ADJOURNMENT I The Regular Meeting of the Town Board of the Town of Wappinger was held on November 14th, 1983, at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 8:00 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Gerard McCluskey, Councilman Bernice Mills, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: Jon Holden Adams, Attorney Rudolph Lapar, Engineer to the Town Kenneth Croshier, Highway Superintendent Mr. Diehl asked those present to stand for the Pledge of Allegiance to the American Flag. The Minutes of the Regular Meeting of October 12th, 1983 and the Special Meeting of October 24th, 1983, having previously been sent to all Board Members, were now placed before them for their considera- tion. onsidera- tion. MR. JOHNSON moved that the Minutes of the Regular Meeting of October 12th, 1983 and the Special Meeting of October 24th, 1983, be and they are hereby approved, as submitted by the Town Clerk. Seconded by Mrs. Mills Motion Unanimously Carried Reports were received from the Town Justices for October, Receiver of Taxes for September, Building Inspector/Zoning Administrator, October, Hydrant Report, October, Supervisor/Comptroller Report through September 30, 1983 and. the U. S. Cablevision Quarterly Report. MR. JOHNSON moved that the above reports be accepted and placed on file. Seconded by Mr. McCluskey Motion Unanimously Carried The following letter was received from Sheldon Kantor: October 18, 1983 Louis D. Diehl Town Supervisor Wappingers Falls, N.Y. Dear Sir - In reference to our discussion, concerning a sewer line from the Kendall Subdivision (James Klein, developer), to my property line. The town board has agreed, that I will have a sewer hook- up available to me at the Kendall Subdivision sewer line (Wappinger Sewer Improvement Area #1). I would like the following questions brought before the Town Board at the next meeting. 1. Who will install a sewer line from the Kendall Subdivision thru the woods (50 feet) and to my property line. 2. Who will pay for the sewer line from the Kendall Subdivision to my property line. Kantor 88 Ardmore Dr. Wappingers Falls, NY It was Mr. Diehl's understanding that the 50' parcel of property from the Kendell Subdivision to Mr. Kantor's property line is a Town easement and it would therefore be the responsibility of the Town to install the two sewer lines (Kantor and Menger) to their property line and the cost would be charged to the district. MR. DIEHL moved that the sewer district (Wappinger Sewer Improvement Area ##1) would be responsible for the installation of sewer lines from the Kendell Subdivision to the property lines of Kantor and Menger. Seconded by Mrs. Mills Motion Unanimously Carried A letter of resignation was received from Gladys Timbo, Clerk to the Assessor for the Town of Wappinger, effective November 28th, 1983. Mr. Diehl noted that Mrs. Timbo has been in her position in the Assessor's Office for approximately twenty years and has officially retired. MRS. MILLS moved to accept Mrs. Timbo's resignation with regret and best wishes for her retirement. Seconded by Mr. Johnson Motion Unanimously Carried 3 L A letter was received from Mr. & Mrs. Gerald Bell thanking the Town Board for their action on the Accessory Apartment Ordinance. You listened to us with great concern and compassion. You took upon yourself a very hard job, one we were told was almost impossible, and established an ordinance for an accessory apartment. We would like to express our gratitude and sincere thank you for all your time and effort to see this through. Seconded by Mr. McCluskey Motion Unanimously Carried The Town Board received a copy of the New York State Department of Transportation's response to Ernst Martin's letter of October 3rd, 1983, regarding the Route 9D Bridge Replacement and his concern that construction of this new bridge could cause flooding of his property. In this letter, Mr. Martin put both the NYSDOT and the Town of Wappinger on notice that he would hold them responsible for any and all damage that may result to property or personal injury. MR. MCCLUSKEY moved to refer the NYSDOT's response to Mr. Martin's letter of October 3rd, 1983 to the Attorney for review. Seconded by Mr. Johnson Motion Unanimously Carried 1,1111 Mill 11,1,111100111111111 11111111111 A letter was received from the Attorney enclosing for the Board's consideration, language to be incorporated in the recent local law passed governing the use of water within the town, to address what powers might be exercised in circumstances of emergency. Mr. Adams elaborated further and stated that he felt it would be desirable to have a formal authority on the part of the Town Board to take specific acts in emergency situations without the necessity of public hearings to impose conservation measures of certain descriptions to