ADJOURNMENT 12 The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 2, 1980 at 7:00 P.M. at the Town Hall, Mill Street, village of Wappingers Falls, Dutchess County, New York. Supervisor Diehl opened the meeting at 7:02 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Frank Versace, Councilman Others Present: Jon Holden Adams, Attorney Mr. Diehl asked that the public stand for the Pledge of Allegiance to the Flag and also requested that we silently confirm our belief in the release of the hostages in Iran and a prayer for world peace. All stood and said the Pledge of Allegiance to the Flag. Mr. Diehl then welcomed the return of Councilman Frank Versace to the Town Board, as he had served previously on the Board, and noted that Mr. Versace was familiar with the progress and desires of this Town. This Board would join as a body to represent the best interests of the Town. He then expressed thanks to prior Councilman Leif Jensen who had served on this Board for two terms, and the last term he had been the Deputy Supervisor. Mr. Diehl stated that he had served with•Mr. Jensen on both sides of the political fence and respected his wisdom and concern for the Town. He went on to say that Mr. Jensen had served as a member of the Tri -Municipal Commission, and had been Chairman of this Commission and had won the respect of the members from the other communities who had chosen him for this position. Supervisor Diehl appointed Nicholas Johnson as Deputy Supervisor, Gail Evans as Bookkeeper, and Leif Jensen as Confidential Secretary and Assistant to the Supervisor. Mrs. Snowden appointed Ethel Relyea as Deputy Town Clerk. Mr. Horton appointed Kenneth Croshier as Deputy Highway Superin- tendent. The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity at the pleasure of the Town Board. Highways Town Historian Recreational Coordinator AND IT IS FURTHER RESOLVED, that the salaries otherwise fixed for theabove designated offices and positions shall be paid to the holders of such offices and positions, with the exception that no compensation shall be paid to the holder of the office of Deputy Town Superintendent of Highways, and the Town Historian is to be paid on a semi-annual basis, payable every other Friday throughout the year 1980, with 26 periods during such year, with the first payday to be January 11, 1980. Seconded by: Councilwoman Mills Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN MILLS Who moved its adoption: 3 RESOLVED, that Henry Cuatt be and he hereby is appointed to the office of Comptroller in the Town of Wappinger to servein such capacity for a term ending on the 31st day of December 1981, and it is further RESOLVED, that the Comptroller be paid an annual salary of $21,550.00 payable every other Friday throughout the year 1980, with 26 pay periods during such year, with the first payday to be January 11, 1980. Seconded by: Councilwoman Reilly Roll Call Vote: Councilman Johnson Ave Councilwoman Mills Ave Councilwoman Reilly Ave Councilman Versace Abstain Supervisor Diehl Ave Before the vote was taken, Mr. Versace said he would abstain, since he had not received a resume from Mr. Cuatt stating his qualifications, and he did not know how many others had applied for this position. When Mr. Diehl voted, he wished to state that he was voting for Mr. Cuatt because he had confidence in him and felt that his ex- perience and qualifications were without question, however he expressed the desire that he, could have voted for two Comptrollers and his other choice would have been to reinstate Matthew Ryan as Comptroller. Mr. Ryan's term as Comptroller has been an asset to the Town, Mr. Diehl continued, and he leaves with a clean bill of health. His affirmative vote was a welcome to Mr. Cuatt as a member of the Town team in his position as Comptroller. The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that Amelia Crosby be and she hereby is appointed to the office of Receiver of Taxes and Assessments in the Town of Wappinger to serve in such capacity for a term ending on the 31st day of December, 1981, and it is further RESOLVED, that the Receiver of Taxes and Assessments be paid an annual salary of $13,090.00 payable every other Friday throughout the year 1980, with 26 pay periods during such year, with the first payday to be January 11, 1980, and be it further RESOLVED, that the Receiver of Taxes and Assessments be and she hereby is authorized to employ such clerical employees as may be necessary for the performance of her duties and to compensate such clerical employees up to the prevailing maximum hourly rate. Snowden be and she hereby is appointed to serve as Registrar of Vital Statistics to the Town of Wappinger, Dutchess County, New York, for a term of four years commencing January 1, 1980, and ending December 31, 1983, pursuant to Section 4123, Public Health Law, and it is further RESOLVED, that said Registrar of Vital Statistics to the Town of Wappinger shall receive no salary or compensation, however, she shall be entitled to receive for the performance of the duties of this respective office the fees fixed by applicable statute. Seconded by: Councilwoman Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that the pay scale for the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following minimum to maximum hourly rates: Heavy Operator Light Operator Laborer Foreman $ 6.79 - $ 7.05 per hour 6.72 - 6.83 per hour 4.73 - 6.69 per hour 7.13 - 7.49 per hour AND BE IT FURTHER RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every other Friday throughout the year 1980, with the first payday to be January 11, 1980. Seconded by: Councilwoman Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: RESOLVED, that the pay scale for all extra part time clerical employees engaged to perform services for the Town Board of this