A Special Meeting of the Town Board of the Town of Wappinger was
held on February 23, 1979, at Town Hall, Mill Street, Village of
Wappingers Falls, Dutchess County, New York.
Said meeting was set at the Regular Meeting of the Town Board held
February 14, 1979. Notices were sent to the newspapers and radio
1! stations and notice was posted on the Town Clerk's Bulletin Board.
Supervisor Diehl opened the meeting at 5:25 P.M.

Mr. Diehl stated that the purpose of this meeting was to consider
setting a public hearing on a proposal received from Sheraton
Enterprises on a Recreational Use Development and any other business
that may come before the Board.
MR. DIEHL moved that a Public Hearing be set on a proposal received
from Sheraton Enterprises requesting a Recreational Use Development
on March 14, 1979 at 7:00 P.M. to hear all persons interested that
may wish to speak on this proposal.
Seconded by Mrs. Mills

MR. JENSEN moved to refer this proposal to Dutchess County Depart-
ment of Planning, Town of Wappinger Planning Board for their review
and recommendation and also that a copy of this be sent to Mr. Lapar,
Engineer to the Town and all agencies be supplied with the Environ-
mental Study that accompanied this proposal.

Group Life Insurance

proposals for Group
Of the various proposals submitted, Marshall and Sterling's
proposal from "Phoenix Mutual Life Insurance Company" at $.695
per $1,000 in insurance is the least expenseive of the term
insurance companies. This will be a monthly cost of approximately
$200 per month.
There is also a proposal from Equittable Life for a policy
whereby the employee contributes as well as the employer. It
would cost the town approximately $211 per month. The advantage
is that it is like a whole life policy in that the actual value
accrues in the policy. The disadvantage is that the average age
of our employees is 44 years old and therefore the average employee
contribution is $19.86. per month.
The current coverage expires on 2/28/79 and the town should
award the policy this month.

MRS—MILLS moved that the firm of Marshall and Sterling be
appointed to provide Group Life Insurance for the Town of Wappinger
employees.

Mr. Logan wrote to the Town Board on two matters: one was a
letter from Roberta Fitzgibbons, All Angels Hill Road stating that
the assessment on their property which was in the Central Wappinger
Water Improvement was for a full unit and it should have been 1/3
of the assessment; tax bills for 1976, 77, 78 and 79 were enclosed.
The other matter was an erroneous assessment on the Widmer Inn
Restaurant placing them in the Wappinger Sewer Improvement #1.
At one time they were placed within this improvmment area and then
removed, however, they were back on again this year.
The Board was in doubt about the refund Mrs. Fitzgibbons was
evidently inquiring about and seeking for previous years.
MR. JENSEN moved that the request of Mrs. Fitzgibbons on erroneous
benefit assessment of 100% instead of 33 1/3%, and refund of over-
paid assessment be referred to the Attorney for review.

MR. DIEHL moved that the Comptroller and Receiver of Taxes take
the necessary action to refund the Widmer Inn Restaurant monies
paid due to property being included in the Wappinger Sewer Improve-
ment #1 erroneously.

The following Local Law was introduced by SUPERVISOR DIEHL:
A LOCAL LAW RELATING TO THE IMPOSITION
CHARGE AND COLLECTION OF WATER RATES FOR
THE CONSUMPTION AND USE OF WATER FOR THE
WATCH HILL WATER IMPROVEMENT AREA AS WELL
AS THE PENALTIES AND ENFORCEMENT THEREOF.
BE IT ENACTED by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
SECTION 1: Imposition and Computation of Water Rates
A. All water rates are payable quarterly and the minimum
rate shall be payable even though no water is consumed, if a
service line is connected with district main unless prior to
the commencement of the quarter the service line is shut off
by the district at the curb box at the request of the owner.
Requests for termination shall be made no later than ten (10)
dayspriorto the end of a quarter. The minimum rate shall
be payable even though the water has been shut off when such
discontinuance has been made by someone not authorized by the
district. District shall mean the Watch Hill Water Improvement
Area.
B. Each owner or tenant of real property using or connected
to the said water system shall pay a water charge at the said
rates as set forth below:

or part thereof
The owner or tenant shall pay a minimum charge of $25.00 per
quarter regardless of the amount of water consumed for said
quarter if that said owner or tenant is connected to the system
for more than thirty (30) days during said quarter. No minimum
charge shall be assessed for connection to the system for less
than thirty (30) days during a quarter.

SECTION 2: Payment and Enforcement of Water Rates
A. All water bills shall be due and payable within
thirty (30) days of the billing date. After the expiration
of thirty (30) days, a penalty equal to ten%(10) of the amount
unpaid shall be added to that bill.
B. Said water charges shall constitute a lien upon the
real properties served by the water system of the district and
such lien shall be prior and superior to every other lien or
claim except the lien of an existing tax, assessment, water
rate, sewer rent or other lawful charge imposed by the Town.
Said lien shall apply whether water charges were incurred by
the owner or tenant.
SECTION 3:
This Local Law shall take effect immediately upon adoption,
and as provided by the Municipal Home Rule Law.
The following resolution was introduced by SUPERVISOR DIEHL
who moved its adoption:
WHEREAS, there has been duly presented and introduced
at a special meeting of this Town Board on the 23rd day of
February, 1979, a proposed Local Law relating to the imposi-
tion charge and collection of water rates for the consumption
and use of water for the Watch Hill Water Improvement Area
as well as the penalties and enforcement thereof and,
WHEREAS, the provisions of the Municipal Home Rule Law
requires that no local law shall be passed by the Legislative
Body of the Town until a Public Hearing thereon has been held
before such body,
NOWI THEREFORE BE IT RESOLVED,
1. That a Public Hearing
proposed Local Law by the Town
on the 14th day of March, 1979

at 7:15 P.M. on such day at
Village of Wappingers Falls,
2. That at least five (5) days notice of such hearing
shall be given by the Town Clerk of the Town of Wappinger,
by the due posting thereof upon the bulletin board maintained
by said Town Claerk in the Town Hall and by publishing such
notice at least once in the official newspaper of the Town of
Wappinger.

A request was received from the Recreation Commission for
permission to attend the 1979 New York State
Park Convention and Exhibition from April 22
1979 at the Nevele Country Club, Ellenville,
Recreation and
through April 25,
New York.
MR. JENSEN moved to grant permission to any member of the
Recreation Commission who wished to attend the aforementioned
convention from April 22 through April 25 and their legitimate
expenses would be a Town charge. This permission was granted
subject to the conditions of the Town policy that only one
overnight conference was allowed for each person yearly,
other than elected officials.
