1983-09-06 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on September 6th, 1983, at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 4:03 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson,. Councilman Bernice Mills, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Absent: Gerard McCluskey, Councilman Others Present: Jon Holden Adams, Attorney Notice of this meeting was sent to all Board Members on September 1st, 1983, calling said meeting for September 6th, 1983 at 4:00 P.M. Notices were also sent to the three newspapers and three radio stations on September 1st, 1983 and posted on the Town Clerk's Bulletin Board. This meeting was calledfor the purpose of considering an amend- ment to the Resolution previously adopted by the Town Board relating to apartment rentals by Senior Citizens living in apartment applying for Condominium. Status, and any other business that may properly come before the Board. The following Resolution was offered by SUPERVISOR DIEHL who moved its adoption: WHEREAS, on August 25, 1983, the Town Board of the Town of Wappinger by resolution adopted Chapter 771 of the Laws of 1983, and WHEREAS, the Town Board now wishes to amend the same, NOW, THEREFORE, BE IT RESOLVED that the provisions of Chapter 771 of the Laws of 1983 be made applicable to eligible senior citizens and eligible disabled persons within the Town of Wappinger as those terms are defined by said Chapter 771, and BE IT FURTHER RESOLVED that any non -purchasing tenant who is either an eligible; senior citizen; or .an eligible disabled person as defined by Chapter 771 of the Laws of 1983 who is an occupant of a building or structure for which conversion is sought from residential rental status to cooperative or condominium ownership shall not, either prior to orlsubsequent to said conversion, be subject to removal from units occupied by them prior,to said coinveraion,uniesa.a proceedipg is com- menced against said tenant for either (1) non-payment of rent, 2 (2) illegal use or occupancy of the premises, or (3) refusal of reasonable access to the owner, and BE IT FURTHER RESOLVED that no rental increases shall be imposed upon said eligible senior citizens and said eligible disabled person other than to the extent permitted by Chapter 771, and BE IT FURTHER RESOLVED that the -provisions of said Chapter 771 shall be limited in its application within the town to the extent set forth by said law, and BE IT FURTHER RESOLVED that the provisions of the resolution adopted by the Town Board on August 25, 1983, to the extent inconsistent with this Resolution, be deemed to be repealed and rescinded, and BE IT FURTHER RESOLVED that the Town Clerk shall forthwith file a certified copy of this resolution with the Attorney General. Seconded by: Councilman Versace Roll Call Vote: 4 Ayes 0 Nays Prior to the adoption of the resolution, Mr. Diehl requested that the rental increase of the senior citizens and disabled persons not exceed 5%. Mr. Adams explained that he was advised by a representative of the Attorney General's office that the Town does not have the option of adopting their own version of the law, it must be adopted under the provisions of Chapter 771. Mr. Adams had been requested by the Board to negotiate a settle- ment with Herman Osten regarding the acquisition of an easement through his property necessary for the water and sewer extension contract in the Cedar Hill Area. He recommended that the Board consider an offer of $6,900 which Mr. Osten's attorney had indicated would be acceptable to his client. MR. DIEHL moved to authorize the Attorney to negotiate an amount up to $6,900 for an easement through the property of Herman Osten which is essential to the water and swwer extension contract in the Cedar Hill area. Seconded by Mr. Johnson Motion Unanimously Carried A memo was received from the Comptroller requesting permission for Ann Buckley and Melva Laffin to attend a Training Schocll at Grossingers from September 27th through September 30th, 1983. Since Mrs. Laffin had been to a prior conference this year, the Board agreed, after discussion, that they would consider a devia- tion from the Town Policy and allow her to attend the School. The Comptroller was requested to provide additional information on the programs offered, which could warrant such action. MR. JOHNSON moved that Ann Buckley be granted permission the Training School at Grossingers from September 27th through the 30th, 1983, at Town expense, and Mrs. Laffin be allowed to attend on a daily basis for which the Town would pay her transportation and one meal. Seconded by Mr. Diehl Motion Unanimously Carried There was no other business to come before the Board. MR. VERSACE moved to close the Special Meeting, seconded by Mr. Johnson and unanimously carried.