avoid undue use of water. MR. JOHNSON moved to authorize the Attorney to prepare the necessary addition to the Local Law Governing the Use of Water for the Board's consideration. Seconded by Mr. McCluskey Motion Unanimously Carried The following letter was received from C. Richard Deininger, 10 Orchard Drive, Town of Wappinger, regarding water problems in the Orchard Homes System of the Central Wappinger Water Improvement Area: October 19, 1983 Mr. Louis D. Diehl, Supervisor Town of Wappinger Mill Street Wappingers Falls, N.Y. 12590 Dear Mr. Diehl: The water problems with the Central Wappingers Water Improve- ment #1 District date back to 1976. We corresponded several times when the Orchard Homes development was connected to the system. Over the past eight years the system has had patch work growth which has resulted in a conglomeration of pieces. The increase in users has amplified the old problems. Those problems are not limited to Orchard Homes. People have told you of the issues involved many times over the years. As a reminder, let me describe what we see from a homeowner viewpoint. 1. No water comes out of tap at least once per week. 2. Low, low water pressure almost daily during summer and random during rest of year. Had problem just last Sunday morning. 3. Air in the water --continuously. 4. Dirt in water randomly. 5. Sudden water disappearance and then sudden blasting reappearance. 6. Water pressure sensitive appliances do not run or work poorly. 7. Destruction of water softener systems from the air blast through the systems. The higher your elevation, the more frequent and more intense the problems are. The point I am making is that the problems are long standing, continuous, and that the water emergency is not over for many people. It is my understanding that 663 additional home sites have been approved for connection to the system. I think it is time to assess where we are before we go any further. There are three fundamental inadequacies that need attention and correction. 1. There is insufficient reserve at a high enough elevation to supply the total system with con- sistent pressure. With the present users, the approved homes and businesses and the ultimate potential for users in the district, this issue needs immediate attention. 2. The distribution (water main) system is inadequate for homes at the end of the mains. During periods of high usage, the pipes are not big enough to supply sufficient volume to those at the end of the mains. Users closer to the sources use the water and none is left for people at the end. These pipes may have met all the state codes when they were installed, but they do not appear to be adequate for today's situation. Before we go connecting more users in a hodge podge way, this should be examined by qualified engineering people. Additional piping mains are most probably needed in a number of areas. 3. There appears to be a basic supply problem. There has been a lot of debate on this subject. In my opinion the pumping records of the system are excellent, but inadequate from which to draw complete conclusions. We need to know where that water shed gets its water. I believe we need to have additional water supply from another aquifer. It is time for the town to carefully examine where we are and put an affordable short and longer range program together. Just purchasing and connecting the Atlas System does not really address the three issues. It merely adds to the patch work. We must stop the patch work growth without a long range plan. I recommend that a committee of interested citizens be assembled to investigate and review this entire water system situation. The intent would be to make recommendations to the Town Board and to protect the interests of the taxpayers. We are not against growth. We are interested in sensible planned growth so that everyone is properly served. Very truly yours, s/ C. Richard Deininger MR. Seconded by Mrs. Mills Motion Unanimously Carried A letter was received from Mr. Spratt, Dutchess County Commissioner of Public Works regarding the enlargement of the Hunters Creed Crossing culvert in the Losee Road area of Myers Corners Road. It was his opinion that the Town's engineer, Mr. Lapar, and the County Engineer, Mr. Anagnos, sit down and reach some technical conclusion so that administrative decisions can be made. Mr. Lapar reported that a meeting took place on November 3, 1983 and maps of this area were given to Mr. Anagnos. The situation was discussed in detail, however, no decision was made by Mr. Anagnos at that meeting. He indicated to Mr. Lapar that he would review the matter and get back to him. They also discussed the drainage problem at Dogwood Hill Road and Myers Corners Road. Both agreed on the method of correcting the problem and Mr. Lapar noted that Mr. Anagnos was in the