Town and/or its officers, officials, and agencies be and the same hereby is fixed and established at a maximum hourly rate of $3.60 per hour, and it is further RESOLVED, that all of such extra part time clerical employees engaged on an hourly basis shall be paid every other Friday through- out the year 1980, with the first payday to be on Friday, January llth, 1980. Seconded by: Councilwoman Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: RESOLVED, that the pay scale for part time Town of Wappinger Vandalism Patrol Personnel engaged to perform certain services for the protection of Town parks, various other Town properties and performance of other such duties as may be assigned by the Town Board of this Town be and the same hereby is fixed and established at a maximum hourly rate of $5.00 per hour, and it is further RESOLVED, that all of such part time Town of Wappinger Vandalism Patrol Personnel engaged on an hourly basis shall be paid every other Friday throughout the year 1980, with the first payday to be on Friday, January llth, 1980, Seconded by: Councilman Johnson Roll Call Vote: Councilman Johnson Councilwoman Mills Councilwoman Reilly Councilman Versace Supervisor Diehl Aye Ave Aye Nay Aye Mr. Versace questioned the rate of $5.00 per hour for the Vandalism Patrol, before the vote was taken. He asked why the 1 difference in hourly pay from part time clerical employees and the patrol. Mr. Diehl explained that the duties of these men required a rate of at least $5.00 per hour; most of them were Deputy Sheriffs who were doing extra duty. This work was hazardous and he knew that neighboring communities were paying $7.50 per hour for their services. Mr. Versace then asked if they were needed in another town, were they allowed to help out. Mr. Diehl answered that if another town needed this patrol for a back-up, he would certainly approve of them going to their aid. Mr. Versace then asked if there had been a curb on vandalism in the Town since the Vandalism Patrol had been instituted. Mr. Diehl thought this a difficult question to answer; for instance what would have happened if they weren't patrolling. He had positive replies and reaction from the State Police. The following resolution was offered by COUNCILWOMAN MILLS who movedits adoption: RESOLVED, that the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders of such offices and positions payable every other Friday throughout the year 1980, with 26 pay periods during such year, with the first payday to be on January llth, 1980. RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holders of these designated positions on such designated paydays of the year 1980. Gartland and Rappleyea be and they hereby are employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such legal advice and services as may be required and they shall receive compensation therefor in accordance with a proposal submitted to this Board. Seconded by: Supervisor Diehl Roll Call Vote: 5 Ayes 0 Nays The next item on the Agenda was for the appointment of Dog Control Officers for the Town. There was no resolution to act on, as it was a new position that has been created due to the change, by the Department of Agriculture and Markets, in the dog licensing procedures. Mr. Johnson explained that there were a few tech- nicalities to straighten out before a resolution could be drawn up. MR. JOHNSON moved to. offer the following names for provisional appointments as Dog Control Officers: James Vicalvi, William Nepfel and George Wells. Seconded by Mrs. Mills Motion Unanimously Carried The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that all individuals hereinafter designated by the Town Board as Court Officers as such title is defined by the Uniform Justice Court Act have all those powers accorded to Court Officers by Law during such time they are actually serving in such capacity, and BE IT FURTHER RESOLVED, that the Town Justices of the Town shall designate and schedule the days and evenings such individuals shall serve as Court Officers, and BE IT FURTHER RESOLVED, that one Court Officer be designated for each session of Court unless the Town Justices determine that more than one be designated for any one session, and BE IT FURTHER RESOLVED, that the Court Officers shall be compensated at the hourly rate of $4.00 for time actually served, and BE IT FURTHER RESOLVED, that the Town Justices shall submit to the Town Comptroller on a weekly basis the names and hours served and that the Town Comptroller be empowered to issue remuneration consistent with the foregoing from funds appro- priated for Justice Court Personal Services, and BE IT FURTHER RESOLVED, that the following individuals be designated as Court Officers for the year 1980. Seconded by: Councilwoman Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN REILLY who moved its adoption: RESOLVED, that the W&SD News, a newspaper regularly published in the Town of Wappinger, Dutchess County, New York, and having a general circulation in this Town, and being a newspaper entered as second class mail matter, be and the same hereby is designated as the official paper of this Town, and it is further RESOLVED, that the Poughkeepsie Journal and the Evening News, newspapers published in the County of Dutchess and having general circulation therein, be and they hereby are designated as addi- tional newspapers for the publication of Town notices, subject to the limitations of Section 64, Subdivision II of the Town Law of the State of New York, and it is further RESOLVED, that the Town Clerk be and she hereby is authorized and directed to give notice of such designation to the publishers of such newspapers. Seconded by: Councilman Johnson Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: RESOLVED, that monthly meetings of the Town Board of the Town of Wappinger