The Regular Monthly Meeting of the Town Board of the Town of
Wappinger was held on February 9, 1976 at 8:00 P.M. at the Town of
Wappinger, Mill Street, Wappingers Falls, New York.
Deputy Supervisor Clausen called the meeting to order at 8:09 P.M.
Present:
Louis Clausen, Deputy Supervisor
Leif Jensen, Councilman
Nicholas Johnson, Councilman
Frank Versace, Councilman
Elaine Snowden, Tann Clerk

Louis Deihl, Supervisor (due to illness)
Others Present:
William Horton, Superintendent of Highways
Allan Rappleyea, Attorney to the Town
Rudolph Lapar, Engineer to the Town
Reports for the month of January were received from the Town
Justices, Building Inspector and Zoning Administrator. The Annual
Report was also received ffom Grinnell Library.
MR. VERSACE moved that the Reports for the month of January from
the Town Justices, Building Inspector and Zoning Administrator,
and also the Annual Report from Grinnell Library be accepted and
placed on file.
Seconded by Mr. Jensen.
Roll Call Vote: 4 Ayes 0 Nays
Applications for Peddlers Licenses were received from Maurice
Keenan and Diana Carozza. The applications had been referred to
the Dutchess County Sheriffs Department, and returned indicating
no criminal record on file.
MR. JENSEN moved to approve the application and grant Maurice
Keenan and Diana Carozza licenses for Hawking and Peddling in the
Town of Wappinger.
Seconded by Mr. Johnson

A letter was received from Thomas Logan, Assessor advising the
Board that the part time employment of Patricia Keener in his
office had been terminated.
MR. JENSEN moved to receive Mr. Logan's notification and place it
on file.
Seconded by Mr. Johnson
Roll Call Vote: 4 Ayes 0 Nays,
Mr. Versace recommended that all of the correspondence from the
Comptrollers Office be held aside until a meeting can be set with
Mr. Ryan to go over the material.
A memo had been received from the Comptroller recommending a policy
for living expenses for those attending the Association of Towns
meeting in New York City. It was his recommendation to establish a
$25 per day meal allowance, the Town be responsible for the least
expensive room, travel expenses reimbursed upon s --u mission of proper
receipts, spouses not associated with the Town are responsible for
their own meals and the difference in lodging between single and
double rates.
MR. JENSEN moved that the memo from the Comptroller be placed on
file in the Town Clerks Office, and accepted by the Town Board as a
future policy.

Mr. Clausen noted that in the absence of either of these positions
the Comptroller does not, or can not, automatically assume these
positions under the title of Comptroller. If we give it another
name such as Purchasing Agent he could fulfill those responsibili-
ties, and, also seeing that the Town Board needs a Director of
Personnel to cover such things as vacations, sick leave, those
other housekeepigg matters that normally come before the department
head, he offered the following motion.
MR. CLAUSEN moved that the Comptroller to the Town, Matthew Rrrn
assume the responsibility as Purchasing Agent and Director of Per-
sonnel in the;Town, without additional renumeration.

A Memo was received from Mr. Ryan indicating Robert Peters and
Joseph Kunkel were assessed on their tax bills for operation and
maintenance charges erroneously.
The following resolution was offered by COUNCILMAN JOHNSON who
moved ita adoption.
WHEREAS the following people have been assessed on their
tax bills Operation and Maintenance charges that they have already
paid;
THEREFORE BE IT RESOLVED that the Comptroller be authorized
to draw checks to the following order:

Gentlemen:
With regard to the above -captioned subject, the Planning
Board herewith refers a letter dated December 4th, 1975 from Peter
P. Tavolacci, Attorney at Law, to your Board for action.
The Planning Board is referring this letter to you as the
writer is requesting the return of a certified check and the
Planning Board is not empowered to return such monies.
We would appreciate being advised of any action your Board
takes regarding this matter. Thank you for your cooperation.

Mr. Rappleyea indicated the matter should be formally acted on by
the Board. Due to the result of litigation the Town Board is
placed now in a position to accept Surety Bonds in place of the
cash bonds previously posted. He indicated he would provide a form
for each of these bonds, to provide uniformity, to be filed with the
Town Clerk, and he will further so inform Mr. Steinhaus and corres-
pond with Mr. Tavolacci and so advise him, and will assume at that
time The Board will authorize the return of the cash.
MR. CLAUSEN moved that this matter be referred to the Attorney to
the Town for processing.

