ADJOURNMENT l '-' l -. l 39~' The Regular Bimonthly Meeting of the Town Board of the Town of Wappinger was held on December 16, 1985 at the Town Hall, Mill Street, Wappingers Falls, Dutchess County, New York. Supervisor Versace opened the Meeting at 8:00 P.M. Present: Frank Versace, Supervisor Joseph Incoronato, Councilman Gerard McCluskey, Councilman Irene Paino, Councilwoman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Bernard Kessler, Attorney Ronald Evangelista, Engineer All joined in the Pledge of Allegiance to the Flag. The Minutes of the December 2, 1985 Regular Bimonthly Meeting and the December 5, 1985 Special Meeting, having previously been forwarded to all Board Members, were now placed before them for their consideration. MR. INCORONATO moved that the above stated Minutes, be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mr. McCluskey Motion Unanimously Carried Reports were received for the month of December from the Town Justices, Receiver of Taxes, Building Inspector, Hydrant Report. and Zoning Administrator for October and November. Mrs. Paino moved to accept the Reports and place them on file. Seconded by Mr. McCluskey Motion Unanimously Carried Mr. Incoronato noted that several months ago the Capolino Zoning Violation problem was brought to the Town Court and asked Town Justice Vincent Francese, who was present, if he could relate, as much as was permissible, the status of this case. Judge Francese replied that the case was not in court and in answer to Mr. Incoronato's question, yes there was an accusatory instrument. The matter was then referred to the Attorney who elaborated that an accusatory instrument was drafted and there were problems with this case which he had discussed with the Zoning Administrator. He concurred with Judge Francese, the case was not now before the court and he did not foresee that it would be placed before the court in the next 3~3 few weeks. Mr. Incoronato expressed his wish that it would be resolved perhaps in January or February as it was probably the longest standing case of the forty or fifty Orders to Remedy that were brought to the court. Petitions & Communications--- A request was received from Derek Haynes at 143 Myers Corners Road to become a tenant to the Central Wappinger Water Improvement - ... ',:, ~ - Area and Wappinger Sewer Improvement Area #1; the property lies outside of the two improvement areas. tJ MR. VERSACE moved to grant permission to Derek Haynes to become a tenant to Central Wappinger Water Improvement Area and Wappinger Sewer Improvement Area #1, subject to approval by the Dutchess County Department of Health, compliance, by signed agreement with the Town, to all conditions of the Town Tenant Policy, and all tie-in expenses to be borne by the homeowner. Seconded by Mrs. Paino Motion Unanimously Carried Several months ago, Mr. Incoronato requested that we contact the _it :::. w'- Metropolitan Transportation Authority relating to their considera- tion of leasing a portion of their property in Chelsea to the Town for the purpose to providing additional parking places for our boating residents. A response was finally received indicating that they had concluded a review of our request and determined, regretfully, that they could not lease this parcel to the Town as the proposed use would interfere with existing railroad facilities currently located at the site. MRS. PAINO moved to accept this communication and place it on file. Seconded by Mr. Incoronato Motion Unanimously Carried ""....a . A letter was received from Gilbert Faustel, Chief, Design Section of the New York State Department of Health, giving approval for 11,...........- ., ,\ plans of Sodium Hexametaphosphate Feed Addition at three well fields in the Town; the firm of Morris & Andros had submitted this plan to the Department of Health in October and were waiting ~or their approval to commence with this project. The Town Board had previously approved the project and Mr.Incoronato suggested that Camo Pollution Control be notified that they could proceed per Mr. Faustel's letter of November 25, 1985. 