ADJOURNMENT 186 The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on June 14, 1976 at 8:00 P.M. at the Town Hall Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:22 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Absent: Nicholas Johnson, Councilman Others Present: William Horton, Highway Superintendent Allan Rappleyea, Attorney to the Town The Minutes of the April 12, 1976 Regular Monthly Meeting and the June 2, 1976 Special Meeting, having been previously sent to the Town Board members, were now placed before them for their approval. MR. CLAUSEN moved the Minutes of the April 12, 1976 Regular Monthly Meeting and the June 2, 1976 Special Meeting, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Reports for the month of May were received from the Supervisor, Town Justices, Receiver of Taxes, Building Inspector, and Zoning Administrator. MR. CLAUSEN moved the reports of the Supervisors, Town Justices, is Building Inspector, Receiver of Taxes and Zoning Administrator be accepted and placed on file. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays 381 The Town Clerk informed the Board that on May 26, 1976, she had received and placed on file the Department of Audit and Control Repott for the Federal Revenue Sharing funds received by the Town of Wappinger for the period covering December 11, 1972 through December 31, 1974. MR. CLAUSEN moved to receive the Audit and Control Report on the Federal Revenue Sharing for the Town of Wappinger. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Supervisor Diehl stated that he was moving item #7 - Resolutions - up ahead of item #5 - Reports and Communications - tonight. He further asked if there would be any objections from the Board if "Resolutions" were placed permanently ahead of "Petitions & Communi- cations". The Board saw no objections to this proceedural change. The following memo was received: MEMO TO: FROM: SUBJECT: DATED: Matthew Ryan, Comptroller William P. Horton, Superintendent of Highways Re -imbursement of Monies May 14, 1976 Due to development in the Kent Ridge Subdivision it was necessary to increase the capacity of the pipe crossing Kent Road. Two bills were incurred and paid with monies from Highway Account DR5110.4: Voucher #88 Audited April 20 Voucher #93 Audited May 10 Total $1,050.00 433.00 $1,483.00 Know find that monies are available in the down -stream drainage account and I request the sum of $1,483.00 be re-imbursed to Highway Account #DR5110.4. MR. CLAUSEN moved that'a transfer of funds in the amount of $1,483,.00 be made from the Capital Fund - Downstream Drainage to Account #DR5110.4. Ryan, Comptroller RE: Transfers The following transfers are needed. The celebrations line item is chert the amount deleted for the Austerity Budget. Seconded by Mr. Jensen Roll Call Vote: 4 Ayes 0 Nays The following Resolution was offered by COUNCILMAN VERSACE who moved its adoption: WHEREAS, the County of Dutchess, through its Office for the Aging, has proposed to the Town of Wappinger that the "Care -A -Van" service, which service is operated by the County of Dutchess for citizens of the Town of Wappinger and other citizens will be continued from August 1, 1976 through July 31, 1977, and WHEREAS., 'tit is estimated that the services to be provided will cost between the sum of $9,000.00 and $10,000.00 188 189 NOW, THEREFORE, BE IT RESOLVED that the Supervisor is hereby authorized and directed to enter into negotiations and to contract with the County of Dutchess (Office for the Aging) for said "Care -A -Van" serviees for the residents of the Town of Wappinger at a cost not to exceed the sum of $10,000.00. Seconded by: Councilman Clausen Roll Call Vote: 4 Ayes 0 Nays The following Resolution was offered by COUNCILMAN VERSACE who moved its adoption: The Supervisor is hereby authorized and directed to execute the memorandum of understanding between the Dutchess County Soil and Water Conservation District and the Town of Wappinger. Seconded by: Councilman Clausen Roll Call Vote: 4 Ayes 0 Nays The following Resolution was introduced by COUNCILMAN VERSACE whomoved its adoption: WHEREAS, the Town of Wappinger has made application to the state and federal governments for participation in and for state and federal aid for the project known as the "Tri -Municipal Sewer Project", and WHEREAS, in accordance with the procedures mandated by law, the Town of Wappinger has formed the Wappinger Sewer Improvement No. 2 for the purposes of engaging and participating in the afore- said improvement project, and WHEREAS, the Town of Wappinger has several other sewer dis- tricts and improvement areas already formed, and WHEREAS, once the major trunk lines and sewer plant are known to be available, the Town will be required to provide ad- ditional lateral service to other areas in the Town, and WHEREAS, the installation and construction of said lateral may also be aided by state and federal funds, BE IT RESOLVED that the Town Board of the Town of Wappinger expresses its intention to promptly proceed with: 1. The application for state and federal funds for the construction of new lateral systems within the Town of Wappinger. 