A Public Hearing was held by theTown Board of the Town of
Wappinger on March 23, 1977, at the Town Hall, Mill Street,
Village of Wappingers Falls, Dutcfiess County, New York on the
Establishment of the Cranberry Hills Water Improvement Area.
Supervisor Diehl opened the Hearing at 7:11 P.M.
Present:

The Town Clerk offered for the record the Affidavits of Posting
and Publication duly signed and notariEed. (These Affidavits
are attached hereto and made a part thereof of the Minutes of
this Hearing).
Deputy Supervisor Clausen asked Mr. Lapar to give a short synopsis
of what was being proposed.
Mr. Lapar explzxiied what was being proposed was the Cranberry
Hills Water Improvement Area to serve the Cranberry Hills Subdivi-
sion. This would be served by Central Wappinger Water, sufficient
water would be available up to 1990 projection. No benefit assess-
ment; developer will put in all facilities; cost would be $1.20
per hundred cubic feet which would run the average hn eowner $120
per year, the existing cost in Central Wappinger, but not a fixed
figure.
Mr. Clausen told the residents that a proposed map of the water
district was available tonight, also a report.
Mr. Diehl arrived at 7:15 P.M.
Mr. Versace asked where the main connection was.
Mr. Lapar responded in the area of Myers Corners Road, where it
hits Kent Road. Provision will be made at a later date, if it
is necessary to tie in at Oakwood.
Mr. Clausen asked if there was any payment of easement for that
line.
Mr. Lapar explained they have a right of way at Buckley Lane.
Mr. Clausen asked, can surrounding land tie into water system
at a later date.
Mr. Versace asked if there would be any expense to the Town for
this district. Will the lines be turned over to the Town after
completion? Will we maintain any of the lines or will the devel-
oper take care of this until completion.
Mr. Lapar's opinion was that the lines will be maintained by
the Town and charged back to the lots in the first section. This
has been Town policy. This is all determined by the Board of
Governors which is the Town Board.
Mr. Versace --there could be maintenance problem with the lines
since they're going in stages and this could be a burden to the
people in the first stage. They could start off with a capital
improvement right away if the Town does assume those lines.
Mr. Jensen - we would probably accept the lines as we accept
the roads. The Attorney could work out an agreement whereby
responsibility will be upon the developer until such time as
the Town takes over.
Mr. Clausen asked if one of the subjects of this Hearing was
whether these homes are metered or not.
Mr. Lapar felt it was mandatory.
Mr. Clausen, do pressure reducing valves have to be placed in
these homes? Is that a Town charge or district charge? Do we
supply the meter and charge the builder? Will there be Town
supervision of installation of lines? Will there be certification
ofinspection of these lines by Mr. Lapar? Have the developers
of Cranberry Hill seen this proposal and are they in agreement,
what is the next step?
Mr. Lapar - this is now submitted to Water Resources Commission.
Mr. Clausen -has this been a major obstacle in front of the Board
in relation to this development.
Mr. Lapar - they debated about going through Oakwood.
Mr. Clausen - is this the most feasible or most acceptable method
to the Town and future residents of that development.
Mr. Lapar felt it would be a benefit to everyone if we could
get around the problem of Oakwood Knolls existing pipeline, to
loop it, engineering -wise would be a better system.
No one else spoke.
Mr. Jensen moved to close the Public Hearing, seconded by Mr.
Clausen and carried.
The Hearing closed at 7:28 P.M.

of Actions which may have a Significant Effect on the Environ-
ment.

The Town Clerk offered for the record the Affidavit of Posting
and Publication duly signed and notarized. All newspapers and
radio stations had been notified. (These Affidavits are attached
hereto and made a part thereof of the Minutes of this Hearing).
Mr. Diehl waived the reading of the Local Law. Copies were avail-
able to the public.
Mr. Clausen asked Mr. Adams if this was in two categories.
Mr. Adams explained that actually it is actions defined by Local
Law - direct actions which are those undertaken by municipal bodies,
in this case_the Town of Wappinger and actions by private persons
under which permits must be obtained, such as Building Permit or
Zoning Permit. Determination must be made if these actions will
have a significant effect on the environment and if so what steps
the applicant must take to safeguard the environment. The same
Board that issues the permit will be performing the analysis as
to whether or not an impact study will be made. If the applicant

fails to supply an impact statement, the Town can direct that
this be done at the expense of the applicant. Any expenses will
be borne by the applicant.
Mr. Clausen said all municipalities must pass regulations for
entitlement actions by Sept. 1. --was this correct, he asked the
Attorney. This hearing includes Entitlement Actions so we will
not have to have another hearing.
Mr. Diehl - this law will give us greater leverage in projecting
landfills.
Mr. Adams explained that landfills were under Type I actions
which would require an impact statement, it would be subject to
very close scrutiny.
No one in the audience spoke --they stated that they just came to
listen.
Mr. Diehl moved to close the Public Hearing, seconded by Mr.
Jensen and carried.
The Hearing closed at 7:52 P.M.