3~ L MRS. PAINO moved to receive the communication, place it on file, and notify Camo Pollution that approval has been received from the New York State Department of Health and they may proceed with the project per report of Morris & Andros submitted in October of 1985. Seconded by Mr. Incoronato ~ Motion Unanimously Carried A Memo was received from Comptroller Ann Garrison enclosing letters from Mr. & Mrs. Pittaro and Mr. & Mrs. Kalaka requesting reim- bursement for operation and maintenance charges which were collected for the Fleetwood Sewer District, although the home was not connected to the system. The Pittaros' owned the home from October 1966 to April of 1980 and then sold it to the Kalakas', who indicated that the total amount paid was $856.84 to date. The same situation arose at a previous meeting with residents who had paid one quarter of operation and maintenance and were reimbursed by the Town. Mrs. Garrison had Camo Pollution check to make sure that the home was not connected to the system and they verified this fact; she had also checked and made sure all other homes in the Fleetwood area were hooked into the system. The Attorney had researched the matter and determined that the current owner was entitled to the reimbursement, but not the previous owner. MRS. PAINO moved to reimburse Mr. & Mrs. Kalaka the sum of $856.84 for operation and maintenance charges paid by them to the Fleetwood Sewer District since 1980, since their home was not connected to the sewer system. Seconded by Mr. Incoronato l ~ Motion Unanimously Carried The Town Clerk asked the Board to consider the date for the Reorganizational Meeting for 1986. MRS. PAINO moved to set the date of January 2, 1986 at 7:30 P.M. for the Reorganizational Meeting for 1986. Seconded by Mr. McCluskey l Motion Unanimously Carried Committee Reports--- There were no Committee Reports submitted by the Town Board Members. 3~ Resolutions--- Public Hearings were held by the Town Board on December 16, 1985 on proposed Local Laws setting water and sewer rates for various districts, and the matter was now placed before the Board for their consideration. MRS. PAINO moved to adopt Local Law #6 of 1985 as follows: BE IT ENACTED by the Town Board of the Town of Wappinger as follows: - A LOCAL LAW AMENDING LOCAL LAW NO. 11 OF 1980 WITH RESPECT TO THE MINIMUM CHARGES FOR CONSUMPTION WITH USE OF WATER FOR THE WATCH HILL WATER DISTRICT. ~ Section 1. Effective the second district fiscal quarter of the year 1986, the following rates shall be charged: the owner shall be obliged to pay the minimum charge of thirty- nine dollars ($39.00) per each quarter, regardless of the consumption of water for said quarter, provided said owner is connected to the system at any time during the quarter. In addition to the foregoing, there shall be the following charges: Number of Gallons Rate Per Thousand Gallons In excess of 2,500 cu. ft. $1.40/100 cu. ft. Section 2. All other provisions of Local Law No. 11 of 1980 are hereby ratified with the exception of Section 1, Subdivision B which this local law hereby amends and which refers to the minimum charges for consumption of water. ~ ~ Section 3. PAINO moved to adopt Local Law #7 of 1985 as follows: A LOCAL LAW AMENDING ALL PRIOR LOCAL LAWS WITH RESPECT TO THE MINIMUM CHARGES FOR THE CONSUMPTION OF WATER IN THE ARDMORE WATER DISTRICT. BE IT ENACTED, by the Town Board of the Town of Wappinger as follows: Section 1. Effective the second district fiscal quarter of the year 1985, the owner shall be obligated to pay the minimum charge of $13.00 each quarter up to and including 2,500 cubic feet of water. In the event the consumption of water exceeds 2,500 cubic feet, the charge shall be $.50 for each 100 cubic feet of water consumption. ~ Section 2. Subdivision B of Section 1, concerning the minimum charges of any prior law is hereby repealed and is to be in conformity with the aforementioned. All other provisions of prior laws concerning water charges shall remain in full force and effect. ~.F ~ Section 3. INCORONATO moved to adopt Local Law #8 of 1985 as follows: A LOCAL LAW AMENDING LOCAL LAW NO. 2 OF 1985, NO. 7 OF 1981 AND NO. 8 OF 1980 RELATING TO THE IMPOSITION AND CHARGE FOR WATER RATES FOR THE CONSUMPTION AND USE OF WATER FOR THE FLEETWOOD WATER DISTRICT. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: L Section 1. Section 1 of Local Law No. 2 of the year 1985 is to be amended as set forth herein below: ~ Section 2. The owner shall be obligated to pay the minimum charge of thirty-one dollars ($31.00) each quarter, regardless of consumption of water for said quarter, provided said owner is connected to the system at any time during the quarter, said rate to commence with the second district fiscal quarter of the year 1986. In addition to the foregoing, there shall be the following charges: Number of Gallons Rate Per Thousand Gallons In excess of 14, 143 gal/qtr. $.967262/1,000 gallons Section 3. All other provisions of Local Law No. 2 of the year 1985 are hereby ratified with the exception of Section 1, which this local law hereby amends and which refers to water charges. Section 4. PAINO moved to adopt Local Law #9 of 1985 as follows: A LOCAL LAW ESTABLISHING WATER RATES FOR CENTRAL WAPPINGER WATER IMPROVEMENT AREA. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. Any and all prior local laws establishing water rates for the Central Wappinger Water Improvement Area with respect to residential uses is hereby repealed, only with respect to water rates and the prior laws are otherwise confirmed. Section 2. The following water rates are hereby established for the Central Wappinger Water Improvement Area: A. Residential .... 1. Now all metered - $13.10 per quarter for all users up to and including 2,500 cubic feet of water l 2. In the event uses exceed 2,500 cubic feet, the charge shall be $.50 per 100 cubic feet. Section 3. This local law shall take effect upon adoption and as provided by the Municipal Home Rule Law. Seconded by: Mr. Incoronato Roll Call Vote: 5 Ayes 0 Nays 391 MRS. PAINO moved to adopt Local Law #10 of 1985 as follows: A LOCAL LAW AMENDING NO. 14 OF 1984, ESTABLISHING THE RATES FOR THE WAPPINGER SEWER IMPROVEMENT AREA #1. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. Effective the second district fiscal quarter of the year 1986, the following rates shall be charged for sewer service to those lines that are connected to the Wappinger Sewer Improvement Area #1 facilities: ~ Seconded by: Mr. Incoronato Roll Call Vote: 5 Ayes 0 Nays ~ A proposed Local Law Amending all Prior Local Laws Relating to Water Rates in the Tall Trees Water Improvement Area was placed before the Board for their consideration, as a Public Hearing had been held on December 16, 1985. MRS. PAINO moved to table the proposed Local Law on Tall Trees Water Improvement Area. Seconded by Mr. McCluskey Roll Call Vote: 4 Ayes Mr. Versace---Nay Motion Carried Mr. Versace noted that the proposed law showed no increase ~.t.C l1li in the rates for that area. Prior to the vote, Mrs. Paino commented, as she did at the Public Hearing, that the Local Law implies that the original rate will remain in effect and this rate does not provide for emergency calls or breaks in the system. She had spoken with Mr. Kelly, Bureau of Municipal Accounting System in the New York State Department of Audit and Control, who indicated that the Town Board may set these rates which would allow for any emergencies, etc. as late as February for 1986 billings. Mr. Versace replied that the proposed Local Law was an amend- ment to an earlier one in 1985 which included a yearly surcharge ~ of $68.32. Mrs. Paino objected to the original rate because it - left no allowance for emergencies. A proposed Local Law on Minimum Charges for the Fleetwood Sewer District was placed before the Board for their considera- tion--a Public Hearing had been held on December 16, 1985 MRS. PAINO moved to table action on the proposed Local Law setting the rates for the Fleetwood Sewer District. Seconded by Mr. McCluskey Roll Call Vote: 3 Ayes Mr. Incoronato---Nay, Mr. Versace---Nay 391. l ~ Motion Carried Again Mrs. Paino explained that the rates set in the proposed Local Law for Fleetwood Sewer District do not allow for preventive maintenance and flushing or emergency breaks and calls and the rate could be set in February which would allow for these items. Mr. Versace voted against tabling these rates since the final budget was not adopted and the rates set in the Preliminary Budget were the figures they should be working with. A proposed Local Law Related to Charges for Rockingham Farms Sewer District was placed before the Board for their consideration, a Public Hearing was held on December 16, 1985. MRS. PAINO moved to table action on the proposed Local Law for Charges for Rockingham Farms Sewer District. Seconded by Mr. McCluskey Roll Call Vote: 3 Ayes 'MI!~' :Incoronato---Nay, Mr. Versace---Nay Motion Carried ~ Mrs. Paino reiterated her reasons for tabling this Local Law the rate would not allow for preventive maintenance, flushing or emergency breaks etc. and Audit and Control would allow them to file the rate in February, which would allow monies for these items. She also mentioned that the direction given her by Audit and Control was verbal, but she is expecting confirmation in writing. Mr. Incoronato made a comment that in these tabled laws, the emergencies and flushing might amount $1,000 to $1,500 and they were talking about $7 or $8 a family IF these emergencies happen at the end of the year. They could borrow from the General Fund for a brief period of time and reimburse the fund by raising the rates in 1987, so, in his opinion, this action was meaningless. Mrs. Paino answered that the rates set should provide the monies for the Town Board to cope with the emergencies. Mr. Versace noted that ample rates were provided in the final budget, however the majority of the Board did not vote for that budget .and the rates presented are the ones they held a Public Hearing on. l L 3rt? The following Resolution was offered by COUNCILMAN MCCLUSKEY who moved its adoption: WHEREAS, a bill has been received for Road Permit Insurance for the road access at the new town hall, in the amount of $100.00, and WHEREAS, a bill has been received for the insurance on the new car purchased for the Building Inspector, in the amount of $307.00, and WHEREAS, no monies have been provided for these expenses, -~......................... ~< ;y BE IT RESOLVED, that the sum of $407.00 be and is hereby transferred from A Fund Contingency 1990.4 to A Fund Insurance 1910.4. 