A letter was received from Henry Mikaelian, General Manager of
NUWS - New and Used Water Specialists Inc. informing the Town
that this firm now can offer chemicals for use in the Town's
Water and Sewer Districts.
MR. VERSACE moved this correspondence be forwarded to Mr. Ryan for
his judgement and action.
Seconded by Mr. Johnson

Sylvia Anderson, Zoning Administrator, requested permission to
attend a public hearing on the Mined Land Reclamation Law in New
Paltz February 20, 1976 and Bruno Hermans, Building Inspector re-
quested permission to attend the 27th Annual Building and Inspectors
School March 3 to 5th at Grossingers, New York.
MR. JOHNSON moved that permission be granted to both Sylvia Anderson
and Bruno Hermans to attend their respective conferences, and that
their legitimate expenses be a Town charge, provided sufficient
funds are available in their respective budgets.

Watch Hill Sect. 6
Gentlemen:
It is now a year since the roads in the Watch Hill Sect. 6
subdivition have been accepted by the Town. The Town had
retained $4,000.00 as a Maintenance Bond as per your letter
of April 21, 1975. We would appreciate the return of that
amount.

Upon being asked for his recommendation, Mr. Horton, Highway
Superintendent indicated that it was March 10, 1975, and the year
is not up as yet.
Mr. Jensen noted that the policy now is that "as builts" be sub-
mitted prior to the final acceptance and release of the Maintenance
Bond.
MR. JENSEN moved to refer this to Mr. Horton for his perusal, who in
turn shall advise Mr. Arkawy of the "as builts" requirements, and
report back to the Board at the next meeting.

Two bonds were offered by Richard Barger, representing Thornacres
Development Corp. for Section 2 and Section 3 of Thornacres.
Mr. Rappleyea indicated he had approved of the form of the bonds,
and can be accepted assuming that the Performance Bond for Section
2 is in the corresponding amount as the cash previously posted, and
the amount for Section 3 is in accordance with the amount required.
MR. JENSEN moved that the Performance Bonds for Thornacres Sections
2 and 3 be accepted conditioned on the fact that the amount of the
Performance Bond for Section 2 is in the amount of the Cash Bond
previously posted, and further that the Cash Bond for Section 2 be
returned.

Gentlemen:
With reference to the December 11, 1975 letter from Mr. George B.
Cacchio of Camo Pollution Control Inc. to the Town Board, our office
has looked into the feasbility of installing, at the Wildwood Plant,
a Wallace & Tierman chlorinator similar to that in use at the
Rockingham Farms Sewage Treatment Plant.
The estimated cost ofa. reconditioned chlorinator is $1,100 and
the cost of a new chlorinator is $1,481. Both chlorinators carry
a one year warranty on parts only.
As indicated by Mr. Cacchi.o, the advantage in having similar
chlorinators at both plants is that spare parts could be purchased
which would be interchangeable.
It is our recommendation that the Town Board consider the purchase
of a reconditioned Wallace & Tiernan Chlorinator, Series A-741.

Enclosed please find a copy of my letter of January 9, 1976 to
William P. Horton, Superintendent of Highways, and his return
memo of January 13, 1976.
It is my recommendation that negotiations be entered into be
the Town's Attorney to obtain the R.O.W.'s required.
I have examined the soil maps of Dutchess County and question
the area of Mansfeld silt loam that the road would pass through.
Mr. Horton has personal knowledge of the construction of the
Central Hudson power lines in this area and indicated to me
that, with proper filling and settling, no serious problem in
the construction of the road should be encountered.
He however suggested, as we do, that the Town obtain the lands
as soon as possible so all waste fill obtained by the Town can
be placed in the low areas and given sufficient time to settle.

which would be utilized with the new flushing pump to be installed.

Vandalism Report
Gentlemen:
Recently, we again experienced vandalism at the above
captioned facility. The wooden enclosure for the return sludge pumps
was dismantled and used for fire wood on the lagoon, and, the door
the the control building was broken.
In addition, the test equipment was broken and the chlorinator
smashed. We have installed a spare CAMO chlorinator until a new
chlorinator can be purchased.
We have notified the Dutchess County Sheriff's Department and
the New York State Police to patrol this area as much as possible.
Please advise as to any further action you wish this office
to take.

Mr. Clausen indicated this vandalism problem had been discussed
numerous times before. It was the feeling that resident children
were the culprits, but nothing short of 24 hour surviellance would
prevent the continuous vandalism. Residents and Police Agencies
alike had been asked to police the plants. A lengthy discussion
ensued as to who were the culprits, what remedies could be used, and
costs to the residents due to vandalism.

MR. CLAUSEN moved that the Recreation Commission receive the letter
from Camo regarding the vandalism in Fleetwood and ask them to look
into vandalism in all recreation areas and reavaluate their needs
for police surviellance within these areas.

Mr. Clausen asked Mr. Incoronato to contact the Fleetwood Civic
Association as to what the problem was and what the Town Board is
trying to do about it and report back to the Town Board.
MR. JENSEN moved that the Supervisor's office be directed to send
out notes attached to the residents in the next water and sewer bills
indicating that their O&M rates could be affected due to vandalism
problems in said districts.

