ADJOURNMENT 1 2 1 2 The Regular Meeting of the Town Board of the Town of Wappinger was held August 13, 1979 at Town Hall, Mill Street, Village of Wappingers P1ls, Dutchess County, New York. Deputy Supervisor Jensen opened the meeting at 8:15 P.M. Present: Leif Jensen, Deputy Supervisor Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Elaine Snowden, Town Clerk Absent: Louis Diehl, Supervisor Others Present: William Horton, Highway Superintendent Rudolph Lapar, Engineer to the Town Jon H. Adams, Attorney to the Town The Minutes of the Regular Meeting of July 9, 1979 and the Special Meeting of July 30, 1979, having previously been sent to the Town Board, were now placed before them for their consideration. MR. JOHNSON moved that the Minutes of the Regular Meeting of July 9, 1979 and the Special Meeting of July 30, 1979, be and they are hereby approved as submitted by the Town Clerk. Seconded by Mrs. Mills Motion Unanimously Carried Reports for the month of June-aficl.:_july received from the Building Inspector and Zoning Administrator and Town Justices, the July Fire Hydrant Report from the Highway Superintendent, and the Quarterly U.S. Cablevision Copp. also Notice of Hearing from the Zoning Board of Appeals. MR. JOHNSON moved that these reports be accepted and placed on file. Seconded by Mrs. Reilly Motion Unanimously Carried Mr. Jensen asked that the format of the Agenda be reversed and Petitions and Communications go ahead of Resolutions as some of the information in Communications reference the Resolutions. �13 A letter was received from Gregory Sarno requesting the status of the Dana Place Drainage Problem Solution which had been the subject of discussion at Board meetings for many months. He concurred with Messrs. Lapar and Horton that the $40,000+ solution is the only way to permantently resolve the problem. Mrs. Mills felt they should not close the door on this solution, but they should keep researching for other solution to alleviate the problem on Dana Place. A letter was received from Erwin Becker regarding the establishment of an Architectural Review Board provided for in the proposed Zoning Ordinance and offered his services in this regard. MR. JOHNSON moved that this letter be referred to the Ordinance Committee for their review. Seconded by Mrs. Mills Motion Unanimously Carried Mr. Saleem Sheredos wrote to the Board regarding the speed. limit on Losee Road with a petition attached from the residents of that road -;requesting 1. a reduction in the speed limit to 3Omph, 2. Losee Road be patrolled frequently by town and state law enforcement officials and 3. divide Losee Road into two dead-end streets. Mr. Jensen a-emarked that the Town Board has tried, in, vain, have the speed limit reduced on ,this road; he requested the Town Clerk to give specific dates on their previous actions. The first resolution was sent to New York State Department of Transportation and Dutchess County Department of Public Works on Aug. 14, 1938, upon request of the residents, another one in December 1978 and a letter was received from Commissioner Spratt "in regard to Losee Road, we feel that the speed at critical locations should be controlled with warning signs with appropriate recommended speed handles so that the traveling public is aware of the conditions. This would be more realistic approach to the control of speed on that road". Other requests dated back to 1976. Mr. Jensen recommended that a letter be sent to the State Troopers and the Dutchess County Sheriff Department requesting patrol of this road at the critical times. MR. JOHNSON moved that the Town Board respond to Mr. Sheredos's letter advising him of our previous actions in dealing with this matter and send him all the correspondence with the New York State Department of Transportation and the Dutchess County Department of Public Works and further that a letter be addressed to the State with a copy to the County, Dutchess County Executive and Wappinger County Legislators, stating that we disagree with the County's kir stand on the speed limit of this road/urging them to study this matter further to, reduce the speed limit to 30mph, on Losee Road. Seconded by Mrs. Mills L Motion Unanimously Carried Before the vote was taken on this motion, Mr. Horton recommended that notice be sent to the State with a copy to the County and ask for the opinion of the State. He disagreed with the County. He noted that MacFarlane Road was across from Losee Road and had a much lower speed limit; it didn't make sense to him posting a higher speed limit on Losee Road than he did on MacFarlane Road. A letter was received from Robert F. Nardozzi, Attorney represent- ing Mr. & Mrs. Charles Fountain who are purchasing property on Losee Road from Mr. & Mrs. Robert Arnold; the problem seems to be a well located on Town property and Mr. Nardozzi wished to clear this with the Town so his clients could take possession of the house and be able to use the well. Mr. Horton felt the Town should obtain a