1984-12-28 RGMThe Year End Meeting of the Town Board of'the Town of Wappinger was held on December 28th, 1984 at the Town Hall, Mill Street, Wappingers Falls, Dutchess County, New York. Supervisor Versace opened the Meeting at 4:26 P.M. Klein, Inc. had heretofore filed for a subdivision of property known as "Fieldstone Farm" in the Town of Wappinger, Dutchess County, New York, and WHEREAS, his application for such subdivision has hereto- fore been granted by the Planning Board of the Town of Wappinger, and WHEREAS, a conservation district was formed and as a result of such formation, a determination was made that James A. Klein, Inc. should deposit certain funds with the Town, and WHEREAS, a question has arisen as to whether such deposit of funds is proper, and which said funds were to be utilized for the maintenance of conservation areas within the subdivision, and WHEREAS, request was made for an opinion from the Office of the State Comptroller as to how the Town of Wappinger may acquire funds to pay for maintenance of the conservation areas, and WHEREAS, one method proposed by the Town was to establish a special fund for each such conservation area, and WHEREAS, the Office of the State Comptroller has advised that no monies may be collected by the Town to assure compliance for deposits for proper maintenance of conservation areas, and WHEREAS, James A. Klein, Inc. in or about April, 1984 made a' deposit with the Town Board of the Town of Wappinger in the sum of $1,954.53, and WHEREAS, it will now be proper to refund such sum together with accrued interest thereon to James A. Klein, Inc, and WHEREAS, the entire sum now on deposit in the Trust and Agency Fund is the sum of $1,986.14 which represents the deposit with accrued interest thereon, NOW, THEREFORE, BE IT RESOLVED, that the said sum of $1,986.14 be refunded to James A. Klein, Inc. from the Trust and Agency Fund of the Town of Wappinger. Seconded by: Councilwoman Ballard Roll Call Vote: 3 Ayes 0 Nays There was no other business to come before the Board. MRS.
