1981-03-25 SPM290 A Special Meeting of the Town Board of the Town of Wappinger was held on March 25, 1981, at Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl called the meeting to order at 8:07 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Frank Versace, Councilman Absent:, Elaine H. Snowden, Town Clerk Others Present: Jon Holden Adams, Attorney Hans Gunderud, Building Inspector/Zoning Administrator Mr. Diehl appointed Councilwoman Reilly to act as secretary in the absence of the Town Clerk. Notice of this meeting was sent to all Board Members on March 20, 1981, calling said meeting for March 25, 1981, to deal with the proposed water tank site and application of Atlas Water Company. Notice was sent to the News Media on March 23, 1981 and also posted on the Town Clerk's Bulletin Board on the same date. The following discussion ensued on the application of Atlas Water Company and the Short Environmental Assessment form attached to said application. Mr. Johnson suggested that the application and attachments be forwarded to the Planning Board, as well as the Zoning Board of Appeals and the Conservation Advisory Council, for their review and comments. He further stated that Item 13 of the Short Environmental Assessment Form should have a full environmental impact study to determine whether or not the storage tank would have an impact on public health and safety. Mr. Adams stated that all agencies should report in writing back to the Board before issuance of any permit. The same procedures should be followed in this instance as are followed by the boards on any application. MR. JOHNSON moved that the application of Atlas Water Compny (and 2J1 all attachments) be forwarded to the Planning Board and all other pertinent agencies of the Town for their review and comments and that a full environmental impact study be completed in regard to Item 13 of the Short Environmental Assessment Form. Seconded by Councilwoman Mills Motion Unanimously Carried The Board then discussed the Pondview Subdivision. Mr. Versace stated that at the meeting of the Board and Fairview Builders several months ago, the Board had made clear that the holding pond at the end of Belair Lane was to be filled in and the water piped to the new storm drains on that road before any further building permits were to be issued. At the March meeting of the Board, it was moved to permit the issuance of two permits on the basis of a letter received from the Town Highway Superintendent statingthat work on the pond was in progress and that approximately $100.00 worth of work remained to be done. Mr. Versace further stated that he visited the site last week and that the pond had not been filled in, that there was no piping to the storm drain and that very little work had been done, as far as he could tell. He also stated that with the rainy season almost here, he felt that the situation was very dangerous to the residents of Belair Lane and that something had to be done immediately. Mr. Diehl commented that he felt the Board had not received the correct information from Mr. Horton when action was taken at the March meeting. Mr. Johnson asked Mr. Adams to send a letter to Joel Hanig, attorney for Fairview Builders advising him that the issuance of the two building permits was done under the assumption that the work on the pond had -been adhered to. Mr. Adams stated that possibly the $4,000.00 being held for the completion of road work, could in part also be used to finish work on the pond. He further stated that the closing of title on one ofthe permits issued was taking place on the 30th or 31st of March, and that it would be difficult for all parties to have the closing delayed. MR. VERSACE made the following motion regarding the issuance of any further building permits: 1. the connection of piping from the pond to the storm drain be completed, 2. that the pond be filled in and returned to its natural state, 3. that the money being held in escrow be used to complete work on the pond if the same is not completed within 30 days by the developer. Seconded by Councilman Johnson Motion Unanimously Carried MR. DIEHL moved the meeting be adjourned, seconded by Mr. Versace and carried. The meeting adjourned at 8:27 P.M.