release from the current owner and this release would become part of the deed for this property; Mr. Adams con- curred with Mr. Horton. ,MR. JOHNSON moved to direct the Attorney to the Town to draw up this release and the Town Clerk contact Mr. Nardozzi informing him of this action and the fact that the well on the property owned by the Town can be used by the owners subject to the signing of this release. Seconded by Mrs. Mills Motion Unanimously Carried 1224 A letter was received from James Klein regarding the possibility of obtaining water from the Central Wappinger Water Improvement to serve his subdivision on All Angels Hill Road which does not lie within this district. MRS. MILLS moved to refer this matter to the Engineer. Before this motion was seconded, Mr. Lapar recommended that this matter be tabled since there is litigation with one of the principal's associates. Mrs. Mills withdrew her motion. MR. JOHNSON moved to table this request, at the recommendation of the Engineer to the Town. Seconded by Mrs. Mills Motion Unanimously Carried The successful bidder of the Hilltop Well #5 Contract, Wilson Excavators Inc., by letter to the Town Board, advised them that because of the length of time involved since the bid was awarded, they will now have to make a cost adjustment to cover increases in material and labor costs and further, if the Town plans to abandon this project, they will seek reimbursement of bonding tests. MR. JOHNSON moved to direct the Town Clerk to send a letter to Wilson Excavators Inc. informing them that the Town has every intent of proceeding with this project but has been tied up in bonding procedures to finance said project, and further ask them what the total cost would be if the work started in sixty days. Seconded by Mrs. Mills Motion Unanimously Carried The following letter was received: July 20, 1979 Town Board Members Town of Wappinger RE: Enclosed pamphlet on Solid Waste Dear Board MeMbers: On Thursday, July 19, 1979, I attended a meeting held by Dutchess County Solid Waste Committee which was chaired by Legislator Robert Sears. 21 ti It appears to me, as of this date, that this is the best idea I have heard yet. Basically, the system can put in operation at a cost of approximately 4 million plus, in a short time and only needs 5 acres of land or less, compared to previous quotes of alternative systems at a cost of 40 to 60 million, plus land acreage of 100 to 300 acres. Again, from limited knowledge available at one session, this appears to be an immediate answer which is within a reasonable dollar figure and could be instituted in a short period of time. The important solution to the whole problem is to make an affirma- tive decision and put the show on the road. Yours truly, 11601 s/ Louis Diehl, Supervisor MRS. Seconded by Mr. Johnson Motion Unanimously Carried A letter was received from Dr. Huang, owner of Sunset Knolls, requesting a zoning change of his property on Route 9. Mr. Jensen recognized Dr. Huang who gppealed'to'the Town Board to consider his rezoning request. MR. JENSEN moved to refer this request to the Zoning Committee for review. Seconded by Mrs. Mills MatiomcUnapimous ly Carried MR. JOHNSON moved to refer Items 6I, Guarino request for rezoning, GJ, Zoning Board of Appeals letter re concern on permitted uses and home occupations in residential zones, 6K, Planning Board re Provisions for Architectural Review Board, 6L, Planning Board re Ohre two communications on changes in text of Zoning Ordinance and 6N, Dominicis re zoning property from HH to residential to the Zoning Committee for their review. Seconded by Mrs. Reilly Motion Unanimously Carried A letter was received from the Planning Board informing the Town Board that they want to hire, at the applicant's expense, another engineering firm to evaluate the drainage plans and profiles for the Cranberry Hills Development. Mr. Adams, Attorney to the'Town responded with the opinion "neither the subdivision regulations 1:_2 in their present forms (as available to me) nor the proposed revised subdivision regulations contain any provision which would permit the imposition of this expense upon the applicant, ----under such circumstances, we should attempt, to elicit their approval". MR. JENSEN moved to receive this letter and place it on file. Seconded by Mrs. Mills Motion Unanimously Carried Mr. Alan Lehigh, Chief of the New Hackensack Fire Company wrote to the Town Board stating that he believed it was necessary for the developers to submit an architect's drawing, along with a plot plan, to the town planning board. MR. JOHNSON moved that this letter be referred to the Building Inspector and Mr. Lehigh be notified of this action. Seconded by Mrs. Reilly Motion Unanimously Carried A letter was received from Alan Lehigh, Chief of the New Hackensack Fire Company expressing concern with the water supply of Central Wappinger Water. Mr. Jensen noted that the Orchard Homes Development was low on water at the time the Fire Company had