process of apportioning the cost of this project to the County and the Town. MR. JOHNSON moved that Mr. Lapar pursue these matters with Mr. Anagnos and a written record of the discussion on the culvert and the Dogwood Hill Road drainage problem be submitted by Mr. Lapar to the Town Board. Seconded by Mrs. Mills Motion Unanimously Carried Three Notices of Public Hearings were received ---two from the Town of Wappinger Planning Board and one from the Town of Fishkill. Mrs. Snowden noted that two of these Hearings had already been held but she wanted it on the record that they had been received by the Town Board. MR. JOHNSON moved to receive the three Notices of Public Hearings and place them on file. Seconded by Mrs. Mills Motion Unanimously Carried A request was received from the Planning Board to consider waiving Downstream Drainage fees for the Shelburne Hills Subdivi- sion (Total of 12 lots off Myers Corners Road). A discussion followed when Mr. Versace asked Mr. Lapar if the trade-off would be beneficial to the Town. Although a culvert had to be replaced under Myers Corners Road by the developer, at n a cost which would be in excess of the drainage fees, it was determined that this work was required under the drainage plan and would have to be done irregardless of whether the fees were waived or not. MR. JOHNSON moved to deny the request of Shelburne Hills Subdivi- sion to waive the Downstream Drainage Fees. Seconded by Mrs. Mills Motion Unanimously Carried A letter was received from the Attorney requesting the Board to consider the renewal of the Justice Court lease. He explained in his letter that the term of the lease expires on February 28, 1984 but the Board can elect to renew the lease for a one year term at the same rent provided the landlord is notified by December 1, 1983. The Town also has the right under this lease to terminate or shorten the term upon ninety days notice. MR. JOHNSON moved to authorize the Attorney to prepare the renewal lease for the Justice Court and authorize the Supervisor to sign the lease. Seconded by Mrs. Mills Motion Unanimously Carried The Town Board received a copy of a letter written to the Planning Board by William Speedling regarding the closing of Ardmore Drive onto Old Hopewell Road. Mr. Johnson noted that this section of the road would remain open since the Town Board declined to take action at the last meeting when the matter was referred to them by the Planning Board. MR. JOHNSON moved to receive Mr. Speedling's letter and place it on file. Seconded by Mrs. Mills Motion Unanimously Carried The Town Board received a letter of thanks from the Dutchess County Association for Senior Citizens for providing additional monies for their Arth and Crafts Program at the Wappinger Center. The Town Board had approved the amount of $1,500.00 from Federal Revenue Sharing Funds in the 1984 Budget for this Program. MR. MCCLUSKEY moved to receive this letter and place it on file. Seconded by Mr. Johnson Motion Unanimously Carried A request was received from the New Hackensack Fire District for the use of two of the Town's voting machines for their annual election on December 13th, 1983. MR. MCCLUSKEY moved to grant permission to the New Hackensack Fire District for the use of two of the Town's voting machines on December 13th, 1983. Seconded by Mr. Johnson Motion Unanimously Carried Under Committee Reports, Mr. Johnson reported that he had received several requests from residents concerning drainage. He questioned the Attorney on the possibility of forming drainage districts and could it be done on a selective basis. Mr. Adams explained that a drainage district could be formed by petition similiar to any other improvement district. The petition should outline the area that would be the subject of such a district so the Town Board would have an idea geographically as to the dimension of the proposed district and the percentage of residents in that area required to sign the petition. Mr. Johnson requested the Attorney to direct a letter to Nelson Gonzalez, 87 Edgehill Drive, Town of Wappinger, and outline the procedure to follow for the formation of a drainage district. Mr. Johnson noted that at least one of the election districtSin the Town (District 3 in Ward 4) has an extremely large number of registered voters and recommended that this district and any others that appear to be overly large, be split appropriately. Since this alteration must be accomplished by January 5, 1984, he recommended immediate action. MR. JOHNSON moved that the Town Clerk, as their representative, work together with the Town Committee Chairmen in an effort to establish a non partisan committee to accomplish the division of these districts. Seconded by Mrs. Mills Motion Unanimously Carried 1 The following proposed Local Law Amending Local Law #1 of 