ADJOURNMENT REMINDER: PUBLIC HEARINGS start a 7:00 P.M. 43 The Regular Bimonthly Meeting of the Town Board of the Town of Wappinger was held on February 2nd 1987, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the meeting at 7:30 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk All joined in the Pledge of Allegiance to the Flag, followed by a moment of silent prayer for the Town of Wappinger and its residents. The Minutes of the Regular Bimonthly Meeting of January 20, 1987, having previously been forwarded to all Board Members, were placed before them for their consideration. Mrs. Paino had just received the Minutes today and wished to have the opportunity to review them. MRS. PAINO moved to table action on the acceptance of the January 20, 1987 Meeting. Seconded by Mr. Reis Motion Unanimously Carried There were no Reports submitted for this meeting. Petitions & Communictions--- A request was received from Cobrew Realty Corp. for acceptance of Hamlet Court as a Town Road. MR. FARINA moved to refer this correspondence to the Engineer to the Town and the Highway Superintendent for their recommendation. Seconded by Mr. Reis Motion Unanimously Carried The Highway Superintendent was present and noted that this road has not been completed according to the Road Specifications and he recommended rejection at this time. The following letter was received from the Engineer in regard to Pizzagalli #3 Water Service: 44 January 9, 1987 Dear Mrs. Paino: We have reviewed Doug Schner's letter of December 1, 1986, regarding the above and advise at this time that field testing be done to simulate the draw from the new building. The actual effect on the existing system may then be measured. It can then be determined what mitigating measures, if any, the developer must offer. MR.REIS moved to direct a letter to Mr. Schner advising him that field testing be done to simulate the draw from the new building, at the recommendation of the Engineer to the Town. Seconded by Mrs. Visconti Motion Unanimously Carried Mrs. Visconti noted that she did not receivea copy of this correspondence and would appreciate one. A notice of Public Hearing was received from the Village of Wappingers Falls on February 3, 1987, regarding a request for a Special Use Permit. MR. FARINA moved to receive this correspondence and place it on file. Seconded by Mr. Reis Motion Unanimously Carried Correspondence was received from the Engineer regarding additional work required on Peel Lane before it can be accepted as a Town Road. In this report, he indicated that a catch basin be installed on the tangent line of Peel Lane at the intersection with Zvi Segal's development; the catch basin would be tied into the existing closed. system. The Engineer recommended that the Town Clerk inform the developer of the work to be done to avoid any future confusion. MRS. PAINO moved to request the Town Clerk to forward a letter to Otto Klassen, as recommended by the Engineer, indicating the work to be done on Peel Lane before the road will be considered for acceptance by the Town. Seconded by Mr. Farina Motion Unanimously Carried 45 In December, a rezoning request was received from Lawrence Farms to change from their present HB -2A designation to SC (shopping center). Before considering this request, the Town Board referred the application to Town Agencies and the Dutchess County Department of Planning for preliminary review. Correspondence was received from the Dutchess County Department recommending that this request be disapproved. Mr. Farina read excerpts from this correspondence --- "The existence of the wetland and wetland buffer area reduces the buildable area of the lot; this has the effect, in a practical sense, of the lot not meeting the minimum acreage (10 acres) for uses in an SC zone". "It is difficult to envision an expansion of uses on this site without violating the provisions of the state wetland law". He felt this was a strong recommendation for disapproving this application. MR. FARINA moved that the request submitted by Lawrence Farm for rezoning from HB -2A to SC (shopping center), be disapproved. Seconded by Mr. Reis Motion Unanimously Carried A request was received from Thomas Ware, Pastor of the Yorktown Christian Center, to waive the fees relating to the construction of their church at Brown Road and All Angels Hill Road. MR. REIS moved to refer this correspondence to the Planning Board for their review and recommendation. Seconded by Mr. Farina Motion Unanimously Carried The reason for this referral was due to