ADJOURNMENT The Regular Bimonthly Meeting of the Town Board of the Town of Wappinger was held on October 25, 1976 at 8:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:10 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Nicholas Johnson, Councilman Frank Versace, Councilman Gladys Ruit, Deputy Town Clerk Absent: Elaine Snowden, Town Clerk Others Present: William Horton, Highway Superintendent Rudolph Lapar, Engineer to the Town The first item on the Agenda was a report from Mr. Lapar on trett View Water Rates. Oct. 14, 1976 Memo to: Town Board Subject: Brett View Water Rates Gentlemen: 363s, As per your request, my office has been informed that the present quarterly rate for the above captioned East Fishkill Water District is 420.50 or $82.00 per year. There are to our knowledge no meters in the system. Respectfully Submitted, s/ Rudolph Lapar MR. CLAUSEN moved that this report be received, placed on file, and .also be taken up at next months meeting. Seconded by Mr. Johnson. Motion Unanimously Carried The following letter was read: October 18, 1976 Ms. Elaine Snowden Town Clerk Town of Wappinger Mill Street Wappingers Falls, NY RO: Thornacres, Section III Dear Ms. Snowden: This letter is to request that the Town of Wappinger take over the roads in the above captioned subdivision. CLAUSEN moved that upon recommendation of the Highway Super- intendent, Caroline Street West in the Thornacres Subdivision, Section III be accepted as and for a Town Road, contingent to "as builts" being received and specifications being approved by the Highway Superintendent and the Engineer to.the Town. Seconded by Mr. Johnson Motion Unanimously Carried The following letter of appreciation from Dr. Jeffrey Brownstein was read: October 18, 1976 Town Clerk's Office Mill Street Wappingers, N.Y. Dear Sirs: We wish to express our thanks to the Town Board, Messrs. Horton, Lapar and Rappleyea for meeting with us in September. We appreciate your taking the time to fully understand our concerns relative to the flow of water in Angel Brook. As a consequence of your sympathetic attitude., we are left with a new hope that you will soon find a way to take positive action to correct the existing and worsening problem. Motion Unanimously Carried A Notice of Public Hearing was received from New York State Department of Environmental Conservation setting the date of November 19, 1976 at 10:00 A.M. in the Town Hall on the applica- tion of Ardmore Hills Water Improvement Area. Mr. Lapar explained that the Improvement Area was already approved about six months ago, but because of the litigation, the State had held up the Hearing. If there were no formal objections, the Hearing might not be held. MR. CLAUSEN moved to receive the Notice of Public Hearing and place it on file. Seconded by Mr. Johnson. Motion Unanimously Carried Mr. Lapar was requested to attend the Hearing if it was held. The following letter was received from Mr. Elwood E. Wiggin: 9 Edgehill Drive Wappingers Falls, N.Y. October 20, 1976 Town Board Town of Wappingers Falls Mill Street Wappingers Falls, N.Y. Gentlemen: I would like to request permission to have a contractor connect my household sewage to the Rockingham Sewer District lines, which runs down Edgehill Drive in front of my house. My present septic system is the second such sewage disposal system for this property and can no longer provide proper service for my family of six, which includes four (4) teenage sons. Per the attached form from the Dutchess County Health Department, dated 10/20/76, my property is presently in violation of this County's Housing Code. V 6 Please give this request your most immddiate attention, as we are presently in an EMERGENCY condition at 9 Edgehill Drive. Thank you. Sincerely yours, s/ Elwood E. Wiggin MR. JOHNSON moved to allow Mr. Wiggin to hook up to the Rocking- ham ockIng- ham Sewer System as a tenant, subject to approval of Mr. Horton, Mr. Lapar and the Dutchess County Department of Health. Seconded by Mr. Clausen. Motion Unanimously Carried Mr. Versace requested that Mr. Wiggin be notified of the action of the Board. Mr. Wiggin was present and expressed his thanks to the Board. He was told to contact Mr. Lapar to make the necessary arrangements. The following letter was read from Mr. Spratt, Commission of Dutchess County Department of Public Works: October 20, 1976 Mrs. Elaine Snowden, Town Clerk Town of Wappinger Mill Street Wappingers Falls, New York Dear Mrs. Snowden: I am returning herewith two requests for speed reductions within the Town of Wappinger. Our traffic engineering group has reviewed both of these requests, and I wish to add other comments to the reason for denial. Oakwood Knolls Area The streets listed in the request are included in a 30MPH area speed limit extension approved by the Department of Trab.Sportation on November 13, 1975. Section 1622.2 of the V.