a drill which lasted 21 hours and used 10,000 gallons of water; however, the indication was that it was a hydraulic problem, not a supply problem. Mr. Johnson added that this particular development is law and has had problems before which has been described in a letter from Mr. Lapar to the Town Board dated March 21, 1979. MR. JOHNSON moved that Mr. Lapar be directed to respond to Mr. Lehigh and explain this situation to him. Seconded by Mrs. Mills Motion Unanimously Carried A memo was received from Mr. Ryan concerning increase of water rates to the Fairchild Corporation since we were losing revenue due to an outdated agreement with Cogar. MR. JOfNSON moved to direct Mr. Ryan to work on specific rates for commercial users of the water system, to be submitted at budget time. Seconded by Mrs. Mills Motion Unanimously Carried 1121R A memo was received from Mr. Ryan re computerized billing and recommendation to change the billing period for the Rockingham Farms District. MRS. MILLS moved to table this matter for further information and review by the Board. Seconded by Mrs. Reilly Motion Unanimously Carried Mr. Lapar wrote a memo to Ni. Diehl concerning continual problems with Neptune Water Meters as follows: Memo To: From: Date: Subject: Louis D. Diehl, Supervisor Rudolph'E. Lapar, P.E. July 11, 1979 Continual Problems with Neptune Water Meters After several investigations of blow -outs by your office and Camo Pollution Control, no pattern of failures has been established. It is our opinion that in most cases it was due to faulty equipment or possible neglect by the Homeowner, (i.e. leaving garage door open during cold spells with meter exposed). The reason the Neptune Meters were installed, is because they were either the low bidder and/or only bidders on all contracts to purchase meters. Since there now appears to be sufficient reason to no longer honor the low bidder, the Board could decide, subject to legal approval of counsel, to buy more expensive meters with better guarantees. I believe one of our sister Towns' did just that. The responsibility for manhours and labor expended in replacement of meters, is a legal question that I certainly, cannot answer. Seconded by Mrs. Mills Motion Unanimously Carried The following report was received from Mx. Lapar: Town Board, Town of Wappinger Mill Street Wappingers Falls, N.Y. 12590 Re: Dear Board Members: July 26, 1979 Cost Estimate for Various Projects in the Town of Wappinger In accordance with your directions, the following is a list of projects and their costs for your consideration. 1. Central Wappinger Water Imp. (See Engineers' Report) $245,000.00 2. Bel -Aire Lane Storm Sewer 151,250.00 (See Memo May 11, 1979) . Widmer Road Culvert (See letter of July 26, 1979) 103,125.00 TOTAL COST $499,375.00 Say $500,000.00 s/ Rudolph E. Lapar, P.E. The next report from Mr. Lapar was a breakdown of the Widmer Road Storm Drainage Problem including replacement of the existing box culvert and stream cleaning, upstream and downstream. The cost stated included legal, engineering and bonding costs. MR. JOHNSON moved that both these reports be received and placed on file. Seconded by Mrs. Mills Motion Unanimously Carried The third report was on improvements to the Central Wappinger Water Improvement Area, Source of Supply and other necessary projects. This report explains the estimated cost of construction which amounts to the figure stated $245,000.00 in Mr. Lapar's first report. MR. JOHNSON moved that this report be received and placed on file. Seconded by Mrs. Mills Motion Unanimously Carried A resignation was received from Dennis Bryers, member of the Conservation Advisory Council. His new job was taking him to the state of Connecticut. MR. JENSEN moved to accept Mr. Bryer's resignation and that a letter be sent to him thanking him for his service on the Conser- vation Council and hope that his new endeavors will be fulfilling. Seconded by Mrs. Mills Motion Unanimously Carried Mr. Thomas Logan, Assessor, wrote to the Board requesting per- mission to attend the New York State Assessors Conference at Grossingers From September 16 through September 19, 1979 and asked that the Town Board urge Mr. Diehl to attend also and 122 0 meet the State Board officials who will be attending the conference. MRS. REILLY moved that Mr. Logan be given permission to attend the New York State Assessors Conference at Grossingers from September 16 through September 19, 1979 and his legitimate expenses be a Town charge and also that Supervisor Diehl be urged to attend this conference. Seconded by Mrs. Mills Motion Unanimously Carried Judge Francese wrote to the Board requesting the appointment of Ms. Brenda Miller as a Court Enforcement Officer as they were having difficulty scheduling the other officers for Wednesday morning court sessions. MRS. REILLY moved to table this matter until the next meeting. Seconded by Mrs. Mills Motion Unanimously Carried A letter was received from Mr. & Mrs. Juan Trillo, 8 Primrose