ADJOURNMENT r The Regular Bimonthly Meeting of the Town Board of the Town of Wappinger was held on February 21, 1984 at the Town Hall, Mill Street, Wappingers Falls, Dutchess County, New York. Supervisor Versace opened the meeting at 8:05 P.M. Present: Frank Versace, Supervisor Renata Ballard, Councilwoman Joseph Incoronato, Councilman Irene Paino, Councilwoman Elaine H. Snowden, Town Clerk Absent: Gerard McCluskey, Councilman Others Present: Bernard Kessler, Attorney Michael Morris, Engineer Kenneth Croshier, Highway Superintendent Supervisor Versace started the meeting with the Pledge of Allegiance to the American Flag. Mrs. Snowden noted that Mr. McCluskey was at the Association of Towns meeting in New York. The Minutes of the Regular Meeting of February 6th, 1984, having previously been sent to -all Board Members, were now placed before the Board for their consideration. MRS. PAINO moved that the Minutes of the Regular Meeting of February 6th, 1984 be and they are hereby approved as submitted by the Town Clerk. Seconded by Mr. Incoronato Motion Unanimously Carried• Reports were received from the Town Justices and the Building Inspector for January and the Building Inspector's Year End Report. MR. INCORONATO moved to accept these reports and place them on file. Seconded by Mrs. Ballard Motion Unanimously Carried Mr. Raymond Croniser had previously requested approval to connect Lot #4 in the Edgehill Manor Subdivision to the Rockingham Farms Sewer District as a tenant to the district. Approval for this connection had been received from the Dutchess County Department of Health and the matter was now placed before the Town Board for their approval. MR. VERSACE moved to grant approval to Mr. Croniser to connect Lot #4 in the Edgehill Manor Subdivision as a tenant to the district, subject to all conditions of the Town Tenant Policy. Seconded by Mrs. Paino Motion Unanimously Carried A request was received from Hans Gunderud, Building Inspector and Fire Inspector to attend a mandatory Fire Inspector School at Montour Falls, New York from April 30th through May 4th, 1984. MRS. BALLARD moved to grant permission to Mr. Gunderud to attend the Fire Inspector School as requested by him. Seconded by Mrs. Paino Motion Unanimously Carried The following letter was received from Michael Morris: February 6, 1984' Mr. Bill Rhode, P.E. Hayward & Pakan Associates 321 Main Mall Poughkeepsie, N.Y. 12601 Re: Central Wappingers #1 Atlas Interconnection (T) Wappingers W117 Dear Bill: On February 3, 1984, in a conversation with Mr. David Wall of Morris and Andros, the following considerations were conveyed concerning this office's review of the above referenced item: 1) The primary design criteria should be one concerned with the needs of all consumers -- Pizzagalli, CWWIA, Cranberry and Atlas -- not with the inherant limitations of any existing water system. 2) Improvements to the interconnection system should be phased so that all of the involved consumers may receive their required demand under all conditions; both at present and in the future. It is this office's intent to keep an open line of communi- cation with all involved parties; to this effect, please reference the list of agencies/individuals to be copied on our communica- tions. Consulting Town Engineer Mr. Versace explained that this letter was in relation to the contract between Central Wappinger Water Improvement Area and Atlas Water Company and concern that all the parties involved would be equally serviced. A meeting will be set up in the near future with all principals to discuss and hopefully resolve some of the existing problems. MR. VERSACE moved to receive this communication and place it on file. Seconded by Mrs. Ballard Motion Unanimously Carried A letter was received from Leo Clark, Central Hudson regarding the conversion of the Danskammer Point Steam Station from oil to coal and enclosing a notice of complete application and avail- ability of the Draft EIS. Mr. Clark indicated to Mr. Versace that he would like to meet with the Town Board and interested agencies to discuss the EIS; in the very near future Mr. Versace would set up a meeting with Mr. Clark for a thorough review of this statement. Mr. Incoronato commented that he would like to discuss with Central Hudson the possibility of using 50% coal and 50% garbage for this conversion which could be a tremendous benefit to the surrounding municipalities