Supervisor Diehl, called the meeting to order at 8:00 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Nicholas, Johnson, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Others Present: Rudolph Lapar, Engineer to the Town The Minutes of the Regular Meeting of October 17, 1977, and the Special Meeting of November 7, 1977, having been previously sent to the Town Board members were now placed before them for their approval. MR. JOHNSON moved the Minutes of the October 17, 1977 Regular Monthly Meeting and the Special Meeting of November 7, 1977, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Diehl. Roll Call Vote: 5 Ayes 0 Nays Reports for the month of November were received from the Town Justices, Building Inspector and Zoning Administrator and Receiver of Taxes, the Semi -Annual Historian's Report and the Annual Report from the Conservation Advisory Council. MR. JENSEN moved to receive the reports and place them on file. Seconded by Mr. Johnson Roll Call Vote: 5 Ayes 0 Nays Mary Schmalz, being recognized by the Chair stated that she had written a report for the Recreation Commission, which she had turned over to the State, and a copy is on file with the Recreation Commission. 554 A memo had been received from Supervisor Diehl regarding the Town's obligations and cancelled obligations. He recommended that Option II, as recommended by the New York State Department of Audit and Control directing the paying agent to mail to the towns the cash statement and the list of paid cancelled obligations at the enC of each month and to retain the paid and cancelled bonds and coupons for at least one year, after which the paying agent will furnish the town with a certificate of destruction be adopted and the Comptroller be instructed to proceed with it. MR. JENSEN moved that Option II, allowing the Marine Midland Bank, as paying agents for the Town of Wappinger to mail to the Town a cash statement and list of paid cancelled obligations at the end of each month, retain the paid and cancelled bonds and coupons for one,.year, and thereupon furnish the Town with a certificate of destruction, be adopted. Seconded by Mr. Johnson Roll Call Vote: 5 Ayes 0 Nays A report on the results of bidding for two projects for the Town, Central Wappinger Water White Gates Meter Pit and Wappinger Storm Sewer Contract #10 (area of Kent Road and Cady Lane) from Mr. Lapar having been received at the November 14th meeting, was again placed before the Bodrd for consideration, as only one of the two projects had been accepted and the bid awarded. The remaining, Wappinger Storm Sewer Contract #10, had three bidders, Wilson Excavators, Inc. Dave Alexander Inc. and Joseph Ruscitti, Inc, with Wilson Excavators, Inc. apparent low bidder @ $49,779.00. The matter had been tabled in order to ascertain if monies were available to fund this project. Mrs. Winters, being recognized by the Chair, asked where is this storm drainage going to run, ana who is going to benefit by it. Mr. Lapar responded that it will run in the easement provided by Mr. Sailer between Cady Land and Fenmore Drive. Mrs. Winters said that to her knowledge there were just two homes on that portion of Kent Road, that the Town is talking about spending $49,000 for drain- age, one is their home, and they have no complaints about the drainage. It seems to them that those storm drains are being put in for the convenience of one person who is going to subdivide, and that's Mr. Sailer, it almost seems to her that it is being put in there to drain a swamp, and she is opposed to the spending of $49,000, no drainage fees are going to cover that amount of money. Mrs. Winters also contended that Mr. Sailer complained of excess water draining on his property, but Mr. Sailer also did give approval to Mr. Longhitano to dump water on his property, and Mr. Lapar has that approval signed by both Mr. & Mrs. Sailer, now we have to turn around the and pay that bill to have that water drained off, or a portion of it. Mr. Winters asked again who was going to benefit by this expenditure, there's been no complaint from people on that end of the road, who instigated the building of a storm sewer where there is obviously no need fcr it, no reason for a storm sewer. Mr. Clausen defended the project by commenting that this was not new, it had been part of a project started a number of years ago4 and this portion had been deleted. This was to have collected the water from Ye Olde Apple Orchard, and as he understands it, the funds ran out. He also IN believed that Mr. Sailer had allowed the run off on to his property temporarily with the understanding that the project would be refunded and completed. There was further discussion centered on the different aspects of this project. Mr. Sailer defended his position, said he did not agree to allow water to be dumped on his property and the lots on Baldwin Drive were the ones he gave Longhitano permission to allow the run off of the back yards to flow on his property, he did not agree to what is now there, the piped drainage from the entire Apple Orchard Development draining on to his property. Mr. Diehl agreed with Mr. Clausen in that this had been a project de- terred due to funding, if the Town had had the money this storm drain would have not been in for a couple of years. The discussion con- tinued rehashing the events leading up to this point in time. MR. CLAUSEN moved to accept the low bid of Wilson Excavators, Inc. for Wappinger Storm Sewer Contract #10 in the amount of $49,779.00 for Kent Road and accomplish the completion of a project that has been hanging for some time and authorize the Supervisor to sign the contract. %.0 57 k Seconded by Mr. Johnson Roll Call Vote: Councilman Clausen Councilman Jensen Councilman Johnson Councilman Versace Supervisor Diehl The following memo was received: Memo To: From: Subject: Dated: Aye Aye Aye Nay Aye Matthew Ryan, Comptroller William P.,Horton, Superintendent of Highways Transfer of Monies November 28, 1977 In order to meet the payroll I respectfully request of Five Thousand ($5,000.) dollars from Account DS5142.4 DR5110.1. Hopefully this will suffice to the end of the a transfer to Account year. Mr. Ryan had confirmed there were sufficient funds available to accomplish this transfer. MR. CLAUSEN moved that the requested transfer of funds for Highway in the amount of $5,000 from Account #DS5142.4 to Account DR5110.1 be approved. Seconded by Mr.Johnson Roll Call Vote: 5 Ayes 0 Nays The following memo was received: Memo To: From: Date: Subject: Town Board Members Matthew W. Ryan, Comptroller December 9, 1977 General Fund -Town Wide -Deficit As you gentlemen are aware, our State Aid per capita is due on the 15th of the months of April, July, September and December (State Finance Law 54-7d) . We were notified this afternoon that the check that we expected on 12/15 will not be mailed until at least 12/23/77 and we should not expect to receive it until 12/27 at the earliest. Therefore, we will not have sufficient funds to meet our payroll and contractual obligations on 12/16/77. In order to insure prompt payment of our obligations (including payroll), I request that the board authorize a loan from General Fund Part Town to General Fund Town Wide in the amount of $30,000.00. These funds will be repaid as soon as the state aid check is received. s/ Matthew Ryan L MR. JOHNSON moved to authorize a loan from Part Town General Fund into Town Wide General Fund in the amount of $30,000 as requested by the Comptroller. Seconded by Mr. Clausen Roll Call Vote: 5 Ayes 0 Nays The Town Clerk brought to the attention of the Board that the second meeting for the month of December would fall on the holiday for Christmas,,,, since Christman falls on Sunday, and the day there- after becomes the holiday. Mr. Jensen commented that the Annual Year End Meeting is needed anyway, so it was agreed to combine the two. MR. JENSEN moved that the second meting for December 26th be cancelled and rescheduled for December 29, 1977 at 7:00 P.M. and be considered as also the Annual Year End Meeting. Seconded by Mr. Clausen Roll Call Vote: 5 Ayes 0 Nays MR. JOHNSON moved that the Reorganizational Meeting be scheduled for January 2, 1978 at 5:00 P.M. attheTown. Seconded by Mr. Jensen Roll Call Vote: 5 Ayes 0 Nays The following resolution was offered. by SUPERVISOR DIEHL who moved its adoption: 556 BE IT RESOLVED that the Town of Wappinger heartily endorses the goals and purposes of the Dutchess County Chapter of the American National Red Cross Blood Program in cooperation with the 01110 Hudson Valley Blood Services, a division of The Greater New York Blood Program. We realize the need for blood and blood products, and accept our community responsibility to care for our fellow man. We, the Town Board of Wappinger, call on the citizens of the Village and Town to demonstrate their concern for the health of our neighbors by giving the gift of life ---blood. The first community visit will be sponsored and coordinated by the Rotary Club of Wappinger. We urge all residents to actively contribute to this vital life saving program. Seconded by Mr. Johnson Roll Call Vote: 5 Ayes 0 Nays Mr. Lapar forwarded the information regarding the Blood Program, that the participation in this program would guarantee the right of blood without any payment to the donor or his immediate family, a pint a year is the pledge. The following letter was received from the Attorney to the Town: December 9, 1977 Town Board, Town Hall Mill Street Wappingers Falls, New York Re: Thomas Martini and others -to- The Town of Wappinger Gentlemen: I enclose for your consideration a resolution of acceptance of two parcels of land in the Town of Wappinger. As you are aware, these offers are made by Daniel J. Donovan, O. Thomas Martini and Mary Sheppard. I believe you are familiar with the two parcels. I also enclose herewith the two deeds for said parcels. I would like to call to your attention the fact that it will be necessary for the Town to pay the taxes on each of these parcels for the coming calendar year and that the taxable status of the property on May 1st required them to be placed on the tax roles. Thomas Martini and Mary Sheppard have offered to the Town of Wappinger two tracts of land generally described as follows: PARCEL I: All that tract south side of Middlebush Road, more particularly described in County Clerk's Office in Liber or parcel of land located on the in the Town of Wappinger, and being a deed recorded in the Dutchess 1065 of Deeds at Page 213. PARCEL II: All that tract or parcel of land located in the Village of Wappingers Falls, Town of Wappinger, being on the westerly side of the Albany Post Road and more particularly described in a deed recorded in Liber 1051 of Deeds at page 382 in the Dutchess County Clerk's Office, and WHEREAS, the ocEfer:of conveyance to the Town of Wappinger contains no restictions upon the use of said tracts of land by the Town of Wappinger; and WHEREAS, the Town of Wappinger may wish to utilize each of the said parcels for its' own purposes or may wish to sell either or both of said parcels with the proceeds of the sale being paid in to the general fund. NOW, THEREFORE, BE IT RESOLVED that the Town of Wappinger hereby acceptt the offer of the said two tracts of land from the parties aforementioned without any restriction or condition. SECONDED: COUNCILMAN VERSACE DATED: December 12, 1977 ROLE CALL VOTE: COUNCILMAN CLAUSEN COUNCILMAN JENSEN COUNCILMAN JOHNSON COUNCILMAN VERSACE Supervisor Diehl Resolution duly adopted AYE AYE AYE AYE AYE 0 Mr. Diehl noted that one of these parcels was situated on Middlebush Road and consisted of approximately 35 undeveloped acres, the second parcel was located on Route 9 in the Village of Wappingers Falls approximately across from Maneri's Tavern and between the Rug Retail Store and the Shell Gas Station (Almost across from the intersection of New Hackensack Rd. w/ Rte. 9) the building is presently being rented by the Rug Store for storage purposes. The question of taxes was raised, and it was noted that the town would have to pay the Ihe taxes for 1978, but would be removed from the taxable rolls in May. The following letter was received: 21 Fenmore Drive Wappinger Falls, N.Y. 12590 November 30, 1977 Town Board Members Town of Wappinger Town Hall, Mill St. Wapp. Falls, N. Y. 12590 Dear Sirs, During the week of Nov. 13-19, 1977, we hooked up to the Town water. The curb box and pipe had to be replaced because the pipe was so rusty that our plumber could not be sure it was "K' copper and also because it was too bent to be used. We have the pipe if you would like to see it. We wot,ld like to be reimbursed for the cost of the curb box and pipe ($16.87). A copy of the bill is attached. Kindly put this matter on the agenda for the next Town Board Meeting. Seconded by Mr. Clausen Roll Call Vote: 5 Ayes 0 Nays (0110 A Notice of Public Hearing was received from the Town of La Grange for a hearing on their Local Law ##2 1977 establishing a comprehensive Zoning Plan for that town to be held December 12, 1977. Mr. Johnson moved the notice be received and placed on file. Seconded by Mr. Diehl Roll Call Vote: 5 Ayes 0 Nays 561 The following letter was received: Town Board Members Town of Wappinger Re: Stotz lease Gentlemen: December 1, 1977 Enclosed please find a copy of a voucher submitted by Mr. Stotz for a claim against the town regarding certain sections of the lease agreement. More specifically, for reimbursement for certain insurance coverage that he paid for that the town should have and school taxes over and above a given "base year". As of this date, I have declined to pay the claim. The claim for the insurance payment is valid (section 25 of lease), however I feel the claim for taxes is not. Section 23 of the lease states that the town is