1981-11-30 SPMA Special Meeting was held by the Town Board of the Town of Wappinger on November 30, 1981 at Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 6:50 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: Jon Holden Adams, Attorney, Notices of this meeting were sent to each Board Member on November 25, 1981, calling said meeting for November 30, 1981 at 6:45 P.M. Notices were also sant to the three newspapers and four radio stations and also posted on the Town Clerk's Bulletin Board. The following proposed Local Law was introduced by SUPERVISOR DIEHL: A LOCAL LAW # OF 1981 AMENDING LOCAL LAW #8 OF 1980 RELATING TO OFETESES,RTHONPTIION WATER CONSUMPTION AND USE OF WATER FOR THE FLEETWOOD WATER DISTRICT AS WELL AS THE PENALTIES AND ENFORCEMENT THEREOF. BE IT ENACTED by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1; Section 1B of Local Law #8 of 1980 is hereby amended as follows: Section 2: The owner shall be obligated to pay the minimum charge of Thirteen and 68/100 Dollars ($13.68) per each quarter, regardless of the consumption of water for said quarter, provided said owner is connected to the system at any time during the quarter. In addition to the foregoing, there shall be the following charges: Number of Gallons Rate Per Thousand Gallons In excess of 14,143/quarter $.967262/1,000 Section 3; This local law shall take effect January 1, 1982. The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 30th day of November, 1981, a proposed Local Law Amending Local Law ##8 of 1980 relating to the imposition, charge and collection of water rates for the consumption and use of water for the Fleetwood Water District as well as the penalties and enforcement thereof, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the llth day of December, 1981 at 7:00 P.M. EST on such day at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilwoman Mills Roll Call Vote: 5 Ayes 0 Nays The following proposed Local Law was introduced by SUPERVISOR DIEHL: A LOCAL LAW # OF 1981 AMENDING LOCAL LAW #9 OF 1980, RELATING TO THE IMPOSITION, CHARGE AND COLLECTION OF WATER RATES FOR THE CONSUMPTION AND USE OF WATER FOR THE TALL TREES WATER DISTRICT AS WELL AS THE PENALTIES AND ENFORCEMENT THEREOF. BE IT ENACTED by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. Section 1B of Local Law ##9, 1980 is hereby amended as follows: Section 2. The owner shall be obligated to pay the minimum charge of Forty=Six Dollars and 04/100 ($46.04) per each quarter, regardless of the consumption of water for said quarter, provided said owner is connected to the system at any time during the quarter. Section 3. Section 5 of Local Law #9, 1980, is hereby deleted. Section 4. This local law shall take effect January 1, 1982. 3 The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 30th day of November, 1981, a proposed Local Law Amending Local Law #9 of 1980, relating to the imposition, charge and collection of water rates for the consumption and use of water for the Tall Trees Water District as well as the penalties and enforce- ment thereof. WHEREAS, the provisions of the Municipal Home Rule requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the llth day of December, 1981 at 7:15 P.M. EST on such day at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilwoman Mills Roll Call Vote: 5 Ayes 0 Nays The following proposed Local Law was introduced by SUPERVISOR DIEHL: A LOCAL LAW # 1981 AMENDING LOCAL LAW # 12 OF 1980 RELATING TO THE IMPOSITION, CHARGE AND COLLECTION OF WATER RATES FOR THE CONSUMPTION AND USE OF WATER FOR THE ROCKINGHAM SEWER DISTRICT AS WELL AS THE PENALTIES AND ENFORCEMENT THEREOF. BE IT ENACTED by the Town Board of the Dutchess County, New York, as follows: Section 1: Section 1B of Local Law #1 amended as follows: Town of Wappinger, of 1980 is hereby Section 2: The owner shall be obligated to pay the minimum charge of Twenty -Nine and 45/100 Dollars ($29.45) per each quarter, regardless of the consumption of water for said quarter, provided said owner is connected to the system at any time during the quarter. Section 3: This local law shall take effect January 1, 1982. The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 30th day of November, 1981, a proposed Local Law Amending Local Law #12 of 1980, relating to the imposition, charge and collection•of water rates for the consumption and use of water for the Rockingham Sewer District as well as the penalties and enforcement thereof, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the llth day of December at 7:30 P.M. EST on such day at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilwoman Mills Roll Call Vote: 5 Ayes 0 Nays The following proposed Local Law was introduced by SUPERVISOR DIEHL: A LOCAL LAW # OF 1981 AMENDING LOCAL LAW #13 OF 1980 RELATING TO THE IMPOSITION CHARGE AND COLLECTION OF WATER RATES FOR THE CONSUMPTION AND USE OF WATER FOR THE MID -POINT PARK SEWER DISTRICT AS WELL AS THE PENALTIES AND ENFORCEMENT THEREOF. BE IT ENACTED by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1: Section 1B of Local Law #13 of 1980 is hereby amended as follows: Section 2: The owner shall be obligated to pay the minimum charge of Seventy -Seven and 74/100 Dollars ($77.74) per each quarter, regardless of the consumption of water for said quarter, provided said owner is connected to the system at any time during the quarter. Section 3: Section 5 of Local Law #13 of 1980 is hereby deleted. Section 4. This local law shall take effect January 1, 1982. 4 The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 30th day of November, 1981, a proposed Local Law Amending Local Law #13 of 1980 relating to the imposition, charge and collection of water rates for the consumption and use of water for the Mid -Point Park Sewer District as well as the penalties and enforcement thereof, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative s - Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the llth day of December, 1981 at 7:45 P.M. EST on such day at the Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilwoman Mills Roll Call Vote: 5 Ayes 0 Nays At the last Town Board meeting, the Attorney was authorized to negotiate with John Vorndran for the.purchase of property to provide protection for the Hilltop Water Site and report his findings to the Board for their approval or disapproval. This matter was now placed before them for their consideration. MR. JOHNSON moved that the Supervisor be authorized to execute an agreement between John Vorndran and Central Wappinger Water Improvement Area, for the purchase of a parcel of land, approxi- mately 6.1 acres in size, in the amount of $7,000.00, subject to approval by the Department of Environmental Conservation, and further moved that a walk way easement only, be provided on any lot adjacent to said lands, conditional upon approval by the Department of Environmental Conservation. Barger dated August 17, 1977, and revised on Sept. 12, 1977 from a zoning status of R-20 to a zoning status of Planned Industry. /hank you for your cooperation. Very truly yours, s/ Michael Cornell Mr. Versace apparently had not received this correspondence and was unfamiliar with it. He had questions regarding the exact location and felt that the applicants should have approached the Town Board in person with a prepared map and description of what was planned for the area. Mr. Diehl then presented tte map that had been submitted and commented that any other information they needed could be obtained when the applicants appeared at the Public Hearing. The Comptroller was present and noted that the Benefit Assessment Roll for 1982 for this district would be $24.32 per unit; for 1981 it was $24.91 per unit. There were no comments from the public.
