane; trees have fallen over wires and all are cautioned to stay away from this type of situation. Our Highway Superintendent indicated that residents can bring tree limbs, if cut up and portable, to the dumpsters available on Saturdays in October at the Castle Point landfill site. He deferred to Mr. Farina for further information. Mr. Farina had conferred with Mr. Croshier last week who agreed that tree limbs could be brought to the landfill site; in view of the situation that now exists, the same procedure will apply and when dry, they will burn this debris. The news media was requested to announce this fact in a press release and a resident from Chelsea, June Wyant, requested that they include the Beacon Free Press which is available to the residents of that area. Relating to the dumpster program, Mr. Farina reported that arrangements have been made with the carter so no residents will be turned away. It appears that most of our residents are pleased to have a place to dump their debris and get their garage space back. Mrs. Visconti attended the Airport Advisory Committee meeting on September 21, 1987; the Chairperson of the Committee, Caroline Raymond informed them that at a meeting with Lucille Pattison it was indicated that revisions are being considered in 1988 which will change the role of the Committee. It is their hope that these changes will not occur and they will remain as they are at present. Dial -A -Ride meeting was held on September 24, 1987 and Mrs. Visconti reported that the County is considering building a garage to house 268 the vans which will enable them to oversee the maintenance schedule. There have been problems with the performance of the private company hired for this maintenance. The Advisory Board has expressed their concern in a letter to the Mountain View Company and hopefully this will be corrected in the near future. Resolutions --- A study conducted by the Dutchess County Clerk and his staff to relocate the Motor Vehicle Services from the city of Beacon to a location in the Fishkill/East Fishkill area was addressed by the Town Board at their last meeting. It was felt by some members of the Board that further information was needed and the matter was again placed on the Agenda for the Board's consideration of supporting the County Clerk in this proposal. Mrs. Paino noted that two representatives from his office were present to answer questions from the Town Board and the public. Discussion was open to the public and comments were heard from Don Synnett, Mayor of the Village of Wappingers Falls, speaking as a resident, since he had no knowledge of this proposal being forwarded to the Village offices, he was against the proposal, felt it would be unfair to Beacon and as far as convenience goes, it was simple for the Village residents to go to Beacon rather than travel to Poughkeepsie. At this point Roberta Rubenstein from the Dutchess County Clerk's office interjected the fact, which was determined by their study, that the majority of population is now and is projected to 1995, in the Fishkill/East Fishkill/Wappinger area; she added that the exact location has not been determined, there are alternate sites being considered. George Urciuoli, resident of Wappinger and native of Beacon agreed with the area of population growth and felt traffic should be kept of off of Route 9D; Mike Hirkala described the trip to Beacon and the parking horrendous; Hank DiMarco's concern was to keep the location away from Route 9 and Route 9D. Don McMillen, Wappinger County Legislature, brought out the fact that a year ago the County went through negotiations to purchase the Roosa building in Beacon and it was his intention when he voted for this that the Motor Vehicle Office would relocate in this building with ample office space and convenient parking. It's hs;understanding that the County Clerk does not wish to relocate at that location. It is the function of the County Executive to relocate offices, however, in this 269 instance the County Clerk has been given permission by her to proceed with the site and the move and design of office; he does not, however, have the power to sign a lease and at this point, her stand on this matter has not been revealed. It is, he continued, a positive fact, that the County Clerk will not relocate to the County building in the city of Beacon and also positive that if the County Executive does not go along with this, he will close down the Motor Vehicle office in Beacon. He was against the location of Fishkill for a site and requested the Town Board to specify a more central location if they did vote on this resolution tonight. Further discussion ensued regarding the intended use of the County owned building in Beacon and who had the authority to choose the site. Connie Smith, resident of Wappinger offered her comment that this is a County problem and the Town should not be involved. MRS. VISCONTI moved to table action on this matter. Seconded by Mr. Valdati Motion Unanimously Carried Mr. Valdati had previously noted that he spoke with the Mayor of the City of Beacon who felt that if the numbers revealed the fact that the Motor Vehicles Office would be more functional in another location, so be it, but he did not go along with neighboring towns being requested to support the proposal to relocate the office from Beacon, since, they had no vote in the matter. Mr. Valdati had abstained on the vote for the support of this proposal at the previous meeting for further information