ADJOURNMENT The Regular Bi -Monthly Meeting of the Town Board of the Town of Wappinger was held on October 15th, 1984 at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Versace opened the Hearing at 8:07 P.M. Present: Frank Versace, Supervisor Renata Ballard, Councilwoman Joseph Incoronato, Councilman Gerard McCluskey, Councilman Irene Paino, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Ronald Evangelista, Engineer Kenneth Croshier, Highway Superintendent The Meeting began with the Pledge of Allegiance to the Flag. The Minutes of the Regular Meeting of October 1st, 1984 and the Special Meeting of October 9th, 1984, having previously been forwarded to all Board Members, were now placed before them for their consideration. MRS. BALLARD moved that above stated Minutes be and they are hereby approved as submitted by the Town Clerk. Seconded by Mrs. Paino Motion Unanimously Carried Reports for the month of September were received from the Town Justices, Receiver of Taxes and Highway Hydrant Report. MRS. PAINO moved to accept these reports and place them on file. Seconded by Mrs. Ballard Motion Unanimously Carried Mr. Hawksley forwarded a Resolution/Recommendation from the Dutchess County Environmental Management Council relating to County management of its wetlands for the Board's consideration. Mr. Hawksley informed the Board that initially the Conservation Council felt that the Town could administer the regulations on their wetlands, however upon their review of these regulations it was their recommendation that the County level control could a_ provide the expertise required. MRS. PAINO moved.to send a letter to the Dutchess County Environmental Management Council stating that the Town Board supports their resolution allowing the County of Dutchess to exercise regulatory authority over its wetlands. Seconded by Mr. McCluskey Motion Unanimously Carried A response was received from the New York State Department of Transportation to our request for left turn phases for Myers Corners/Middlebush Road and Route 9 intersections. They are presently engaged in a review of the existing signal operation and although they feel it is appropriate to modify this operation it would also be necessary to make physical modifications on side road approaches to the light. Mr. Fitzpatrick indicated that the Board would be informed of the time schedule for the proposed work when they determine the procedure they will follow after this review. MRS. BALLARD moved to receive this communication and place it on file. Seconded by Mr. McCluskey Motion Unanimously Carried Mr. Ernst Martin, Jr. of Paggi & Martin, wrote to the Board on behalf of Clinton Lucas requesting a water hook-up from CWWI for a parcel of property on Myers Corners Road west of Hiview Road. Mr. Joseph Paggi represented the firm and informed the Board that the parcel was within the CWWI and the Dutchess County Department of Health requested approval from the Town that the parcel would be served with Town facilities. MR. VERSACE moved to allow Mr. Lucas to tie into the CWWIA, the connection would be at his expense and the Department of Health be notified of the Town's approval of this hook-up. Seconded by Mrs. Ballard Motion Unanimously Carried Mr. Evangelista requested that the Engineer representing Mr. Lucas provide a copy of the Tax Map identifying the parcel along 3 with the Grid Number of the parcel to the Town Clerk for filing with the letter of request for the hook-up to CWWIA. Sandra Goldberg, Wappinger County Legislator, was introduced by Supervisor Versace and reported on a scheduled informational hearing on a resolution authorizing the Commissioner of Finance to sell property at the Airport owned by the County which had been originally designated as a buffer zone for a private area; this hearing would take place on October 18, 1984, 7:30 P.M. at the cafetorium of Vassar Road School for the public to make comments and ask questions. The second item she was unhappy to report was a Committee defeat of a proposal for the County to pay for the reassessment project and charge back to the municipalities. Committee Reports --- Mrs. Ballard had no reports for this meeting. Mrs. Paino reported that the Fall Clean Up would commence on the east side of Route 9 on October 22, 1984 and the west side, including the portion of the Village of Wappingers Falls within the Town of Wappinger, would start on November 5, 1984. She outlined the usual procedures for the clean up and distributed these regulations to