liable for any increase in taxes over the "base year of 76-77". This, however, is the bone of contention. The tax rolls for school taxes in 1976 and State, County and Town taxes for 1977 were finalized in May of 1976. At this time the premise in question was incomplete and therefore, not fully assessed. After the contract was finalized and renovations were complete a new assessment was made in the new assessments of May 1977. It is this assessment that I feel is the figure to be used. If the Town Board agrees, please let me know as I am holding up the payment of the legitimate claim. MWR/db Enclosures CC: Allan E. Rappleyea, Esq. Motion Unanimously Carried The following memo was received: 562 MEMO TO: Town Board Members FROM: Matthew !Ryan, Comptroller DATE: December 1,"1977 SUBJECT: Bids for services Just a quick reminder that it is time again to authorize bids for various services. Among those that should be bid are: 1) Chemicals for our sewer and water treatment plants. 2) Removal of sludge from our treatment plants. 3) Camo's contract for running the various plants as well as performing the various chemical tests that are mandated by the various health agencies. 160 In addition to the above, the Town Board should consider a possible bid for imsurance services. If these expenses are true to projections the 1978 payments (including health and hospitalization) will be approximately $100,000. When authorized by the Town Board, I will prepare or have prepared the various "specs" for the above so that a timely bid award can be made. s/ Matt MATTHEW RYAN, COMPTROLLER MWR/db Mr. Diehl entertained a motion to instruct the Engineer to finalize bidding papers in regard to the three (3) subjects Mr. Ryan has re- commended and immediately go to bid on them upon receiving the information provided by the Engineer. Mr. Johnson suggested consideration of Mr. Ryans recommendation of a possible bid for Insurance Services be added as a fourth item to be bid. The total premiums indicated by Mr. Ryan seems like a lot of money. Mr. Diehl agreed that it was costly, but to do so the Town would have to engage an appropriate professional to prepare specifics in order to go to bid, as you couldn't go to any individual Ins. Co. and have them write up the bids. Mr. Johnson suggested asking various Insurance Agents to come inspect the insurance requirements of the Town and offer a bid for their services. He doesn't believe the Town would have to prepare bids in that reapect. Mr. Diehl was hesitant to agree with Mr. Jc'_inson but would prefer it be done with the recommendations and opinion of the attorneys. Mr. Johnson moved that the first three items of Mr. Ryan's memo be referred to the Engineer to the Town for the purpose of preparing bid specifications, and go to bid as soon as possible. Miller Re: Loss due to sewer blockage Date: December 9, 1977 This letter comes to you in the "wake" of a disaster believed to be caused by a blockage in the main sewer line. At approximately 10:00 AM Sunday December 4, 1977, I discovered, in the lower bathroom of my raised ranch home, about an inch of water on the floor. The water was spilling out into the rest of the lower level and onto our newly purchased wall-to-wall carpeting. The water was overflowing from the toilet bowl. It wasn't until hours later that I discovered and was told of the reason for the overflow. Several attempts were made to contact town officials (water and sewer, board members), police, firemen, plumbers, health department for assistance. To our disbelief no one would help. Some, in fact, were quite rude, commenting that it was Sunday and a family day, or that they didn't work on Sunday. When the blockage finally cleared, my lower level was under approximately 3 inches of water. Water containing raw sewage soaked the carpeting in three rooms, has sinced caused floor tiles to come up, soak moulding off the bathroom walls, woiled and stained walls and furniture and created a most unpleasant situation to put in mildly. Mr. Diehl's home was finally reached and with the aid of Mrs. Diehl help was on the way. Camo Pollution Company, represented by Mr. Terry Glass, arrived. He checked the main sewer line on Balfour Drive and concluded that there was a blockage in the main line. My home is the lowest home on the block and thus became the unfortunate beneficiary. Mr. Louis Diehl was next to arrive. He was briefed of the situation by Mr. Glass and then accompanied my wife and me into the flooded area and saw the damaged area. Fire Chief Ed Frappier later arrived and with a water vac aided me in getting as much of the water out as we could. Together we removed over one hundred gallons of water and sewage. In the early evening my wife went to the laundromat to wash small towels and rugs. The next day the wall-to-wall carpet was lifted and rolled up by those who installed it. My wife and I took the day off from work to be there when the carpet was raised and continued with the cleanup. A total figure of loss is not available at this time. An appraiser would be needed for this purpose. the 56i1 It is my understanding that the Town has insurance that would cover our losses. It is with this letter that I appeal to you for collection of these losses. Below please find a list of damages. 1. Wall-to-wall carpeting lower level completely and padding in my family room of ruined - $463.74. 2. Floor tile in bathroom and family room - no cost figure available. • Mouldings in bathroom - no cost figure available. 4. Walls in bathroom stained - no cost figure available. 5. Rug in den, 12'x15' was partially wet - steam cleaning necessary. 6. Blue area rug in laundry room 5'x9' also needs steam cleaning. 7. Monies have been spent to clean other small area rugs. 8. Couch in family room was cleaned immediately to prevent staining and further damages. 9. The bill for removal of wall-to-wall carpeting has not been received to this date. s/ Stephen J. Miller 24 Balfour Drive Wappingers Falls, N.Y. 12590 297-4753 Mr. Diehl believed the first action to be taken would be to establish w/ Camo the condition that was found at the scene, and second he believed the Insurance company should be notified and they in turn evaluate what damage has occurred and the possibility of salvaging any of the rugs or material through cleaning processes, and third, because there has not been a final cost estimate on many of the items, the board should wait for the final cost that the Millers are presenting from those 3 evaluations the hoard can make some determination. Mr. Claus added that Mrs. Miller had called him and asked what she shpuld do icith the rug. He didn't pretend to give her any legal advice but in hts opinion, because it gave such a bad odor, he said he wouldn't blame her if she put the rug outside, and if the rug is ruined or had been damaged at that point he felt that no one would' blame her for putting the rug outside, rather than having it in her basement in that condition. Mr. Johnson agreed in that a report should be received from Camo first. Mr. Johnson moved that a letter be drafted to Camo Pollution requesting a report on their findings in this matter and correspondence be sent to our insurance agent advising them of the potential liability and asking for a comment. Also Mrs. Miller be re4uested to forward future complete estimates of damages to the board. Seconded by Mr. Clausen Motion Unanimously Carried The following letter was received: December 8, 1977 Town Board Town of Wappinger Wappingers Falls,N.Y. 12590 In re: Permission be become Tenants to Rockingham Sewer District Gentlemen: Permission is requested to make a sewer connection to the Rockingham, Farm Serer District at my residence, 18 Edgehill Drive. It is my understanding that if this request is approved we would be considered as tenants to the named sewer district. The urgency of this request was necessitated by my recent discovery that the leechfield on my septic system is totally inoperative and will need immediate replacement before the ground freezes. Attached per your instructions is a signed agreement. Your consideration in this matter will be greatly appreciated. s/ Arthur F. Campbell 18 Edgehill Drive Wappingers Falls, N.Y. Tel. Campbell,Sr. 18 Edgehill Drive, become a tenant to the Rockingham Farms Sewer District and make a sewer hook up connection to said District, subject.to the following conditions. 1. The connection is to be made at your expense, and ct:bject to inspection by the Town Plumbing Inspector. 2. That the Tap Fee.. of 8500.00 be paid prior to connection to the Sewer Line. 3. That you agree to pay double the sewer service charge as that of the District Residents. 4. That the appropriate Permits be first obtained from the appropriate Departments after receipt of approval by the Town Board. These being, $25.00 Sewer hook-up fee; and, Road Opening Permit, if applicable, from the Superintendent of Highways, at a calculated cost determined by extent of any work involved. aGG 5. That you agree that you will become part of any Sewer District or Sewer Improvement Area formed in the future which would include your property under ordinary cir- cumstances, and you hereby waive any objections to the formation of such District or Improvement area. Seconded by Mr. Jensen Roll Call Vote: 5 Ayes 0 Nays Mary Schmalz, member of the Recreation CUmmission, reported that they definitely got their county grants for 1978. She had re- ported that their State aid was $9,405.50 and the County aid will be $7,000 more, giving a grand total of $16,405.50, which of course we match in the ToWn Budget. Mr. Versace stated that at the November meeting the board referred the suggestionsof some of the solutions to the odor problem at the Oakwood plant, to Mr. Lapar, did he now have a report on this. Mr. Diehl stated he had spoken to Mr. Cacchio last week in regard to the 6 randates to get onto this and advise the hoard whether they would or wouldn't be done. MR. VERSACE moved that the recommendations made to the town board by Joseph F. Marcogliese, P.E., Sr. Sanitary Engineer for N.Y.S. Environmental Conservation of the 6 items that could help the odor problems at the Oakwood Knolls sewer plant be reviewed by Mr. Cacchio and his report promptly given to the town board. Mr. Lapar indicated thayhe had had a verbal inference of a denial by the county,as the plant is now above capacity and the chances are that it will not be allowed. He is awaiting written report. Re: December 6, 1977 12590 Puretz & Adams Subdivision Myers Corners Road Grid #19-6158-04-894014-00 Area: 5.804 Acres Dear Board Members: The inclusion of this parcel in the Oakwood Knolls Water District, should be by the recommendation of the Water Treatment Plant Operators and the Dutchess County Health Department, since the original kIstem was designed to accommodate Section #1 and Section #2 of the Oakwood Knolls Subdivision and Section #2 was never built. Rules, of course, have changed over the last 10 years and a de' termination by the Ditchess County Health Department must be made. This parcel is in the Wappinger Sewer Improvement #1 and it has been the policy to allow such parcel to tie in. The Dutchess County Health Department has made this the province of the Town Board. Seconded by Mr. Clausen Motion Unanimously Carried The request of Stanley Rapp and Richard Ford for release of their Highway Maintenance Bid for the roads in the Naro Sub- division was again placed before the board. M r. Diehl commented that Mr. Horton having advised the board last month that the year was not up then, had since verbally indicated the Bond could now be released, the work having been completed to his satisfaction. Mr. Jensen suggested that since Mr. Horton wasinot present this evening, and the board had no written recommendation, the matter be tabled. MR. CLAUSEN moved the request of Ford and Rapp be tabled for written recommendation by the Highway Superintendent. Seconded by Mr. Johnson The suggestion of the Town Clerk to the Comptroller regarding the purchase of some new voting machines for the town having been presented to the board in November, was again before them with a recommendation by Mr. Snowden, voting machine custodian. He suggested the purchase of 4 machines, so that two of the oldest machines could be kept aside for use as spares (1960 & 1961) and 2 additional machines would be available for Election Districts that had increased considerably in registrations. Mx. Diehl ''as of the opinionthat the town was in a position to, and should purchase, two voting machines. Mr. Clausen supported Mr. Diehl's comments, and possibly pick up 2 next year. MR. DIEHL moved that 2 voting machines be purchased , and funded from the appropriate account recommended by the Comptroller, transferring, when appropriate, Seconded by Mr. Clausen from CF8160.4 to CF1450.2. Horton, on December 6, 1977, it was ascertained that the elements of various agreements between Perkins & Scofield for the benefit of Mr. Vrooman were completed during the Fall of 1975. CLAUSEN moved that Mr. Vrooman be so notified of Mr. Lapar's report, that the conditions as far as the Highway 8upt. and the Engineer to the town are concerned, have been met, and that the town takes the position that all agreements and conditions were met. -569 Seconded by Mr. Versace: Roll Call Vote: 5 Ayes 0 Nays Mr. Johnson brought up the drainage problem of Martin Brive, by asking Mr. Lapar how the bidding was progressing. Mr. Diehl read in part from a memo by Mr. Lapar which stated that bids for Mid Point Park would be available on December 14, 1977, and will be opened on December 22, 1977. ¥r. Lapar explained the hold-up on Mid Point was due to the fact that Mr. Horton had requested a number of alternates, and a lot more work was necessary in the preparation of the specifications than