on the reaction of the officials of Beacon to this proposal. Now that he had satisfied this point, he stated that he would again abstain if the Town Board chose to support the proposal. His personal viewpoint was that this office should be centrally located and the County Clerk is capable of making this decision; he supported the proposal, but as a Council- man on the Town Board it would not appear that his input would have any bearing on the decision for the County Clerk to implement his proposal. Mrs. Paino concurred with Mr. Valdati's statements in that she, too would support the County Clerk in his proposal since the statistics supporting his intent clearly indicate the growth pattern and the relocation would be a big plus for the residents of Wappinger. Mr. Farina also had comments and complimented the County Clerk L L 270 for his foresight in planning for the future. Mrs. Visconti agreed that the Town should not get involved, it's not our "fight"; if it was being relocated in the Town of Wappinger, that would be a different story. The motion was made and unanimously carried. A vacancy existed on the Board of Assessment Review due to the expiration of Stell Dlhosh's term. The following resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that Stella Dlhosh be and she is hereby reappointed as a member of the Town of Wappinger Board of Assessment Review to fill the vacancy created by the expiration of her term, and BE IT FURTHER RESOLVED, that the term of said Stella Dlhosh on the Board of Assessment Review shall be for five years, expiring on September 30, 1992. Seconded by: Supervisor Paino Roll Call Vote: 4 Ayes 0 Nays Mr. Reis ---Absent A Memo was received from Herbert Levenson, Zoning Administrator requesting that the $1,000 Escrow Fund be released to Lee Myles; the landscaping has been completed to his satisfaction. MR. FARINA moved to approve the release of $1,000 Escrow Fund being held for Lee Myles for landscaping the site, at the recommendation of the Zoning Administrator. Seconded by Mrs. Visconti Motion Unanimously Carried A second request from the Zoning Administrator was to release the sum of $3,800 to Friendly Acura from the Escrow Fund being held for landscaping which has been completed to the satisfaction of the Zoning Administrator. MR. FARINA moved to release $3,800 to Friendly Acura from the Escrow Fund being held for landscaping, at the recommendation of the Zoning Administrator. Seconded by Mrs. Visconti Motion Unanimously Carried The acceptance of Stage Road was placed before the Board for their consideration. Mrs. Snowden informed the Board Members that all the required documents had been received except the most important --- the recommendation of the Highway Superintendent. 271 MRS. PAINO moved to table consideration of this matter to the meeting of October 19th, 1987, pending the recommendation of the Highway Superintendent. Seconded by Mrs. Visconti Motion Unanimously Carried The following resolution was offered by COUNCILMAN FARINA who moved its adoption: RESOLVED, that all delinquent water and sewer bills in arrears as of November 18th, 1987 in: Oakwood Water District, Central Wappinger Water Improvement Area, Fleetwood Water District, Tall Trees Water Improvement Area, Ardmore Water Improvement Area, Watch Hill Water Improvement Area, Wappinger Sewer Improvement Area #l, Wildwood Sewer District, Rockingham Farms Sewer District, Fleetwood Sewer District and Mid -Point Sewer District, in the Town of Wappinger, be forwarded to the County of Dutchess to be placed on the Tax Rolls of 1988. A list of all delinquent charges will be forwarded to the County on November 25, 1987. Seconded by: Councilwoman Visconti Roll Call Vote: 4 Ayes 0 Nays Mr.Reis---Absent At the last meeting the Assessor had been directed to complete the Benefit Assessment Rolls for the Water and Sewer District; it is now required that the Town Board set a date and time for the Public Hearings on these Rolls. MRS. PAINO moved to set the Public Hearings on the Benefit Assessment Rolls for the following Water and Sewer Districts and Improvement Areas on November 5th, 1987 starting at 7:30 P.M. and continuing at three minute intervals until completed: Central Wappinger Water Improvement Area, Oakwood Water District, Fleetwood Water District, Tall Trees Water Improvement Area, Ardmore Water Improvement Area, Wappinger Sewer Improvement Area, Wildwood Sewer District, Rockingham Farms Sewer District, Fleetwood Sewer District, Mid -Point Sewer District and Watch Hill Sewer District. Seconded by Mr. Farina Motion Unanimously Carried Unfinished Business --- The matter of the Railside Drive proposal, having been tabled from the last meeting for further information from Town involved agencies, was again placed before the Board for their consideration. MRS. PAINO moved to table the matter to the October 19th, 1987 meeting. Seconded by Mr. Valdati Motion Unanimously Carried 272 In answer to questions from interested people in the audience, Mrs. Paino indicated that the Board was in favor of the concept in that it would take some traffic off of Route 9 and Route 9D and relieve the Village of their traffic burden. However, both she and Mrs. Visconti expressed their concern on the impact this proposal could have on the hamlets of Chelsea and Hughsonville. It was their intent that these hamlets not be disturbed and the plan will have to eliminate the disturbance of these communities. The matter required discussion with the