ADJOURNMENT 1 L The Regular Meeting of the Town Board of the Town of Wappinger was held on April 12, 1976 at 8:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Deputy Supervisor Clausen called the meeting to order at 8:10 P.M. Present: Louis Clausen, Deputy Supervisor Leif Jensen, Councilman Nicholas Johnson, Councilman Frank Versace, Councilman Gladys Ruit, Deputy Town Clerk Absent: Louis Diehl, Supervisor Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Jon Adams, Attorney from Allan Rappleyea's office Rudolph Lapar, Engineer to the Town The Minutes of the December 8, 1975 Regular; December 29, 1975 Audit Meeting; Special Reorganizational and Reorganizational Meeting January 2, 1976; January 12, 1976 Regular; and Special Meeting March 22, 1976, having been previously sent to the Town Board members, were no placed before them for their approval. MR. JENSEN moved the Minutes of the December 8, 1975; December 29, 1975 Audit Meeting; Special Reorganizational and Reorganizational Meeting January 2, 1976; January 12, 1976 Regular; and Special Meeting of March 22, 1976 as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Johnson Roll Call Vote: 4 Ayes 0 Nays The reports for the month of March were received from the Building Inspector, Town Justices, Zoning Administrator and Receiver of Taxes. MR. JENSEN moved that the reports for the month of March submitted by the Building Inspector, Town Justices, Zoning Adminstrator and Receiver 112 of Taxes be accepted and placed on file. Seconded by Mr. Versace Roll Call Vote: 4 Ayes 0 Nays Mr. Clausen indicated there were residents present from the Robinson Lane who would be entertained first before resuming with the Agenda. Harry Nichols, Robinson Lane, being recognized by the Chair, presented a petition to the Board, containing 150 names opposing a landfill site on the Parkers Outdoor World property. Mr. Robert Baston, Paulette Lane.forwarded a petition opposing a landfill site on Parkers Outdoor World property containing 360 signatures. Mr. Robert Carponaro, 1 Paulette Lane alsosubmitted a similar petition containing 140 signatures. Cheryl Snethen and Judy Markbein also submitted the same petitions. There were a total of 1,080 signatures in all submitted. MR. JOHNSON moved that all the petitions herewith submitted in opposition to a landfill site on the Parkers Outdoor World Property be received and placed on file. Seconded by Mr. Jensen Roll Call Vote: 4 Ayes 0 Nays Mr. Joe Rawls, Roberts Running Creek Trailer Park, being recog- nized by the Chair voiced his opposition also to any landfill which would contaminate the Sprout Creek. He said he would fight to the hitter end if this particular landfill was considered. Mr. Charles Patterson, Hackensack Heights, asked where he could tkke his kitchen garbage now. This question generated some further discussion on the solid waste problems now being faced in Wappinger and other municipalities. Continuing on with the normal Agenda, the following letter was received and read: ANGEL BROOK CIVIC ASSOCIATION Dr. Jeffrey E. Brownstein, Sec. 2 Tor Road Wappingers Falls, N.Y. March 8, 1976 Wappingers Town Board Wappinger, New York, Gentlemen: Recent investigations by the members of the Angel Brook Civic 160 Association of the hazards of the brook in the vicinity of 23 Alpert Drive give cause for alarm. The parents of Angel Brook are deepij concerned about the safety of their children due to the following: 1. The velocity and depth of the water during and immediately after heavy rains. 2. The depth of the water under normal conditions which at one point exceeds three feet. 3. The erosion of the banks which is compounding the danger. The deteriorating conditions require immediate attention without which inaction may result in the death of a child. As concerned parents, we urge you to take immediate action. As our elected officials, we urge you to allocate our -tax dollars immediately to correct the situation. There can hardly be a higher priority than to protect the lives of the children who live in our com- munity. om- munity. Will you please make this a high priority on your agenda and inform us when the above is brought to the attention of the board. Dr. Brownstein, being present was recognized by the Chair, elaborated on his letter, and voiced additional concerns for the children who play in the area of 23 Alpert Drive. Mr. Clausen reminded Dr. Brownstein that this particular problem had a history, which he may or may not be aware of, and if he and some of the other residents in the area at some future time would like to come down and discuss this again, the Board would share their thoughts and finding with them. Mr. Clausen suggested the invit- 114 tation to attend the Angel Brook Civic Association meeting for the purpose of discussing this problem be addressed to the Town Clerk who would forward same to all Board members. MR. JOHNSON moved to receive Dr. Brownstein's correspondence and place it on file. Seconded by Mr. Jensen Roll Call Vote: 4 Ayes 0 Nays The following letter was received: FLEETWOOD APARTMENTS Osborne Hill Road Wappingers Falls, N. Y. 12590 March 11, 1976 Town Board of the Town of Wappinger Town Hall Mill Street Wappingers Falls, N.Y. Dear Sirs: I am writing about my garden apartment house property located at the intersection of Osborne Hill Road and Ketchamtown Road in the Fleetwood section of Wappingers Falls. The apartment house consists of three buildings with a total of 42 units and is known as Fleetwood Apartments. As a result of a recent inspection by my insurance company they have stated the following: "All possible efforts should be made to provide an adequate cty water supply with a minimum of two hydrants within 500 feet of the buildings." I am sure you will agree with me that the safety of this concentration of people is worthy of your deepest consideration and I do urge that you will take this matter under your most serious consideration. Seconded by Mr. Johnson Roll Call Vote: 4 Ayes 0 Nays �r+ l: 115 The following letter was received: March 24, 1976 Gentlemen: Enclosed are photos of the property recorded as belonging to M.T.S. Corp. on Maloney Road. It is the property where Village Crest has it's wells, as a point of location. For more than two year and through many roadblocks, I have been working on this project, for as you can see by the photos, this mess needs eraticating as an "attractive nuisance" and an eyesore. Finally, I am pleased to say that Jon Adams and I have arrived at the place in time and our endeavors, where we must turn over the matter into your capable hands. Mr. Adams tells me that the Town Board will have to go for bids for demolition and removal, the price of which may be attached to the tax bill of the owner. I would appreciate your action on this matter as soon as possible because Mr. Adams and I have so much invested in this undertaking. Yours truly, s/ Sylvia Anderson MR. JENSEN moved that formal bids be solicited for demolitions of property belonging to M.T.S. Corp. on Maloney Road within the guidelines of this order, and under the guidance of the Attorney to the Town. Seconded by Mr. Versace Roll Call Vote: 4 Ayes 0 Nays A letter of objection was received from Mr. Benjamin Marino with reference to a statement included in all the water and sewer billings the that dealt with vandalism in the various plants. MR. JENSEN moved to receive Mr. Marino's letter and place it on file. Seconded by Mr. Johnson Roll Call Vote: k A letter was received from Annamae Gutmann requesting the Town to declare a "no parking" area on both sides on New Hackensack Road in the vicinity of MacDonalds' since she has experienced a 116 great deal of trouble with trucks parking in front of her driveway, excessive litter strewn in the road after the truckers have eaten, and also the fumes and noise from these vehicles is obnoxious in the summer. Mr. Horton, upon a question from Mr. Jensen, indicated that this is a County road and James Spratt would be the appropriate person to contact. MR. JENSEN moved that a letter be sent to James Spratt, Dutchess County Highway Commissioner of Public Works stating Mrs. Gutmann's complaints and asking him for remedial action at once with a copy to the Town of Wappinger County Representatives. Seconded by Mr. Johnson. Roll Call Vote: 4 Ayes 0 Nays Mr. Johnson suggested a letter also be addressed to Mrs. Gutmann indicating Board action. Applications for Hawking and Peddling Licenses were received from Thomas Bires, Charles and Judith LaBlanc, John Circello and Walter Leczinski. The applications had been referred to the Dutchess County Sheriffs Department, and returned indicating no criminal record in file. MR. JENSEN moved to approve the applications and grant Thomas Bires, Charles and Judith LaBlanc, John Circello and Walter Leczinski licenses for Hawking and Peddling in the Town of Wappin- ger. Seconded by Mr. Versace Roll Call Vote: 4 Ayes 0 Nays The following was received and read: March 31, 1976 Town Board, Town of Wappingers Town Hall Mill Street Wappingers Falls, NY Re: Games of Chance 1 17 Gentlemen: As you are aware, the Constitution was amended as a result of the passage of a proposition at the 1975 general election wherein and whereby local municipalities may conduct a referendum on whether or not religious charitable or other non-profit organizations shall be permitted to conduct games of chance. The 1975 amendment expanded, the prior provisions of the law which permitted bingo to cover other games of chance, such as the awarding of prizes on the basis of numbers, colors or symbols or as a result of the spinning of a wheel, drawing or otherwise. As noted, it is necessary