Court, regarding water damage caused to the entire first floor of their house due to a water meter that had burst. A bill was enclosed for removal of the water soaked carpet and pad, plus the installation of a new carpet. They sought replacement of the rug and the possibility of tile floors although at the present time there was no visible damage to the floors. MR. JOHNSON moved to refer this complaint to the Attorney for his opinion. Seconded by Mrs. Mills Motion Unanimously Carried The following letter was received: August 9, 1979 Town Board, Town of Wappinger Town Hall, Mill Street Wappingers Falls, N.Y. RE: Zoning violations by Mr. Neave, 66, Spook Hill Road Dear Board Members: At your request and as a result of several formal complaints registered with this office, I investigated whether or not Mr. Neave: 1221 1. Is running a business from his home. 2. Is dumping debris on vacant lands across from his residence. 3. Is or has "several" trucks parked at his residence. 4. Is using his gasoline storage tank prior to final inspections by the Fire Inspector. 5. Is any way letting others use gas from his tank. The answers to all of the above is no. Specifically, Mr. Neave does not have a stock in trade at his residence, he has only one truck. There is no sign on the property and customers do not come to the residence in connection with his landscaping business. I have had verbal confirmation from Mr. Neave as of August 6th that he has not used gas from his tank and is in the process of devising testing methods for the final test of the storage tank facility. Respectfully, s/ Hans R. Gunderud Building Inspector & Zoning Administrator Mr.Jensen noted that the Zoning Administrator found no violations on Mr. Neave's property. Mr. Jack Raio, being recognized by the Chair, disagreed with these findings; he claimed the parking of commercial trucks on the property is a violation --were they in a residential or commercial area --the Board acted in haste, a permit should not have been issued to put in a gas tank. Mr. Jensen explained that at the time the permit was issued, the Building Inspector had to ascertain if he would use if for private use or commercial use. Mr. Gunderud determined that he was not running a business from his home and he issued the permit within the guide lines of the law. Mr. Jensen told him the Town can do no more than they have already done; the Zoning Adainistrator will keep checking to see if there are zoning violations and if so, they will be corrected. The following Local Law was introduced by COUNCILMAN JOHNSON: BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. It shall be unlawful for any person to open any fire hydrant for the purpose of discharging water therefrom within the Town of Wappinger unless that opening is an "exempt opening" as defined by Section 2 of this local luw. Section 2. Individuals who are members of local fire companies engaged in activities under the supervision and direction of local fire officials shall be exempted from the provisions of Section 1 of this local law, as shall all employees or authorized agents of the Town engaged in town activities. Section 3. Any person violating the provisions of this local law shall be subject to a fine not exceeding $500.00 or to imprisonment for a period not exceeding 10 (ten) days or to a combination of the above. Section 4. This local law shall take effect immediately upon filing with the Secretary of State. The following resolution was introduced by COUNCILMAN JOHNSON who moved its adoption: WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 13th day of August, 1979, a proposed Local Law entitled, "Regulating the Opening of Fire Hydrants in the Town of Wappinger, and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 27th day of August, 1979 at 7:00 P.M. EDT, on such day at Town Hall, Mill Street, in the Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk•in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by: Councilwoman Mills Roll Call Vote: 4 Ayes 0 Nays The following Loeal,Law was introduced by COUNCILWOMAN MILLS: BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1. It shall be unlawful for any person to remove, destroy, damage, deface, paint, or otherwise alter in any manner whatsoever any public sign within the Town of Wappinger, including but not limited to street signs, traffic regulation or advisory signs, directional signs, speed limit signs, safety signs, traffic lights or any other public signs of any nature or character. Section 2. Persons violating this local law shall be subject to fines not exceeding $100.00 or incarceration for a period not exceeding 5 (five) days or both. Section 3. Notwithstanding the foregoing, the Town may recover from any person violating this local law by appropriate civil action that sum of money necessary to reimburse the town for any damage caused by such person together with such action, including reasonable attorney's fees. Section 4. If any part, section, sentence, word, or other