2. The application to the State Comptroller for the approval of new lateral districts or improvement areas. 3. The incorporation of such new areas into existing service areas so as to provide uniformity of sewer rates throughout the Town of Wappinger. 4. The elimination of the small separate improvement areas or districts so as to provide uniformity of benefit assessment costs, and it is further RESOLVED, that the Supervisor is hereby authorized and directed 190 to confer with the New York STate Comptroller so as to present to the Town Board a specific plan and time table to accomplish the aforesaid, and it is further RESOLVED, that the Town Board shall immediately interview and confer with engineering firms so as to engage such firm as shall be selected to prepare a study and report with regard to the construction of new lateral systems within the Town of Wappinger. Seconded by: Councilman Clausen Roll Call Vote: Councilman Clausen Councilman Jensen Councilman Johnson Councilman Versace Supervisor Diehl Aye Aye Absent Aye Aye The following Resolution was. introduced by COUNCILMAN CLAUSEN, who moved its adoption: WHEREAS, the Tri -Municipal Commission has selected a site upon the property formerly owned by the Children's Aid Society for the construction of a sewer facility, and WHEREAS, the New York State Department of Audit and Control has approved of the purchase of said lands as a prelim- inary step, and WHEREAS, a contract has been prepared for said purchase, NOW, THEREFORE, BE IT RESOLVED that the Chairman of the Commission is hereby authorized to execute the said contract on behalf of the Commission. Seconded by: Councilman Versace Roll Call Vote: Councilman Clausen Councilman Jensen Councilman Johnson Councilman Versace Supervisor Diehl The following resolution was moved its adoption, seconded Aye Aye Absent Aye Aye offered by COUNCILMAN VERSACE who by Councilman Clausen, to -wit: BOND RESOLUTION DATED June 14, 1976, A.IESOLUTION AUTHORIZING THE ISSUANCE OF $29,461,430 SERIAL BONDS OF THE TOWN OF WAPPINGER, DUTCHESS COUNTY NEW YORK, TO PAY THE COST OF WAPPINGER SEWER IMPROVEMENT NO. 2, AUTHORIZED PURSUANT TO ARTICLE 12-C OF THE TOWN LAW. WHEREAS, pursuant to proceedings heretofore had and taken under the provisions of Article12-C of the Town Law, and more particularly an approving order of the State Comptroller dated December 29, 1975, and a final order of this Town Board dated December 23, 1974, the Town of Wappinger has established and authorized Wappinger Sewer Improvement No. 2 in said Town, and hasset forth the benefited area to be served thereby; and, WHEREAS, it is now desired to provide for the financing of the cost of improvements therein; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. The specific object or purpose of the Town of Wappinger, Dutchess County, New York, for which the bonds herein authorized are to be issued is the construction of improvements consisting of sewer lines, treatment plant facilities, pumping stations and associated facilities located in the Town of Wappinger and the Towns of LaGrange and Poughkeepsie, and the Village of Wappingers Falls, designed to serve the Wappinger Drainage Basin and pursuant to an intermunicipal agreement among said three towns and said village. Section 2. The maximum estimated cost of the aforesaid improvements is $70,304,620. and the plan of financing thereof is as follows: a) By the issuance of $29,461,430 serial bonds of the Town of Wappinger, hereby authorized to be issued pursuant to the Local Finance Law, which amount constitutes the share of the total cost of said project to be borne by said Town pursuant to the aforesaid intermunicipal agreement; and b) By the contribution to the total cost of said project $40,843,190. from the other parties to said intermunicipal agree- ment. Section 3.. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty year; pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such bonds as the same respectively become due and payable. There shall be annually apportioned and assessed upon the several lots and parcels of land within an area of said Sewer Improvement No. 2 which the Town Board shall determine and specify to be especially benefited by the improvement, an amount sufficient to pay the principal and interest on said bonds as the same become due, but if not paid from such source, all the taxable real property in said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds as the same shall become due. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond antici- pation cotes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the 192 provisions of the Local Finance Law. Section 6. The validity of such bonds andbond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in viohtion of the provisions of the Constitution. Section 7. This resolution, which takes effect immediately, shall be published in full in W&SD News, the official newspaper together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. The applications had been referred to the Dutchess County Sheriff's Department, and returned indicating no criminal record on file. MR. CLAUSEN moved to approve the applications and grant Gordon Bennett and Andrew Aschmann licenses for Hawking and Peddling in the Town of Wappinger. Seconded by Mr. Jensen Roll Call Vote: '4 Ayes 0 Nays Requests were received from Louis Diehl and William J. Bulger to attend seminars. Mr. Diehl requested to attend the Summer Conference School of the Supervisors and County Legislator's Assocyation of the State of New York at Cooperstown June 27th through June 30th, 1976, and William Bulger requested to attend the Justices Training Program at St. Lawrence University Cannon, New York July 18th through July 24th, 1976. MR. JENSEN moved that Supervisor Diehl and Judge Bulger be granted permission to attend their respective training sessions, and that their legitimate expenses be a Town charge. Seconded by Mr. Clausen. Roll Call Vote: 4 Ayes 0 Nays The following letter was received: May 16, 1976 Wappinger Town Board Mill Street Wappingers Falls, New York Gentlemen: 196 I would like to see the Cable TV Committee reactivated. My reasons are as follows: 1. Reception is poor and there is interference. Calls to Cable TV and Central Hudson have caused people to come and check the lines. No apparent corrective action has been taken or have results been forwarded to me. 2. On FM even some local stations are received with annoying hiss. A Peekskill station, WHUD, cannot be received clearly. WQXR and WNYC have poor reception, though some NYC stations are better. 3. My same tuner, tested in a Hagantown home, (Slate Hill Road) offered clear reception, yet I think they are on the same master antenna as we are. 4. We do not get the UHF stations, although other cable companies provide this at no additional cost. (Ex. Northport, Long Island, and Naugatuck, Connecticut). 5. At hearingscgranting the franchise, glowing predictions were made of community service to be provided by Cable TV. (In particular, screening of Town Board meetings). Needless to say this promise has not been fulfilled. 6. A cable TV franchise should not betransferred or sold without going through the same procedures that a new entrant into the town should follow. The franchise is a virtual monopoly and the citizens cannot avail themselves of competitive services. 7. With cable TV I would expect the signal strength and color to be the same from channel to channel. I find that this is not true. (Channels 2, 3, and 10 are mismatched during a program as are 4 and 6). This is a source of annoyance in having to re -adjust knobs. Thank you for taking the time to consider my letter. DIEHL moved that Charles Cortellino be appointed Chairman of the Cablevision Committee and further that Mr. Cortellino bring names in to the Town Board of interested parties to serve on this committee, so the Town Board at its next meeting can reactivate the CATV Committee. Seconded by Mr. Clausen. Roll Call Vote: 4 Ayes 0 Nays Correspondence from Joern-Olaf C. Weber, addressed to Mr. Lapar P.E., was received concerning correcting damages done to his property due to installation of sewer lines. MR. DIEHL moved that as there was no answer as yet to Mr. Weber's complaint, therefore recommended that the Town Clerk inform Mr. Weber that the Engineer and Attorney are working on it, and will go on the next Town Board agenda, hoping the problem will then be solved. A meeting with the Engineer and Attorney on this specific matter will also be called. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays The following letter was received and directed to be placed on file: May 28, 1976 Mr. Louis Diehl Town Hall Wappingers Falls, N.Y. Dear Mr. Diehl: Thank you for your letter informing us of the water pressure problem and the offer of a valve to decrease the pressure if necessary. This was an accident that I really appreciated! I personally do not have a need for a valve to decrease the pressure in fact, I was very happy when suddenly we were blessed with a fair amount of water pressure. For the first time in eighteen years our water closets began to fill in 'a decent amount of time to be ade- quate to do the job for which they were intended. Laundry is finished in a morning now, rather than taking all day waiting for the tub to fill for each cycle. And a tingly shower! -what more could I ask for?! Except, maybe, a little more pressure because we still have the shower problem when someone in the house turns on another faucet the water tends to change temperature due to lessened pressure. We're enjoying what we have, and i hope they don't fix it the way it was! Sincerely, Mrs. Wm. Johnson 10 Ardmore Drive Wappingers Falls, N.Y. 798 A letter was received from James R. Smucker, Conference Minister of the New York Conference United Church of Christ, in connection with an inquiry as to the sale of some property (located on Myers Corners and All Angels) for a possible site for a new Town Hall. He indicated they were interested in selling, and at present were in the process of securing an update appraisal of the property and will again contact the Town when this is done. Mr. Diehl commented that, in correspondence with the State Government, there appears to be money available for grants for Town Halls. One of the major items necessary is to pin point the piece of land the Town Hall would go on. The correspondence from Mr. Smucker was ordered placed on file. Assessor Gentlemen: I am in receipt of a couple of Notes of Issue in several tax review cases. These matters were originally assigned to Mr. Quinn and were continued by him in subsequent years. As you know, Mr. Quinn is now a member_ofthe Supreme Court bench and, therefore, would not be available to continue these cases. These cases should, therefore, be assigned to other counsel. As I am quite busy with other matters, I would appreciate it if they were assigned to some other counsel other than myself. Re: Oakwood Knolls Sewer Deposition Problem at 36 Roberts Lane (Cerbino) Dear Board Members: We have investigated this problem and the easiest solution appears to be the installation of a manhole at the dead-end of this line. The manhole, of course, will be in close proximity to another manhole but, because of the late development of these lots, the line was extended without benefit of a manhole and we feel that this is the solution to that problem. Mr. Versace recommended this matter be discussed at the work session scheduled for June 22nd and, monies are not available for this work presently. Mr. Diehl elaborated saying also that the County Health Department has condemned various operations and mechanics of the water system itself, and he believes they will have to look and see what has to be repaired on the water system from the ±eports of the County Health Department and make a decision of borrowing funds to repair the system and putting blowoff hydrants at the same time. A report was received from Camo Pollution Control Inc. notifying the Board that once again the Hilltop Water System Control Building had been broken into; blocks were removed from the buildings'side- wall and they listed items that were found missing. Mr. Versace indicated there would be a meeting to morrow with Camo, at which time the problem can be discussed, and can be further discussed at the work session on the 22nd. A report was received from Camo Pollution Control regarding the #2 blower at the Oakwood Knolls Wastewater Treatment Plant, which was sent out for an overhaul. Mr. Diehl recommended Mr. Lapar receive a copy so that it may be discussed at the executive session and he can get a price on a new blower. Mr. Versace asked that this be checked to see if this was part of Hall & Company contract. A memo was received from Mr. Ryan, Comptroller, regarding meter reading. He recommended the Board consider the purchase of a reader unit costing $300.00. L MIR 202 Mr. Versace suggested this matter be held for the executive session for in depth discussion. A letter was received from E. C. Schueler, County Executive, regarding cut backs in county services, and in this instance the Mosquito Control Department. He