that the matter be submitted to the voters at a special or general election. If the Board would like to present this matter at either a special or general election, please advise me so that I may prepare the proper proposal for submission. JENSEN moved to direct the Attorney to the Town to draw up the necessary resolutions regarding games of chance for referendum and, if possible, get it on the next election. Seconded by Mr. Johnson Roll Call Vote: 4 Ayes 0 Nays A letter was received from Mary White regarding her being fully assessed on the benefit sewer tax. The sewer line ends three houses above her. Mrs. White was one of the lots designated as receiving no service, and that the Town could make the decision for an adjustment in her sewer tax. Mrs. White commented this would be satisfactory if the Board did, in fact, cake some adjustment. MR. JOHNSON moved that Mrs. White's letter be received and placed on file, with a copy to be sent to the Attorney to the Town and Mr. Logan, Assessor, for research as to adjustment of last years payment. Seconded by Mr. Versace. Roll Call Vote: 4 Ayes 0 Nays 118 Mr. Herbert Stenger voiced his objections to the sewer tax on his property, White Gates Apartments. Mr. Clausen indicated this would be forwarded to the Attorney, also. The following letter was received: March 17, 1976 Town Board Town of Wappinger Mill Street Wappingers Falls, N.Y. Gentlemen: Enclosed is a copy of my receipt for road opening permit deposit in the amount of $130.00. The above amount was to be returned to me, as yet I have not received same. Please return my deposit as soon as possible. Thank you for your cooperation. JENSEN moved to accept the Highway Superintendent's recommenda- tion and return..$105.00 to Mr. Daniel Fowler from his $130.00 road opening permit deposit. Seconded by Mr. Johnson Roll Call Vote: 4 Ayes 0 Nays A request was received from Peter Tavolacci, representing NARO Subdivision requesting the return of the cash bond held in escrow and accept a performance bond in its place. MR. JENSEN moved to table Mr. Tavolacci's request to Mr. Rappleyea for his recommendation. Seconded by Mr. Johnson. Roll Call Vote: 4 Ayes 0 Nays kw 11'9 Letters were received from John A. and Joseph F. Clark and Ian MacDonald regarding the local Historic Zoning proposed for the Hughsonville Area, Mr. Archie R. Hansen regarding his property as relates to the proposed new Zoning Ordinance, and Stanley Ries concerning a roller skating rink. Mr. Johnson indicated discussions had been held earlier with these people he believes the Board has to discuss the whole zoning problem and these letters are part of those topics. MR. JOHNSON moved that the letters from John A. and Joseph F. Clark, Stanley Ries, Archie Hansen and Ian MacDonald irepresenting the Curries) be received and placed on file and to be taken up in executive session when the Board discusses the Zoning Ordinance. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Two memos were received from the Planning Board, one regarding the Montfort & Nestler eight lot commercial subdivision located on Route 9; the second regarding Section 419- Wetlands and Steep Slopee of the proposed Zoning Ordinance. MR. JOHNSON moved that these letters be received and placed on file, and brought up for discussion in executive session when the Board discusses the proposed Zoning Ordinance. Seconded by Mr. Johnson. Roll Call Vote: 4 Ayes 0 Nays The following letter was received: 16►, March 22, 1976 Town Board Members Town of Wappinger Mill Street - Town Hall Wappingers Falls, New York Gentlemen: I have researched this claiM and cannot find where the Planning Board has the authority to hire outside Engineers even when there is an apparent conflict of interest. JENSEN moved that authorization be granted the Planning Board to hire an outside Engineer, in this particular instance and further authorize the Comptroller to make payment of the voucher for Mr. Peter N. May 4, 5, 6; Recreation Coma, mission, Recreation Convention Grossingers May 2nd through May 5th (two members from the Commission) and Edward Hawksley to attend the Seventh National Rural Development Leaders School, Lake Harmony, Penna. April 25th thru May lst. MR. JENSEN moved that permission be granted to Eleanor Croshier, Elaine Snowden, two members of the Recreation Commission and Edward Hawksley to attend their respectively requested meetings, and that their legitimate expenses be Town charges. Seconded by Mr. Johnson. Roll Call Vote: 4 Ayes 0 Nays MR. JOHNSON moved that the correspondence from Camo Pollution Control Inc. with reference to 1. Central Wappinger Water Pressure; 2. Laboratory Analysis; 3. Harwood Manor Apts. (Fleetwood); 4. Baldwin Place Pump Station; and 5. Rockingham Water Supply Pump Control system be received and placed on file for further discussion. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Mrs. Markbein questioned Mr. Jensen on letter #5 and he indicated that the new controls had not as yet been installed. The following report was received from Camo Pollution Control Inc: 06. 121 March 23, 19/', Town of Wappinger Town Board Mill Street Wappingers Falls, New York Re: Discolored water at Solomon residence 10 Franton Drive Fleetwood Water District Gentlemen: Recently we answered a complaint at the abobe residence in regard to "dirty" water. Samples of the water from the Solomon residence, the water plant and nearby homes revealed that the problem was only observed at the Solomon residence. The distri- bution system was observed to have a 0.05 mg/1 iron content while the sample collected from the Solomon residence was observed to have an iron content of 0.3 mg/L A twenty-four settleability test indicated that the color observed ("rust color") was not due to settleables dispersed in the sample but suspended and/or dissolved material. We cleaned and flushed the meter and flushed the line as best possible from the street to the meter. We also flushed the main line on several occasions. The Solomon residence is in a low area and the system presently has only three (3) flushing hydrants. The hydrant nearest the Solomon residence being at the high point of the section. Any further investigation of this problem should be done through the Town Engineer. Please advise as to any further action you wish us to take. JENSEN moved that the Engineer Mr. Lapar be directed to prepare specifications and go out to bid for the Fleetwood discolored water problem. Seconded by Mr. Johnson. Roll Call Vote: 4 Ayes 0 Nays The following report was received: 122 March 10, 1976 Town Board' Town of Wappinger Mill Street Wappingers Falls, N.Y. Re: Sewage House Pumps Dear Board Members: In certain areas of the Wappinger Sewer Improvement #1 pumps will be needed to service houses in low areas. We have examined several pumps and have chosen one we feel is best suited for this purpose. Please advise us of what action you wish us to take as people will soon be wanting to tie in. Thank you. Roll Call Vote: 4 Ayes 0 Nays Mr. Lapar forwarded some information on Bike Guards for possible use in the Widmer Road Storm Sewer Project. MR. JENSEN moved that Mr. Horton and/or the Comptroller purchase or secure a sample of one bike Guard to see what it looks like and have Mr. Horton evaluate it to determine it it will interfere with snow plowing. Seconded by Mr. Clausen. Roll Call Vote: 4 Ayes 0 Nays A report was received from Mr. Lapar regarding the Orchard Homes and Mid -Point Park Well & Pump sites with a copy attached of a memo he had written to Bob Cacchio (Camo Pollution). These are systems abandoned due to the tie-in of Hilltop Water - the question is maintaining them as standby or complete abandonment. MR. JENSEN moved to receive and place on file Mr. Lapar's commun- ication regarding the 2 well sites for further discussion with Mr. Cacchio. Seconded by Mr. Versace. Roll Call Vote: 4 Ayes 0 Nays 123 Mr. Huber, being recognized by the Chair, asked that since the abandonment of the Mid -Point Water System, was there some other use the wells and pump system could be utilized rather than dismantle the plant, such as selling water to a private concern. Mr. Versace answered that he, Mr. Jensen, Mr. Cacchio and Mr. ' Lapar had discussed this possibility and had agreed they didn't want to go into the business of selling water, but by the same token, they would try to sell or trade off the equipment to other 1 districts within the Town to recover whatever costs can be recovered. Keith Christofferson, asked if the residents of Royal Ridge could be informed of what would take place with the well site and possibly help decide what could be done with it. Mr. Clausen believed the Board would welcome any suggestions either by Mr. Chritofferson or any other residents. JOHNSON moved to receive Mr. Lapar's letter regarding Wappinger Sewer Improvement #1 - Contract #4 and Central Wappinger Water Contract #5, and place it on file. Seconded by Mr. Jensen Roll Call Vote: 3 Ayes 0 Nays Mr. Versace --Abstain 12 The following Report was received and read: March 29, 1976 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Improvements to Rockingham S.T.P. Contract #1 Dear Board Members: As part of the above referenced contract, repairs were made to the existing intermittent Sand Filters. It was learned, during the repairs, that part of the problem which led to the rupture and eventual failure of the filters was the protrusion of roots from brush and small trees through the lining of the filter. Consequently, this office would recommend that the Town initiate a brush and weed control schedule along the filter banks to htlp prevent this problem from developing in the future. Dear