&T. Law prohibits area speed limits less than 30 MPH. Marlorville Road, Hamilton Road and Connors Road Area Due to low traffic volumes and low accident rate, it is recom- mended that adequate warning signs for curves and intersections and regulatory signs at intersections should be erected by the Town rather than establishing a speed limit which would be very difficult to enforce. 7 I am very sorry that it is necessary to deny your requests, however, in the interest of highway safety, we must be consistent in the way we handle these accordingly. Seconded by Mr. Johnson. Motion Unanimously Carried The next item was to set a date for the Public Hearing on the Preliminary Budget. The following Resolution was offered by SUPNRVIEOR DIEHL wilt) MOV its adoption: RESOLVED, that this Town Board, having reviewed the tentative budget for the year 1977, as provided for in Section 106 of the Town Law proposed the salaries of the following Town Officers: Supervisor $15,300.00 Town Clerk 12,245.00 Town Justice (each) 5,875.00 Councilman (each) 3,975.00 Supt. of Highways 16,773.00 AND BE IT FURTHER RESOLVED, that this Board shall meet at 8:00 o'clock P.M. on the 4th day of November, 1976, Town Hall, Mill Street, Wappingers Falls, New York for the purpose of holding a Public Hearing upon such Preliminary Budget, and be it FURTHER RESOLVED, that the Town Clerk give notice of such Public Hearing in the manner provided in Section 102 of the Town Law. Seconded by Mr. Clausen Roll Call Vote: 5 Ayes 0 Nays Mr. Diehl, upon recommendation of Mr. Horton, Highway Super- intendent, brought up the subject of maintenance of traffic lights in the Town at County intersections; the maintenance of traffic lights should be paid for by the County, one light located at the intersection of All Angels Hill Road and Old Hopewell Road, and the other one at the intersection of Myers Corners Road and All Angels Hill Road. MR. DIEHL moved that the Town Clerk direct a letter to Mr. Spratt Commissioner of Dutchess County Department of Public Works and the Clerk to the County Legislature requesting that the County pay for the maintenance of the two lights in the Town located at County intersections; All Angels Hill Road and Myers Corners Road and All Angels Hill Road and Old Hopewell Road. Seconded by Mr. Johnson. Motion Unanimously Carried A bid was received from Mr. Robert Ruit to complete work at the new location of Justice Court. This would include a Judge's Platform, a Witness Platform and a Jury Box and the amount was $956.00. MR. CLAUSEN moved to authorize Mr. Ruit to do the necessary repairs and/or building setting up Justice Court at a price of $956.00 plus any allowances as stated in the letter due to unknown prices. Seconded by Mr. Jensen Motion Unanimously Carried Mr. Diehl then brought up the subject of a pick-up in the Town for metal objects. He and Mr. Horton had been in touch with Mr. Johnson of New York Car Crusher Company in regard to this pick-up, such as refrigerators, stoves, water tanks and other metal products. MR. CLAUSEN moved that the Supervisor and the Highway Superin- tendent be authorized to negotiate with Mr. Johnson of New York Car Crusher Company and arrange for pick-up of metal trash in the Town, also that they be authorized to set dates for this pick-up and advertise same. Seconded by Mr. Jensen, Motion Unanimously Carried Mr. Jensen reported briefly on a Tri -Municipal meeting with EPA Consultants to discuss letter of September 30, 1976. These are work type sessions where they "roll up their sleeves", and see if they can settle various differences they have on the project. He was hopeful they would move forward. No other business came before the Board. MR. CLAUSEN moved to adjourn the meeting, seconded by Mr. Versace and unanimously carried. The meeting adjourned at 8:30 P.M.