concerns of the Planning Board on action taken by the Town Board at their last meeting to waive fees for the Islamic Church at Myers Corners Road and All Angels Hill Road. It was determined that a drainage problem could affect the adjoining property (Schlathaus Property) and drainage fees may be needed from the applicant to correct the problem. Correspondence permission for New York State was received from the Recreation Commission requesting their members to attend the Annual Recreation and Park Society at the Conference of the Kutcher's Country Club from April 5th through April 8th, 1987. MR. REIS moved to grant permission to the Recreation Commission to attend the above stated Conference and their legitimate expenses, 46 including mileage at $.21 per mile, be a Town Charge. Seconded by Mr. Farina Motion Unanimously Carried The annual contract with the Little League Association in the amount of $5,000 was placed before the Town Board for their consideration. MR. REIS moved to approve the contract and authorize the Supervisor to sign said contract. Seconded by Mr. Farina Motion Unanimously Carried The Town Clerk noted that the next meeting would fall on a Town Holiday (February 16, Washingtons Birthday) and asked the Board if they wished to consider changing the date of the meeting. Mrs. Paino added that some of the Town Board Members would be at the Association of Towns meeting, therefore, there would be no second meeting in February; the next Town Board meeting will be March 2, 1987. A communication was received from Hayward and Pakan regarding the Town Hall Facility - General Construction Contract. MR. REIS moved to table action on this matter. Seconded by Mr. Farina Motion Unanimously Carried Mrs. Paino noted that they would meet with Hayward and Paken this week to discuss discrepancies that existed in the building. A notice of Public Hearing was received from the Town of LaGrange, set .on February 4, 1987 relating to an amendment to their Code. MR. FARINA moved to receive this notification and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried Before going on to Committee Reports, Mrs. Paino recognized two of our County Legislators, Don McMillen and Roger Higgins and invited them to address the Town Board. Mr. Higgins spoke on the railroad drawbridge across Wappingers Creek, at New Hamburg, explaining that the bridge has been closed since 1983 due to a mutual agreement between Metro -North and the Coast Guard. The reason was that the bridge was not being used and there were no objections from the public on this action. At the time of the 47 agreement, the Coast Guard had the foresight to specify that if there was enough public interest to open the bridge at a future time, Metro -North would have six months after notification from the Coast Guard to return the draw to operable condition. It has now been determined that Metro -North has requested that this drawbridge be permanently closed. Prompted by this fact, a number of boating enthusiasts and the yacht clubs in the area, are fighting Metro - North's request to keep it closed. It is their opinion that future development along the Wappingers Creek will be completely stifled if noone has access to it. The bridge, he noted, also provides refuge to larger boats during inclement weather. The Yacht Clubs and boaters in the area have sent over 300 letters to the Coast Guard who has promised to hold a public hearing on this matter prior to making a decision. The Town of Poughkeepsie has written to the Coast Guard requesting that the bridge be maintained and available to boats on a twenty-four hour basis; he requested that our Town Board lend their support to this cause. MR. REIS moved to forward a letter to the Coast Guard, with a copy to Metro -North, indicating that the Town Board of the Town of Wappinger adds their support to keeping the drawbridge permanently open, at no extra cost to Dutchess County. Seconded by Mr. Valdati (for discussion purposes) Motion Unanimously Carried Mr. Valdati questioned whether there were enough interested people in the area to warrant the permanent opening of the bridge since it was a big undertaking which will involve considerable expense. Mr. Higgins responded that is the purpose of a public hearing, however the fact that over 300 people have taken the time to write to the Coast Guard supportive of this, is a strong indication. Mr. McMillen added that this bridge represents the only access to the Hudson River by boat and he agreed it would stifle future development in that area. Mrs. Paino