Resolution Terminating Inter -Municipal Cooperation Agreement for Code Enforcement
Services with the Town of Union Vale
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on December
13, 2010.
The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilman Beale and seconded by
Councilman Bettina.
WHEREAS, by written agreement dated June 12, 2009, the Town of Wappinger entered
into an Inter -Municipal Cooperation Agreement with the Town of Union Vale to provide Code
Enforcement Services to the Town of Union Vale; and
WHEREAS, the Town Board has determined that it is no longer in a position to provide
Code Enforcement Services to the Town of Union Vale; and
WHEREAS, pursuant to paragraph 3 of the Inter -Municipal Agreement, either party can
terminate the agreement upon sixty (60) days notice to the other party;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby elects to terminate the Inter -Municipal Cooperation
Agreement for Code Enforcement Services dated June 12, 2009, with the Town of
Union Vale whereby the Town of Wappinger was to provide Municipal Code
Enforcement Services to the Town of Union Vale.
3. Pursuant to paragraph 3 of the Inter -Municipal Agreement, the effective date of
the termination shall be March 1, 2011.
4. Christopher J. Colsey, Supervisor, and Albert P. Roberts, Attorney to the Town,
are directed to take whatever steps are necessary to notify the Town Board of the
Town of Union Vale of the Town of Wappinger's determination to terminate the
Inter -Municipal Agreement.
The foregoing was put to a vote which resulted as follows:
