1976-06-07 SPM1 8 0 A Special Meeting of the Town Board of the Town of Wappinger was held on June 7, 1976, at the Town Hall, Mill Street, Wappingers Falls, New York. Notice of said meeting was mailed to each Board member on June 3, 1976, calling the meeting for 8:00 P.M. June 7, 1976 for the purpose of setting a date for a Public Hearing on the proposed Zoning tie w Ordinance, consideration of returning to single entry bookkeeping as opposed to double entry and a computer type machine, and any other business that may properly come before the Board. Supervisor Diehl called the meeting to order at 8:39 P.M. Present: Louis Diehl, Supervisor Leif Jensen, Councilman Nicholas Johnson, Councilman Frank Versace, Councilman Gladys Ruit, Deputy Town Clerk Absent: Louis Clausen, Councilman Elaine Snowden, Town Clerk Others Present: Rudolph Lapar, Engineer to the Town Allan Rappleyea, Attorney to the Town Mr. Diehl explained the purpose of the meeting was to set a Public Hearing on further amendments to the proposed Zoning Ordinance Amendments as the changes have been received from F.P. Clark Asso- ciates. The following Ordinance was introduced by COUNCILMAN JOHNSON, who moved its adoption: BE IT RESOLVED AND ORDAINED by the Town Board of the Town of Wappinger, Dutchess County, New York, in pursuance of the authority conferred by the Town Law of the State of New York, that the Zoning Ordinance and *lap of the Town of Wappinger adopted January 29, 1963, as amended from time to time, is hereby further amended as follows: Section 1 - Article 2V - Regulations Registration of Non -Conforming Uses . 1 81 404.6 Registration of Non -Conforming Uses During the first/one (1) year following the Effective date of this Ordinance or of any amendment thereto, the owner or owners of property on which there is a non -conforming, non-resi- dential use of land or buildings (within the definition of this Ordinance or which may be made so by an amendment thereto), shall register such non -conforming use by filing, with the Zoning Admin- istrator a statement of such non -conforming use. The acceptance of such statements shall not constitute an authorization to operate an unlawful use. The filing of a false registration statement shall constitute a violation of the Ordinance. If the owner of a non -conforming use shall not so register it, such use shall be presumed to have been discontinued unless the owner submits proof that the use existed legally prior to the effective date of the regulation that made it non -conforming. Annually, the Zoning Administrator may send a questionnaire to the persons who have registered a non -conforming use, inquiring as to the status of such use. Such questionnaire shall be sent by certified mail "return receipt requested" to the last addresses available from the filed registration statements. If such questionnaire is not returned within ninety (90) days, the Zoning Administrator shall so record this fact and send a notice to the last address of the owner to the effect that the non -conforming use is presumed to have been abandoned or discontinued unless the owner establishes, to the satisfaction of the Zoning Administrator, proof that the use has continued. Bon -residence Districts 416.52 Not more than one (1) free standing sign, composed of no more than two (2) back to back faces, along each street on which the lot abuts provided that the aggregate area of each such sign shall not exceed one (1) square foot for each linear foot of building facing the street or twenty-five (25) square feet, whichever is smaller. 424. Beekeeping 424.1 All persons ttarting a beekeeping operation after this Ordinance goes into effect shall have worked with an exper- ienced beekeeper for no less than eighty (80) hours or have an equivalent educational certificate. 424.2 Each beekeeper shall register his beekeeping operation with the State Department of Agriculture as required by State law. 424.3 A beekeeper shall not create or maintain an unsafe or hazardous condition to the community. If such a complaint is registered with the Town Zoning Administrator, the Town can request an investigation by the State Bee Inspector or a local recognized bee authority, to help render a decision. If the beekeeper is found in fault, corrections or removal must be made in accordance with the inspection report within a sixty (60) day period. 1. Section 445 - Standards for regulating development in flood prone areas renumbered as Section 460 4. Section 460 - Board of Architectural Review - Deleted in its entirety. 182 5. There will be no pages 71 & 72 **6. Sections 421 and 422 - Schedule of Regulations for residential districts, and schedule of regulations for non-residential districts. Added to chart: Recreational use by Special Use Permit to Al, P1 and residentail districts by Town Board approval. Section II This Ordinance shall take effect upon adoption, posting ir and publication as provided by Town Law. JOHNSON moved that a Public Hearing be held by the Town Board of the Town of Wappinger on July 14, 1976 at 7:30 P.M. at the Wappingers Junior High School, Remsen Avenue, Wappingers Falls, New York upon the proposed amendments of the proposed comprehen- sive Zoning Ordinance, the latter being subject of three prior Public Hearings held on June 24, 1975, July 29, 1975 and March 1, 1976, pursuant to notices thereof previously published. The purpose of the Public Hearing to be held on July 14, 1976 is to consider these further amendments to the said comprehensive Zoning Ordinance and Map proposed at or resulting from the aforesaid prior Public Hearings and to hear all interested persons either for or against said amendments. JOHNSON moved to set a Special Meeting of the Town Board of the Town of Wappinger for Wednesday, July 14, 1976 at 9:00 P.M. at the Wappinger Junior High School, Remsen Avenue, Wappingers Falls,New York. Seconded by Mr. Diehl Roll Call Vote: 4 Ayes 0 Nays 83 Mr. Diehl then went into Item #2 on tonight's agenda regarding purchase of a computer, using single or double bookkeeping, or hiring a full time bookkeeper. There were different avenues they could take. The Comptroller had discussed this with the Board previously and requested that action be taken by the Board. Mr. Johnson was in favor of purchasing the machine. He went by the figures Mr. Ryan had given to him and according to them, it would cost less over a period of three years than the system they are presently using. If they use double entry bookkeeping, they must have a bookkeeper. The machine would be used for all sewer and water billing, all invoices, eventually the ,payroll. Mr. Versace felt that the double entry bookkeeping system was supposed to be implemented when the Comptroller was hired. He questioned the status of Mrs. Egan and Mrs. Laffin if the machine was installed. Since the machine is supposed to save time, does this mean someone has to be eliminated in the office? He then questioned their status if the Town went Civil Service; they would then have to take tests for different titles and possibly could be replaced, if others ware more qualified. Discussion followed on man vs. machine, who would learn the machine, and other internal problems. Mr. Jensen suggested that this matter be referred to Miscellaneous Committee, Mr. Johnson and Mr. Clausen, for a recommendation and report back to the Board. Mr. Diehl then wanted to discuss a communication received from Freda Casner, Director, Dutchess County Youth Board, regarding the possibility of use of space and phone in the Town Hall for "Rent -a -Kid" program. Town Hall would be available during days and Mr. Logan had no objection to offering space in his office for this service as long as a telephone was provided, as he could not spare either one of his lines. Previously Dutchess Bank and Trust had sponsored the program, but withdrew their services this year. The cost involved might be $125 to $150 a month for the phone. Mr. Diehl felt it was a worthwhile community project for the youth 184 and he had no objection to the use of our facilities. Mr. Jensen was upset; he felt the County was always suggesting that the Towns sponsor these County functions, but they never seem to have the money available to put them into action. He asked if the County had approached the Village for space and phone, 1: were the other Towns getting involved. Mr. Versace felt that the Village of Wappingers Falls would agree to split the cost of the monthly bill of the phone. It was decided that Mr. Diehl would contact Mrs. Casmer to inquire if there was any funding they could rely on from the County. He would also contact the Village Board with the proposal that they share the cost involved. MR. JOHNSON moved to adjourn the meeting, seconded by Mr. Jensen and carried.