Board Members: I enclose a copy of my letter dated September 11, 1975, and although my verbal understanding is that the water is the Town's responsibility to the curb shutoff and the sewer lateral goes to the street main, we would certainly appreciate this position in writing. Mr. Jensen that the Board had taken formal action on this subject in the past, and suggested the Town Clerk be directed to send a letter to Mr. Lapar confirming this action of the Board with a letter to the Building Inspector's office. MR. JOHNSON moved to receive and place on file the letters from Mr. Lapar regarding Pressure Regulators, and meter readouts for further discussion in executive session. Seconded by Mr. Jensen Roll Call Vote: 4 Ayes 0 Nays The following letter was received and read: April 1, 1976 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Maintenance of Wells Hilltop & Rockingham Farms Water Systems Gentlemen: Because of the problem encountered in Well #3 of the Hilltop Water Co. and good engineering practice our office urgently recommends that the Town Board institute a periodic maintenance and cleaning procedure for each -well. Since we have had trouble with Well #3, and chemical tests indi- cate that loss of capacity of that well is due to physical forces, it is our recommendation that the well be redeveloped. Authorization for informal bids to redevelop Hilltop Well #3 is requested. Also, a yearly preventive maintenance program for all wells in Town -owned systems should be implemented. Re: Water Service & Sewer Lateral Installations Dear Board Members: Once again I am writing to advise you of the inherent dangers of improper installation of sewer and water house connections. The Oakwood Knolls Sewage Treatment Plant has a capacity of 203,000 gallons per day and this will be reached very quickly if there are faulty connections. This office believes that an effective inspection program will not only insure a good installation for the homeowner but also allows more customers to use the treatment facilities, thus creating additional revenues for the Town. This office believes that if such a program is not initiated immediately serious problems within the sewer and water system are certain to occur. In the last several months, the resignation of three ranking General Electric _Corp. nuclear engineers, plus the departure of Con Edison's chief safety engineer at Indian Point - over the unwarranted hazards connected with nuclear power generation - lend added weight to the arguments against nuclear energy. Gentlemen: The Wappinger Conservation Association is becoming increas- ingly alarmed over the failure of the Board to adopt a new zoning ordinance after two comprehensive public hearings dating back to last July. This continued vacillation by the Town Fathers and failure to move on the proposed ordinance is contrary to the public interest and borders on nonfeasance. Although the updated zoning law may have some minor flaws, these weak spots can be omitted or amended at a later date, after its enactment. Meanwhile, a far greater risk to the town's future growth rests with Wappinger's continuing operation under the dangerously obsolete 1963 zoning regulations. Joseph Paggi from the Town Engineer's office suggested that I write to you in reference to the swamp problem at Lake Oniad. The specific area in question is along the road in front of #16, #18 and *20 LakeOniad Drive. It is the property in front of Rosenthal, Brown and Sparacino. These areas in question have more water retained than in the past. Previously, these areas were just "damp" - now, they are a developing "swamp area" causing a potential health hazard. In my discussion with Mr. Paggi, we have figured that the only change between the past years and this year is the installa- tion of the water and sewer pipes and the change in the road. The road changes may have caused a change in the contours of the land, not permitting drainage or causing poor or improper drainage, thus increasing the amount of water retained on the land, creating a swamp. Mr. Paggi suggested that I write and ask the town to study this problem towards solving this potential heiath hazard. I would greatly appreciate further direction and information for this problem. Roll Call Vote: 4 Ayes 0 Nays L 129 Under Committee Reports, Mr. Versace stated there had been reports from some residents in Oakwood Knolls, whose property adjoins the sewer plant, of raw sewage fluting out. He believes these people had spoken to Mr. Lapar, and he asked Mr. Lapar if he had a report on it. Mr. Lapar indicated that there was a complaint to the Dutchess County Health Department on it, and Mr. Cacchio investi- gated. Mr. Versace added the report had come back from the Health Department and it was raw sewage, and since it was, he asked Mr. Lapar if he would contact