The Regular Bimonthly Meeting of the Town Board of the Town of
Wappinger was held on November 28, 1977 at 8:00 P.M. at the Town
Hall, Mill Street, Wappingers Falls, New York.
Supervisor Diehl called the meeting to order at 8:07 P.M.

(Prior to opening this meeting, the Board sat informally with
a delegation of residents from the Chelsea area to listen to, and
discuss, parking problems in the Hamlet of Chelsea. This matter
was restated prior to adjournment and a synopsis of the discussion
will be incorporated in the minutes where applicable).
Supervisor Diehl called the meeting to order at 8:07 P.M.

ment Area, Wappinger Sewer Improvement Area #1, Tall Treps Water
Improvement, Ardmore Improvement, Wildwood Sewer District, Oakwood

the matter was placed before the Board for their consideX'ation.

notification on Nov. 21st of what the indebtedness was. Prior to
that he had certain questions of the Comptroller concerning some
transfers of money and was told there was a $25,000 transfer in
Central Wappinger Water in May. In going through some of his
correspondence from Mr. Ryan, it had been indicated there was a
shortfall of payment that was due in May and there had to be a
transfer of $66,000 from Capital fund to help pay for this note
that was due. In October there was a loan of $58,000 from Sewer
#1 to Central Water, which meant there was a total of $124,000
outstanding. Upon receiving the information on Nov. 21st, he
found out that only $83,000 was shown as an indebtedness on budget
notes, only $30,000 was to be repaid with some interest to Sewer

Improvement #1 which leaves an outstanding indebtedness of
$$53,000, but he still hasn't figured out where $41,000 went.
So Central Wappinger Water Improvement is further in debt than
the serial bonds that they have plus the budget notes. Sewer
Improvement #1 which had a budget note of $21,000 and a balance
at the end of this year of only $13,000 with a $7,000 payment
coming in for 1978. There is $200,000 outstanding on bond anti-
cipation notes with no payments due at all for 1978 and he agrees
with decreases but he forsees that both of these districts will
be in financial difficulties probably in 1979 and 1980 when some
of this indebtedness has to be paid. That is his reason for voting
No on the Benefit Assessments.
A Public Hearing having been duly held on Local Law #8 of 1977
to provide for written notice of defective and/or snow and ice
conditions of highways and sidewalks on Nov. 28, 1977, the matter
was placed before the Board for their consideration.
MR. JENSEN moved to adopt Local Law #8 of 1977, a Local Law to
Provide for Written Notice of Defective and/or Snow and Ice
conditions of Highways and Sidewalks, (the text of which is
attached hereto and made part hereof of the Minutes of this
Meeting).

A Public Hearing having been duly held on Local Law #9 of 1977,
Limiting Parking and Standing of Vehicles of Certain Streets in
the Town of Wappinger on Nov. 28, 1977, the matter was placed
before the Board for their consideration.
MR. JENSEN moved to adopt Local Law #9 of 1977 Limiting Parking
and Standing of Certain Streets in the Town of Wappinger as follows:
BE IT ENACTED by the Town Board of the Town of
Wappinger as follows:
Section I: No vehicle shall park or stand and no
person shall cause a vehicle to park or stand on the
following street of the Town:
Beginning at tale intersection of Osborne Hill Road
(CR35) and Ketchamtown Road and proceeding westerly along
Ketchamtown Road for a distance of 500+ feet.

Section II: Anyone who shall violate any provision
of this local law shall upon conviction, be subject to
a fine not to exceed Twenty -Five ($25.00) Dollars, as
determined by the Court.
Section III: This local law shall take effect
immediately following filing with the Secretary of State.

Gentlemen:
I stated my concern over the possible drainage problems
with the subdivision of Mr. Scofield's property on All Angels
Hill Rd. at the initial planning meetings and at a later date,
letters and meetings were sent and held to solution the problem.
I have this information on file if you require it.
My concerns have materialized. The distruction of the water-
shed and the redirection of the water run-off, compounded by the
dam on Mr. Perkin's property are causing flooding of my basement.
I have lived at this address for over eight years with -out
water in the cellar. Now I have 2" to 4" of water, and have to
pump every time we have heavy rain or a fast thaw.
Please review this problem.

Mr. Diehl commented that he remembered several years ago many
meetings and discussions on this matter, and that at the time,
there was a split Board decision as to which way to go in the
matter.

MR. DIEHL Moved that Mr. Lapar, amE Mrf. Horton' immediately research
and review all conditions of the original specs and agreements
to see if they had been completed by Mr. Scofield as required.