recognized Sandra Goldberg, Wappinger County Legislator, who had just arrived at the meeting, and asked her if she had a report on County activities to offer to the Board. Mrs. Goldberg had no report at this time. 48 Committee Reports --- Mr. Valdati, Mr. Reis and Mr. Farina had no reports for this meeting. Mrs. Visconti, Personnel, noted that at a recent meeting it was brought to the attention of the Town Board that the Justice Court has submitted vouchers in the month of December and to date they had not been paid. She requested a report from the Comptroller concerning this matter. Mrs. Paino responded that this had been taken care of immediately after they learned about it. Mrs. Visconti reported that the traffic light was in place at the intersection of Rt. 376 and Lake Walton Road; they were not operable at this time but, hopefully, they would be before the start of the Little League season. Mrs. Paino was pleased since she had introduced this resolution three years ago when she was a Councilwoman on the Board. Resolutions --- Public Hearings having been held by the Town Board on February 2, 1987 on proposed Local Laws setting water and sewer rates for various districts, the matter was placed before the Board for their consideration. MRS. PAINO moved to adopt Local Law #2 of 1987 as follows: A LOCAL LAW AMENDING LOCAL LAW #1 OF 1985, LOCAL LAW NO. 1 OF 1982, LOCAL LAW NO. 9 OF 1980 WITH RESPECT TO THE ESTABLISHMENT OF WATER RATES FOR THE TALL TREES WATER DISTRICT. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. Any and all prior laws establishing water rates for the Tall Trees Water District with respect to residential uses is hereby repealed, only with respect to water rates and the prior laws otherwise confirmed. Section 2. The following water rates are hereby established for the Tall Trees Water District. A. Residential 1. Each residential unit connected to the system: $218.00 annually and payable on a quarterly basis. Section 3. This local law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Mr. Farina Roll Call Vote: 5 Ayes 0 Nays 49 Mrs. Paino indicated that there would be no action on the proposed Local Law for the Oakwood Water District, and the present rate would remain in effect. MRS. PAINO moved to adopt Local Law #3 of 1987 as follows: A LOCAL LAW AMENDING LOCAL LAW NO. 7 OF 1985 WITH RESPECT TO THE ESTABLISHMENT OF WATER RATES FOR THE ARDMORE WATER DISTRICT. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. Any and all prior laws establishing water rates for the Ardmore Water District with respect to residential uses is hereby repealed, only with respect to water rates and the prior laws otherwise confirmed. Section 2. The following rates are hereby established for the Ardmore Water District. A. Residential 1. Each residential unit connected to the system, be obligated to pay the minimum charge of $14.00 each quarter, regardless of consumption of water for said quarter. In addition to the fore- going, there shall be the following charges: If the residential uses more than 2,500 cubic feet per quarter, the residential unit will be charged at the rate of $.75 per 100 cubic feet. Section 3. This local law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Mr. Reis Roll Call Vote: 5 Ayes 0 Nays MRS. PAINO moved to reject the proposed Local Law Establishing Water Rates for the Central Wappinger Water Improvement Area. Seconded by Mr. Reis Motion Unanimously Carried The following proposed Local Law was introduced by SUPERVISOR PAINO: LOCAL LAW OF THE YEAR 1987 AMENDING LOCAL LAW NO.9 OF 1985 WITH RESPECT TO THE ESTABLISHMENT OF WATER RATES FOR THE CENTRAL WAPPINGER IMPROVEMENT AREA BE IT ENACTED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: SECTION 1. Any and all prior local laws establishing water rates for the Central Wappinger Water Improvement Area with respect to residential uses is hereby repealed, only with respect to water rates and the prior laws are otherwise confirmed. SECTION 2. The following water rates are hereby established for the Central Wappinger Water Improvement Area; A. Residential 1. Now all metered - $12.50 per quarter for all uses up to and including 2,500 cubic feet of water. 