the news media for publication. Drainage, Mrs. Paino requested the Engineer to compile the list of 20+ drainage problems in the Town as soon as possible. Ordinance, Mr. Incoronato made a presentation to the Board on the need for upgrading and improving the present Zoning Ordinance. He proposed that a Citizen Zoning Advisory Council be established to aid the Town Board with this project and his first step to initiate this council was to appoint a Steering Committee to provide the necessary framework for the Town Board appointment of a Zoning Council. MR. INCORONATO moved to appoint the following members to the Steering Committee: Victor Fanuele, Edward Hawksley, Charles Cortellino, Michael Hirkala and Helen Byron. Seconded by Mrs. Ballard Motion Unanimously Carried Mr. Incoronato requested that these members be notified of their first meeting on November 1, 1984 at 7:30 P.M. at the Town Hall. Resolutions Bids on General Construction, Plumbing, Heating, Ventilation, Air Conditioning and Electrical Contracts for the Town Hall were received and opened on the 27th day of September, 1984. MRS. BALLARD moved to award the following bids on the Town Hall: General Construction: Plumbing: HVAC: Electrical: Eugene Ossie, $784,217.00 A. C. Smith 48,450.00 C. B. Strain 296,460.00 Rondout Electr.•133,752.00 and authorize the Supervisor to sign the contracts after they have been reviewed and approved by the Attorney to the Town. Seconded by Mr. Incoronato Roll Call Vote: 5 Ayes 0 Nays Prior to voting on this motion, Mrs. Paino asked that the following items be included in the contract: any work that is improperly done must be corrected by and at the expense of the contractor; no asbestos or PCB's will be in the materials for the building and all change orders must have Town Board approval. Mr. McCluskey---- a definite time limit be stated in the contract and recommended a November 1985 completion date. Mrs. Ballard responded that all of these items were discussed at a recent work shop with the Attorney and Hayward and Pakan and would be considered when the contracts are drawn; the contracts presently being reviewed by Hayward and Pakan include a time limit of 360 days from the signing of the contract which concurs with Mr. McCluskey's recommendation of November 1985 as the date of completion. Although Mr. McCluskey voted on awarding the bids for the Town Hall, he commented that he was not satisfied with the firm of Hayward and Pakan and in his opinion, they acted in a very un- professional manner and could have killed this project. He concluded his comments with the statement that they did a botched up job. A recommendation was received from the New Hackensack Fire District for the appointment of Peter Howell to the Town Fire Prevention Bureau. MRS. PAINO moved to confirm the appointment of Peter Howell as a member of the Town Fire Prevention Bureau. Seconded by Mr. McCluskey Motion Unanimously Carried Public Hearings having been duly held on October 1st, 1984 on the Benefit Assessment Rolls for the Oakwood Knolls Water District, Central Wappinger Water Improvement Area, Ardmore Water Improve- ment Area, Tall Trees Water Improvement Area, Fleetwood Water District, Fleetwood Sewer District, Mid -Point Sewer District, Wappinger Sewer Improvement Area #1, Wildwood Sewer District and Watch Hill Sewer District, the matter was now placed before the Board for their consideration. The following resolution was introduced by SUPERVISOR VERSACE who moved its adoption: WHEREAS, the Town Assessor did prepare at the direction of the Town Board, the Assessment Rolls for the Oakwood Knolls Water District, for the assessment to Abe levied in 1985, and WHEREAS, said Assessment Roll was filed with the Town Clerk of the Town of Wappinger, and WHEREAS, she thereafter gave notice by posting upon the bulletin board of the Town and in the newspaper published within the Town of the time and place when the Town Board would conduct a hearing and hear objections upon or to said roll, and WHEREAS, the Town Board of the Town of Wappinger did meet on the 1st day of October, 1984, to consider and hear objections of said roll, NOW, THEREFORE, BE IT RESOLVED, that the Assessment Roll of 1984, for the Oakwood Knolls Water District for taxes to be collected in 1985, be approved, ratified and confirmed and adopted, and the Supervisor and Town Clerk are hereby authorized and directed to execute the warrant for collection of said taxes in the manner prescribed by Law. Seconded by: Councilwoman Ballard