shall be held at 8:00 P.M., at the Town Hall, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, in the evening of the second Monday of each month, or at such other place or places within the Town of Wappinger as the Town Board shall from time to time designate. NOW, THEREFORE BE IT RESOLVED, that the Town Clerk is hereby authorized and directed to establish a petty cash fund in the sum of $50.00 for the use of said Town Clerk. Seconded by: Councilman Johnson Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that a petty cash account not to exceed the sum of $200.00 and the same hereby is established for the Receiver of Taxes, and it is further RESOLVED, that payments from said petty cash account be made and that the Supervisor of this Town be reimbursed for advances made to such account in accordance with the provisions of Section 64, Subdivision la of the Town Law of the State of New York. Seconded by: Councilwoman Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN REILLY who moved its adoption: RESOLVED, that voucher -order checks of the Town of Wappinger may be signed with a facsimile signature of the Supervisor of the Town of Wappinger as reproduced by a mechanical check -signing device or machine provided that the safeguards specified by the manufacturer and inherent in the operations of such device are properly observed, and it is further RESOLVED, that a certified copy of this resolution be filed with all banking institutions which are depositaries of the monies and funds of the Town of Wappinger, for the purpose of indicating authority for the use of such facsimile signature, and it is further 12-; , 1 131 RESOLVED, that the Supervisor of the Town of Wappinger be and is hereby authorized and empowered to take all steps which may be necessary and proper to acquire a mechanical checksigning device for use in conformity with this resolution. Seconded by: Councilwoman Mills Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: WHEREAS, Subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper. WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Councilman Johnson Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, it has come to the attention of this Town Board of the Town of Wappinger that there are now or may be in the future funds and monies, except proceeds of loans and monies the investment of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit account, in, or certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligations of the United States of America and/or the State of New York, and WHEREAS, it appears that the temporary deposit and/or investment of such excess and surplus funds may be beneficial and profitable to the Town of Wappinger, L NOW, THEREFORE IT IS HEREBY 1.32 RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger be and he hereby is authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section 11 of the General Municipal Law of the State of New York, and it is further RESOLVED, that such temporary deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section 11 of the General Municipal Law of the State of New York, and it is further RESOLVED, that the aforesaid Supervisor of this Town be and he hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this resolution. Seconded by Mr. Johnson Motion 'Unanimously Carried MR. DIEHL moved to appoint Leif Jensen and Nicholas Johnson as members of the Tri -Municipal Commission from the Town of Wappinger. Seconded by Mrs. Reilly Roll Call Vote: Councilman Johnson Aye Councilwoman Mills Nay Councilwoman Reilly Aye Councilman Versace Nay Supervisor Diehl Aye Motion Carried When Mr. Diehl asked if there was discussion on this motion, Mr. Versace voiced his objection to the appointments. He had no objection to Mr. Johnson, but he felt that in a project such as this, another Board member should be appointed, since decisions had to be made and reports made to the Board. He summed up his remarks by stating that he would feel more comfortable if a Board 133 member was appointed to this Commission. Mrs. Mills clarified her "Nay" vote by explaining that she was in favor of Mr. Jensen's appointment, but not Mr. Johnson's appointment to the Tri -Municipal Commission. JOHNSON moved to grant permission to all officers, officials and certain employees of the Town of Wappinger to attend the Association of Towns meeting, February 17th through February 20th, 1980, and that their actual and legitimate expenses be a Town charge. JOHNSON moved that Mr. Diehl be designated as Representative of the Town of Wappinger at the Association of Towns' Meeting, and Mrs. Mills be designated as Alternate of the Town of Wappinger at this meeting. Councilwoman Reilly offered the name of Carlton Relyea. MR. JOHNSON moved to approve the list of Town of Wappinger Paid Holidays for the Year 1980, as submitted by the Town Clerk. Seconded by Mr. Diehl Motion Unanimously Carried Mrs. Snowden brought up a letter from Mrs. Crosby, Receiver of Taxes, which was not pertinent to this meeting, but required action from the Board before the next regular Board meeting. The memo regarded a request to enclose an information letter on taxes, special districts, capital assessments, water and sewer rents, etc. in the tax bills. This, she felt, would help to answer questions from residents that called through the year seeking this information. MR. VERSACE moved to authorize Mrs. Crosby to enclose the Tax Information Letter, including the recommendations of the Comptroller, in the Tax Bills, subject to approval by the Attorney of the language of the letter, and approval also of the Water and Sewer Committee. Seconded by Mr. Johnson Motion Unanimously Carried Mr. Johnson commented that they had hoped to make minor changes in one of the benefits in the Employees Policy, but it was not completed at this time.