portion of this local law is found to be invalid by a court of competent jurisdiction, such finding of invalidity shall not affect that portion of the local law not found to be invalid. Section 5. This local law shall take effect immediately upon filing with the Secretary of State. The following resolution was introduced by COUNCILWOMAN MILLS who moved its adoption: 3 WHEREAS, there has been duly presented and introduced at a meeting of this Town Board on the 13th day of August, 1979, a proposed Local Law entitled "Prohibiting Destruction of Public Signs", and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing thereon has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 27th day of August, 1979, at 7:15 P.M. EDT, on such day at Town Hall, Mill Street, in the Village of Wappingers Falls, Dutchess County, 1411110 New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall and by publishing such notice at least once in the official newspaper of the Town of Wappinger. The following resolution was offered by COUNCILMAN JENSEN, who moved its adoption, seconded by Councilwoman Reilly, to -wit: A RESOLUTION AUTHORIZING THE CONSTRUCTION OF DRAINAGE IMPROVEMENTS IN AND ALONG VARIOUS TOWN HIGHWAYS IN AND FOR THE TOWN OF WAPPINGER, DUTCHESS COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $254,375 AND AUTHORIZING THE ISSUANCE OF $241,000 SERIAL BONDS AND $13,375 CAPITAL NOTES OF SAID TOWN TO PAY THE COST THEREOF. BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New Yokk as follows: Section 1. The construction of drainage improvements in and along various Town highways in and for the Town of Wappinger, Dutchess County, New York, is hereby authorized at a maximum estimated cost of $254,375. Section 2. The plan for the financing of such maximum estimated cost is as follows: a) By the issuance of $245,000 serial bonds of said Town, hereby authorized to be issued therefor pursuant to the Local Finance Law; and b) By the issuance of $13,375 capital notes of said Town, hereby authorized to be issued therefor pursuant to the Local Finance Law. Such capital notes shall be sold at private sale, and all further powers in connection with the details and sale thereof are hereby delegated to the Supervisor of said Town in accordance with the Local Finance Law. Im- provement rIm- provement Area shall consist of a water piping system for the connection of new wells into the existing water distribution system of Central Wappinger Water Improvement Area No. 1, heretofore established in said Town, including a control building, chlorine contact and soda ash tanks, hydrants, valves,. and all other original furnishings, equipment, machinery and apparatus required in connection therewith, and including land and rights -in -land; and WHEREAS, it is hereby determined that the maximum amount proposed to be expended for said improvement is $245,000, which shall be financed by the issuance of serial bonds of said Town to mature in annual installments over a period not exceeding forty years, which cost shall be assessed, levied and collected from the several lots and parcels of land in said Central Wappinger Water Improvement Area No. 1-a in just proportion to the amount of benefit which such improvement shall confer upon such lots and parcels; and WHEREAS, it is now desired.,to call a public hearing on the foregoing matter pursuant to subdivision 3 of Section 209-q of the Town Law; NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. Section 2. The Town Clerk is hereby authorized and directed to give notice of such public hearing in accordance with the requirements of subdivision 3 of Section 209-c of the Town Law. Section 3. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or purposes is forty years, pursuant to subdivision 4 of para- graph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such obligations as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. There shall annually be levied on all the taxable real property in said Town a tax sufficient to pay the principal of and interest on such obligations as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor of said Town, the chief fiscal officer. Such notes shall be of such terms, form, and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds, capital notes, and bond anticipation notes may be contested only if: a) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or b) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit, or proceeding contesting such validity is commenced within twenty days after the date of such publication, or c) Such obligations are authorized in violation of the provisions of the Constitution. Section 7. Upon this resolution taking effect, the same shall be published in full in the W&SD News, which is hereby designated as the official newspaper of said Town for such purpose, together with a notice of the Town Clerk in sub- stantially the form provided in Section 81.00 of the Local Finance Law. Section 8. This resolution is adopted subject to