Roll Call Vote: 5 Ayes 0 Nays The following resolution was introduced by SUPERVISOR VERSACE who moved its adoption: WHEREAS, the Town Assessor did prepare at the direction of the Town Board, the Assessment Rolls for the Watch Hill Sewer District, for the assessment to be levied in 1985, and WHEREAS, Said Assessment Roll was filed with the Town Clerk of the Town of Wappinger, and WHEREAS, she thereafter gave notice by posting upon the bulletin board of the Town and in the newspaper published within the Town of the time and place when the Town Board would conduct a hearing and hear objections upon or to said roll, and WHEREAS, the Town Board of the Town of Wappinger did meet on the 1st day of October, 1984, to consider and hear objections of said roll, NOW, THEREFORE, BE IT RESOLVED, that the Assessment Roll of 1984 for the Watch Hill Sewer District for taxes to be collected in 1985, be approved, ratified and confirmed and adopted, and the Supervisor and Town Clerk are hereby authorized and directed to execute the warrant for collection of said taxes in the manner prescribed by Law. Seconded by: Councilwoman Ballard Roll Call Vote: 5 Ayes 0 Nays The Chairman of the Town Fire Prevention Bureau, Bud Pottenburgh, submitted a fee schedule inspections to the Board for their consideration. MR. VERSACE moved to table consideration of this request to the November 5th, 1984 meeting. Seconded by Mrs. Ballard Motion Unanimously Carried Since the Attorney was not present at the meeting to present the necessary documents for the Amendments for Special Use Permits, Mr. Versace recommended that this item be tabled. MR. VERSACE moved to table this matter to the next meeting for further information from the Attorney. Seconded by Mr. Incoronato Motion Unanimously Carried The following resolution was offered by SUPERVISOR VERSACE who moved its adoption: RESOLVED, the sum of $414.40 be and is hereby transferred from Account A1220.4 for payment of bus transportation in relation to District Little League Champions, such expenditure approved at the Town Board Meeting of August 6, 1984. Seconded by: Councilwoman Ballard Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by SUPERVISOR VERSACE who moved its adoption: RESOLVED, the sum of $6,116.60 be and is hereby appropriated for Morris & Andros for professional services rendered in relation to Drainage, such services authorized by Town Board at its regular meeting of July 16, 1984 and BE IT FURTHER RESOLVED that such funds are appropriated from the Special Revenue Fund, Downstream Drainage. Seconded by: Councilwoman Ballard Roll Call Vote: 5 Ayes 0 Nays Under Unfinished Business, the matter of the water line dedication from Pizzagalli Development Company to the Town had been tabled from the last meeting. Mr. Versace reported that he has set a work shop for October 25th, 1984 with )I representatives from Pizzagalli to review this matter and further action would be taken at a future meeting. The Board was waiting for a report from the D.E.C. on the application submitted by Jo Mo Realty for a Special Use Permit to fill the lands of Montfort. MR. VERSACE moved to table consideration of this application for further information. Seconded by Mrs. Paino Motion Unanimously Carried A report was received from the Zoning Administrator regarding Mrs. Zak's inquiry on the date of the rezoning of that property from residential to commercial. Mrs. Farnsworth indicated that the parcel was shown as HB -2A on the zoning map adopted in March of 1980 and recommended that a further research be conducted in the Town Clerk's office since rezoning is a function of the Town Board. Mrs. Zak was not satisfied with this report and requested a further investigation on the legality of the activities being conducted on that parcel of property. She questioned whether the Zoning Board of Appeals had the authority the permit these uses and urged the Board to finalize this investigation before it was too late to prevent further violations. Mr. Incoronato informed Mrs. Zak that he would get a legal opinion from the Attorney on her concerns and report his findings to her. RESOLUTION OF TOWN BOARD APPROVING PRELIMINARY BUDGET AND CALLING PUBLIC HEARING THEREON The following resolution was offered by SUPERVISOR VERSACE who moved its adoption: RESOLVED, that this Town Board does hereby prepare and approve as the preliminary budget of this Town for the fiscal year beginning on the 1st day of January, 1985, and be it FURTHER RESOLVED, that such preliminary budget