ADJOURNMENT 954 The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 5, 1979 at 5:00 P.M. at Town Hall, Mill Street, Village of Wappingers Falls, County, New York. Supervisor Diehl opened the Meeting at 5:05 P.M. Present: Louis Diehl, Supervisor Leif Jensen, Councilman Nicholas Johnson, Councilman Bernice Mills, Councilwoman Janet Reilly, Councilwoman Elaine Snowden, Town Clerk Others Present: William Horton, Highway Superintendent Matthew Ryan, Comptroller Dutchess The Supervisor appointed Leif Jensen as Deputy Supervisor and Gail Evans as Bookkeeper. Mr. Horton appointed Kenneth, Croshier as Deputy Highway Superin- tendent. Mrs. Snowden appointed Gladys Ruit and Ethel Relyea as her two Deputies. The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders Of such offices and positcions payable every other Friday throughout the year 1979, with 26 pay periods during such year, with the first payday to be on January 12th, 1979. RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holders of these designated paydays of the year 1979. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JENSEN who moved its adoption: RESOLVED, that the pay scale for the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following minimum to maximum hourly rates: Heavy Motor Equipment Operator Light Motor Equipment Operator Ldborer Foreman $6.17-$6.41 per hour 6.11- 6.21 per hour 4.30- 6.08 per hour 6.81 per hour Time and one-half for overtime over 40 hours. AND BE IT FURTHER RESOLVED, that all of such Highway Depart- ment employees engaged on an hourly basis shall be paid every other Friday throughout the year 1979, with the first payday to be January 12, 1979. Seconded by Councilwoman Reilly Roll Call Vote: 5 Ayes 0 Nays Before the vote was taken on this resolution which originally read $3.50 per hour pay scale, Mr. Diehl requested that the Board raise this hourly pay to $4.00 per hour. His reason was that the lowest pay scale of any municipality in this area for part time patrol is $3.75 per hour, part time Deputy Sheriff's pay is set at $5.00 per hour. Mr. Diehl remarked that it is becoming extremely difficult to find personnel at the pay level we now have and he strongly recommended the hourly pay be to $4.00 per hour. raised The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that William Nepfel, George Wells and James Vicalvi be and they are hereby appointed to serve as Dog Wardens for the Town of Wappinger, Dutchess County, New York at the pleasure of the Town Board, and it is further RESOLVED, $4.00 per call Seconded by Mrs Roll Call Vote: that they shall receive compensation thereof at plus mileage. . Reilly 5 Ayes 0 Nays The next resolution was for the appointment of Town Enforcement Officers; the Board had received no recommendations from Justice Court. The resolution named four people and theTown Board questioned whether they could have more people and were they limited to four. There was no information available at the time, on this matter. Mrs. Mills requested that they act separately on 95 the people named in the resolution. The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: RESOLVED, that the following person be and he hereby is appointed to serve as enforcement officer in and for the Town of Wappinger, Dutchess County, New York, at the pleasure of the Town Board: ARTHUR WADDLE AND IT IS FURTHER RESOLVED, that the aforesaid person so designated as an enforcement -officer shall be paid no salary by theTown Board but shall be entitled to collect the statutory fees allowed by law. AND IT IS FURTHER RESOLVED, that the aforesaid person so designated as an enforcement officer shall be paid no salary by the Town Board but shall be entitled to collect the statutory fees allowed by law. The following resolution was offered by COUNCILMAN JOHNSON who moved its adoptioN: RESOLVED, that all of the official bonds and undertakings by the officers, clerks or employees of the Town of Wappinger may be in the form of a blanket undertaking from any duly authorized corporate surety and said undertaking shall indemnify the Town of Wappinger against the loss of the type more particularly set forth in Section II of the Public Officers Law. Seconded by Mrs. Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JENSEN who moved its adoption: RESOLVED, that the Marine Midland National Bank of Southeastern New York, Dutchess Bank and Trust Company, the Chemical Bank of New York, the Chase Manhattan Bank and the Empire National Bank, each being a banking institution main- taining banking rooms and offices in Dutchess County, New York, be and they each hereby are severally designated as depositories of the moniesof this Town, and it is further RESOLVED, that the Town Clerk be and she hereby is directed to give notice of such designation to each of said banking institutions. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that monthly meetings of the Town Board of the Town of Wappinger, shall be held at 8:00 P.M., at the Town Hall, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, in the evening of the second Monday of each month, or at such other place or places within the Town of Wappinger as the Town Board shall from time to time designate. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that the firm of Pelligrini and Sedore Certified Public Accountants be and they hereby are retained to audit the accounts and reports of theTown Supervisor, the Town Clerk and Town Justices for the year 1978, and it is further RESOLVED, that the said accountants receive reasonable compensation for the productive services which they shall render to the Town in this connection. Seconded by Mrs. Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: WHEREAS, the Town Clerk of the Town of Wappinger has numerous requests for the expenditure of small amounts of cash for postage, supplies, and miscellaneous items, for various departmentsof the Town of Wappinger. NOW, THEREFORE BE IT RESOLVED, that the Town Clerk is hereby authorized and directed to establish a petty cash fund in the sum of $50.00 for the use of said Town Clerk. Seconded by Mr. Jensen Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that a petty cash account not to exceed the sum of $200.00 and the same hereby is established for the Receiver of Taxes, and it is further RESOLVED, that payments from said petty cash account be made and that the Supervisor of this Town be reimbursed for advances made to such account in accordance with the provisions of Section 64, Subdivision la of theTown Law of the State of New York. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays The following who moved its WHEREAS, requires that resolution was offered by COUNCILWOMAN REILLY adoption: Subdivision 10 of Section 29 of the Town Law the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company where Town monies are deposited, show- ing the amount of such monies on deposit with said bank.or trust company, and cause a certified copy of such report to be published in the official newspaper. WHEREAS, in lieu of preparing the report required by Subdivi- sion 10 of Section 29 of the Town Law, the Town Board may determine by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Copptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official news- paper. NOW, THEREFORE IT IS HEREBY RESOLVED, that in lieu of preparing the report bequired by Subdivision 10 of Section 29 of the Town Law, the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report imo the State Comptroller required by Section 30 of the General Municipal Law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILWOMAN MILLS who moved its adoption: WHEREAS, it has come to the attention of this Town Board of the Town of Wappinger that there are now or may be in the future funds and monies, except proceeds of loans and monies the investment of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, in, or certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligationsof the United States of American and/or the State of New York, and WHEREAS, it appears that the temporary deposit and/or investment t100 of such excess and surplus funds may be beneficial and profitable to the Town of Wappinger, NOW, THEREFORE IT IS HEREBY RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger be and he hereby is authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section II of the General Municipal Law of the State of New York, and it is further RESOLVED, that such temporary deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section II of the General Municipal Law of the State of New York, and it is further RESOLVED, that the aforesaid Supervisor of this Town be and he hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this resolution. JOHNSON moved that compensation for mileage for Town Officials and employees shall be established at 17 per mile - Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays MR. JENSEN moved that the name of Philip Galioto be recommended to the Dutchess County Civil Defense to be appointed as Deputy Civil Defense Director for the Town of Wappinger for 1979. Seconded by Mrs. Reilly Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered by COUNCILMAN JOHNSON who moved its adoption: RESOLVED, that James Mills, Jr. be and he hereby is appointed to fill the vacancy on the Planning Board of the Town of Wappinger, which has occurred by reason of the expiration of his term, and it is further RESOLVED, that the said James Mills, Jr. is hereby appointed to the said Town of Wappinger Planning Board for a term which shall expire January 1986. Seconded by Mrs. Reilly Roll Call Vote: 4 Ayes Mrs. Mills- -Abstained MR. JOHNSON moved that Victor Fanuele be reappointed as Chairman of the Planning Board, as recommended by that Board. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays A recommendation for Chairman of the Zoning Board of Appeals had not been received from that Board and Mr. Diehl directed that they be contacted to submit their recommendation. MRS. MILLS moved that Joseph Landolfi be named Chairman of the Zoning Board of Appeals until a recommendation is received from that Board. Seconded by Mr. Johnson Roll Call Vote: 5 Ayes 0 Nays 9 62 COUNCILWOMAN REILLY moved that Hugh J. Maurer be named Chairman of the Recreation Commission. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays The Town Board had compiled a Governing Policy of all Town Depart- ments regarding hours of operation, basic requirements of various positions in conjunction with established duties, vacations, sick tiO leave and personal days and holidays. This policy had previously been discussed with department heads and copies were now available for those interested. In order that those present could acquaint themselves with the policy, the matter was tabled until later in the meeting. L MR. JOHNSON moved to grant permission to all officers, officials and certain employees of the Town of Wappinger to attend the Association of Towns meeting, February 18th through the 21st of February 1979, and that their actual and legitimate expenses be a Town charge. Seconded by Mrs. Mills Roll Call Vote: 5 Ayes 0 Nays Mr. Johnson explained that he used the wording "certain employees" in his motion to indicate that everyone who worked for the Town of Wappinger did not have "carte blanche" to attend this meeting; the qualification would be a need or benefit to the Town or to that person on behalf of the Town to attend. MR. DIEHL moved that Mrs. Mills be designated as Representative of the Town of Wappinger at the Association of Towns' Meeting. Seconded by Mrs. Reilly Roll Call Vote: 4 Ayes Mrs. Mills --Abstained MR. JOHNSON moved that Mr. Diehl be designated as Alternate of the Town of Wappinger at the Association of Towns' Meeting. Seconded by Mrs. Reilly Roll Call Vote: 4 Ayes Mr. Diehl --Abstained Mr. Diehl had received a recommendation from Mr. Maurer, Chairman of Recreation Commission for a caretaker, for George Schlathaus's house which was left to the Town last year after the death of Mr. Schlathaus. Mr. John Vorndran was the person named for the caretaker's position; he had agreed to pay $200.00 a month plus utilities and also agreed to maintain the property and the building. Mr. Jensen felt that the Board should meet the person desiring to take this position, whether it be Mr. Vorndran or someone else. An agreement should be drawn up, the name to be added later, and everything should be clearly understood before any action was taken. Mr. Diehl directed that this matter be referred to the Attorney to draw up an agreement to be approved by the Town Board. It was agreed that Mr Maurer and Mr. Adams should consult on this matter until a mutual agreement can be presented to the Board. MR. JENSEN moved that after this agreement was drawn up by Mr. Adams including the recommendations of Mr. Maurer and subsequently approved by the Town Board, the Board and Mr. Maurer should then meet with and interview Mr. John Vorndran as a potential tenant for Mr. Schlathaus's house and hopefully come to a mutual approval of this matter. Seconded by Mr. Johnson Motion Unanimously Carried M. JoHilson brought up a Town policy on conferences that had been previously adopted. This policy allowed one overnight conference for all department heads and employees, it excluded elected officials. MR. JOHNSON moved that Town personnel be allowed to go to one over- night convention with the exception that department heads be allowed to go to any function with prior approval of the Town Board that proves to be beneficial to the Town and further if the depart- ment head cannot attend but feels someone in his or her department should attend, he or she may designate a person to attend. Seconded by Mrs. Mills Motion Unanimously Carried The new Governing Policy of the Town was now brought up for action by the Board. By this time those present had digested the items 964 included and there was discussion from the employees present. Mrs. Eleanor Croshier, Secretary to the Town Justices informed the Board that she worked over 35 hours every week; how would she be remunerated. Mr. Johnson explained