pre- viously planned. Mr. Johnson's next question was in relation to the resolution of the aesthetic problem of the pumping station on Top 0' Hill Road. He had spoken to Mr. Lapar who indicated that the design of the concrete pillbox is such that back filling would take place at some time, and all that will then show is the cap. He also asked if any reports were received frrliCr. Horton on Camo Pollution on the door to this pumping station that wouldn't close. Mr. Lapar answered no. Mr. Johnson stated that the third part of the complaint was the camouflaging of the ventilating stack. Mr. Lapar's opinion was to wait until the backfilling was done, then perhaps it will be less obstrusive, the problem being that it has to be there because the pump needs ventilation. Mr. Johnson asked Councilman Versace if he had any reports on the progress of Sewer Improvement #3. Mr. Versace replied no, he had received the report from Mr. Lapar on it, but he hasn't discussed it with him. Mr. Jensen asked Mr. Versace how old the report was, they are coming into another fiscal year and lhe also was wondering what was happening with Sewer #3. There's been a lot of discussion about the lateral districts, and he wondered if Mr. Versace could give the board some clarification of when they could expect the report, could the board get it by the end of the year? Mr. Versace stated they could have it by the end of the year, but he assumed that the new board would pick it up from there since he wouldn't be having anything to do with the lateral districts, but he would give them a report. 70 Mr. Clausen asked that the following letter be raad: November 30, 1977 Town Board Mill Street, Town Hall Wappingers Falls, New York Dear Board Members: Please consider adoption of the following policies within the applicable Town Ordinances: 1. Mandatory installation of footing drains on residential construction. Provisions should be made to allow the proper authorities to waive the requirement if field conditions warrant such action. 2. Requirement to submit a certified plot plan showing the "as built" foundation location on construction which is within three (3) feet of the sideyard setback requirements. This requirement would be based on the "proposed construction" plot plan submitted to obtain the building permit and/or significant variation from proposed plans determined at the time of field inspection. 1 would appreciate consideration of these policies at your earliest convenience. Diehl commented that he believed this was a subject that has been discused with Mr. Lapar and Mr. Horton, and they both endorsed such a policy. MR. CLAUSEN moved that a copy of Mr. Ruit's letter be sent to Mr. Lapar, Mr. Horton and Mr. Rappleyea for their recommendations sp that a public hearing upon a Zoning Amendment be forthcoming. Seconded by Mr. Johnson Roll Call Vote: 5 Ayes 0 Nays Mr. Incoronato, being recognized by the Chair, stated he had %be observed a 9 foot fence being erected on what he believes to be the Town of Wappinger recreational property in Fleetwood north of the sewer plant. The man erecting the fencing had identified himself as Mr. Osborne, and it seems he had also bridged the stream and it seems he is going to store heavy equipment in the enclosure. Also Mr. Incoronato felt the piping is going to be inadequate where he is bridging the stream, possibly incurring a drainage problem there. He would like someone to take a look at the Town's deed for that recreational property and see if, in fact, this person has trespassed on public property. MR. CLAUSEN moved that Mr. Lapar be directed to look into and evaluate the conditions the fence being erected in the vicinity of the Fleetwood Recreation area, in conjunction with any other Town officials, if necessary. Seconded by Mr. Versace Roll Call Vote: 5 Ayes 0 Nays Mr. Clausen commented on the question of Junkyard licenses, which comes up the first of the year, and the question of Mid -Hudson Auto Wreckers operation. It seems to him the time has come where the attorneys and Zoning Administrator should see to it that either all conditions of that operation should be met, certainly no licensing be granted as of the 1st of the year, and possibly citations should start coming forth to either clear up the unlicensed business and/or enforced stipulations, this has been carried on long enough and it certainly should be concluded one way or another. MR. CLAUSEN moved that the Attorney be requested to forward an opinion to the Board with regard to the Mid -Hudson Auto Wreckers problem before the first of the year in clearing up the junkyard problems.