Mr. Clausen, on the motion as it was being proposed, commented
that as he understood it, the situation was that at many of those
meetings, Mr. Vrooman refused to have Mr. Scofield, at that time,
use the ditch that ran IJehind his property either by being piped
and covered up or allowing it to run in an open ditch. So, the
alternative was to have Mr. Scofield realign the proposal that he
initially had and run it further up his development into the pond.
Mr. Vrooman was against any situation, he was against having a
development or any water collecting in back of his home. He felt
the Board should see if everything has been installed and accepted
and approved subject to the specifications, and if Mr. Vrooman has
any specific complaint he felt he should document it, because he
didn't believe Mr. Vrooman would be satisfied no matter what happens.
Letters were received from (Miss) Effie Magdalany and Margaret
Barry, both complaining about the water pump station on Top 0' Hill
Road. They both expressed their distaste for its unsightly appear-
ance and their belief that its unsightly appearance would decrease
the value of their_properties in an otherwise beautiful area.
Mr. Johnson stated he had spoken with Mrs. Lunn, who had sent the
first letter to the Boz d, and also Mrs. Barry. The situation is
to attempt to reach certain water pressure on top of the hill, this
pumping station was installed. It's a large concrete pillbox,
stands about two feet high with a long concrete slab covering
the pit, and a smoke stack approximately 6 ft.high for ventilation.
He had at first considered screening with trees and shrubs to hide
the pumping station, but that would be an impossibility since the
structure is right against the road. There are some things that
could possibly be done such as have the highway crew backfill to
bring the concrete pillbox to an even grade so that all that would
be visible would be the concrete stab on the top with its trap
door, and he would recommend, 1, that that be done, secondly, he
had been informed that the door latch and the door does not close
properly and he would further recommend that a letter be sent to
the Highway Superintendent to see that a lock or latch was put
on the hatch door. He doesn't know what can be done with the
ventilator stack, but he would ask that Rudy Lapar and Bill Horton
be asked to look at it for some recommendations.
MR. JOHNSON moved that the Highway Department be asked to back fill
around the concrete pillbox (water booster pump station on Top 0'
Hill Road) so that all that showed would be the concrete slab, and
secondly, to check the door and latch to see that they are seated
properly so they cannot be opened by unauthorized persons, and
also check if there was some other method of ventilation other
than the stack presently installed.

A letter was received from Jon H. Adams regarding litigation by
Stotz vs. Zoning Board of Appeals on a decision on an appeal by
said Board.

A memo was received from Mr. Ryan regarding the purchase of
several new voting machines.
Mr. Diehl questioned the number of voting machines that would
actually be needed, and Mr. Johnson suggested that a report be
received from the Voting Machine Custodians as to just what
condition the voting machines are in, it might be that some type
of schedule could be set up to replace machines as necessary on a
regular basis.
The matter was tabled to the December meeting.
It was discussed about setting a Public Hearing for the CATV
Franchise. It was agreed to place the matter on the December
Agenda to set a date after the first of the year.
Supervisor Diehl stated that just prior to the meeting being
called to order, a delegation was in from Chelsea, in regard to
parked cars along the highways in that hamlet.
The following is a synopsis of that discussion:
The Town Board informally convened at 7:24 P.M. for the purpose
of an informal meeting with a delegation from the Chelsea area
re parking in the Chelsea Hamlet.
Mr. Diehl informed those residents present that although the
regular meeting had not been called to order, the discussion
would be taped and will be made a part of the meeting to enter-
tain the delegation from Chelsea where they are having trouble
with some residents parking on the streets to hear their complaints
and recommendations on how to solve the problem.
Mr. Diehl briefly summa;;ized what he knew of the problem. He
indicated he had received a letter from Mr. Robinson in regard
to parking problems in the Hamlet of Chelsea and conditions that
would cause the possible passing of a fire truck in some areas of
this Hamlet. He intends to have the vandalism patrol hand out copies
of the Snow Ordinance, at various times, through the area where
they find parked cars in the streets as a warning. He also intends
to leave some copies of the Snow Ordinance with members of the
Fire Company so if they see problems they can also put them on
the car windshields. It had also been mentioned there were no
signs in Chelsea advising of the Snow Ordinance. Mr. Tompkins
addressed the Board stating that they didn't particularly wish to see
people get ticketed, but there are some consistent violators. They
don't mind those that park off the road, but when there are four
wheels on the pavement, and some of the streets are narrow to
begin with, it creates a hazardous condition, especially when
there is ice or snow on the roads. He made reference to some
new people who moved in on Spring Street who don't use their
driveway, and if someone is parked on the other side of the street,
emergency equipment can't get through, and there is one house on
the bad turn on Broadway where the resident constantly parks on
the corner. These people have been asked on numerous occasions
not to park on these streets, but they won't move them. He
suggested Snow Ordinance signs be put up, so these people would
know they can't park on the streets. Mr. Diehl asked if those

present agreed that by putting Snow Ordinance notices on windshield
will be of some help, and, during the winter, Mr. Horton does,
when he finds cars parked on the roads, call the Sheriff and have
the cars ticketed. Mr. Diehl indicated he would entertain a
motion now, which will be reaffirmed appropriately in the meeting,
to place three Snow Ordinance Signs, in Chelsea, one coming in on
Chelsea from Route 9D, one at Castle Point Road and a third on
River Road.
MR. JENSEN moved that Mr. Horton be instructed to place the three
Snow Ordinance Signs in the Chelsea Area at his earliest conven-
ience.

Roll Call Vote: 5 Ayes 0 Nays
Mr. Diehl recapped this discussion, and concluded by indicating
that Mr. Jensen had moved that Mr. Horton be instructed to place
three Snow Ordinance signs in the Chelsea Area at his earliest
convenience, and that the Board had agreed to, through public
relations, get notices to the public down there on the Snow
Ordinance. The motion was reaffirmed by the entire Board.
There being no other business to come before the Board, Supervisor
Diehl entertained a motion to adjourn.
MR. JENSEN moved the meeting be adjourned, seconded by Mr. Johnson,
and unanimously carried.
The Meeting adjourned at 9:00 P.M.

Mr. Jensen who had introduced this Law explained that this was a prior
notice law to notify the Highway Superintendent and/or Town Clerk of
any defects in Highways and to protect the Town from being liable for
any problems with the Highway unless we have prior notice that the
defect was there.