shall be filed in the office of the Town Clerk where it shall be available for inspection by an interested person at all reasonable hours, and be it FURTHER RESOLVED, that this Board shall meet at 7:30 o'clock P.M. on the 29th day of October, 1984, at the Town Hall of the Town of Wappinger, for the purpose of holding a public hearing upon such preliminary budget, and be it FURTHER RESOLVED, that the Town Clerk give notice of such public hearing in the manner provided in Section 108 of the Town Law, and that such notice be posted and published once in the W & S D News. Seconded by: Councilwoman Paino Roll Call Vote: 5 Ayes 0 Nays Mr. McCluskey questioned the Comptroller on the amount paid to Hayward and Pakan; she replied that it was approximately $47,000, not including the test borings. Mr . McCluskey asked that a letter be directed to the Attorney requesting an opinion on whether the Town could sue this firm for damages and could they be replaced as supervisors of the construction of the Town Hall if it became necessary. This was a personal request from Mr. McCluskey and did not involve the other Board Members. There was no other business to come before the Board. MR. Snowden A Public Hearing was held by the Town Board of the Town of Wappinger on October 15th, 1984 at the Town Hall, Mill Street, Wappingers Falls, New York on the Benefit Assessment Roll for the Oakwood Knolls Water District. Supervisor Versace opened the Hearing at 7:00 P.M. Present: Frank Versace, Supervisor Joseph Incoronato, Councilman Renata Ballard, Councilwoman Elaine H. Snowden, Town Clerk, Absent: Gerard McCluskey, Councilman Irene Paino, Councilwoman The Town Clerk offered for the record the Affidavit of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made 'part thereof of the Minutes of this Hearing). Mr. Versace noted that the rate for this Assessment Roll was $25.71 per unit in 1984 and the rate for 1985 will be $24.89, a reduction of $.$2. There were no persons present to speak either for or against the Assessment Roll and no written grievances had been received or filed. MR. Supervisor Versace opened the Hearing at 7:35 P.M. Present: Frank Versace, Supervisor Joseph Incoronato, Councilman Renata Ballard, Councilwoman Gerard McCluskey, Councilman Irene Paino, Councilwoman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof of the Minutes of this Hearing). Mr. Versace noted that the 1984 rate for each unit was $132.23 and for 1985 it would be $113.03 for each unit. There were no persons present to speak either for or against the Assessment Roll and no written grievances had been received or filed. MR. VERSACE moved to close the Public Hearing, seconded by Mrs. Paino and unanimously carried. The Hearing closed at 7:36 P.M. Representatives from DWS New York Holdings, Inc. and WVC Realty Corp. arrived immediately after the closing of this Hearing and requested the Board to reopen the Hearing for their comments. MR. VERSACE moved to reopen the Public Hearing on the Benefit. Assessment Rolls for the Wappinger Sewer Improvement Area #1,. Seconded by Mr. Incoronato Motion Unanimously Carried Supervisor Versace reopened the Hearing at 7:38 P.M. Present: Frank Versace, Supervisor Renata Ballard, Councilwoman Joseph Incoronato, Councilman Gerard McCluskey, Councilman Irene Paino, Councilwoman Elaine H. Snowden, Town Clerk Mr. Herbert N. Wallace, 322 Mill Street, Poughkeepsie, New York, representative of DWS New York Holdings, Inc. and WVC Realty Corp., protested the benefit assessment appliedto the property owned by DWS and WVC since they are assessed on approved units even though they only have preliminary subdivision approval. It was his understanding that this Sewer Improvement Area does not have the capacity to serve 550 units but the principals are paying on this number of units. He further pointed out that in order to hook-up to the sewer property and they do not have system, they must go through the power of condemnation to the necessary easements. He respectfully submitted to the private acquire Board that this is confiscation of property without benefits due to assessment of 550 units that cannot be serviced and they are paying benefits far in excess of any benefits they can receive because the plant does not have the capacity to serve the involved units. Mr. Wallace thanked the Board for reopening the Public Hearing for his comments. There were no other comments either for or against the Benefit Assessment Roll for the Wappinger Sewer Improvement Area #1. MR.
