ADJOURNMENT The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 2, 1987, at the Town Hall, Middlebush Road, Town of Wappinger, Dutchess County, New York. Supervisor Paino opened the Meeting at 7:07 P.M. Present: Irene Paino, Supervisor Vincent Farina, Councilman David Reis, Councilman June Visconti, Councilwoman Robert Valdati, Councilman Elaine H. Snowden, Town Clerk Others Present: Joseph E. Paggi, Jr., Engineer All joined in the Pledge of Allegiance to the Flag at the commencement of the Meeting. The Supervisor requested all to remain standing for a moment of silence for the Town of Wappinger and its residents, thanksgiving for a good 1986 and hopes for a better 1987. Reaffirm Appointments by the Supervisor (Deputy Supervisor, Bookkeeper). Mrs. Paino reaffirmed her appointment of David Reis as Deputy Supervisor and expressed her thanks to him for the help she received from him during 1986. Mrs. Paino reaffirmed her appointment of Joyce Benedetto as Bookkeeper. Reaffirm Appointments by the Town Clerk (Deputy Town Clerks). The Town CLerk reaffirmed her appointments of Gladys Ruit and Margaret Roe as Deputy Town Clerks. The Highway Superintendent had previously indicated that he wished to reaffirm his appointment of John DeCarlo as Deputy Highway Superin- tendent. Resolutions --- TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING ISSUANCE AND PAYMENT FOR PAYDAYS OF 1987 The following resolution was offered by COUNCILMAN FARINA who moved its adoption: RESOLVED, that the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders of such offices and positions payable every other Friday throughout the year 1987, with 26 pay periods during such year with the first payday to be on January 9, 1987, and be it further RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holders of these designated positions on such designated paydays of the year 1987. Seconded by: Councilwoman Visconti Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES AND POSITIONS OF EMPLOYMENT The following resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity at the pleasure of the Town Board. NAME OFFICE John DeCarlo Deputy Superintendent Highway Constance Smith Town Historian AND IT IS FURTHER RESOLVED, that the salaries otherwise fixed for the above designated offices and positions shall be paid to the holders of such offices and positions, with the exception that no compensation shall be paid to the holder of the office of Deputy Town Superintendent of Highways, and the Town Historian is to be paid on a semi-annual basis, during such year consistent with the pay schedule adopted for the year 1987. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING A FIRE INSPECTOR IN THE TOWN OF WAPPINGER The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that Thomas Classey, be and he hereby is appointed to serve as Fire Inspector in the Town of Wappinger, Dutchess County, New York, and BE IT FURTHER RESOLVED, that the salary for the Fire Inspector be and the same hereby is fixed and established at an annual rate of $20,000.00 to be paid every other Friday throughout the year 1987, commencing on January 9, 1987, with 26 pay periods during such year. The first payday to be January 9, 1987, consistent with the pay schedule adopted for the year 1987. The first payday to be January 9, 1987, consistent with the pay schedule adopted for the year 1987. Seconded by: Councilwoman Visconti Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT The following resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLVED, that the pay scale for the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following minimum to maximum hourly rates: Heavy Motor Equipment Operator $ 10.44 -- $ 10.80 Light Motor Equipment Operator 10.33 -- 10.49 Laborer 7.51 -- 10.30 Foreman 10.91 -- 11.41 AND BE IT FURTHER RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every other Friday throughout the year 1987, with 26 pay periods during such year, consistent with the pay schedule adopted for the year 1987. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK SETTING SALARY FOR PART TIME HYDRANT INSPECTOR The following resolution was offered by COUNCILMAN FARINA who moved its adoption: RESOLVED, that the hourly rate for Robert Cacio, part time Hydrant Inspector, under the supervision of the Highway Department, be and the same hereby is fixed and established at $5.00 per hour, to be paid every other Friday throughout the year 1987, with 26 pay periods during the year, consistent with the pay schedule adopted for the year 1987. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR PART TIME CLERICAL EMPLOYEES ENGAGED TO SERVE THE TOWN BOARD AND ITS OFFICERS, OFFICIALS AND AGENCIES The following resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLVED, that the pay scale for all presently employed part time clerical employees engaged to perform services for the Town Board of this Town and/or its offices, officials and agencies be and the same hereby is fixed and established at a minimum hourly rate of $3.75 to a maximum hourly rate of $5.00 per hour, and IT IS FURTHER RESOLVED, that the part time hourly rate for any subsequent Part Time Clerical employee engaged by any Official or Agency Department Head shall be established at the minimum hourly rate, or if otherwise fixed and established, shall be subject to the approval of the Town Board, and IT IS FURTHER RESOLVED, that all such extra part time Clerical employees engaged on an hourly basis shall be paid every other Friday throughout the year 1987, with the first payday to be on Friday, January 9th, 1987. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK EMPLOYING LEGAL SERVICES FOR THE TOWN The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that Jennifer Van Tuyl of the firm of Pagones, Cross, Van Tuyl, Rizzo and McCabe be and they hereby are employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such legal advice and services as may be required and they shall receive compensation therefor in accordance with a proposal to this Board. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK EMPLOYING ENGINEERING SERVICES FOR THE TOWN The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that Paggi & Martin be and they hereby are employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such engineering advice and services as may be required and they shall receive compensation therefor in accordance with a proposal submitted to this Board. TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING CERTIFIED PUBLIC ACCOUNTANT TO AUDIT THE ACCOUNTS AND REPORTS OF THE SUPERVISOR, TOWN CLERK AND TOWN JUSTICES FOR THE YEAR 1986 The following resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLVED, that Sedore & O'Sullivan, Certified Public Accountants, be and they hereby are retained to audit the accounts and reports of the Town Supervisor, the Town Clerk and the Town Justices for the year 1986, and it is further 7 RESOLVED, that the said accountants receive reasonable compensation for the productive services which they shall render to the Town in this connection. Seconded by: Councilman Valdati Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK DESIGNATING COURT OFFICERS OF THE TOWN OF WAPPINGER The following resolution was offered by COUNCILMAN FARINA who moved its adoption: BE IT RESOLVED, that all individuals hereinafter designated by the Town Board as Court Officers as such title is defined by the Uniform Justice Court Act have all those powers accorded to Court Officers by Law during such time they are actually serving in such capacity, and BE IT RESOLVED, that the Town Justices of the Town shall designate and schedule the days and evenings such individuals shall serve as Court Officers, and BE IT RESOLVED, that one Court Officer be designated for each session of court unless the Town Justices determine that more than one be designated for any one session, and BE IT RESOLVED, that the Court Officers shall be compensated at the hourly rate of $5.25 for time actually served, and BE IT RESOLVED that the Town Justices shall submit to the Town Comptroller on a weekly basis the names and hours served and that the Town Comptroller be empowered to issue remuneration consistent with the foregoing from funds appropriated for Justice Court, and BE IT RESOLVED that the following individuals be designated as Court Officers for the year 1987: Howard Webster Delbert Wilson Arthur Eichler Albert Berberich Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK DESIGNATING INSURANCE AGENT FOR THE TOWN OF WAPPINGER The following resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLVED, that Marshall & Sterling, a general insurance agent doing business in the Town of Wappinger, Dutchess County, New York be and it is hereby designated as the insurance agent for this Town. Seconded by: Councilwoman Visconti Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR PART TIME VANDALISM PATROL PERSONNEL The following resolution was offered by COUNCILMAN FARINA who moved its adoption: RESOLVED, that the pay scale for part time Town of Wappinger Vandalism Patrol Personnel engaged to perform certain services for the protection of Town Parks, various other Town properties and performance of other such duties as may be assigned by the Town Board of this Town, be and the same hereby is fixed and established at a maximum hourly rate of $9.00 per hour, and it is further RESOLVED, that all of such part time Town of Wappinger Vandalism Patrol Personnel engaged on an hourly basis shall be paid every other Friday throughout the year 1987, with 26 pay periods during such year consistent with the pay schedule adopted for the year 1987. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING PETTY CASH FUND FOR THE RECEIVER OF TAXES The following resolution was offered by COUNCILMAN REIS who moved its adoption: RESOLVED, that a petty cash account not to exceed the sum of $200.00 and the same hereby is established for the Receiver of Taxes, and it is further RESOLVED, that payments from said petty cash account be made and the Supervisor of this Town be reimbursed for advances made to such account in accordance with the provision of Section 64, Subdivision la of the Town Law of the State of New York. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK DESIGNATING THE TIME AND PLACE FOR THE HOLDING OF THE TOWN BOARD MEETINGS The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the first monthly meeting of the Town Board of the Town of Wappinger for the year 1987, shall be held on January 20, 1987 at 7:30 P.M., at the Town Hall, 20 Middlebush Road, Town of Wappinger, New York, and BE IT FURTHER RESOLVED, that commencing with the first Monday in February, 1987, the regular bi-monthly meetings of the Town Board of the Town of Wappinger, shall be held at 7:30 P.M. at the Town Hall, 20 Middlebush Road, Town of Wappinger, Dutchess County, New York, in the evening of the 1st and 3rd Mondays of each month, or at such other place or places within the Town of Wappinger as the Town Board shall from time to time designate. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK DESIGNATING DEPOSITORIES FOR THE TOWN OF WAPPINGER MONIES The following resolution was offered by SUPERVISOR PAINO who moved its adoption: RESOLVED, that the Marine Midland National Bank of Southeastern New York, the Dutchess Bank and Trust Company, the Chase Manhattan Bank, the Norstar Bank, and the Fishkill National Bank, each being a banking institution maintaining banking rooms and offices in Dutchess County, New York, be and they each hereby are severally designated as depositories of the monies of this Town, and BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby is directed to give notice of such designation to each of said banking institutions. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK DESIGNATING OFFICIAL NEWSPAPER OF THE TOWN OF WAPPINGER The following resolution was offered by COUNCILMAN FARINA who moved its adoption: RESOLVED, that the Southern Dutchess News, a newspaper regularly published in the Town of Wappinger, Dutchess County, New York, and having a general circulation in this Town, and being a newspaper entered as second class mail matter, be and the same hereby is designated as the official newspaper of this Town, and BE IT FURTHER RESOLVED, that the Poughkeepsie Journal, the Evening News and the Hornet, newspapers published in the County of Dutchess and having general circulation therein, be and they hereby are designated as additional newspapers for the publication of Town notices, subject to the limitations of Section 64, Subdivision 11 of the Town Law of the State of New York, and BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby is authorized and directed to give notice of such designation to the publishers of such newspapers. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING THE SUBMISSION OF THE SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE COMPTROLLER The following resolution was offered by COUNCILMAN REIS who moved its adoption: WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by her together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper, and WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of Town Law, the Town Board may determine, by resolution that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. NOW, THEREFORE IT IS HEREBY RESOLVED, that in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Councilman Farina Roll Call Vote: 5 Ayes 0 Nays TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK RELATIVE TO THE TEMPORARY DEPOSIT AND INVESTMENT OF TOWN FUNDS The following resolution was offered by COUNCILMAN FARINA who moved its adoption: WHEREAS, It has come to the attention of this Town Board of the Town of Wappinger that there are now or may be in the future, funds and monies, except proceeds of loans and monies the invest- ments of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, or in certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligations of the United States of American and/or the State of New York, and WHEREAS, It appears that the Temporary Deposit and/or investment of such excess and surplus funds may be beneficial and profitable to the Town of Wappinger, NOW, THEREFORE, IT IS HEREBY RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger be and she is authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section 11 of the General Municipal Law of the State of New York, and IT IS FURTHER RESOLVED, that such Temporary deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section 11 of the General Municipal Law of the State of New York, and IT IS FURTHER RESOLVED, that the aforesaid Supervisor of this Town be and she hereby is autorized, empowered and directed to take all steps necessary from time to time to carry out and implement this resolution. Seconded by: Councilman Valdati Roll Call Vote: 5 Ayes 0 Nays The next item for the Town Board to consider was the appointment of a member to the Planning Board since Charles May's term expired and he had previously indicated that he did not wish to accept another appointment to the Board. Councilwoman Visconti moved to appoint Arthur Waddle as a member of the Planning Board to replace Charles May. Mr. Reis commented that he had approached Paula Papastrat regarding this appointment but she had contacted him indicating that she could not accept this appointment. Mr. Farina added that he had the same communication from Mrs. Papastrat. MRS. PAINO moved to table action on the appointment to the Planning Board. Seconded by: Councilman Farina Roll Call Vote: Councilman Farina Aye Councilman Reis Aye Councilman Valdati Nay Councilwoman Visconti Nay Supervisor Paino Aye Motion Carried Prior to the vote Mrs. Paino invited comments from the public on the motion appointing Mr. Urciuoli as Chairman of the Zoning Board of Appeals. Michael Lynch was in favor of this appointment, felt it was time for a change. Bernice Mills asked when the vacancy occurs on this Board and was told it will be next month. She then voiced her disappointment that Mr. Caballero was not reappointed as Chairman of the ZBA. She and others feel that he has done a good job; his fellow members have commended him for the job he has done as Chairman. Nicholas Johnson also expressed his displeasure that the Board had turned