1978-08-21 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on August 21, 1978 at Town of Wappinger Justice Court, 14-16 Old Route 9, in the Town of Wappinger, Dutchess County, New York to consider Sewer District & set granting a franchise a rate structure a Public Hearing for Fleetwood Water & on same; for U.S.Cablevision, Inc. to consider and to consider, direction the Town wishes to take for possible application for "Round 3" E.D.A. Grants. Notice of said meeting was mailed to each Board member on August 16, 1978, calling the meeting for 7:30 P.M. 21, 1978. Notices were also given of said meeting Poughkeepsie Journal,Southern Dutchess News on August to the (W&SD) and the Beacon Evening News, Radio Stations WBNR, WHPN, WEOK and WKIP. A notice was posted on the Town Clerk's bulletin August 16, 1978. Supervisor Diehl opened the meeting at 7:30 P.M. Present: Louis Diehl, Supervisor Nicholas Johnson, Councilman Leif Jensen, Councilman Janet Reilly, Councilwoman Bernice Mills, Councilwoman Elaine H. Snowden,. Adams, Attorney Rudolph Lapar, Engineer to the Town Matthew Ryan, Comptroller The following Local Law was introduced by Councilman JENSEN: A'local law amending Local Law #7 of 1975 establishing rates for the Fleetwood Water Bistrict, BE IT ENACTED by the Town Board of the Dutchess County, New York, as follows: SECTION 1: SECTION 2: A minimum of whichever is SECTION 3: Town of Wappinger, Section 1 of Local Law No. 7 of 1975 is hereby amended: The following rates shall be charged for the Flitetwood Water District; $9.90 per quarter or 70 per 1,000 Gallons, greater. This Local Law shall take effect:upon adoption and as provided by the Municipal Home Rule Law. 820 821 The following resolution was introduced by Councilman JENSEN who moved its adoption: WHEREAS, them has been duly presented & introduced at a meeting of this Town Board on the 21st day of August 1978 a proposed Local Law entitled "Local Law Amending Local Law #7 of 197(5 Establishing Rates for the Fleetwood Wanterr District and WHEREAS, the provisions of the Municipal Home Rule Law requires that no local law shall be passed by the Legislative Body of the Town until a Public Hearing theron has been held before such body, NOW, THEREFORE BE IT RESOLVED, 1. That a Public Hearing shall be held on the said proposed Local Law by the Town Board of the Town of Wappinger on the 31st day of August, 1978 at 7:30 P.M. on such day at Town Hall, Mill Street, in the Village of Wappingers Falls, Dutchess County, New York. 2. That at least five (5) days notice of such hearing shall be given by the Town Clerk of the Town of Wappinger, by the due posting thereof upon the bulletin board maintained by said Town Clerk in the Town Hall & by publishing such notice at least once in the official newspaper of the Town of Wappinger. Seconded by Mrs. Reilly. Motion Unanimously Carried The following Local Law was introduced by Councilwoman MILLS: A Local Law Amending Local Law ##4 of 1976 Establishing Rates for the Fleetwood Sewer District. BE IT ENACTED by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1: Section Section 2 of Local Law ##4 of 1976 is hereby amended. 2; The following rates shall be charged for the Fleetwood Sewer District: A minimum of $34.20 per quarter or $1.99 per 1,000 gallons of water, whichever is greater. Section 3. This Local Law shall take effect upon adops tion and as provided by Municipal Home Rule Law. The following memo was read: Memo to: From: Date: Subject: Town Board Members Matthew Ryan, Comptroller August 14, 1978 Fixed Asset Accounting Motion Unanimously Carried As we have discussed in the past, the State has mandated a system of fixed asset accounting. a list of assets with a value of $100.00 or more created and maintained. It must show: This 'must as the Town as of New York In effect, must be 1) Acquisition value 2) Depreciated value 3) Estimated replacement cost new 4) Estimated replacement cost less depreciation (Insurance value) be done for all sewer and water districts as well a whole. This is an item that is considered "specialized" and therefore is not biddable. We did, however, obtain several proposals for review. If the Town Board approves this item the proper appropriation would be: FROM CF1990.4 Federal Revenue Sharing Contingency TO CF1315.4 Federal Revenue Sharing Comptroller It should be remembered that this system must be in effect by 12/31 of this year. s/Matt Comptroller The following letter was read: August 17, 1978 Mr. Louis D.Diehl, Supervisor Town of Wappinger Mill Street W.ppingers Falls, New York 12590 Dear Lou: The New York State Department of Audit and Control has man- dated that municipalities the size of the Town of Wappinger, must adopt General Fixed Asset Accounting for years beginning in 1978. In addition to the fact that it is mandated, there are a number of considerations which makes recording and accounting for general fixed assets preferable. The purposes of recording general fixed assets are primarily stewardship needs to