for garbage disposal. MR. VERSACE moved to receive this communication from Central Hudson and place it on file. Seconded by Mrs. Ballard Motion Unanimously Carried Correspondence was received from Bradly Whited, Commissioner of Aviation relating to the tree removal project on airport property which started on February 14th, 1984. Mr. Whited's letter to Mrs. Pattison indicated that a crew from Camp Beacon would be working full time to accomplish this workk. MR. VERSACE moved to receive this correspondence and place it on file. Seconded by Mrs. Paino Motion Unanimously Carried Mr. Logan wrote to the Town Board regarding a memo received from the Counsel to the State Division of Equalization and Assessment relative to the assessment of certain property owned by New York Telephone and American Telephone and Telegraph. Since the memo gave no clear direction Mr. Logan requested that it be referred to the Attorney for a written opinion. Mr. Kessler had received a copy of Mr. Logan's letter and the enclosed memo which was a lengthy one and needed further review by him. He would research this matter further including state legislation that may cover this matter and report his findings to the Board and Mr. Logan. MR. VERSACE moved to refer this matter to the Attorney for review and report to the Town Board and Mr. Logan. Seconded by Mrs. Paino Motion Unanimously Carried Correspondence was received from Mr. Adams, former Attorney to the Town relating to Town of Wappinger vs. Republic Insurance Co. (Serenity Mission Road Bond). Mr. Versace explained that Mr. Adams had diligently pursued this matter to recoup the monies the Town had expended to complete the roads in that subdivision. The check forwarded by Mr. Adams from Republic Insurance Company was in the amount of $37,786.88 which ..was the amount expended by the Town. These monies were expended from Federal Revenue Sharing Funds and would be returned to that fund. MR. VERSACE moved to receive this letter and request the Town Clerk to send a letter to Mr. Adams thanking him for his services to the Town in procuring this money and his diligent pursuit of the matter. Seconded by Mr. Incoronato Motion Unanimously Carried Committee Reports ---Mrs. Ballard reported that the Engineer, Ron Evangelista had been directed to contact several ground testing firms to make a presentation to the Town Board of the services they would provide and the costs involved to conduct a ground 3 water study or aquifer test on CWWIA. Mr. Evangelista has set up a work shop for March 29, 1984 at 7:30 P.M. with Dunn-Geoscience Corp. of Latham, New York for their presentation. Other firms will meet with the Board sometime in April, dates will be set in the near future. Housing and Building Committee --Mrs. Ballard reported that the lights had been replaced in the Town Meeting Rooms and new strings put on; the clock will also be replaced. Mrs. Ballard thanked everyone for being so cooperative with the new "No Smoking" policy in the Town Hall; no complaints had been received from the Town Board members or residents nor had the other Boards or Commissions voiced any complaints on this new ruling. Mrs. Paino reported on complaints received relevant to the New Hackensack Road areathe first was in regard to a tractor trailer parked along New Hackensack from time to time. The Zoning Administrator reported in a memo to the Town Board that neither the Department of Motor Vehicles Code, New York State nor Town Ordinances restrict parking of this vehicle and she suggested that research is needed to consider a regulation that defines suitable and unsuitable locations for parking truck rigs of certain sizes. Mrs. Paino referred this matter to a future work shop session. The second item had to do with the gate open at Scenic Garden Apartments and Mrs. Paino reported that she could find no law indicating that this gate has to be closed at all times. The third item referenced a traffic back-up problem at the car wash especially on weekends when the weather is pleasant. Mrs. Paino contacted the officials of the Village since a portion of the car wash is within the Village so they are aware of the situation and she also spoke to the Deputy Sheriff so they are alerted and will check at times they feel it is necessary. Mrs. Paino reported that a special work shop meeting had been held last Tuesday with Deputy Sheriff Carl Amburgey which resulted in the Town