that certain jobs require certain time at meetings or court that go along with the job. For example, the secretary to the Zoning Board and Planning Board should attend the meetings of these Boards and the secretary to the Justice Court would be expected to attend court sessions. On the last the page of the Policy under "Extra Work'it stated that full time salaried employees who have been requested to work additional hours over and above their normal prescribed duties may be compensated with Town Board approval; said compensation may either be by compensatory time off, or by renumeration. Mrs. Croshier informed the Board that, in her case, it was not extra work above her normal duties, this was constant. He cited an example of the Zoning Board secretary having to do extra typing for a new zoning ordinance; this would be considered extra work and she could, if she desired, receive "comp time" for this and take the time in the week or two that followed, or renumeration. This explanation, however, did not satisfy Mrs. Croshier, as she was putting in her extra work weekly, it was not just a one time event. She felt that the policy was too general, they should have been more specific. Their intent seemed to be to have everyone work 35 hours. Mr. Johnson disagreed with that; some of the jobs involve more than 35 hours, this was established when the positions were filled, it's the part of the job. At one time, he said the pay scales were low, but some of them have really escalated. Mrs. Croshier was not satisfied the with these facts and Mr. Johnson informed her that if there is a problem, it will have to be discussed with them, the department head and the employer. She felt her situation was unique and furthermore just because our hours start at 9 A.M. you don't walk into work at that time, nor do you leave at the prescribed time, especially when attorneys walk in and out. Mr. Johnson reassured her the Board wanted to do the right thing by her and they would gladly talk it out whenever a situation arose that needed discussing. Mrs. Frisina, Secretary to the Highway Superintendent told Mr. Johnson he brought up a good point about the 12. hour mandatory lunch break, but the office had to remain open. She could not do both; there's only one person in that office. The Board felt they might have to come up with a different phone system; they just wanted to make sure telephones were answered. The Board wanted everyone to have lunch without working, but ----keep the offices opened. In some cases, they would have to change the existing procedures. Mrs. Frisina then asked --are you saying that this is a start, it's open to amendment, to change, to adjusting, as the problems come up? Mr. Johnson responded that they would always be open to amendments, it's their first attempt to draw up a personnel policy and as the problems arose, they would take them into consideration. This was his opinion, but the Board agreed. Mr. Lloyd Anderson of the Highway Department thought the Board opened "a can of worms". They work sometimes 10 and 12 hours plowing snow, the State Law says you can only go 6 hours without a break. Mr. Johnson informed him that the hourly paid employees in the highway are under the jurisdiction of the Highway Superin- tendent and this 1/2 hour, mandatory break does not'pertain to over- time*of these -men.: They are on hourly pay; you don't have to take a break on overtime hours if you don't want it. Michael Krisko, member of the highway department complained about the new policy on personal days --they don't have six days anymore, it's up the discretion of the department head. Were they telling him he could take off any time he wants? The answer was negative; the Board assumed that when an employer asked for this time, the department head would decide if he needed it. If they made a practice of taking it every week or every other week, it certainly would not always be granted. The Board felt it was to their advantage; suppose there was an emergency, suppose they needed more than 61/2 days; if the situation arose and it was warranted, the employer would be granted the extra personal days. Mr, Krisko also stated they were not happy with the 7% salary increase. He was informed that figuring all benefits it was close to an 11% raise. Mr. Krisko was not interested in benefits, his interest was monetary; he wanted the hourly rate increased. He felt it ko 9 6 6 was an insult offering them a 7% raise. When told by Mrs. Mills that he might notappreciate the benefits now but would when he was older, he said the present was important to him, he did not care when he was fifty. Mr. Horton offered the information that about 5 years ago, the personal days were offered