50 2. In the event uses exceed 2,500 cubic feet, the charge shall be .50 per 100 cubic feet. SECTION 3. This local law shall take effect upon adoption and as provided by the Municipal Home Rule Law. The following Resolution was offered by SUPERVISOR PAINO who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board held February 2, 1987, a proposed Local Law Amending Local Law No. 9 of 1985 With Respect to the Establishment of Water Rates for the Central Wappinger Water Improvement Area, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the legislative body of the town until a public hearing thereon has been held before such body, NOW, THEREFORE, BE IT RESOLVED, 1. That a public hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 2nd day of March, 1987 at 7:25 o'clock P.M. on such day, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. PAINO moved to adopt Local Law #4 of 1987 as follows: A LOCAL LAW AMENDING LOCAL LAW NO. 13 OF 1984 WITH RESPECT TO THE ESTABLISHMENT OF SEWER RATES FOR THE WILDWOOD SEWER DISTRICT. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. Any and all prior laws establishing sewer rates for the Wildwood Sewer District with respect to residential uses is hereby repealed, only with respect to sewer rates and the prior laws otherwise confirmed. Section 2. The following sewer rates are hereby established for the Wildwood Sewer District. A. Residential 1. Each residential unit connected to the system: $261.40 annually payable on a quarterly basis. Section 3. This local law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Mr. Reis Roll Call Vote: 5 Ayes 0 Nays MR. REIS moved to adopt Local Law #5 of 1987 as follows: A LOCAL LAW AMENDING LOCAL LAW NO. 6 OF 1984, LOCAL LAW NO. 1 OF 1981 WITH RESPECT TO THE ESTABLISHMENT OF SEWER RATES FOR THE FLEETWOOD SEWER DISTRICT. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: 51 Section 1. Any and all prior laws establishing sewer rates for the Fleetwood Sewer District with respect to residential uses is hereby repealed, only with respect to sewer rates and the prior laws otherwise confirmed. Section 2. The following sewer rates are hereby established for the Fleetwood Sewer District. A. Residential 1. Each residential unit be obligated to pay the minimum charge of $60.00 each quarter, regardless of consumption of water for said quarter. In addition to the foregoing, there shall be the following charges: if the residential unit uses more than 17,186 gallons per quarter, the residential unit will be charged at the rate of $2.50 per 1,000 gallons. Section 3. This local law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Mrs. Paino Roll Call Vote: 5 Ayes 0 Nays MRS. PAINO moved to adopt Local Law #6 of 1987 as follows: A LOCAL LAW AMENDING LOCAL LAW NO. 15 OF 1984 WITH RESPECT TO THE ESTABLISHMENT OF SEWER RATES FOR THE MID -POINT PARK SEWER DISTRICT. BE IT ENACTED, by the Town Board of the Town of Wappinger as follows: Section 1. Any and all prior laws establishing sewer rates for the Mid -Point Sewer District with respect to residential uses is hereby repealed, only with respect to sewer rates and the prior laws otherwise confirmed. Section 2. The following sewer rates are hereby established for the Mid -Point Park Sewer District. A. Residential 1. Each residential unit connected to the system: $474.40 annually and payable on a quarterly basis. Section 3. This local law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Mr. Reis Roll Call Vote: 5 Ayes 0 Nays MRS. PAINO moved to adopt Local Law #7 of 1987 as follows: A LOCAL LAW AMENDING LOCAL LAW NO. 12 OF 1984 WITH RESPECT TO THE ESTABLISHMENT OF SEWER RATES FOR THE ROCKINGHAM SEWER DISTRICT. BE IT ENACTED, by the Town Board of the Town of Wappinger as follows: Section 1. Any and all prior laws establishing sewer rates for the Rockingham Sewer District with respect to residential uses is hereby repealed, only with respect to sewer rates and the prior laws otherwise confirmed. Section 2. The following sewer rates are hereby established for the Rockingham Sewer District. A. Residential 1. Each residential unit connected to the system: $275.60 annually and payable on a quarterly basis. 52 Section 3. This local law shall take effect upon adoption and as provided by Municipal Home Rule Law. Seconded by: Mr. Reis Roll Call Vote: 5 Ayes 0 Nays MR. REIS moved to adopt Local Law #8 of 1987 as follows: A LOCAL LAW AMENDING LOCAL LAW NO. 10 OF 1985, LOCAL LAW NO. 14 OF 1984, LOCAL LAW NO. 5 OF 1976 WITH RESPECT TO THE ESTABLISHMENT OF SEWER RATES FOR THE WAPPINGER SEWER IMPROVEMENT AREA #1. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. Any and all prior laws establishing sewer rates for the Wappinger Sewer Improvement Area #1 with respect to residential uses is hereby repealed, only with respect to sewer rates and the prior laws otherwise confirmed. Section 2. The following sewer rates are hereby established for Wappinger Sewer Improvement Area #1. A. Residential 1. Each residential unit connected to the system: $100.00 annually and payable each quarter. Section 3. This local law shall take effect upon adoption and as provided in Municiapl Home Rule Law. Seconded by: Mr. Farina Roll Call Vote: 5 Ayes 0 Nays Unfinished Business --- A Memo was received from the Planning Board relating to Town Board action at the last meeting to waive all fees pertaining to the construction of the Islamic Church at All Angels Hill Road and Myers Corners Road. They pointed out that there is a major concern with drainage from that site to the adjoining property (Schlathaus Park)and recommended that the Town Board reconsider waiving the downstream drainage fees in light of the work that may have to be done downstream to correct the drainage problem. MR. REIS moved to rescind the motion made at the January 20, 1987 Town Board Meeting relating to the waiver of all fees pertaining to the construction of the Islamic Church. Seconded by Mrs. Paino Motion Unanimously Carried MR. REIS moved to waive the fees pertaining to the construction of the Islamic Church, with the exception of the Downstream Drainage Fees. Seconded by Mr. Valdati Motion Unanimously Carried L 53 Mrs. Paino requested that the applicant be notified of this action. A letter was received from the New York State Department of Trans- portation relating to a traffic light at Smithtown Road and Rt.9 and closing the median at Osborne Hill Road, due to the rezoning of Lloyd Home and Building Center. MRS. PAINO moved to receive the correspondence and place it on file Seconded by Mr. Reis Motion Unanimously Carried Mrs. Paino noted that this work is the responsibility of Lloyd Home and Building Center as stipulated in Town Board approval of the rezoning, and must be performed prior to the issuance of a Certificate of Occupancy. Mr. Hawksley, Chairman of the Planning Board was present and Mrs. Paino wanted him to be aware of this situation. A Letter of Credit was received from the Fishkill National Bank for Stenger Court, however no deed had been received, so action could not be taken on the acceptance of this road. This document was satisfactory in form and content but the date of expiration, January 21, 1988 would have to be changed since the road was not accepted at this time. Our Highway Superintendent, Ken Croshier, noted that the Town Road Specifications have a deadline date of October 31st for acceptance of roads and this should be adhered to. It appears that the developers are putting in requests to accept their roads in the winter season so they will not have to maintain them. He urged the Board to enforce these regulations and stated that he would no longer give his recommendation on accepting roads if the requests were submitted after the expiration date. MR. FARINA moved to forward a letter to the Fishkill National Bank and the developer indicating that the date on the Letter of Credit for Stenger Court is not acceptable at this time. Seconded by Mrs. Paino Motion Unanimously Carried Correspondence was received by the Town Board relating to the Wappinger Sewage Treatment Facilities Report; the first, from the Attorney to the Town was the notice to involved agencies on the designation of the lead agency for this project. A second com- munication was from the New York State Department of Environmental 54 Conservation acknowledging receipt of the report and indicating that it adequately discusses the alternative projects and treatment processes to adequately solve the Oakwood Knolls Sewer District's problems. They requested the Town Board to inform them of their final decision on the alternatives presented, after the SEQR process has been completed. MRS. PAINO moved to receive these two communications and place them on file. Seconded by Mr. Farina Motion Unanimously Carried Mr. Incoronato, being recognized by the Chair, assumed that the site mentioned as one of the alternatives for the construction of a sewer plant was Reese Park. He referred to a recent article in the Poughkeepsie Journal which quoted Mrs. Reese as saying that she never intended to allow any kind of construction on the property which she deeded to the Town many years ago. Since then she has reiterated her opposition and indicated that she will fight the construction of a sewer treatment plant on the property. In the meantime, he continued, the Town has engaged a firm to conduct an E.I.S. on the location, spending thousands of dollars for something that may never materialize. In