Board's decision to resume the Vandalism Patrol. Deputy Sheriff Amburgey will contact deputies to work on the Patrol and has assured the Board they will be back on the road this coming Friday. Bids on Highway Material and Fuel Oil were opened on February 10th, 1984; a Bid Report and recommendations from the Highway Superintendent were submitted and are attached hereto and made part thereof of the Minutes of this meeting. MR. VERSACE moved that the bids be awarded as recommended by the Highway Superintendent. Seconded by Mrs. Paino Motion Unanimously Carried Three bids for the 1975 Hornet and the 1978 Concord were opened on February 17th, 1984 Donald Van Buren: 1975 Hornet $ 90.00 1978 Concord 150.00 Tommy Coughlin: Terry Glass: 1978 Concord 1978 Concord 125.00 75.00 In view of the fact that rejecting these bids would mean going through the same procedure all over again, the Comptroller suggested that the Board accept the bid from Mr. Van Buren. MR. VERSACE moved to reject these bids and authorized the Comptroller to rebid for the sale of the two cars in the Legal Notices and also place an ad in the classified section of the W & S D News. Seconded by Mrs. Ballard Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AMENDING THE PAY SCALE FOR PART TIME VANDALISM PATROL PERSONNEL The following resolution was offered by COUNCILWOMAN PAINO who moved its adoption: WHEREAS, the Town Board did, on January 2, 1984, adopt a pay scale resolution establishing a meximum hourly rate to be paid to the Town of Wappinger Vandalism Patrol Personnel for the year 1984, and WHEREAS, the Town Board has subsequently re-evaluated and reconsidered the worth of the performance of said Personnel, NOW, THEREFORE, BE IT RESOLVED, that the pay scale for part time Town of Wappinger Vandalism Patrol Personnel engaged to perform certain services for the protection of the Town Parks and other various Town Properties, as may be assigned by the Town Board, be amended to a maximum hourly rate of $9.00 for the year 1984. Seconded by: Councilwoman Ballard Roll Call Vote: Supervisor Versace Ave Councilwoman Ballard Ave Councilman Incoronato Ave Councilman McCluskey Absent Councilwoman Paino Ave The following resOlution ~offered by COUNCILWOMAN PAINO who moved its. adoption: WHEREAS, the Office of the Secretary of the Treasury in Washington, D.C. has most recently forwarded an outline of administrative requirements of revenue sharing handicapped discrimination regulations; and WHEREAS, that the Town of Wappinger is a government agency that receives more than $25,000 in revenue sharing funds; and WHEREAS, such Town has ninety (90) days from the effective date of the regulations to give initial notification to the public that such Town has a policy against handicapped discrim- ination; and WHEREAS, that the outline for such administrative require- ments were not received by the Town of Wappinger until after January 17, 1984, NOW, THEREFORE, BE IT RESOLVED, that the public notice concerning revenue sharing handicapped regulations which will be published as expeditiously as possible be, and the same is hereby affirmed and this resolution reaffirms the public notice which will be published by Amelia Crosby, the Town Comptroller. Seconded by: Councilwoman Ballard Roll Call Vote: 4 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN BALLARD who moved its adoption: WHEREAS, the allocation of State funds for the D. W. I. Program will be delayed and WHEREAS, there is currently insufficient funds to continue with the program, NOW, BE IT RESOLVED, that the sum of $1,500.00 be and is hereby transferred from the General Fund, Town Wide to the Special Service Fund for the D. W. I. Program and said sum of $1,500.00 is to be reimbursed to the General Fund, Town Wide upon receipt of the County allocation of monies for this program. Seconded by: Councilwoman Paino Roll Call Vote: 4 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN PAINO who moved its adoption: WHEREAS, the Town of Wappinger has entered into a contract with the Central Installation Company for the installation of new water meters in the Central Wappinger Water Improvement Area, and WHEREAS, there may be some additional costs to the home- owner for the installation of such meters, and WHEREAS, the Town of Wappinger will be responsible for some of the additional costs in regard to such installations, NOW, BE IT RESOLVED, each homeowner