suggested that in order to provide Wappinger with any degree of service this year, that the Town supply a man from the Highway Department to work with the County at those times when they would be in the Town of Wappinger. it was questioned how many hours the man would be required for and to what extent was the control program, and will the equipment be brought to Wappinger. Supervisor Diehl directed that the Town Clerk write to the County Executive for the answers to these questions. Mr. Incoronato, being recognized by the chair, questioned whether the County had explored the use of nematodes as a natural way of destroying the mosquito larvae in the swamps. He mentioned a man who was experimenting with them for commercial use in Clinton Corners. This should be considered instead of polluting the environment with spraying chemicals. Mr. Hawksley echoled Mr. Incoronato's sentiments. A letter was received from Mr. Charles S. Rose, owner -director of Toy Town Tots Day Nursery on Middlebush Road. He asked the Town to request a reduced speed limit on Middlebush Road. A petition on the same topic was received from Mr. Peter Geraci, requesting a 15 MPH speed limit for Apple Ridge Estates (Ye Olde Apple Orchard). His petition also included requests for "Children at Play" signs and Stop signs to be installed at the eastern and western sides of MacIntosh Lane. (His petition contained 116 signatures). Mr. Jensen commented that the Apple Ridge Estates area has already received a 30 MPH speed limit from the State and 15MPH would be next to impossible to get. Mr. Geraci indicated that when they first got the petition up they didn't realize a speed limit was already established. He did stress the erection of the Stop signs for MacIntosh Lane. He also had not realized that the erection of "Children at Play" signs were prohibited, but now understood and would not pursue the installation of them. Mr. Diehl asked Mr. Horton to look into the request for the Stop signs for MacIntosh Lane, and report back to the Board at their next meeting. MR. CLAUSEN moved that the Town request the County to make a survey of Middlebush Road for the purpose of establishing a reduced speed limit on said road. Hawksley Co -Chairman of the Conservation Advisory Council, advising the Town Board that it is the Council's feeling that the administration of the Freshwater Wetlands Act can best be accomplished at the local level, and, therefore, recommends that the Town implement a local Freshwater Wetlands Protection Ordinance. Mr. Rappleyea indicated that he would have a proposed ordinance prepared for the July Town Board meeting. A report was received from Edward S. Hawksley on his attendance at the seventh National Rural Development Leaders School, sponsored by the Rural Development Service thf the US Dept. of Agriculture. A second report from Mr. Hawksley was an outline of the Conservation Advisory Councils position on the concept of open space preservation in the Town of Wappinger. Supervisor Diehl directed that both reports from Mr. Hawksley be received and placed on file. Mr. Jensen, under Committee Reports, addressed the problem of the Hilltop Waterworks wells, that the wells are not produding to their full capacity, and these wells should be recharged. 204.„ r MR. JENSEN moved that the Engineer to the Town be authorized and directed to seek informal bids for recharging the wells at the Hilltop Water Works. One of the problems discussed was the Truett matter. It was aced if Mr. Lapar and Mr. Horton couldn't look at the problem again and reevaluate and look for other options other than what has already been agreed upon. (that was piping the ditch). MR. CLAUSEN moved that Mr. Lapar and Mr. Horton be directed to reevaluate the options available to the Town in solving the Truett complaint in Af1*lbrook Estates. Mini Computer The miscellaneous committee has been looking into the need of a full time, qualified, DE bookkeeper , in the comptrollers office (or 2 full time, part timers) or replacing this function with a mini computer. Even though the mini computer will afford the Town with a valuable tool, that would be able to automate many functions that are being done manually, I feel that the Town is not ready to take such a step. I, therefore, recommend that the Town hire a qualified full time DE bookkeeper or at least a qualified full time, part time qualified DE bookkeeper to replace Mr. Doyle, who is looking to retire. VERSACE moved that a Department Head Meeting be scheduled for Tuesday, July 6, 1976, at 8:00 P.M. and that all Department Heads be so notified.