Mr. Cacchio to come up with a solution. Mr. Jensen reported on the Tri -Municipal meeting last Thursday, that the Grant Application is still in the process, and the State has indicated that possibly late May or early June it would be approved. Also, from the House Committee he reported on reviewing various areas for leasing, and there was one viable one for the XYZ Corp. for 10,000 sq. ft. MR. JENSEN moved to authorize and direct the Attorney to the Town to draw up a lease between the Town and the XYZ Corp. for rental space of 10,000 sq. ft. for consideration. Seconded by Mr. Clausen. Roll Call Vote: 4 Ayes 0 Nays Mr. Versace commented that there were no cost figures of the present facilities vs. the cost at the XYZ Bldg. and therefore, at this time would not support this motion at this time. Mr. Clausen said that it had been briefly discussed by himself, Mr. Jensen and Mr. Johnson that they would support a motion to have the Attorney draw up a lease arrangement, realizing of course, that there would be further discussion, and if when the lease was prepared, it wasn't acceptable, they wouldn't act upon it. Further delay might result in loosing the opportunity, and this is not a firm commitment on the part of the Board. Mr. Versace still wanted a cost comparison from the Comptroller. Diehl Supervisor Mr. Clausen commented that, rather than the Board acting tonight, since it probably is the first time the residents have heard this proposal, the Board would like some feed -back on it to see if the residents feel this is a good location or possibly suggestions for a better site. The matter can be more deeply discussed at the executive meeting on April 19th and a decision then reached. The Board basically has no objections to this site, delayed action is only to give residents a chance for imput if so desired. MR. Ward, Dogwood Hill Road, indicating that since the installation of the new water pipe system, a continuous upflow of water exists in front of his prop- erty at the connection valve location, a leak had been detected and presumably repaired last fall. He requests an engineering review of the situation to either ascertain if the condition is surface water or still another leak in the water line. MR. JENSEN moved that the Engineer to the Town review the repair job that was done by the Contractor, and report back to the Board 1g his findings. Seconded by Mr. Clausen. April 7, 1976 Town Board of Wappinger Wappingers Falls, N.Y. Gentlemen: On February 6, 1976 we mailed to Mrs. Crosby, Town Tax Collector, a tax bill in the amount of $777.12 and a check to cover payment in full for same. As the premises we inhabit was purchased from Nancy Kowalski in 1975, the tax bill was in the name of the former owner. On April 5, 1976, when we reconciled our bank statement, we discovered that the check had not been deposited. On inquiry to the Tax Collector on April 6, 1976 regarding this, she informed us that she had net received our payment and, further, that a delinquency payment of 2% was now due. We are hereby respectfully petitioning relief from the payment of this penalty as our books show payment on February 6, 1976. As we are a federal credit union our books are under the exam- ination of the Federal Credit Union Administration, and, also, as our books are closed each month there can be no doubt of the issuance of the check, in full, and on time. Roll Call Vote: 4 Ayes 0 Nays Mr. Herb Stoller, being recognized by the Chair, commented that, under Roberts Rules of Order, he believed that after a motion and second there was discussion and he felt there were areas where the public might like to participate in discussion, but the Board had been eliminating any discussion on some of the motions. When asked .by Mr. Clausen what area was of concern he questioned the authority of the Comptroller to recommend an accounting firm to audit the Town's Books. Mr. Clausen responded that the two pro- posals were identical and the proposals had been examined by the Board. He further added that to be recognized all Mr. Stoller had to do was raise his hand. Mr. Steinhaus, Chairman of the Planning Board, being recognized by the Chair, questioned whether there was a need for consultation with the Town Board prior to using the services of a Planning Con- sultant, since money was allocated in the contractual portion of their budget for these purposes. The Board did not feel it was necessary since these allocation were budgeted. Mrs. Nancy Haytnn, being recognized by the Chair, recommended that the Board of Ethics be reinstated by the Town Board to look into some situations that have been uncovered. Mr. iausen felt there would be no objection to reinstitute a Board of Ethics committee at this time. He recommended that each member of the Board come in 1 with a name that they would like to serve on the