1984-12-06 PH Book 1A Public Hearing was held by the Town Board of the Town of Wappinger on December 6, 1984 at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York on a proposed Local Law of the Year 1984 Amending Local Law No.7 of 1981 and Local Law 8 of 1980 Relating to the Imposition and Charge for Water Rates for the Consumption and Use of Water for the Fleetwood Water District. Supervisor Versace opened the Hearing at 7:10 P.M. Present: Frank Versace, Supervisor Renata Ballard, Councilwoman Gerard McCluskair9,Cdunciltanu Irene Paino, Councilwoman Elaine H. Snowden, Town Clerk Absent: Joseph Incoronato, Councilman The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). Mr. Versace noted that the Comptroller and Bookkeeper were present for any questions the public might have, also Michael Morris, Engineer for Camo Pollution Control and : Michael Tremper, the Field Director for Camo. Before opening the Hearing to the public, Mr. Versace made the following comments ----the 1984 rate is $13.68 minimum charge per quarter, the proposed rate for 1985 will be $37.00 minimum charge per quarter. This increase will pay the operation and maintenance charges for the year and hopefully wipe out the existing deficit of $10,800.00 by the end of 1985. In addition to these expenses, 'additional capital improvement work will be addressed at a later date which will be financed by bonding; public hearings will be held before these expenditures are approved. This work is necessary to upgrade the plant as indicated by the New York State Department of Environmental Conservation. Mr. Versace asked for comments from the public on the proposed increase in this district. There were no residents from Fleetwood Water District present. No one spoke either for or against the proposed local law. MR. VERSACE moved to close the Public Hearing, seconded by Mr. McCluskey and unanimously carried. The Hearing closed at 7:14 P.M. Section 2. The owner shall be obligated to pay the minimum charge of $37.00 each quarter, regardless of the consumption of water for said quarter, provided said owner is con- nected to the system at any time during the quarter, said rate to commence with the 2nd district fiscal quarter of the year 1985. Section 3. This local law shall take ef- fect upon adoption and as provided by the Municipal Home Rule Law. Mr. Versace made the following comments prior to receiving comments from the public: 1984 rate is $37.64, proposed rate for 1985 will be increased to $47.00 minimum charge per quarter which will cover cost of operation and maintenance. All additional work required by the New York State Department of Conservation will require bonding for capital improvements and public hearings will be held before the expenditures are approved. There is no deficit in this district. Mr. Versace asked for comments from the public; no one spoke either for or against the proposed local law. MR. Effective the aeleond district fiscal quarter of the year 1985, the following rates shall be charged: the owner shall be obligated 10 pay the minimum charge of 547.00 per quarter, regardless of the consumption of water for said quarter, provided said owner la connected to the system at any time during the quarter. All other provisions of Local Law No. 1 of the year 1981 are hereby ratified, with the exception of Section 1 subdivision B which this local law hereby amends and which refers to the minimum charges for consumption of water.