permissive referendum. Mr. Jensen replied yes, this was for Bel -Aire Storm Sewer and Widmer Road Culvert. The next item was an Ordinance regulating water and sewer service pipes, however, more information was forthcoming from the Building Inspector's office and the Engineer and the Board took no action. MR. JOHNSON moved to table action on this Ordinance until the next meeting. Seconded by Mrs. Reilly Motion Unanimously Carried The Town Clerk had been served with five Tax Reviews, namely: City of New York, Central Dutchess Nursing Home, Hidden Hollow, White Gates Associates and Wappinger Associates. MR. JOHNSON moved that these Tax Reviews be referred to Rosen, Crane and Wolfson, Attorneys, to defend on behalf of the Town of Wappinger. Seconded by Mrs. Reilly Motion Unanimously Carried A Public Hearing having been held by the Town Board on an Ordinance Amending the Zoning Ordinance and Map of the Town of Wappinger (Rt. 9 Commercial Adjustments), on July 30, 1979, the matter was now placed before them for their consideration. Mr. Johnson felt they should not act on this matter tonight as the new Zoning Ordinance was not in effect and it would be inappropriate to vote on amendments to an ordinance that is not a working one. MR. JOHNSON moved to table action on this matter. Seconded by Mrs. Reilly Motion Unanimously Carried 123 7 Mr. Hirkala, being recognized by the Chair, asked when the legal notice was published on this Zoning Amendment. He had not seen it in the local newspaper and when he called the Town Hall that day (July 30th) he said he was told there was no public hearing, just an informational meeting. He always attended these public hearings and was upset that he was misinformed. A Public Hearing having been held by the Town Board of the Town of Wappinger on an Ordinance Amending the Zoning Ordinance of the Town of Wappinger Prohibiting Gasoline Storage Tanks in Residential Areas, the matter was now placed before them for their consideration. The following Ordinance was offered by MR. JENSEN who moved its adoption: BE IT ORDAINED by the Town Board of the Town of Wappinger as f llows : The Zoning Ordinance adopted by the Town Board of the Town of Wappinger on January 29, 1963, is amended as follows: Section 1. Section 459.00 459.01 459.02 Section 2. This prescribed by Town Law Seconded by Mr. Jobnson Storage of Gasoline No storage of gasoline for use in motor vehicles or other motors shall be permitted in any residential zones. This section shall not apply to temporary storage of gasoline in portable containers having a capacity less than five gallons. Ordinance shall become effective as Section 265. Roll Call Vote: 4 Ayes 0 Nays A memo was received from Mr. Ryan requesting the transfer of $236.00 from B1990.4 Contingency to B8020.4 Planning Contractual. These vouchers were for consulting services of Frederick Clark Associates in connection with the revised Zoning Ordinance and for professional services of a court stenographer for public hearing of June 26, 1979. MR. JOHNSON moved that the transfer be approved of $236.00 from B1990.4 Contingency to B8020.4 Planning Contractual for additional zoning expenses. Seconded by Mrs. Reilly Roll Call Vote: 4 Ayes 0 Nays 23 8 Another memo was received from Mr. Ryan requsting authorization of payment of vouchers for expenses incurred in the lawsuit of Lombardi vs. Town of Wappinger. One in the amount of $412.50 for Paggi & Martin, Testimony, one in the amount of $3,686.51 for Rudolph E. Lapar, E.B.T. MRS. REILLY moved that Mr. Ryan be authorized to pay these vouchers as requested. Seconded by Mrs. Mills Motion Unanimously Carried A letter was received from Jeffrey R. Otto, Attorney for the Boards of Commissioners of the Hughsonville Fire District and New Hackensack Fire District concerning a change in the boundary lines of these two fire districts. According to Town Law, Section 172-a, a written petition signed by a majority of the members of the board of fire commissioners of each fire district shall be submitted to the Town Board and a public hearing must be held. The Town Clerk had notified the attorneys of this requirement, but had received no further communication from them. MR. JOHNSON moved to table this matter. Seconded by Mrs. Mills Motion Unanimously Carried Mr. Johnson reported that they had received tacit approval from the Department of Interior to use the Castle Point Site for a landfill for a Fall Clean -Up and possibly the Spring Clean -Up, since the time has been proposed for approximately one year. There were conditions attached to this approval and Mr. Johnson requested that copy of this correspondence be 'given to Mr. Horton and Mr. Lapar, in order for them to review these conditions and respond to the Department of Interior. MR. JOHNSON moved to refer the information from the Department of Interior to the Town Engineer and Highway Superintendent, and direct the Highway Superintendent to prepare the site at Castle Point, upon approval of the Department of Interior