1976-03-22 SPMA Special Meeting of the Town Board of the Town of Wappinger was held on March 22, 1976 at the Town Hall, Mill Street, Wappingers Falls, New York. Notice of said meeting was mailed to each Board member on March 11, 1976 calling the meeting for 8:00 P.M. March 22, 1976;for the purpose of considering applications for the possible appointment of an accountant to audit the Town's fiscal affairs for the year 1975, and any other business that may properly come before the Board. Deputy Supervisor Clausen called the meeting to order at 10:05 P.M. Present: Louis Clausen, Deputy Supervisor Leif Jensen, Councilman Nicholas Johnson, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Absent: Louis Diehl, Supervisor Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town In light of the fact that there were several pending proposals from accountants to audit the fiscal affairs of the Town of Wappinger for 1975, the matter was not placed before the Board for consideration. The following Resolution was offered by COUNCILMAN JENSEN who moved its adoption: The Supervisor is hereby authorized and directed to execute the attached agreement for the purchase of an easement for sewer purposes of approximately 1,000 feet from Wallace Sheft, Isaac Oberman and Buddy Hackett. Seconded by Nicholas Johnson Roll Call Vote: 4 Ayes 0 Nays The following Resolution was offered by COUNCILMAN VERSACE who moved its adoption: Mies WHEREAS, the Town of Wappinger has on deposit the sum of $22,000.00 and the interest thereon from Julius Gerzof on behalf of Opalo Realty Corp as a deposit to guarantee the completion of certain improvements in Section III of Ye Olde Apple Orchard and WHEREAS, the Town of Wappinger is holding a cash deposit of $5,000.00 with regard to Ye Olde Apple Orchard and the location and charging of certain water lines in and on Pippin Lane and WHEREAS, Opalo Realty has presented a surety bond by Peerless Insurance Company (Bond #S66 36 35) to substitute for said cash deposit with regard to Section III of Ye Olde Apple Orchard and WHEREAS, said Bond #S66 36'35 was. amended by a amendment dated March 17, 1976, NOW, THEREFORE, BE IT RESOLVED that Bond #S66 36 35 of the Peerless Insurance Company is accepted in place of and instead of the cash security of $22,000.00 with regard to Section III of Ye Olde Apple Orchard as a guarantee with regard to the roads and improvements in said Section III and be it further RESOLVED, that the said cash deposit of $22,000.00 for road maintenance security and the sum of $5,000.00 (both with the interest accrued thereon) shall be returned to said Julius Gerzof and it is further RESOLVED that Bond #S91 16 42 changed to #S45 33 66 is hereby released and discharged and the same may be returned to the Principal the said bond having been for Section II Ye Olde Apple Orchard and said Section II having been satisfactorily completed. Seconded by: Councilman Jensen Roll Call Vote: 4 Ayes 0 Nays The following Resolution was offered by COUNCILMAN VERSACE who moved its adoption: RESOLVED, that the Town of Wappinger hereby agrees to accept, as a contribution for Recreational purposes, the sum of $2,500.00 from Julius Gerzof and Opalo Realty Corp. Seconded by Councilman Johnson Roll Call Vote: 4 Ayes 0 Nays The following Resolution was offered by COUNCILMAN VERSACE who moved its adoption: RESOLVED, that the Town of Wappinger accept the Performance Bond #916271, submitted by Klassen Builders, Inc. in the amount of $10,800.00 for East Salem Road and further authorize the re= lease and return to Klassen Builders Inc.. the. cash Surety Bond in the amount of $10,800.00 with aeertted: ,interest .posted -with the :TownWappinger April 30, 1974 and be it FURTHER RESOLVED, that the Town of Wappinger accept the Maintenance Bond #916272 submitted by Klassen Builders Inc for East Salem Road in the amount of $7,236.00 and further authorize the release and return to Klassen Builders Inc. the cash Surety Bond, in the amount of $8,606.67 with accrued interest posted with the Town of Wappinger May 7, 1974.
