1982-07-26 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on July 26,. 1982, at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 7:16 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Gerard McCluskey, Councilman Bernice Mills, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: Kenneth Croshier, Acting Highway Superintendent This meeting was set at the regular meeting of the Town Board held July 12, 1982, for the purpose of releasing the escrow money of the Pondview Subdivision developer being held by the Town until the work was completed and other business that might come before the Board. Mr. Diehl brought up a request received from Mrs. Crosby to attend a conference for Receiver of Taxes,sponsored by the Association of Towns at Cornell University since an invitation to conduct a class at the conference had been extended to her. They had done this for several years and Mrs. Crosby said she would attend if it was the desire of the Board but she had already attended the Town meeting held in New York last February. MRS. MILLS moved that the request made by ,Mrs. Crosby to attend the Association of Towns meeting, be denied. Seconded by Mr. Versace Roll Call Vote: 3 Ayes Mr. Johnson ---Nay, Mr. McCluskey ---Abstained Mr. Croshier was then questioned on the status of the work at Pondview and he recommended that the escrow money be released since the work had been completed. Mrs. Mills brought up the fact that there was a pile of debris left and it was unsightly; she wanted to know who left it there and why it wasn't cleaned up. It was determined that most of, it belonged to the new owners of the second section of Pondview and it should be brought to the attention of the Zoning Administrator. MR. DIEHL moved that the Zoning Administrator be instructed to immediately cite the person responsible for the violation described by Mrs. Mills at the Pondview Subdivision. Seconded by Mr. McCluskey Motion Unanimously Carried Discussion then followed on the amount of the total escrow held by the Town which was determined to be $16,450.00 and the bills that were ow-ed„(by the developer. It was agreed that Wilson Excavator should be paid their snow plowing bill in the amount of $517.00 and the balance of the escrow money would be released to the road contractor. MR. MCCLUSNEY moved that upon the recommendation of the Highway Superintendent the escrow money of Pondview Subdivision Developer in the amount of $16,450.00 be released as follows: $15,933.00 be paid to AAA Paving Company and $517.00 be paid to Wilson Excavators, Inc., with consent of Fairview Enterprises (developer of Pondview Subdivision). Seconded by Mr. Johnson Roll Call Vote: 4 Ayes Mrs. Mills ---Nay Mrs. Mills stated for the record that she was voting against the motion due to the fact that the debris was left around the road. Mr. Hanig requested that copies of these checks be sent to him after their release. The following proposed Local Law was introduced by COUNCILMAN JOHNSON: BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. It shall be deemedunlawful for the operator of any motor vehicle to permit his motor vehicle to be driven to the left side of the center of the roadway in overtaking and passing another vehicle proceeding in the same direction when official markings are in place indicating those portions of any town highway where overtaking and passing or driving to the left of such markings are prohibited, such marking being a double line. No driver of a vehicle proceeding along such town highway shall at any time drive on the left side of such markings. Section 2. The foregoing limita tion shall not apply to the driver of a vehicle turning left when entering or leaving such highway Where a left turn is permitted. Section 3. Any violation of this local law shall be deemed a traffic infraction and theoperator of said vehicle shall be subject to a fine for such infraction not exceeding $25.00. Section 4. This local law shall take effect upon with the Secretary of State as provided by law. filing The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 26th day of July, 1982, a proposed local law pzoviding for application of pavement markings on town highways, WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 9th day of August, 1982 at 7:45 P.M. EDT on such day at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger by due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilman McCluskey Roll Call Vote: 5 Ayes 0 Nays The following proposed Local Law was introduced by COUNCILMAN JOHNSON: BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1: It shall be unlawful for any motor vehicle to park or stand in that area designated and marked as a "no parking" area at the Chelsea Boat Ramp, said no parking area to extend on the east side of Front Street between the boat ramp at its easterly side and the intersection of Front Street with Bank Street. Section 2: A violation of this local law shall be subject to a fine no greater than $25.00. The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 26th day of July, 1982, a proposed local law which would prohibit parking in the area of the Chelsea Boat Ramp, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 9th day of August, 1982 at 7:40 P.M. EDT on such day at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing sahll be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilman McCluskey Roll Call Vote: 5 Ayes 0 Nays The Town Clerk presented the Report of Examination from the New York State Department of Audit and Control to the Town Board. MR. MCCLUSKEY moved to accept the Report of Examination presented from the Town Clerk. Seconded by Mr. Johnson Motion Unanimously Carried The Board requested the Supervisor to set up a meeting with the Town CPA, the firm of Pellegrini and Sedore to review this report with them. Mr. Johnson reported that he had received complaints from residents of large aircraft, such as 727's and B17's at the Dutchess County airport and he did not feel that the facilities at the airport were intended to handle planes of this size except under emergencies, and suggested that they contact the County for information on their policy in this matter. MR. JOHNSON moved that the Town Board voice their objections to the County Executive and the Commissioner of Aviations for the use of Dutchess County Airport for planes the size of the 727's and B17's except under emergency Seconded by Mr. McCluskey conditions. Motion Unanimously Carried Mr. Versace brought up the subject of clean-up around the Kent Road recreation pond area which he had previously discussed with the Recreation Commission Chairman. It had been mowed by the maintenance men, however, Mr. Versace felt that a small dozer would do a good job in grading that area and clearing it of all debris. This brought up a question on the boundary lines around the pond and it was agreed that this factor should first be determined before taking any action for a thorough clean-up. MR. MCCLUSKEY moved that the Engineer research the property to determine the boundary lines and any existing rights of way Seconded by Mr. Diehl Motion Unanimously Carried MR.