'WI Seconded by; Councilwoman Paino Roll Call Vote: 5 Ayes 0 Nays A Memo was received from the Comptroller enclosing a resolution relating to an increase in the State Insurance Fund rates which was approved by the State Legislature, retroactively for the period from March 1984 thru March 1985 period. Mrs. Garrison elaborated on the request to transfer the monies since no pro- vision had been made in the 1985 budget to cover the increase in this line item for the above mentioned period. - The following Resolution was offered by COUNCILMAN MCCLUSKEY who offered its adoption: WHEREAS, the Town has received an additional charge from the State Insurance Fund, Worker's Compensation and WHEREAS, no funds are available in these line items, BE IT RESOLVED, that the following transfers be approved, from A Fund Contingency 1990.4 to A Fund Workers Compensation 9040.8, $1,380.81, from B Fund Contingency 1990.4 to B Fund Workers Compensation 9040.8, $893.46, from B Fund Contingency 1990.4 to Highway Fund Workers Compensation 9040.8, $5,848.15. The Comptroller provided The following Resolution was offered by COUNCILMAN INCORONATO who moved its adoption: WHEREAS, there was insufficient funds available in the line item for the Attorney, and WHEREAS, monies were set aside for tis contingency, BE IT RESOLVED, that the sum of $6,371.00 be and is hereby transferred from Contingency A 1990.4 to Attorney A.1420.4 Seconded by: Supervisor Versace Roll Call Vote: 5 Ayes 0 Nays ~o6 The following Resolution was offered by COUNCILMAN INCORONATO who moved its adoption: WHEREAS, the monies for litigation were never appropriated to the Attorneys line item and WHEREAS, the monies were set aside in Contingency against possible litigation, l BE IT RESOLVED, that the sum of $6,245.00 be and is hereby transferred from "A Fund" Contingency 1990.4 to "A Fund" 1420.4 and ~ BE IT FURTHER RESOLVED, that the sum of $6,470.00 be and is hereby transferred from "B Fund" Contingency 1990.4 to "B Fund" 1420.4. Seconded by: Councilman Incoronato Roll Call Vote: 5 Ayes 0 Nays A request was received from James Klein for the Town to take over the operation and maintenance of the sewer pump that services Section 2 of Fieldstone Farms. The Engineer had no problems with a favorable response by the Town Board to this request, but recommendffithat Camo Pollution Control check over the system to make sure it is in proper working l condition. Mr. Incoronato suggested that the developer provide a warranty for the pump station in the event the operation of the system becomes faulty, the Town will not have the burden of repair expenses. Mr. McCluskey suggested that Camo Pollution Control check the alarm system, if one has been installed, and if not, the developer be requested to install one prior to the Town taking over the system. Mr. Evangelista added that in addition to the warranty on the pump from the developer, the manufacturer's warrant should also ~ be provided to the Town --- this would provide two-fold protection. L MR. VERSACE moved, upon the recommendation of the Engineer to have Camo Pollution Control check the sewer pump that services Section 2 of Fieldstone Farms, obtain the developer's and manufacturer's warranty, also have Camo check the alarm system if already installed and if not, request the developer to install one prior to Town taking over the system, and table action for the pleasure of the new administration. Seconded by Mrs. Paino Motion Unanimously Carried 1/6/ The CSEA Contract for the Highway Employees of the Town was placed before the Board for their consideration. Mr. Versace had no problems with the terms of the contract and asked the other Board Members what their feelings were on this matter. Mrs. Paino asked the Attorney if he had reviewed this contract, and Mr. Kessler replied that he had seen the terms of the ~;4 1.1 agreement proposed by the union after negotiations had taken place and found it to be in substantial form. MRS. PAINO moved to approve the contract between the CSEA and ~ the Town of Wappinger, on behalf of the Highway Department and authorize the Supervisor to sign said contract. Seconded by Mr. McCluskey Motion Unanimously Carried A Memo was received from the Comptroller requesting Town Board approval on a bill from K & A Excavating Contractors, Inc. relating to the Hamilton Drainage Project. Mr. Evangelista stated that he reviewed the voucher request with Mrs. Garrison and at this time he does not recommend that the Board pay the amount to K & A dre to certain items ~..'