1982-04-26 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on April 26th, 1982 at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 7:20 P.M. Present: Louis Diehl, Supervisor Gerard McCluskey, Councilman Bernice Mills, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Absent: Nicholas Johnson, Councilman Notice of said meeting had been sent to all Board Members on April 22, 1982, calling the meeting for April 26th, 1982 at 7:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Notices were also sent to the three newspapers and four radio stations and posted on the Town Clerk's Bulletin Board. The purpose of the meeting was to review action to be taken with respect to submitting an application to DEC for water distribution in Cranberry Water Improvement District, and initiating steps for renegotiating the Cablevision agreement. The Attorney had forwarded a resolution to the Town Board for their consideration in the matter of the Cranberry Hills Water Improvement Area. The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: WHEREAS, upon the request of the Supervisor of the Town of Wappinger, a special meeting of the Town Board has been duly convened after appropriate notice toeach board member and compliance with the Open Meetings Law, and WHEREAS, the office of the attorney to the town has recommended that the town submit to the Department of Environmental Conservation an application for the purpose of obtaining permission for distribution only of water within the Cranberry Hills Water Improvement Area, said recommendation being made after discussions between him and representatives of the Attorney General of the State of New York, NOW, BE IT RESOLVED that the attorney to the town and/or the engineer to the town be and is authorized to make such application as is necessary to the Department of Environmental Conservation for the sole purpose of obtaining rights of the Cranberry Hills Water Improvement Area to distribute water within the confines of that district. Seconded by: Councilman McCluskey Roll Call Vote: 4 Ayes 0 Nays Before the vote was taken, there was discussion on the resolution. Mrs. Mills was confused as to what they were actually acting on and Mr. Diehl admitted that he, too, was confused when he read it and had called the Attorney for clarification. It had been formerly stated at public hearings and meetings that the Town has the right to distribute water within the Cranberry Area, however, it has never been established by Town Board resolution and that was the purpose of this resolution. It could still mean that Atlas Water Company would provide the water, but the Town would distribute the lines and the water within the district. Mr. Adams stated in his letter to the Board that submission of litigation by all parties involved including Atlas Water Company have been deferred, but he recommended that the Board pass this resolution to authorize submission of an application for this distribution. The Cranberry Hills Water Improvement Area has already been established by the Town Board; this was a different matter. The vote was then taken. in the matter of the renewal of the Cablevision Franchise by U. S. Cablevision Co., there were questions and problems related to this renewal, and Mr. Adams recommended that the Town designate a negotiating team and set a date for its firtt meeting with a further recommendation of proceeding promptly in this matter. Mr. Cortellino, Chairman of the CATV Committee, could not be present at the meeting, but had contacted Mrs. Snowden with his recommendations. Three members of the CATV Committee were named -- Charles Cortellino, Dr. Robert Ballard and William Hald, two members from the Town Board (Mrs. Mills and Mr. Versace volunteered to serve on this team) and Jon Holden Adams as the Attorney. The Board felt that Mr. Cortellino should chair this team. MR. DIEHL moved that the following persons be appointed to the Negotiating Team for renewal of the Cablevision Franchise with U. S. Cablevision Company: Charles Cortellino, Chairman, Dr. Robert Ballard, William Hald, Bernice Mills, Frank Versace and Attorney Jon Holden Adams, and the first meeting be set for 46, May 17, 1982 at 7:30 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York, Seconded by Mr. McCluskey and the members be so notified. Motion Unanimously Carried Mr. McCluskey then brought up a letter from Mr. Adams stating that the application for renewal of the franchise from the cable company was unacceptable in the form it was submitted. MR. MCCLUSKEY moved that the Town Clerk inform Mr. Adams to notify the cable company that their application for renewal of the cable franchise was faulty and not acceptable as per the law. Seconded by Mr. Diehl Motion Unanimously Carried Mr. McCluskey brought up a matter concerning a request from Mrs. Emmet on Middlebush Road for consideration by the Board of her leasing or buying Town property on that road from one to five acres; he did not have all the particulars in his possesion but said he would mention it at the special meeting. He would contact her and ask for a letter to the Town Board giving complete information and Mr. Diehl said they would address it at the next regular meeting of the Board. MRS. MILLS moved to close the Special Meeting, seconded by Mr. McCluskey and unanimously carried. The meeting closed at 7:35 P.M. Spl. Mtg. 4/26/82 Elaine H. A Public Hearing was held by the Town Board of the Town of Wappinger on April 26, 1982 at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York on an Ordinance Amending the Ordinance Regulating Peddling and Hawking, to increase the annual permit fee from $35.00 to $150.00. Supervisor Diehl opened the Hearing at 6:55 P.M. Present: Louis Diehl, Supervisor Gerard McCluskey, Councilman Bernice Mills, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. These Affidavits are attached hereto and made part thereof of the minutes of this Hearing. Supervisor Diehl asked for comments from the public. Gary Ferrero, Cameli Drive, does ice cream vending through the streets of Wappinger, Beacon and Poughkeepsie felt that if this Town raised the fee to $150.00, the neighboring towns would do it also, there will be no way to hold it down and he would be out of business. The Beacon fee is $25.00, the same in Poughkeepsie. Since he lives in the Village he is exempt from fees. Does not mind paying as long as it is reasonable. When asked why he felt it was unreasonable, he replied that his work was seasonal. He mentioned the expenses he had doing this business. Mrs. Mills brought up the fact that there are business people paying rent and taxes and trying to survive. Their complaints prompted this action away. Mr. McCluskey added his comments since the trucks were taking their business itemizing the expenses that business people have and they have no choice in the matter. The Town has to give them some protection. Mr. Versace pointed out that the Town was notitrying to put the vendors out of business but some of them had caused friction with the local business people and were not observing the require- ment that they move their trucks every half hour and this was one of the reasons this action of increasing the fee had been initiated. Mr. Ferrero felt the raise was exhorbitant and should be increased maybe another $10.00. He couldn't understand what the money had to do with it since if you wanted to stay in business you would pay it. Mrs. Mills moved to close the Public Hearing, seconded by Mr. McCluskey•and unanimously carried. The Hearing closed at 7:17 P.M. Elaine H.