and the Dutchess County Department of Health to use said site for the Town Fall Cleanup, and possibly a Spring Cleanup . Seconded by Mrs. Mills Motion Unanimously Carried 12. Mr. Johnson reported that he had contacted EcolSciences, Inc. for an estimate to prepare a draft Environmental Impact Study on the proposed Zoning Ordinance. The reason he chose this firm was because they were presently doing the Study on the Tri -Municipal District and they were familiar with the Zoning Ordinance, and he felt this would save the Town both time and money. The first response from them was not sufficient and Mr. Johnson requested another proposal and expected to receive it very shortly. A discussion followed with Mr. Incoronato, after he was recog- nized by the Chair, on the procedures the Board was following with the EIS. He did not agree with the Board with their intentions of comparing the 1963 zoning Ordinance and the pro- posed Zoning Ordinance and the application He further commented that the Board should Conservation Advisory Council on was also recognized by the Chair the draft and added their procedures and felt the Board should of the SEQRA law. consult with the EIS. Mr. Hirkala, his comments on take a long hard look at their actions and even if it took longer it should be done properly, do not look at just the minimum requirements, go beyond that. Mr. Johnson met with the Recreation Commission regarding the report on the Capital Improvement Plan that had been requested from them. They had questions to discuss with the Committee and this report would probably be submitted in the next two weeks. Mrs. Reilly reported that she had met with the architect that was doing the Space Needs Survey on the proposed Town Hall --she had received the report and would present it at the next meeting. Mr. Jensen reporting on Tri -Municipal, stated that the EIS was still going on, and the Federal Government was coming in with new PRM's which they feel are required and these are being studied. The draft EIS is still slated for completion in July 1980 and there will be additional informational meetings probably in September of 1979 and they will be looking for additional input from the four communities involved. 240 Under unfinished business, reports were received both from Mr. Lapar and the Dutchess County Department of Health giving approval for tie-in to the Wildwood Sewer District by Mr. & Mrs. Ralph Leed at 113 New Hackensack Road. Mr. Lapar noted that the tenant's policy is in effect for all districts and would apply in this case. Mrs. Mills remarked that before she voted on this matter she would like to know what the policy stated. The Town Clerk informed the Board that the policy states that the tenant pay a $500.00 fee, all expenses are their expenses, and the O&M rates will be double the normal rates,, plus the $25.00 hook-up fee and possibly a fee for a road opening permit if this is necessary. An agreement is drawn up with these conditions clearly defined and the tenant must sign this agreement before the permit is issued. MRS. MILLS moved that the Leeds be allowed to tie in to the Wildwood Sewer District subject to fees as follows: $500.00 hook-up fee, double O&M rates, $25.00 tap fee, and road opening fee if deemed necessary by Highway Superintendent, in this case, it would have to be obtained from the Dutchess County Department of Public Works and agreement to be signed by Mr. & Mrs. Leed. Seconded by Mr. Johnson Motion Unanimously Carried Mr. Johnson reported that they had met with Mr. Seymour Arkawy on the Watch Hill Water District to discuss bulk rates but did not make progress. However, leaks that have been causing a major problem have been found and repaired by now; when the next billing goes out they will know if this had any effect on the amount of consumption and if the rates will be affected. Mr. Incoronato, being recognized by the Chair, asked about a report he read on a landfill for inorganic material to be opened by the airport. Mr. Jensen informed him this was a County project, and he felt the Town of Wappinger had done their job with landfills, there are other sites they could place such a landfill. We have no other information since Mr. Pagones, County Legislator could not attend this meeting tonight. 1c1 MR. JOHNSON moved to direct a letter to Mr. Erichsen, from U. S. Cablevision requesting that he televise the Town of Wappinger Community Day, September 9, 1979, as stated in their memorandum to Town Officials stating that they would like to televise local functions. Seconded by Mrs. Mills Motion Unanimously Carried Mr. Jensen requested Mr. Horton to check on the area of Ketchamtown Road off of Route 9D where there is a bad curve and if signs are not alteady installed, would he please put warning signs there; he had received complaints on this. If one is already there, it seems it is too far a distance from where the curve is. Mr. Horton replied he would check this out but a sign must be 450' before the curve. 1241 MRS.