..J'...".'.'.'.' II that require clarification by that company. MR. VERSACE moved that the request for payment to K & A Excavating Contractors, Inc. relating to the Hamilton Drainage Project be tabled for further clarification of the vouchers by said company, upon the recommendation of the Engineer. Seconded by Mrs. Paino Motion Unanimously Carried The Comptroller requested the Board to authorize her to go to bid for the electrostatic refinishing, re-upholstering, manu- facturing of parts and installation of such, of the existing .., office furniture owned by the Town. on the refinishing of the furniture owned by the Town. i.:;j...... PAINO moved to authorize the Comptroller to go to bid Seconded by Mr.McCluskey Motion Unanimously Carried When seconding the motion, Mr. McCluskey wished to discuss the subject; he asked the Comptroller if the process of the electrostatic refinishing was a recognized method or was it copyrighted by a company as a newer method. Mrs. Garrison l -..., l '" l L.)o:z. replied that it was a form of painting metal cabinets so the paint does not chip as easily, and was recommended to her by the Town of Fishkill who have used this method and have been very satisfied with it. The company suggested that the painting be done after it is moved to the new Town Hall; supposedly there is no mess because it is charged electrocally. Mr. McCluskey suggested that the Fire Inspector check the process to determine that it is safe. He asked if there was just one company in the area that was familiar with the process or would other companies be able to bid on the job; the reply was that there was only one firm in the area that did this type of refinishing, however, Audit and Control recommended that the Town go to bid even though there was only one company qualified to bid. There were several Change Orders submitted by Hayward and Pakan for the new Town Hall. Mrs. Paino had a problem with Change Order #5 from the Eugene Ossie, Inc. General Contractor in the amount of $14,238.00 which she discovered related to the cutting of several trees; initially, the County had suggested that only one tree be removed from the entrance to the Town Hall; she preferred that this Change Order be tabled for review with the County and the Town Planning Board. Mrs. Paino noted that it is a general practice in the Town to cut down as few trees as possible. MRS. PAINO moved to table Change Order #5 from the General Contractor for the Town Hall in the amount of $14,238.00, relating to cutting trees, for further review with pertinent agencies of the Town and County. Seconded by Mr. Incoronato 5 Ayes o Nays MRS. PAINO moved to approve Change Order #6, General Contractor, reframing Town Clerk's window, install 4' x 8' rolling aluminum shutter, #5, C. B. Strain, eight additional fire dampers and access doors, # 3, 4, 5, Rondout Electric, addition of lighting fixtures in soffits over entryways, electrical changes in Town Clerk's office, install switches on boiler circulator pumps and authorize the Supervisor to sign approved Change Orders. Seconded by Mr. Incoronato Motion Unanimously Carried Unfinished Business --- Mrs. Paino noted that she had received several calls from -- -~----- -...-p.. J./ 63 residents in the Pine Ridge section of the Town who are upset with the condition the roads are being left in by PASNY. MRS. PAINO moved to send a letter to PASNY indicating that the Town of Wappinger expects them to clean up the roads in our Town during the construction period. Seconded by Mr. Incoronato Motion Unanimously Carried ~:--- i;y' ~ -"it Mr. Evangelista commented that in order to expedite this letter vJ in the proper direction, Ken Croshier could provide us with the name of the designated person in that department who is knowledg- able of the roads used in the Town and is available to check on their condition, when requested. Mr. Versace referred to correspondence received by the Town Board relating to Lot #76 in the old section of Pondview which has now been purchased. There was a question on whether water and sewer service is available to the new owners and Camo Pollution has determined after Mr. Versace had them check it out that the :::v~::e::tn::s::::::::eh:::h:::: :::d~r::e:::l:si:i::i:h:h:b:::::ictll tion of the Town to provide the water and sewer facilities to the owners of the parcel. MR. VERSACE moved that Camo Pollution Control be authorized to provide and sewer connections from the main line to the property line at Lot #76 in Pondview. Seconded by Mrs. Paino Motion Unanimously Carried Mr. McCluskey had one item relating to the tenants of the Schlathaus property owned by the Town. The Attorney had been notified to send a termination of lease notice enclosing a ~ letter requesting that the tenant contact the Town Board to L) 1.1 discuss some matters relating to the terms of the lease and further negotiations. The Attorney had forwarded the ninety day termination notice on November 8, 1985, enclosing the direction for the tenant to contact the Town, however, to this date, no response has been received from him. There was no other business to come before the Town. MR. INCORONATO moved to adjourn the meeting, seconded by Mr. L ~ l -., l 4/01/ McCluskey and unanimously carried. Snowden Town Clerk A Public Hearing was held by the Town Board of the Town of Wappinger on December 16, 1985 at Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York on a Local Law Amending All Prior Local Laws with - Respect to the Minimum Charges for the Consumption of Water in the Fleetwood Sewer District. Supervisor Versace opened the Hearing at 7:03 P.M. PRE SENT: Frank Versace, Supervisor Joseph Incoronato, Councilman Gerard McCluskey, Councilman Irene Paino, Councilwoman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made a part thereof of the minutes of this Hearing.) Mr. Versace mentioned that the rates for this District will increase from $47.00 minimum charge in 1985 to $62.20 minimum charge in 1986. Mrs. Paino noted that these rates do not include enough in the budget to cover preventive flushing or repairs of breakage and emergency calls and complaints. Mr. Versace said that these rates are in the Preliminary Budget proposed to the Town Board and since the Final Budget was not adopted, by law we have to revert back to this Budget. He stated that money for preventive maintenance was included in the Final Budget which was not adopted. Mrs. Paino said she had spoken to John Kelly of Audit and Control, Bureau of Municipal Accounting System, and he indicated that preventive flushing and repairs of broken lines are reasonable requests and that the Town Board would be allowed to raise the rates slightly higher. She said she is waiting for a confirmation letter from Mr. Kelly. There were no further comments either for or against the proposed Local Law. Mrs. Paino stated she had no problem with the deletion of the surcharge but that the Local Law implies the existing rates will remain in effect. She feels that the existing rates do not include enough in the budget to cover preventive flushing or repairs of breakage and emergency calls and complaints. Audit and Control has indicated that these problems would constitute a reasonable request and the Town Board would be allowed to raise the rates slightly higher. She said she is waiting for a confirmation letter from them. PRESENT: Frank Versace, Supervisor Joseph Incoronato, Councilman Gerard McCluskey, Councilman Irene Paino, Councilwoman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (The Affidavits are attached hereto and made a part thereof of the Minutes of this Hearing.) Mr. Versace noted that the rates would remain the same and that this Proposed Local Law would delete the surcharge of $68.32 against the residents since during 1985 the full indebtedness has been paid back to the General Fund. Mrs. Paino stated she had no problem with the deletion of the surcharge but that the Local Law implies the existing rates will remain in effect. She feels that the existing rates do not include enough in the budget to cover preventive flushing or repairs of breakage and emergency calls and complaints. Audit and Control has indicated that these problems would constitute a reasonable request and the Town Board would be allowed to raise the rates slightly higher. She said she is waiting for a confirmation letter from them. Mr. Versace said that these rates are in the Preliminary Budget proposed to the Town Board and since the Final Budget was not adopted, by law we have to revert back to the Preliminary Budget. He stated that no money was put in the Preliminary Budget for preventive maintenance but was included in the Final Budget which was not adopted. There were no further comments from the Public either for or against the .......- proposed Local Law. 'Mr. Incoronato moved to close the Public Hearing seconded by Mrs. Paino and unanimously carried.
