1981-12-30 RGMA Year End Meeting was held by the Town Board of the Town of Wappinger on December 30, 1981 at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 4:08 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Absent: Janet Reilly, Councilwoman This meeting had been set at the regular meeting of the Town Board held December 14, 1981 and Mx. Diehl explained that the meeting was for the purpose of closing out the books for the year and making the necessary transfers. The Comptroller was present to explain and answer whatever questions the Board had. There were several transfers from the water and sewer districts to the Comptroller's account and he explained that this was the salary of the clerk for the water and sewer billing and should be charged to the districts, not his account:next year it would be coded in the computor as a charge to the districts. Mr. Cuatt then explained some of the transfersand encumbrances which were questioned by the Board. MR. Board Members and News Media were duly notified and notification placed on the Town Clerk's Bulletin Board. The following segment of the Town Board meeting complies with this notice of a Special Meeting). Two proposed Consent Orders were received from Rosen Crane and Wolfson for consideration by the Town Board ---One from WVC Realty Corp and one from DWS NY Holding, Inc. on the Cranberry Hills Subdivision Assessment. Mr. Logan was present to explain to the Board how this Order would affect the Town and School Taxes; the assessment was reduced by one-half, from $330,000.00 to $165,000.00 which would reduce the Town Tax by $3,300.00 and the School Tax by $15,000.00. He noted that the School does not share the cost of the legal fee for this suit. The Sewer Benefit Assessment would not be changed since this is set by the Town Board. The Board had questions on the Assessment Roll and the Tax Roll that this would affect and a lengthy discussion followed. The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: BE IT RESOLVED, that Rosen Crane and Wolfson is hereby directed to execute a Consent Judgment settling the WVC Realty Corp. against the Town of Wappinger tax certiorari, a copy of which is attached hereto and made part hereof, and that Rosen Crane and Wolfson is authorized and directed to settle the above captioned proceeding pursuant to the terms of said judgment. Seconded by: Councilman Johnson Roll Call Vote: 4 Ayes 0 Nays The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: BE IT RESOLVED, that Rosen Crane and Wolfson is hereby directed to execute a Consent -Judgment settling the DWS NY Holdings, Inc. against the Town of Wappinger tax certiorari, a copy of which is attached hereto and made part hereof, and that Rosen Crane and Wolfson is authorized and directed to settle the above captioned proceeding pursuant to the terms of said judgment. Seconded by: Councilman Johnson Roll Call Vote: 4 Ayes 0 Nays Mr. Johnson requested that the Comptroller be notified that there would be a deficit of $3,300 in the Town Tax appropriation due to this settlement and recommended that he research the budget to make up this deficit. A Public Hearing had been held on December 14, 1981 on a rezoning application from Cornell and Drake for a change from Residential to Planned Industry; the Hearing was recessed to January 6, 1982 for additional information on what was planned for the site. A letter was received from Michael Cornell withdrawing the application for PI and submitting another request for a change to OR -10A (Office Research - ten acres). MR. DIEHL moved that the recessed Public Hearing scheduled for January 6th, 1982 be cancelled, due to the fact that Cornell & Drake had withdrawn their request for rezoning their property to Planned Industry. Seconded by Mr. Johnson Roll Call Vote: 4 Ayes 0 Nays MR. DIEHL moved that the rezoning request of Cornell & Drake for OR be referred to the Zoning Committee for review and recommendation to the full Board. Seconded by Mr. Johnson Roll Call Vote: 3 Ayes Mr. Versace ---Nay Mr. Versace, explaining his Nay vote, stated that the proper procedure would be for the applicants to come before the Board at a regular meeting and submit a definite plan; as it stood now, there was nothing for the Zoning Committee to review. G A discussion followed between Mr. Logan and the Town Board regarding litigation pending with Back Construction Company. MR. DIEHL moved that Mr. Logan be authorized to discuss with Wappinger Central School Officials-, the opinion of the Town Board that the School share 2/3 of the legal expense incurred in defense of the suit brought against the Town of Wappinger by Brack Construction Company, as recommended in Mr. Logan's letter to the Town Board. Seconded by Mr. Johnson Roll Call Vote: 4 Ayes 0 Nays li/ MR. JOHNSON moved to close the meeting, seconded by Mrs. Mills and carried. The Meeting closed at 4:45 P.M.
