1980-01-09 PH«, is j: 13c A Public Hearing was held by the Town Board of the Town of Wappinger on January 9, 1980, at Town Hall, Mill Street, Village of Wappingers Falls, Dutchess County, New York, on an Ordinance Amending the Cable Television Franchise Agreement with W. S. Cablevision Corp. Deputy Supervisor Nicholas Johnson opened the Hearing at 7:33 P.M. Present: Nicholas Johnson, Deputy Supervisor Bernice Mills, Councilwoman Janet Reilly, Councilwoman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Absent: Louis Diehl, Supervisor The Town Clerk offered for the record the Affidavits of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part hereof of the minutes of this hearing). Mr. Robert Smith, Fenmore Drive, asked if the charge on the second outlet of $1.50 was standard rate. Mr. Erichsen, Manager of the Cable Company answered that this rate stayed the same --$1.50 for the second outlet and $1.00 for each additional outlet. Mr. William Hall, 14 Split Tree Drive, asked if this increase included the Madision Square package at $54.00 a year and the additional channels out of Philadelphia. Mr. Erichsen explained that the 95 increase in the monthly fee was due to a rise in operating costs, and he went on to explain the services they were now getting. They had added additional channels, such as Off Track Betting, Channel 17 out of Philadelphis, Channel 8 from New Haven which had to be eliminated in favor of Dutchess County College translator, Channel 54, also a Christian Broadcasting network, a satellite family type program. These are all available on the newer TV sets or the option of purchasing a converter, which they would provide. They are also setting aside a channel for the Wappinger School district use, since this was agreed when the franchise was approved. They will also provide a 137 cable news service which has been delayed. He hoped to make the cable TV package as attractive as possible thus enabling them to increase the subscribers and the revenue which would then offset increased costs. Mrs. Mills had had a complaint from a woman due to the timing of the shows, for example, an R rated movie was on at 8 PM and a PG was on at 10 PM. The customer felt this should have been reversed. Mr. Versace asked for clarification of the services they were offering ---4 additional channels for an increased rate of $.95; on newer sets they would have no problem, on older sets, a convertor could be purchased. Mr. Erichsen corrected this statement, they did not sell the convertor's, they rented them, and only for specific models. When asked the rental price, Mr. Erichsen explained three types --one at $1.00 a month, a better one at $2.25 a month with its own selector, and a third deluxe version with remote control; at this time that rental was not given. Mr. Versace went on to ask about the outages and the poor service from the company. Mr. Erichsen then explained about the causes of some outages, especially if they were related to power failure or car accidents, their hands were tied, they had to wait for other agencies to perform before they could repair their facilities. As for poor service problems, they do respond within 24 hours of the complaint. Mr. Versace then asked about the billing system which is 60 days prior to service; what if the customer was without service for two or three days, how do they compensate the customer for this loss of service. Mr. Erichsen explained that the state has a new set of rules, one of which is to give a customer credit for any outage in excess of 24 hours, if the fault is that of the cablevision and if the customer has notified the company of the fact. Mr. Versace then cited another incident whereby the customer took the credit off the bill before sending in the payment, but it was never removed and each bill was sent with a notice to pay the deduction. This was due to the fact that the bills are going to a computer center and they are just not entering this credit into the computer. It should first be brought to the attention of the Beacon office and let them institute the credit. Mr. Versace then asked about the questionaires that are sent out from their office and how often they send them. 133 S l Mr. Johnson asked Mr. Erichsen to send copies of these question- aires to the Town Hall so the Board could see them. Mrs. Snowden asked if it was possible to buy a converter or if you had to rent them; Mr. Erichsen said they could be purchased from a TV dealer or Radio Shack or similiar dealers. Mrs. Mills asked about the billing system, why does cable and Home Box come every other month, she sends them both together, but they are due at different times. The company should inform the customer that they can both be paid together even though the addresses are different. Mr. Erichsen explained that they would soon have a different billing sytem and the customer would have the option of paying them monthly or every other month. Mrs. Mills asked if the $54.00 payment for the sport package was payable in advance in full. Robert Smith asked if the yearly sports package was from January to January --the reply was that it's from the date you take it. William Hall asked when this sport package would be available - Mr. Erichsen said all this was subject to Town Board approval and State approval. Mr. Johnson asked if there was a reason other than additional revenue why they charged for additional sets in the house. Mr. Erichsen said they were required to provide a certain amount of signal to the rear of each home; when another connection is added inside the house, the level at the pole must be raised and the amplifier must be raised as well; this is also a check on the signals required.