pertinent agencies of the Town to gain their input and for this reason Mrs. Paino recommended that no action be taken pending a future work shop. All who wished to speak were invited to do so and after a lengthy discussion Mrs. Paino requested Mr. DiMarco, Co -Chairman of the Committee for Railside Drive, to contact her to set up a meeting for discussion on this proposal. A report was received from the Engineer regarding Davco Pump Station on Baldwin Drive and after inspection he recommended that a manhole insert be placed on the wet well and the dry well be raised and waterproofed. MR. FARINA moved to authorize the expenditure of a maximum of $1,800 on the Davco Pump Station on Baldwin Drive, as recommended by the Engineer. Seconded by Mrs. Visconti Motion Unanimously Carried Copy of correspondence from Highland Glen Development Corp. to Robert Gray of Barger, Campbell, Gray & Railing was forwarded to the Town Board regarding repairs on the Pondview Pump Station. Mr. Paggi noted that he was working with Highland Glen Development Corp. and the Dutchess County Health Department to determine why the pump was not functioning. MR. FARINA moved to receive this correspondence and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried Leif Jensen, Chairman of the Tri -Municipal Sewer Commission, wrote to the Board regarding clarification of reimbursement by the Town on expenses relating to the preparation of the E.I.S. on the Wasterwater Treatment Plan. Mr. Jensen suggested that a meeting be 273 set up with the Board to clarify the issues. Mrs. Paino scheduled a meeting for October 21, 1987 at 7:30 P.M. with representatives of the Tri -Municipal Commission and Saratoga Associates (firm hired to prepare E.I.S.) There was no other business to come before the Board. MR. VALDATI moved to adjourn the meeting, seconded by Mr. Farina and unanimously carried. The meeting adjourned at 9:20 P.M. Reg. Mtg. 10/5/87 7;;CM,_32 Elaine H. Snowden Town Clerk A Public Hearing was held by the Town Board of the Town of Wappinger on October 19, 1987, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York, to consider the Establishment of an Ambulance District within the Town. Supervisor Paino opened the Hearing at 7:05 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). The Attorney to the Town was present and referred to a map indicating that the District would encompass all of the Town of Wappinger outside of the Village of Wappingers Falls. The State Legislature, by special legislation, authorized the Town to consider establishing this district. The procedures require legal notification of the public hearing, which the Town Clerk has attested to; determination by the Town Board that owners within the proposed district will be benefitted by services that will be provided by the district; boundaries must be established and Town Board will have to make the determination as to whether or not all property owners who will be benefitted are so included and finally the Town Board must determine that the establishemnt of the district will be in the public interest. The district will provide that the Town would be authorized to enter into a contract with ambulance services to provide this service to all residents within the ambulance district at no cost, or a cost that will be levied 011100 as a tax on real property. There were representatives from the Sloper Willen Ambulance Service present and Mrs. Paino invited them to make a presentation. It was pointed out that the Town has not entered into an agreement with any ambulance service but they have discussed the matter with Sloper Willen as they are local and have served our area since their formation. Prior to comments from representatives of Sloper Willen, a resident of Chelsea asked what about the people in that area presently serviced by Beacon Ambulance Volunteers. The Town Clerk explained that Beacon Ambulance services part of Chelsea area, however, the basic Town of Wappinger portion of that area is in what is considered, the Sloper area. The residents differed with that conception stating that for years Chelsea Road has been the dividing line, everything north is Sloper and everything south is Beacon. John Kloepper, Chief of services at Sloper Willen, operating the services for 13 years and a resident for 19 years, noted that there is a division in the Chelsea Fire District, one section is covered by Sloper Willen and one section covered by Beacon Volunteers; the districts were assigned by the State of New York since 1975 and the dividing line is the Town of Wappinger. The residents present disagreed with his statement. Councilman Reis took the floor and referring to the posted map noted that the hamlet of Chelsea is proposed for this district as it is within the Town of Wappinger, however, if Chelsea is served by the Beacon Volunteers, this should be checked for the legal aspects and if it is determined that they are served at no charge the boundaries of the proposed district will have to be changed. The Attorney was requested to investigate the matter to determine if the Chelsea residents have legal coverage on ambulance service with Beacon. Robert Conrad, Central Avenue, has used Sloper's services for many times for his wife and thanks to them, she's alive; he doesn't think volunteers can handle her situation. Councilman Valdati asked if it is determined that the Chelsea residents are covered, as suggested by the residents, would this affect the rates to the Town. If a work shop is