A Special Meeting of the Town Board of the Town of Wappinger was
held on September 24, 1979 at 6:45 P.M. at Town Hall, Mill Street,
Village of Wappingers Falls, Dutchess County, New York.
Notice of said meeting was sent to each Board Member on September
20, 1979, calling the meeting for September 24, 1979 at 6:45 P.M.
Notices were sent to newspapers and radio stations and also posted
on the Town Clerk's Bulletin Board.
Supervisor Diehl opened the meeting at 6:56 P.M.
Present:

Leif Jensen, Councilman
Nicholas Johnson, Councilman
Bernice Mills, Councilwoman
Janet Reilly, Councilwoman
Elaine Snowden, Town Clerk
Mr. Diehl noted that the purpose of this meeting was to consider
appropriate action relative to the petition presented calling for
a special referendum on the Drainage Bond Resolution.
MR. JENSEN moved to rescind the Bonding Resolution on Drainage
Improvements in the amount of $254,375.00, adopted by the Town
Board on August 13th, 1979, and further, that the Board, in the
future would review the program of Downstream Drainage, namely,
stream cleaning as requested by the Highway Superintendent.
Seconded by Mrs. Mills
Motion Unanimously Carried
Before the motion was seconded and voted on, each Board Member
had comments
Mr. Diehl believed the residents signed this petition in good faith,
but the information given by those carrying the petition was not
complete, and in cases where petitions were left in retail stores
unattended and signatures were not witnessed, legal action could be
instituted.
Mr. Jensen felt, too, that the residents did sign in good faith;
there are discrepancies in the petition; some people in the Village
of Wappingers Falls signed, some people living in Red Oaks Mill
have signed it. He concurred with Mr. Diehl in cases where the
petitions were left at local stores.

After he made the motion, he added that the drainage study that was
started several years ago be reopened next year and they review the
complete drainage for the Town.
Mrs. Mills, after seconding the motion, commented that she knew for
a fact that the people did not know the whole story, the peeple
circulating the petition should have told people the truth.
Mr. Johnson commented that the Drainage Committee had put these
drainage projects together, the Bell -Air Project and the MacDonald
Project, hoping to alleviate problems in those areas. He believes
that they are viable projects, if not in total, then the Drainage
Committee will look for other ways.
Mrs. Reilly also spoke to people who had signed the petition and
she felt as the others felt{,: they were signed in good faith, but
the people were completely misinformed; they are two projects that
desperately need to be done.
Mr. Incoronato, being recognized by the Chair, said that Mr. Diehl
had made a universal statement about people not knowing what they
were signing. He had walked around with the petitions and had
explained to the people what they were signing for. The Board had
deliberately tied these projects together for bonding; the needed
drainage such as Bell -Air and the stream cleaning on MacDonald's
property will suffer because of this. The downstream drainage
on D.W.S. property was attached to needed drainage projects and
he labeled it "highway robbery".
Mr. Diehl reiterated that when the first drainage plan came up,
there was nothing in the plan in the area of MacDonald's property
or D.W.S. property which happens to adjoin it. The Board decided
to give relief to the MacDonald's and this was added to the drainage
project, not because it was the Town responsibility, but because
it would alleviate his problem. There was no intent or thought for
D.W.S., they felt that D.W.S. were taking care of their problems
through their ponds.
Mr. Hirkala, being recognized by the Chair, told Mr. Diehl this
story may or may not be true, but the fault was still with the
Board because they did not inform the public, they should make sure
the taxpayers know what is going on.

Mr. Diehl asked if there was anything else to come before the
Board.
Mr. Johnson noted that the next regular meeting of the Town Board
would fall on October 8, 1979, which was a holiday. It was the
policy in the past to change the date of the regular meeting.
MR. JOHNSON moved to change the regularly scheduled Town Board
meeting of October 8, 1979 to October 10, 1979, due to the holiday
which falls on the 8th of October, 1979.
Seconded by Mrs. Mills
Motion Unanimously Carried
Mr. Jensen had one more item he wished to bring up --on the corner
of Ervin Drive and Myers Corners Road going east toward All Angels
Hill Road, there is a catch basin put in by the County with a post
which could be hazardous if someone happened to make a sharp right
hand curve. He requested that a letter be sent to Mr. Spratt,
Dutchess County Commissioner of Public Works, asking him to review
this situation and correct it.
MR. JOHNSON moved to close the meeting, seconded by Mrs. Reilly
and unanimously carried.
The meeting closed at 7:22 P.M.

A Public Hearing was held by the.Pown Board of the Town of
Wappinger on September 24, 1979, on a proposed Local Law Setting
Forth Local Fees for Purebred Licenses, at Town Hall, Mill Street,
Wappingers Falls, New York.
Supervisor Diehl opened the Hearing at 7:23 P.M.

The Town Clerk offered for the record the Affidavits of Posting
and Publication duly signed and notarized (attached hereto and
made part thereof of the minutes of this Hearing).
Supervisor Diehl asked if anyone wished to speak for or against
this Local Law.
There was no one present in the audience to speak for or against
this Local Law.
Mr. Johnson moved to close the Hearing, seconded by Mrs. Reilly
and carried.
The Hearing closed at 7:26 P.M.