will be responsible for all repairs to any and all leaking water lines and the cost in the sum of $23.00 for the simple installation of a shut-off valve, if such shut-off valve is necessary and desired by the hdbowner, NOW, BE IT RESOLVED, that the Comptroller of the Town of.Wappinger'shall add is hereby authorized to send out correspondence to each homeowner in the Central Wappinger Water Improvement Area with the information pertaining to such installation. Seconded by: Councilwoman Ballard Roll Call Vote: 4 Ayes 0 Nays A report was received from the Engineer regarding a drainage problem at Mr. William Vrooman's home at 57 All Angels Hill Road. This was referred to the Engineer at the last meeting and he was researching the history of this problem. Mr. Versace tabled this matter to the next meeting pending further information from the Engineer. A second report from the Engineer referenced the Cranberry Hills Development Sewer Connection to Wappinger Sewer Improvement Area #1. It was the Engineer's opinion that this connection was the responsibility of DWS Holdings and he was pursuing this further. Mr. Versace tabled this item for further information from the Engineer. A third report from the Engineer was in regard to the Agreement with the -County on the culvert and stream cleaning on Myers Corners Road in the Losee Road area. He advised the Board that Mr. Anagnos Director of Engineering in the Dutchess County Department of Public Works requested the Town Attorney to contact the County Attorney in this matter. MR. VERSACE moved to refer this matter to the Attorney for review with the County Attorney. Seconded by Mrs. Ballard Motion Unanimously Carried The matter of a petition from James Klein for a Conservation Park District in the Kendell Farms Subdivision was referred to a work shop session at the last meeting. A meeting was held last Thursday evening with Mr. Klein, Chairman of the Planning Board, Town Board and two residents from that area. The Board felt strongly that the entrance road to the development should be from Old Hopewell Road thereby elitinating the connecting road between the Kendall development and Orchard Drive. This matter would be taken up at the next Planning Board meeting and when that Board comes to some determination they will again present it to the Town Board for their consideration. Mr. Versace tabled the matter for a report from the Planning Board. Under New Business, a letter was received from Albert Roberts requesting two building permits for the model duplex style home on lots 39 and 40 in the Hamlet Subdivision. Normally in a new subdivision, the Town will allow one building permit for a model home, however due to the duplex type home two permits were needed and required Town Board approval. MR. VERSACE moved to authorize the Building Inspector to issue two (2) building permits for Lots ##39 and #40 in the Hamlet Subdivision to be used for the model home(s). Seconded by Mrs. Paino Motion Unanimously Carried Mr. Versace noted that this permission for the two building permits does not infer that a Certificate of Occupancy will go along with the permits, This would not be issued until the development is complete with all services. Mrs. Snowden informed the Board that she was served with a Notice of Claim from Rudolph E. Lapar, former Engineer to the Town, on this day. Mr. Versace explained that this action was in regard to vouchers submitted for monies Mr. Lapar feels the Town owes him in relation to two specific projects ---one on Wappinger Sewer Impzovement Area #1, a continuation of the existing sewer area which involved a sewer line in the Cedar Hill Area. This bid has not been awarded due to the fact that the original monies have been expended and additional bonding must be obtained. Mr. Lapar has received payment for the design of the project. The second item was for a storm drainage project, Phase III and IV which was awarded to Dave Alexander, Inc., but the work has not been started as yet. Mr. Lapar was also paid for the design of this project. MR. VERSACE moved to refer the Notice of Claim from Mr. Lapar to the Attorney to the Town for necessary action. Seconded by Mrs. Ballard Motion Unanimously Carried Mrs. Paino received the following letter from Alice Speedling, 4 Ardmore Drive, Town of Wappinger: February 17, 1984 Mrs. Irene Paino Mill St. Wappingers Falls, N.Y. 12590 Dear Irene, On the morming of Feb. 9, 