1980-03-05 PHA3 0 The Adjourned Public Hearing of February 13, 1980 on the Map, Plan and Report for the Construction of a Storm Sewer on Bel -Aire Lane was resumed on March 5, 1980. Supervisor Diehl opened the Hearing at 7:07 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: Rudolph Lapar, Engineer to the Town Mr. Diehl stated for the record that the Board had been advised by the Attorney that the Town could not enter into private property to correct a drainage problem. Mr. Horton had previously advised him that he could not work on the roads until the drainage was corrected --it would be a waste of money. Mr. Dick King, Orange Court, felt there should be additional grading other than the Orange Court circle. If they decided to do this, how long would it take. He then expressed concern about the present catch basin which was above the water flow. Mr. Fred Wise, Henry Drive, spoke of the development of new property where the pipes would have to go through, as mentioned at the last hearing. At that time it was not known who the legal owner of the property was and had agreed this was the first step. He wanted to know if any attempt had been made to find the owner and contact him. Mr. Versace answered that the Building Inspector had made two attempts to contempt him by registered mail, but both communications were returned. Discussion followed on the benefits this developer would gain from the project and the fact that he was not obligated to maintain the holding ponds. Mr. Wise asked if the drainage project included the resurfacing of Orange Court; the reply was yes, but when he asked about this work for Henry Drive and Alladin Court, Mr. Lapar said it dad not. Carol Petvai, corner of Bel -Aire Lane, asked why the drainage was not being continued in front of her house. It is impossible to enter the driveway due to the grading of the road. They put a 1 galvanized pipe there but it is useless since it fills up with stone every time it rains. Mr. Lapar explained that she was actually talking about a regrading of the road between Alladin Court and the easement, and this was something Mr. Horton should look at. Mr. Petvai could not understand the direction of the drainage project ---it would not help him since it didn't cover the front of his home --they stopped short of him by 200'. Mr. Lapar tried to explain what they proposed to do and it would help him. Mr. Petvai persisted with his problem claiming that the Town project would not help him. It was area and he could then show solved with this project. Jim Sheedy spoke on the Petvai's problem They have seen the engineering plans, he agreed that Mr. Lapar would visit the Mr. Petvai how his problem would be and agreed with them. said and they are not satisfied. Everyone present knows there is a problem with the pond by his house and the Petvai's want to hear and he does, too, that before any other homes go in that area, the drainage problems will be resolved. He wants to hear that the drainage will not be allowed to drain into the stream. Gene Coppolla said he keeps hearing "if" this project goes through, what is the doubt in their mind. Fred take Mike Wise was concerned about the size of the pipe ---would this care of the whole area. Stach, Myers Corners Road, not a resident of the subject area, asked if he understood the situation which was that the development of 30 houses on the hill was approved and all the storm sewers would be put in eventually and it looks to him like the Town is investing in a 42" pipe up there to complete some type of commitment. Mr. Lapar explained that this was not the situation. The 42" pipe is to take care of eventual drainage from the upper part of that area when and if it is developed. The Town, by its subdivision regulations, forces every developer to put in pipes sufficient to take care of the upstream water. Mr. Petvai still had questions and did not think the 42" pipe was sufficient since the development was not complete. 23 2 Mr. Lapar assured him that when the Town does the job it is a "cadillac" job, not so with the developers. it is a different situation now, the Town makes sure the developer uses the superior quality materials as is used in Town projects. Further discussion ensued between Mr. Versace and Mr. Lapar on the Alladin Court drainage and a possible tie-in with the Hunt development off Myers Corners Road.