held, as Mr. Reis requested, then new figures will have to be determined if the boundaries are changed to delete Chelsea. Kenneth Kane, a Village resident asked if they would be involved in the district, and if not, would it still cost them the same. The Attorney responded that the Town has no jurisdiction over the Village in the case of special districts and they, therefore cannot include them. They are a separate government and can consider establishing such a district within the Village. Cecile Hawksley, resident of the Town for 22 years never had the need for an ambulance until a few weeks ago when her mother had a heart attach. She commended Sloper Willen for their fabulous service which she felt, helped save her mother's life. L Fran Greggo,Stoneykill Road asked if the tax they were talking about on the ambulance district would be based on the ridiculous new assessment. Would she pay the same or more than someone else and would it matter how many times you used the ambulance. The average cost to the taxpayer will amount to approximately $25.00 per year for each household, according to the Assessor's calculations. It is based on the assessment just like the fire districts. Alex Rosmilso, Chelsea Road, said he usually gets the job of calling the ambulance when an accident occurs at the Chelsea Ridge entrance and the Beacon Volunteer ambulance is there right away whereas Sloper Willen takes twice Sloper Willen. Jim Tompkins asked for service when a as long; they have a lot more to speak for than if Sloper Willen be able to charge a resident district is formed. He was told there will be no charge in the area of the district. Terry Strohm asked the representatives of Sloper Willen what is the charge for service when they use all of their equipment; it seems that everyone is worrying about $25.00. Mr. Kloepper responded that the basic life support is about an average of $202 and advanced life support about $325 in each instance. Anita Hoffnagle, Bookkeeper at Sloper Willen wanted to clarify the fact that the Town Board was considering the plan which would enable them to collect all fees possible from the insurance companies. Bills would therefore have to be sent to the patient in order to obtain the proper information as to whether they have would be no out of pocket money involved. Mr. Farina explained there are two proposals being considered, the one is for no billing and the other involves billing in order to collect the allowed amount from the insurance company. The no billing proposal inourance however there I would cost about $40.00 per household as opposed to the $25.00 for the other one. The Town Board was considering the billing proposal because it would cost the taxpayers the least amount of money. Jim Tompkins asked the representatives from Sloper Willen why did they want their cake and want to eat it, too; why do they want the money from the insurance and the taxes as well; if a fire company can operate out of tax money, why can't they. President Sloper Board of Trustees Dr6.Sdhwerm n/reiterated the two proposals, pointing out that the least expensive one at a cost of $25.00 to the residents would enable the ambulance company to collect the allowed amount for that service and the remainder would be made up from the tax levied on the residents within the district. There will be no profit to them and in no way are they trying to keep the cake and eat it, too. It simply will allow that the residents will pay nothing out of their pocket other than the district tax levied on all within the district. The proposal for the ambulance district, they felt, would be particularly beneficial to those with no insurance or with very little supplemental coverage, such as Medicare. Mr. Farina noted that one of the items in the proposal that has not been settled relates to consignment over to the ambulance agency, which means that Sloper would handle the paper work to collect from the insurance company and if that happens, the resident would never see a bill. John Senchak asked how many people this will affect; the answer was there are approximately 7 thousand parcels in the Town; referring to the billing of $40.00 per household, that's $280,000 to the ambulance for doing nothing in addition to the monies collected from the insurance company. Mr. Farina explained that the budget proposal is $460,000 and under the first proposal the Town must raise $222,900 based on the assessed value of the Town, $966,000,000.00; under the second proposal, the insurance company would reduce the amount to be raised by taxes to $149,000. In either case the ambulance service will have to account for the money that has been raised by taxes and turned over to them; at the end of the year when the new contract is discussed if they have not written off this amount like any other budget item, it would be unexpended balance and would be applied toward the next year's budget; in the event they overspent the money the Town would not be backcharged for it, however, it would be a point in negotiations for the new contract. Mr. Senchak still thought it would be very profitable for Sloper. Mrs. Greggo wondered why when these subjects come up it's always the property owner that pays taxes---what about these apartments and developments, why not tax the individual. She was informed that this is a provision of the State Law and tax on real property must be followed as they prescribe. Rick Kosowski asked if state law has a provision for a pay as you go