his opinion, they should wait until it is determined whether the site is accessible. Mrs. Paino noted that these concerns were expressed by Mr. Incoronato at the public informational meeting on this plan and were addressed by the Attorney to the Town. She indicated to him and to the Poughkeepsie Journal that there are deed restrictions on that property, however they are not insurmountable. Mr. Valdati reported that he had received many calls from the residents of Ward 1, which he represents, and the locality of Reese Park and they were all negative for the use of the land as a sewer treatment plant. He pointed out, that is only one alternative, there are others to consider and he was sure that the final deter- mination would be in the best interests of the Town and its residents. Mrs. Paino agreed with this fact and pointed out that there would still be acres of open space if that was the concern; the Reese Park site is at least 40 acres in size and if they were to pursue that location, the sewer plant would use about 6 of those acres, leaving the remaining 34 acres for the open space. Contrary to Mr. Incoronato's 55 belief that the Town Board recommended this site, Mrs. Paino emphasized the fact that it was the Engineer's recommendation and not that of the Town Board. Both she and Mr. Reis stated that their final decision would be based on the results of the E.I.S. over the recommendation of the Engineers. Before closing this discussion Mrs. Paino addressed a question from Mrs. Goldberg relating to the use of the Reese Park site for two of the alternatives, and confirmed this fact. The only alternative that would not involve this site would be the reconstruc- tion of the present plant at Oakwood Knolls. She also responded to Mr. Hirkala's concern that the taxpayers of the Town be informed if it would affect them, and assured him that these facts will be stressed very strongly at the public hearings which will be held in the next few months. The following letter was received from James Spratt, Dutchess County Commissioner of Public Works: January 15, 1987 Elaine H. Snowden Town Clerk, Town of Wappinger Middlebush Road Wappingers Falls, N.Y. 12590 Re: Speed Limit Request, Brown Road Dear Elaine: This letter is to inform you that we have conducted a field review of the conditions on Brown Road and can not agree with your request to reduce the speed limit below the existing 30 MPH which currently exists. It is a common practice for the State not to approve speed limits under 30 MPH and in combination with the field information gathered, it would not be possible to approve your request. Seconded by Mr. Farina Motion Unanimously Carried Mr. Valdati wished to speak on a motion made at the previous meeting relating to Town Board objection to Pizzagalli's intent to build a zero discharge plant at their proposed I.B.M. facility on Myers Corners Road. Since this item was not on the agenda of that meeting, he did not have the proper information available when the motion was made. Now that he had gathered information which has 56 formulated his opinion, he requested to change the vote he cast for that motion. His position now was that he would not want to delay or prohibit construction of the proposed I.B.M. building in our Town as it would represent an equity to the Town and some tax relief to our homeowners. MR. VALDATI moved to reconsider the vote on the Pizzagalli issue to construct a zero discharge sewer treatment plant at their proposed I.B.M. facility. Seconded by Mrs. Visconti Motion Unanimously Carried Recognizing the fact that Mr. Valdati was a new member of the Board and was seeking information on matters brought before them, Mrs. Paino called for a five minute recess to clarify the situation. The Board recessed at 8:35 P.M. The Meeting was called back to order at 8:42 and the five Board Members were present. Mrs. Paino explained that Mr. Valdati had made a motion which was seconded and unanimously carried to reconsider the vote made at the January 20, 1987 meeting relating to Pizzagalli's intent to build a zero sewer treatment plant at the proposed I.B.M. facility. MRS. PAINO moved to direct a letter to Pizzagalli Development Corp., informing them that the Town Board is opposed to the construction of a zero discharge sewer treatment plant for their proposed I.B.M. facility on Myers Corners Road. Seconded by: Mr. Reis Roll Call Vote: Mr. Farina Aye Mr. Reis Aye Mr. Valdati Nay Mrs. Visconti Nay Mrs. Paino Aye Motion Carried Prior to casting his vote Mr. Farina noted that he had