1983 Providing for Credits to Customers Within the Wildwood Sewer District was introduced by COUNCILWOMAN MILLS: WHEREAS, there continues to exist within the Wildwood Sewer District sufficient assets to meet the operating budget of said district for 1984, and WHEREAS, for purposes of administration, the billing period should conform to a calendar year, BE IT ENACTED by the Town Board of the Town of Wappinger as follows: ONE: The credits to be applied to owners of single-family residential homes within the Wildwood Sewer District as set forth in Local Law No. 1 of 1983 shall be continued for each month of 1984. TWO: The quarterly billing cycle of said district shall, upon adoption of this local law, be a calendar year cycle, with the last day of March, June, September and December being the last day of each billing cycle. THREE: This local law shall take effect upon filing of the same with the Secretary of State. The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 14th day of November, 1983, a proposed Local Law Amending Local Law No. 1 of 1983 providing for credits to customers within the Wildwood Sewer District, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 12th day of December, 1983 at 7:55 P.M. EST, on such day at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilman Johnson Roll Call Vote: 5 Ayes 0 Nays Mr. Versace requested the Comptroller to provide the Board with the present amount of surplus funds in the Wildwood Sewer District and the amount of money that will be deleted from these funds to allow credit to the customers of the district. He added that he would like to have this information for the public hearing. )o Mrs. Mills mentioned to the Attorney that she had requested an amendment to the Local Law on Sewer to conform it with the Local Law on Water regarding the homeowner's and the district's respon- sibility. Mr. Adams replied that he had given a draft of this amendment to Mr. Gunderud and Mr. Lapar which he would submit to the Board when he received comments from Mr. Gunderud and Mr. Lapar. As a point of information, Mrs. Mills reported that she had been informed by Mr. Lapar that it would cost about one and a half million dollars to install a water tank on Cedar Hill with a six million gallon capacity. A resolution on a proposed stipulation providing for the payments due to the City of New York was forwarded to the Town Board by the Attorney for their consideration. Mr. Adams explained in his cover letter that under the terms of the stipulation, the town is to pay $317,905.61 in nineteen quarterly payments commencing January 1, 1985. Mr. Versace asked if any allowance had been made in the 1984 Budget to start the repayment of this obligation since the first payment was due in January of 1985 Mr. Diehl responded that no monies had been allowed in the 1984 Budget for this item. Mr. Versace then asked the Attorney if Federal Revenue Funds could be applied for this repayment and Mr. Adams responded that he would have to research this matter. Mr. Johnson commented that the stipulation itself was a fair offer of repayment, however, on the subject of the Matter of the City of New York vs. Wappinger, he expressed his opinion that it "stinks". The Town, he continued, was bamboozled due to the fact that the City of New York had more Justices than Dutchess County on the Court of Appeals and the decision was in their favor. MR. DIEHL moved to table action on this matter for further review by the Attorney. Seconded by Mr. Versace Motion Unanimously Carried The bonding resolution for the Central Wappinger Water Improvement Area Extension Contract was again placed before the Board for their I J consideration. The Attorney recommended that no action be taken since the resolution required for application to Audit and Control had not been received from the bonding counsel. MR. MCCLUSKEY moved that this matter be tabled to the next meeting. Seconded by Mr. Johnson Motion Unanimously Carried Mr. Johnson asked that Item 7c (Adoption of 1984 Budget) be tabled until the end of the meeting. The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: WHEREAS, the Town Board wishes to provide direction for the Assessor in the preparation of the benefit assessment roll for special districts within the town insofar as said assessments reflect multiple residence dwellings, and WHEREAS, the Town Board wishes to provide for one unit of assessment for the purpose of benefit assessments for each residential unit within a multiple residential structure, NOW, THEREFORE BE IT RESOLVED that the Town Assessor in the preparation of the 1985 and subsequent assessment rolls for special districts or improvement areas within which there are multiple residence of one unit, the same being the same benefit assessment unit imposed upon single family residential