1984, we began experiencing water backing -up from our septic tank into the kitchen sink and washing machine. Upon my digging up the septic tank cover and subsequent pumping of the tank we determined that the leach fields for our system were no longer working and corrective action would have to be taken as soon as possible. We were aware that town sewage was available because we pay the full benefit assessment for the Wappingers Water System and that we were also the only house in the development that had not been hooked up to the town sewage. Speaking to a couple of contractors, I was considering to do the work, it became obvious we would have to obtain a map of our property showing the sewer lateral location to prevent unnecessary excavation and possible damage to the mains. We then contacted the Building Inspectors office, the Town Highway Dept. and a representative of Camo Pollution and were informed by all these offices that the only maps available were in the possession of the past Town Eng. Mr. R. Lapar. When we contacted Mr. Lapar concerning our situation, he agreed to let us have a copy of the map showing our sewer lateral location for a fee of fifty dollars. We felt this was somewhat unreasonable but had no choice other than to pay Mr. Lapar for the map. We feel we should be entitled to a reimbursment of this fifty dollar fee from the Town of Wappingers in so much as these maps should be on file at the Town Hall as public records and available to any party needing similiar information. Attached is a copy of the receipt from Mr. Lapar and the map we obtained from him. Your help and concern in this matter has been greatly appreciated by us both. Thank you. Sincerely, s/ Wm. J. PAINO moved to authorize the Comptroller to reimburse Mrs. Speedling for the $50.00 fee charged by Mr. Lapar for a map of the sewer laterals relevant to her property. Seconded by Mrs. Ballard Motion Unanimously Carried MR. VERSACE moved to refer Mrs. Speedling's letter to the Attorney for his review and recommendation to the Town Board. Seconded by Mrs. Paino Motion Unanimously Carried Mr. Incoronato asked what happens if hundreds of other residents require maps for problems they might encounter relating to sewer lines or malfunctioning septic systems, etc., --- what are the Town's rights. Mr. Versace, responding to Mr. Incoronato's question relating to maps and as-builts in Mr. Lapar's possession, felt that the Town was entitled to these maps and informed the Board that the matter is presently in the hands of the Attorney who is working in con- junction with the Engineer to take the proper action to determine if the Town of Wappinger can recover what they feel belongs to them. Correspondence was received from I.B.M. in response to our letter to them regarding the traffic light on Myers Corners Road, east of Fenmore Drive operating on red and green signals at unscheduled hours. They had alerted the Electric Company and the necessary timing adjustments were made. This complaint was referred to them at the last meeting and Mr. Versace commented that I.B.M. was very cooperative in correcting the situation. MR. VERSACE moved to receive this correspondence and place it on file. Seconded by Mrs. Paino Motion Unanimously Carried Mr. Versace asked Mr. Croshier about the stop signs for Bel -Aire Lane and he replied that he would have a report for the next meeting. 7d - Mr. -Versace recognized Don McMillen, Wappinger County Legislator who had just arrived at the meeting and asked him if he wished to report on any County activities. Mr. McMillen mentioned that the Legislature was completely reorganized and they were now forming Committees. Mr. Incoronato asked him the status of the County Project on garbage to steam conversion -- he had not heard anything on it in over a month. Mr. McMillen reported that the County was in the process of negotiating for the sale of land and in some cases using condemnation procedures; all the court actions have been taken care of and the project should start by July of this year. The Legislature is urging the Commissioner of Solid Waste to set a guaranteed tipping fee. The intent is for the County as a whole to join in this project and eventually eliminate landfills. There was no other business to come before the Board. MR. VERSACE moved to adjourn the meeting, seconded by Mrs. Ballard and unanimously carried. The Meeting adjourned at 9:08 P.M. Reg.