abstained on the last vote relating to this issue since he is an I.B.M. employee and it could be construed that it was a conflict of interest; since then he sought professional advice of that corporation and was informed that as Councilman of the Town he should vote his conscience and what he felt was for the best interest of the Town. He therefore voted in support of the motion as he felt it was not in the best interest 57 of the Town to allow the construction of this facility. New Business --- Sandra Goldberg, Wappinger County Legislator had an item to bring to the Town Board's attention and reported that a public hearing would be held on February 26, 1987 at 4 P.M. at the County regarding a proposal from Richmor Aviation to change their lease with the County to allow them to do maintenance on single engine and twin engine aircraft which are based at the Dutchess County Airport. Mrs. Visconti made known to the Board that due to the confusion that had transpired at the previous Town Board meeting during the Pizzagalli issue, she had canvassed our neighboring towns to determine their procedure on addressing items that do not appear on the written agenda for town board meetings. The general policy is to table the item,unless it appears to be an emergency situation, to give the board members an opportunity to review the matter and do the required research. The Town of Poughkeepsie has established a policy requi-ring the unanimous consent of their Town Board to address an item that does not appear on their written agenda. She recommended that this Town Board adopt such a policy to avoid the confusion they have recently experienced. Mrs. Paino reminded Mrs. Visconti that the action they took on the Pizzagalli situation was considered to be an emergency since she had pointed out prior to their action that the Planning Board had scheduled a scoping session with Pizzagalli and it was important that they knew the position of the Town Board in this matter. One more item brought up by Mr. Farina related to authorization of meal allowance for those attending the Association of Towns meeting. gibe MR. FARINA moved to approve the same allowance as was used last year. Seconded by Mrs. Paino Motion Unanimously Carried Note: See meeting of Feb. 3, 1986, Pg. 58 Mrs. Visconti also had another item to bring before the Board and referred to the school buses that have been parked at the Fairchild property on All Angels Hill Road pending a report on the air quality 58 testing being conducted at the Fishkill Plains school. The Zoning Administrator had contacted the Superintendent of Schools on this matter, however, now that a new one has been appointed, Mrs. Visconti request that we inquire about the status of this situation. The residents of her Ward have registered some concerns on the fumes emitting from the busses and she anticipates further complaints as the warmer weather approaches us. MRS. VISCONTI moved to forward a letter to the Superintendent of Schools requesting the status of the removal of the busses presently parked at the Fairchild property. Supervisor Paino opened the Hearing at 7:12 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman Robert Valdati, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). Mrs. Paino asked for comments from the audience either for or against the proposed Local Law. Jim Mills, Brian Place, stated that the last rate they were paying was $37.000 per quarter; according to this law, the rate was going up 75%. He asked if there was any unexpended balance at the end of 1986 and if not, were they overexpended. Mrs. Paino replied that the increase was due to the cost of sludge removal and secondly there was a problem in Wildwood and the sludge had to be pumped more frequently, thus raising that item even more. Bob Cacchio, President of Camo Pollution Control, explained that there was bacteria in the system which had to be removed and that was the reason they had to pump the sludge more than they usually do; the cost of this service came in at a higher price than they anticipated. This happened about four years ago and they had to follow the procedure with more frequent pumping. In answer to Mr. Mill's question on the same unexpended balance, Mr. Farina noted that the unexpended balance in 1985 was carried over to 1986, but there was none to carry over for this year. There were no other comments made on the proposed Local Law. MRS. PAINO moved to close the Public Hearing, seconded by Mr. Reis and unanimously carried. The Hearing closed at 7:15 P.M. Elaine H.