down Mr. Caballero as Chairman. Councilwoman Visconti noted that she had attended most all of the ZBA meetings and felt the Board, as a whole, did an excellent job. Councilman Reis brought up the fact that the position of Chairman /. is a responsible one and should include the security of the building after their meeting; the fact that this $1.5 million dollar building was left open after ZBA meetings was a big factor in Mr. Reis's motion to replace the Chairman. This statement brought about a discussion on the responsibility of locking the Town Hall and who should be provided with a key; those who participated included James Mills, Don McMillan, June Visconti and Gerard McCluskey. ‘✓ The vote on the motion to appoint Mr. Urciuoli as Chairman of the Zoning Board of Appeals was then taken. Mrs. Paino indicated that her reason for appointing Mr. Urciuoli stemmed from the fact that the residents who had recently complained about this Board felt another member should chair this Board and recommended that it be him. COUNCILWOMAN VISCONTI moved that a letter of thanks be forwarded to Mr. Caballero for his services to the Town as Chairman of the Zoning Board of Appeals. Seconded by Councilman Farina Motion Unanimously Carried COUNCILMAN FARINA moved to reappoint Ralph Holt as Chairman of the Recreation Commission for the year 1987. Seconded by: Councilman Reis Roll Call Vote: 5 Ayes 0 Nays The next matter for the Board's consideration was granting permission for attendance at the Annual Association of Towns Meeting. MRS. PAINO moved to authorize all elected Officials (with the exception of the Town Justices), the Chairmen of the Zoning Board of Appeals and Planning Board, or their designee, and new members of the respective Boards appointed prior to the meeting, to attend the Association of Towns Meeting in 1987. Seconded by: Mr. Farina Roll Call Vote: 4 Ayes (Mrs. Visconti ---Nay) Before voting on this motion, Mrs. Visconti asked for a clarification -- did this mean that the existing members of the Boards were excluded from attending the meeting; if this was the case, she did not agree as she felt that they too, could benefit from the new courses that were offered. Mrs. Paino indicated that the purpose of excluding the present members of the Boards was to tighten up the budget in 1987 and keep taxes down to a minimum. The present members could avail themselves of the series of short courses such as were offered at Millbrook last year which covered many new subjects that would be just as beneficial to them. The motion was carried as presented by Mrs. Paino, excluding the present members of the Zoning Board of Appeals and the Planning Board from attending the Association of Towns Meeting this year. MRS. PAINO moved to appoint Councilman Farina as the Representative of the Town of Wappinger at the Annual Association of Towns Meeting and Councilman Reis as the Alternate. New Business --- Mr. Valdati referred to a matter of concern expressed to him by the residents of Indian Village outlined in the following letter received by them from their water company. Dear Customer, The original design of the water system required the installation of a gasoline engine powered standby transfer pump to be used in case of a power outage, to transfer the water from the storage tank to the system. This method requires a person, upon notification of a power outage to go to the pump house, start the engine and continually monitor the system as long as the power is off. To turn on and off to get the engine to maintain safe and adequate pressure in the system, the standby gasoline engine and possibly the pump also need extensive maintenance. It is estimated that it will cost $1,200 to repair the gasoline engine alone. One of the alternatives to repair the gasoline engine is the installation of a standby gasoline generator, estimated cost $4,500. The generator will be cheaper to maintain and operate. The cost of either repairing the existing gasoline engine and transfer pump, or the cost of the generator, will be borne by you, the customer. We, therefore, are asking you to fill in the bottom of this letter, return the letter and let us know your preference. Please return by January 20, 1987. If you have any further questions you may call us at 896-6100 and we will try to answer them. s/ Robert Hankin, President The residents have made knowito Mr. Valdati that they do have questions but are unable to obtain responses from their water company; there appears to be little or no communication from the company on this matter. They have suggested to Mr. Valdati that the Town Board be the mediator between the water company and its customers, and he requested that this matter be placed on a future work shop agenda for discussion with the parties involved. Mrs. Maloney, Cayuga Drive, represented the residents in their appeal to Mr. Valdati. Another matter Mr. Valdati referred to was a report on dumping activity on Creek Road, off of New Hamburg Road. Upon visiting this site he found many large items which could have been brought to the landfill when it was accessible. It is an unsightly mess and he requested that the Highway Department be notified to clear the area. Mrs. Paino suggested that he contact that department with this request. There was no other business to come before the Board. COUNCILMAN REIS moved to close the Reorganizational Meeting, seconded by Councilman Valdati and unanimously carried.