provide for physical and dollar value control and secondarily for an accountability for general government capital expenditures over the years. While the stewardship of dollars has always been uppermost in the minds of elected officials, generally the same has not been true of general fixed assets. While this is not true in the Town of Wappinger, this is the primary reason for the mandate. A direct result of recording general fixed assets, is the recording of depreciation. With respect to depreciation of general fixed assets, there are two reasons for a renewed interest in the subject. One is the increasing trend in the number of governmental grants, both of Federal to State and Local, and of State to Local, which allow depreciation as a reimburseable cost. Another is the need to marshall all costs including depreciation for the purposes of measuring cost of governmental services and evaluating the efficiency of programs. Motion Unanimously Carried The Board had a lengthy discussion on the availability of the E.D.A. Grants and the probability of receiving any. Mr. Johnson felt that they should apply for monies toward a new pumping station for C.W.W..#1. They would need it next year so why not apply & see if they could get a Grant for this project. MR.JOHNSON moved to direct the Engineer to prepare plans for a new pump house for C.W.W.#1. Seconded by Mrs. Mills. Motion Unanimously Carried Mr. Lapar submitted two (2) reports, one quoting three (3) in- & Water Line Shut.4ff formal bids on Orchard Homes Water Line Repair/ In each case LBJ Construction Co., Wappingers Falls, N. Y. was low bidder in the amount of $489.00 for each bid. Mr. Lapar recommended the bid be awarded to the low bidder LBJ Construction Co. MRS. MILLS moved that these two (2) bids, one for Water Line Shut - Off & one for Water Line Repair, both for Orchard Homes Water and each bid in the amount of $489.00 be awarded to LBJ Construction Co. and the Supervisor be authorized to sign the contract with said company. Seconded by Mr. Johnson Motion Unanimously Carried d 824 The Board then discussed the Franchise Renewal on Cable T.V. Mr. Adams had prepared an addendum to the original Franchise Agreement which had been submitted by the company. After con- ferring with Mr. Erichsen, General Manager of U.S.Cablevision he presented some suggestions from him. Under Paragraph 10, 2 (i) should read all VHF television stations assigned to Newyork City; the paragraph in the middle after 2 (iii), starts with "each VHF station", on second line substitute "reasonably"instead of "technically"; under Paragraph 12, start off with "should cable - vision desire to amend this ordinance ", etc. The Board desired to review these changes before acting on the proposed franchise & Mr. Diehl directed that this matter be tabled until the next regular Town Board meeting. Mr. Johnson requested the Town Clerk to send Mr. Ascenzi, Manager of Village Crest Apts. a copy of the Local Law which was recently adopted by the Board, which prohibited parking in the Fire Lanes of the Apts. An incident had been reported there and the authori- ties could find no record of the Law. Mrs. Snowden informed the Board that all law enforcement agencies & Mr. Ascenzi had been notified of the adoption of this Law, but she would send further notices. This happens time & time again she explained, because, as one trooper told her these laws are poeted,but in the course of time, pulled off of their bulletin board. On the same subject, Mr. Jensen noted that a Local Law had been passed limiting parking & standing of vehicles at the intersection of Old Rte. 9 & Old Hopewell Road, near the Town's Bell Site & there are no "No Parking" signs posted and there are cars parked all around the prohibited area. He recom- mended that a letter be sent to Highway Superintendent to please replace these signs immediately. Mrs. Milts noted that the Association of Towns Fund was almost de- pleted even though all members of Boards have not attended various conferences. She asked Mr. Ryan about the figure they were putting into next years budget & perhaps they should consider raising the Association of Towns Fund. How did he estimate it? When he re- plied they went by last year's figure, she thought they should cal- culate it further & allow for a whole Board to attend, rather than go into a minus amount on that line item so early in the year. 825 Mrs. Mills then questioned if another member from.`Planning Board or Zoning Board could attend a conference in place of another who has hit attended any during the year. There was discussion on this; there had been no deviation up to this point from the Town policy which allowed one overnight conference per person per year. Mr. Johson recommended that Mr. Diehl contact the Chairman of the Planning Board & Zoning Board and explore their feelings on the importance of a member or members attending a particular confer- ence which was forthcoming & report back to the Board for their decision in this matter.