dwellings, and BE IT FURTHER RESOLVED that a multiple residence be deemed to be any residence or structure whether residential or commercial, which has within the structure multiple separate units used for residential or commercial purposes. Seconded by: Councilman McCluskey Roll Call Vote: 5 Ayes 0 Nays Public Hearings having been duly held on November 14th, 1983, on the Benefit Assessment Rolls for the Fleetwood Water District, Oakwood Knolls Water District, Central Wappinger Improvement Area, Ardmore Water Improvement Area, Tall Trees Water Improvement Area, Mid -Point Sewer District, Wappinger Sewer Improvement Area #1, Fleetwood Sewer District, Wildwood Sewer District and Watch Hill Sewer District, the matter was now placed before the Board for their consideration. The following resolution was introduced by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, the Town Assessor did prepare at the direction of the Town Board, the Assessment Rolls for the Fleetwood Water District, for the assessment to be levied in 1984, and WHEREAS, said Assessment Roll was filed with the Town Clerk of the Town of Wappinger, and WHEREAS, she thereafter gave notice by posting upon the bulletin board of the Town and in the newspaper published within the Town of the time and place when the Town Board would conduct a hearing and hear objections upon or to said roll, and WHEREAS, the Town Board of the Town of Wappinger did meet the 14th day of November, 1983, to consider and hear objections of said roll, NOW, THEREFORE, BE IT RESOLVED, that the Assessment Roll of 1983 for the Fleetwood Water District for taxes to be collected in 1984, be approved, ratified and confirmed and adopted, and the Supervisor and Town Clerk are hereby authorized and directed to execute the warrant for collection of said taxes in the manner prescribed by Law. Seconded by: Councilman McCluskey Roll Call Vote: 5 Ayes 0 Nays An Agreement between the County of Dutchess and the Town of Wappinger for the Urban County Program, Sub -Grant Agreement was forwarded to the Supervisor for his signature in order to receive the grant from the Consortium funds. MR. MCCLUSKEY moved to authorize the Supervisor to sign the Agreement with the County for the Urban County Program. Seconded by Mr. Johnson Motion Unanimously Carried Mr. Lapar had discussed Phase No. 3 and 4 of the Drainage Study with the Town Board at a previous work shop session and was now ready to go to bid on this project. MRS. MILLS moved to authorize Mr. Lapar to prepare specs and go to bid on Drainage Projects Phase No. 3 and No. 4. Seconded by Mr. Versace Motion Unanimously Carried The project was explained by Mr. Lapar at the request of Mr. Versace; it included 5 areas ---drainage problems at Tor Road and Rich Drive, Maloney Road near the Town of LaGrange; problems with culverts at Ketchamtown Road, one near Fleetwood and the other farther west and one at DeGarmo Hills Road. The next item on the agenda for the Board's consideration was to authorize the Engineer to go to bid on the Control Building for Central Wappinger Water Improvement Area. Mr. Versace commented that he did not recall any discussion on this matter and asked Mr. Lapar to explain what it involved. Mr. Lapar explained that the project started in 1979 to fulfill requirements of the Dutchess County Health Department and the Department of Environmental Conservation to alleviate problems within the water district, specifically pertaining to vandalism, disinfection of the system and possible power failure. It would also give a year round record of the depth of water in every well (5 existing wells and 6 testing wells) which would provide a complete aquifer profile at all times. Mr. Versace objected to taking action on this project before the Board discussed it further; they were aware of the improvements needed in CWWIA and the items mentioned by Mr. Lapar would not necessarily eliminate the water shortage in CWWIA. MR. VERSACE moved to remove Item 7g from the Agenda ( Authorize the Engineer to go to bid on the Control Building for CWWIA). Seconded by Mr. Johnson Motion Unanimously Carried MR. MCCLUSKEY moved to refer Item 7g to the Water and Sewer Committee for review. Seconded by Mr. Johnson Motion Unanimously Carried Since no action was taken at the last meeting on Bids for the Refurbishment of the Recreation Barn on Montfort Road, the matter was again placed before the Board for their consideration. MR. DIEHL moved that no action be taken on this bid tonight and the matter be referred to the Recreation Committee for further review with the Recreation Commission. Seconded by Mr. McCluskey Motion Unanimously Carried MR. JOHNSON moved that a letter be directed to the Recreation Commission requesting clarification of their unsigned letter of 12 recommendation on bid (submitted at October 