Ethic's Committee, and see if the Board can't reestablish one, using the same rules and guidelines that have been used by the Town Board in the past. Mr. Johnson indicated he had researched the question and what was being referred to was Local Law ##2 of 1970 and a Board of Ethics was appointed at that time, he doesn't know if that Board could or still serve. Mrs. Hayton asked if the matter could be resolved at the next regular Board meeting. Mr. Johnson asked if she had a reason for this request, upon which she responded she had a matter she wished this Board to look into. Mr. Mills, having been a member of the Town Board at the time of adoption of Local Law #2, 1970, believed that the function of the Board of Ethics was for employees and officers to seek rulings as to whether they had a conflict. Nobody can bring up charges against anybody and have the Board of Ethics investigate. It was the individual himself who would ask the Board of Ethics if he was in fact in conflict of interest, that's the basic structure of the Board of Ethics. Judy Markbein stated she has attended numerous recreation meetings and has requested benches for the recreation area in Rockingham. The request was made in October, there still are no benches and she is wondering why. Mr. Clausen asked the Clerk to write to the Recreation Commission asking what the status was of the Rockingham benches that were prmmised to be installed last October, with their answer directed to both the Town Board and Mrs. Markbein. Mr. Hawksley being recognized, mentioned that a few months past he had presented the Board with a proposed agreement for the soil conservation service and requested that the Town enter into it, so that the Conservation Advisory Council could avail itself of the free services, had the Board considered it? Mr. Clausen suggested this matter be discussed at the Department Head meeting, and also the Attorney to peruse it. The following letter was received and read: March 14, 1976 Mrs. Elaine Snowden, Town Clerk Town of Wappinger Mill Street Wappingers Falls, New York Dear Mrs. Snowden: 13'x' I am returning herewith the three requests for speed limits directed to this office for transmittal to the New York State Department of Transportation. I am returning them as the Department of Transporta- tion on previous occasions made determinations that indicated they would not approve the reduction of speed on any one of these special areas. Please review the matter and, if you feel you wish to pursue this request to the Department of Trnasportation without this office concurring as to the need, I will be more than happy to act as the transmitting agent. Grierson had called him in regard to vehicles using as a turn -a -round the shoulder of New Hackensack Road in the vicinity of her home, causing a dust problem in her home and property. He had suggested she write Mr. Spratt, informing him of this problem, and asking for relief, which she indicated she would do. MR. CLAUSEN moved that the Town Board bring to Mr. Spratt's attention the problem that Mrs. Grierson is experiencing, and asking for some type of relief on her behalf. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Mr. Versace asked Mr. Horton if he had contacted Mrs. Sweeney, Eck Road, as he had received correspondence from her relative to a road problem. Mr. Horton had not as yet contacted her and Mr. Versace asked him for a report on it at the next meeting. Mr. Versace alse indicated that Mr. Snyder, Kent Road, had written in regard to some ROW on his property, and asked that the Attorney contact him and find out what the problem is. L Mr. Incoronato, being recognized by the Chair, stated that the Wappinger Conservation Association was going to head a litter cleanup drive at Reese Park on April 24th and he would like to first ask permission from the Town to enter the Park to pick up the debris and secondly, a Town truck to come later (mon. or Tues) to pick up the picked up debris from the main parking area. Mr. Clausen indicated that the request for the Town truck should go to Mr. Hopton, and although the Board has no objections, the Association should contact Mr. Maurer, the Recreation Commission Chairman, and ask their permission, or at least notify them of the project. Mr. Clausen asked Mr. Horton if he had any objections about supplying a truck for Mr. Incoronato's cleanup project, and Mr. Horton asked where would it be dumped after they picked it up. Mr. Horton queried the Board as to the status of the Revenue Sharing Money, as paving season is upon them, and he would like to know where he stands, if he can or cannot proeeed with all the roads planned. County Representative John Armstrong was present, and was asked if he had any reports he wished to give. Mr. Armstrong spoke briefly on the balefill problem from the County level. MR.