to the highway, with no pay raise; now they were taking that away from them. At that time, hospitali- zation was also given in a package deal. Suppose he wasn't the Highway Superintendent one year or more from now, it's up to his discretion; suppose a new one preferred not to give them this time when they asked for it. When this package deal was negotiated, everything was done in good faith, now this Board is changing all that; it didn't seem fair to him. They have no protection. The Board felt if the men had this problem, they could go to the Town Board, but Mr. Horton felt they shouldn't have to go through that. Another item brought up was sick days; this had not been included in the new policy, however the old policy stated that 120 days could be accumulated and one day per month was allowed. Mr. John Buckley of the highway department said he never used his sick leave; he had accumulated 120 days, now he was losing them. The Board stated that this policy did not change. Mr. Buckley insisted he was losing a benefit; he wanted it there even though he didn't use it. If it was raised to 165 days accumulated when he retires he can use it. The State has that policy (165 days). Mr. Jensen felt the policy should be adopted tonight and they the could give consideration to the points that were brought up; perhaps at a future time they could raise the number of accumulated sick days allowed, but for now they should have a working policy. MR. JENSEN moved that the Governing Policy for all Town Departments beadopted with an amendment that the Sick Day Policy be added to it, one day per month, not to exceed 120 days accumulation. Seconded by Mr. Johnson Motion Unanimously Carried 967 TOWN OF WAPPINGER GOVERNING POLICY OF ALL TOWN DEPARTMENTS HOURS OF OPERATION BASIC REQUIREMENTS OF VARIOUS POSITIONS IN CONJUNCTION WITH ESTABLISHED DUTIES. VACATIONS, SICK LEAVE & PERSONAL DAYS, HOLIDAYS January 1, 1979 In order to maintain uniformity throughout all Town of Wappinger Departments and Town of Wappinger Offices, the following will apply as of January 1, 1979: HOURS OF OPERATION All Town Offices such as 1. Supervisor 2. Town Clerk 3. Comptroller 4. Building Inspector 5. Zoning Administrator 6. Receiver of Taxes 7. Highway 8. Justices 9. Assessor will be open Monday through Friday from 9:00 NOTE: Office employees are expected to take lunch break during these hours, however, the open during said hours. HOURLY PAID HIGHWAY EMPLOYEES A.M. to 4:30 P.M. their half 1/2 hour offices will remain Hourly paid Highway employees starting time will be set by the Highway Superintendent (Example: 7:30 A.M. to 4:00 P.M. providing an eight (8) hour work day, and allowing half (1/2) hour for lunch each day). BASIC REQUIREMENTS OF VARIOUS POSITIONS IN CONJUNCTION WITH ESTABLISHED DUTIES The following will apply for various appointed positions as part of said employees job: 1. Comptroller, Assessor, Receiver of Taxes, Building Inspector, Zoning Administrator: To attend any meeting requested by the Town Board, Planning Board and/or Zoning Board of Appeals. 2. Secretary/Clerk to the Planning Board and Zoning Board: To attend the regular scheduled meetings of said Boards. 3. secretary/Clerk to the Highway Superintendent: a. To attend any meeting requested by the Highway Superintendent and/or Town Board. b. To assist with various Town Hall duties when work load permits; re: half (1/2) day at Highway Office and half (1/2) day at Town Hall. 4. Secretary/Clerk to the Town Justices -Town Justice Court: To attend any meeting and Court appearance as requested by the Town Justices. 5. Seturetary/Clerk to the Comptroller: To attend any meeting and/or work session as requested by the Town Board and/or Comptroller for such items as preparing and finalizing the Town Budget. 6. Secretary/Clerk to Assessor: To attend meetings and/or work sessions required by the Assessor for such items as Assessment Rolls and Grievance Procedures. VACATION The following Vacation Plan is for full time employees, will be implemented January 1., 1979 for new employees: After After After After 1 year service 3 years service 5 years service 10 years service Imo Ma 1 week 2 weeks 3 weeks 4 weeks NOTE: Full time employees hired before January 1, 1979 will still receive 3 weeks vacation and those full time employees with 10 or more years of service will be entitled to 4 weeks vacation. PERSONAL TIME OFF and Department Heads may grant personal time off to full time employees based on need and employment record. DEATH IN FAMILY Full time employees may be granted, if necessary, two (2) days bereavement in case of death of Immediate Family re: Husband/Wife, Son, Daughter, Mother, Father, Mother -In -Law, or Father -In -Law.