12th, 1983 Town Board meeting), information on program planned for this building including total cost and the approximate total cost of replacement of present structure. Seconded by Mr. McCluskey Motion Unanimously Carried The bid on the contract for the purchase of remote reading water meters had been awarded at the April llth, 1983 meeting to the firm of Rockwell International Corp. and the contract required the Supervisor's signature. MRS. MILLS moved to authorize the Supervisor to sign the contract with Rockwell International Corp. for the purchase of remote reading water meters. Seconded by Mr. Johnson Roll Call Vote: 4 Ayes Mr. Versace ---Nay Before the vote was taken Mr. Versace expressed concern that monies to cover both the purchase and installation of the water meters would not be sufficient and no action should be taken on this matter until the CWWIA budget was reviewed by the Board. During the discussion that followed, Mrs. Milts stated that there were sufficient funds in the CWWIA budget to cover these contracts, however that did not include any other work that had to be done in that district. Her motion was to have the contract signed for the meters and any other budgetary items would have to be reviewed. A Public Hearing having been held by the Town Board on the 1984 Preliminary Budget and Federal Revenue Sharing Budget on November 9th, 1983, the matter was now placed before them for their consid- eration. Seconded by Mrs. Mills Roll Call Vote: 4 Ayes Mr. Versace --- Nay Mr. Versace asked Mr. Adams if some of the items could be replaced in the budget or would the new Town Board have to live with this budget as adopted. Mr. Adams replied that he would have to review each item since some could be changed but others could not be touched. It appeared to Mr. Versace that they would have to live with this budget. He further commented that in any election year somebody wins and somebody loses and it was unfortunate that the Republican majority present this evening had actually totally destroyed the budget. The elimination of the position of Comptroller was probably intended as a punishment to him since he was responsible for handling the finances of the Town. Even with all of these cuts, the new administration will still work for the benefit of the Town; they will do a good job and will work under the handicap that was imposed on them by the outgoing Republican administration. If they had won, there wouldn't have been one item changed. The new Board will be boxed in. Unfortunately, the Democratic administration will have to make some cuts to handle the finances of the Town and an indepth study will have to be done on the services provided by the Town. Mary Schmalz was recognized by the Chair and quoted from Article 8, Section 1 of the State Constitution which prohibited municipalities providing monies to private organizations. She referred to the Town providing funds to the Little League Association under the "A" fund which included the Village portion of the Town even though the youth of the Village were excluded from this activity. She stated that the 'Town Board had put money in the budget which was against the law. Mr. Versace added further comments on the adoption of the budget with no increase in the water and sewer districts. Thanks to the courtesy of the outgoing Republican Board, the improvements recom- mended for CWWIA would have to be eliminated and he anticipated many problems in that district throughout the next year. He did not feel that there was that kind of hardship in losing an election, or that any one person was entitled to hold a position for the rest of his life or until he decided to retire. It was the wishes of the residents of this Town to elect a majority of new Town Board members and the handicap that was imposed on the new Board is about the lowest action he's seen in politics in many years. Michael Hirkala was recognized by the Chair and stated that he had been attending Town Board meetings for many years; there were lots of actions he agreed with and others that he disagreed with. In all these years he's been a registered Republican and tried to keep an open mind as best he could. This action by the four Republican Town Board members is totally vindictive, petty and small and it reflects the fact that his middle of the road thoughts over the years have been wrong. Perhaps the voters of the Town sensed it was time to take action and God bless the fact that they did. The voters and citizens of the Town come first, not the person or the party and their action to benefit their particular ego has hurt the people of the Town. If any of the present Board decided to run again he hoped this action would be remembered and it would be blasted all over the front page. There was no other business to come before the Board. MR.