ambulance service instead of taxing everyone. George Ursiuoli asked if the formation of an ambulance district was mandated by the State, and if not who is bringing forth this proposal. It was explained that Sloper Willen had asked the Town Board to consider this over a year ago and the Board decided to put it before the residents. It was mentioned previously by one of the representatives of Sloper Willen that this Town is one of very few municipalities in Dutchess County that do not have an ambulance district. r.. Jim Tompkins asked how the members of the Board of Directors of the 160 ambulance service are elected or appointed. The response was that the members of the Board are nominated by various members from the service and they are elected by members of the service. Mr. Tompkins commented to the Board that if they do form an ambulance district, the voters have no say who sits on that Board and controls the funds. The Attorney explained that the Town Board become the Commissioners of the special district once it is formed and do the negotiations with the ambulance service, not necessarily Sloper Willen, and depending what is arrived at after contractual discussions, this is the amount that has to be raised to operate the district. Mike Usifer asked for an explanation as to how they arrived at the Mr. Usifer Farina; after this was figures stated by Mr.explained asked where the Town will get the difference if the budgeted amount is exceeded and was told that the Town will not be charged with this amount, however, it will be used to renogotiate the contract for the following year. Mr. Usifer's next question was would the Town put the contract out to bid if the ambulance district was formed. The Attorney stated that it is not mandated to go to bid since it is a professional service but it was probable that the Town Board would invite other ambulance services to bid, along with Sloper Willen. Alex Rosmilso asked if it would be possible for the residents of the 1111, Town to vote on the district. Once a resolution to establish a district is approved by the Town Board, it could stipulate that this is subject to a permissive referendum, in which case a certain percentage of the residents within the district would have to petition for such a referendum. Rosemary Summers, representative of Sloper Willen and resident of the Town noted that this group was not present to be attacked or to shove this down their throat, they just wanted to answer questions. She related some of the incidents she has seen while associated with the ambulance service and felt that the Town needed this district. This will enable everyone to use the service, not just those who have insurance; it will help those who can't afford the service but need it. Although she didn't want to pay a tax any more than the rest of the residents did, she would be willing to do so for the availibility of this ambulance service and urged the residents to think about it. Barbara Gutsler, Russett Lane, had no opinion on the formation of an ambulance district, came to the hearing to learn more about it but felt that $25 or $40 or $50 a year did not amount to much, it's a small price to pay and have the assurance that a professional ambulance service is available to you. The amount may seem staggering to some but they should study what makes up an ambulance service and the monies they have to expend on equipment, service, etc. She urged the residents to listen to the facts and then form an opinion. Sandy Goldberg was in favor of the ambulance district since it enabled the Town to serve its residents. When she has to call for service, she wants to know she has a first class service to respond and Sloper Willen is that. The Town Board will look into the fact brought up previously that Chelsea is already served by the Beacon Volunteers, but aside from that, the Town owes this to its citizenry and the cost is minimal. Mrs. Visconti asked Rosemary Summers to provide the residents with the names of some of the people who have served on Sloper Willen Board. Among them were: Jim Sedore, Maynard Brownell, Carl Relyea, Bill Parsons, Elaine Snowden, Bill Partridge, Dennis Lasowski, Dr. Brannan and many more; Mrs. Summers pointed out that input from the Town Officials is something they seek and the relationship has been an open one. Kathy Hamilton, Hughsonville felt that $25 or $40 a year was nothing and it could help someone who doesn't have the money to call an ambulance. George Urciuoli asked if the Town formed an ambulance district will this lock out any other ambulance service from coming into the Town. The Attorney responded that this does not give the service an exclusive franchise, it will be a contract for one year to serve those within the designated boundaries and it is conceivable that the Town could have multiple contracts. Mr. Urciuoli had other questions on another service wanting to locate in Wappinger or a hospital wanting to provide medical service and add another tax to the roll; he felt this was a form of socialized medicine. Mrs. Paino felt this was mixing apples and oranges and did not apply to the subject matter. It was pointed out by Mrs. Summers that what they have to look at is emergency service, just as fire and police. Another resident wanted to make sure that the ambulance would be there for those that need it and they won't receive a bill. Mrs. Paino noted that the comments were becoming repetitious and asked that a motion be made to close the Hearing. MRS.