A report was received from Csmo indicating results of examination
of the water supply from Schoonmaker Plant which should be investi-
gated. All samples indicated a water which is corrosive.
Mr. Jensen recognizing the fact that the Board had previously
directed Mr. Lapar in this area, wished to reaffirm that the Board
requested the Engineer to come up with a solution for 'corrective
action in this matter.
An application was received from Kenneth Santos, representing Argan
Development Corp. for the Town Board to consider this application
under Article 281 for an 88 acre parcel on Route 376.
MR. CLAUSEN moved that the Argan Development Corp. application be
received and placed on file for future recommendations.

Mr. Santos was present for the Argan application, and indicated
to the Board that he would appreciate getting an idea of what the
Board was thinking and what direction the corporation should pursue.

Corp. and place it on file for future recommendations.

Mr. Frank Buyakowski having requested to speak before the Board
regarding taxes on his 17 acre parcel on Kent Road, was present,
and recognized by the Chair. He indicated he wished to discuss
with the Board the resolution by the Board of September 5, 1975,
in which he felt there was a mistake made regarding his property.
As part owner of the Kent Ridge Development the referenced para-
graph to him in the resolution is only partly true. There are
two sections to his development - Section 1 has approval - Section
2 has not yet received final approval. The tax bill showed 28 lots
when, so far, only 4 lots are approved, and he believes the Assessor
should be so notified.
Mr. Clausen indicated there may have been a mistake made with the
intent of approval - temporary or final - but he believes the Board
should discuss the matter with the Attorney, and if a mistake has
been made to make an adjustment in the future. Mr. Jensen noted
he had heard no objections at the public hearings held. Mr.
Buyakowski stated he wasn't objecting to the assessments and if in
fact, he had final approval on the lots he would not object, but
there are two other subdivisions in the water and sewer improvements
that also have preliminary approval that are not being taxers the
way he is being taxed, and he feels his subdivision is being singled
out. He just wants to be treated as the others are.

MR. CLAUSEN moved to refer this matter to the Attorney to the Town,
and be handled in executive session in the future, and will get
back with Mr. Buyakowski.

Under Committee Reports, Mr. Versace wanted to verify a correspond-
ence from Camo Pollution concerning the evening of January 13th,
in Oakwood Knolls, when there was backup of sewage coming through
a manhole cover. Mr. Cacchio stated that Mr. Horton, Mr. Glass and
Mr. Ellis were upon the scene, that it had subsided somewhat after
checking it out, and were unable to contact the Town of Poughkeepsie
for power equipment, and that work was done the following day. On
that evening Mr. Horton, Mr. Glass and himself were there, Mr. Ellis
was not present, and at that time he didn't believe any contact was
made with the Town of Poughkeepsie and no contact was made to rod
that easement out until the next morning. The water meters, in
speaking with the building office, it has come to his attention that
Mr. Cacchio has taken meters from the office and has used them
evidently in the water district, but we do not have a record of the
serial numbers of the new meters that he took, or record of the
meters that were replaced, but according to Mr. Cacchio, they are
at the Oakwood Plant. He would like to see a letter sent to Mr.
Cacchio asking him to send to the Town Board and Building Inspector's
office the serial numbers of all the meters that he %as taken out
and the old meters that are presently there and serial numbers of
the ones repaired. Mr. Jensen had believed that the Building
Inspector had a list of all the serial numbers, and when these were
handed out to a new customer he was keeping a record of who was
receiving them. He would like to check again with the Building Inspect-
or to see if this is being kept up. This however, should be discussed
at a full executive session.
Mr. Jensen suggested that a memorandum be sent to the Building
Inspector, Mr. Hermans and ask him what has been kept up to date,
as they are under his care and protection.
MR. VERSACE moved that a letter be sent to both Mr. Hermans and
Mr. Cacchio stating the procedure should be that accounts be made
for water meters by serial numbers be on file in the Building
Inspector's office, and further, that Mr. Cacchio forward the
meter serial numbers that he had taken out, and where they have
been placed at, so the Town will have a record of them.

Mr. Versace added that he had asked the clerk in the Building
Inspector's office not to issue any more water meters to Mr. Cacchio
until this matter is cleared up. Mr. Clausen stated that he didn't
believe anyone of the Board members, as in individual Board member
can or should direct any other Member of the Town to carry out a
policy that is not a Town Board policy coming from the Town Board.
He wasn't objecting to the request, there was nothing illegal
about that, only the method, and he thanked Mr. Versace for bring-
ing it to the Board's attention.
Mr. Johnson gave the following report on his investigation of the
need for a part time clerk for the Zoning Administrator:
At the January 2, 1976 reorganization meeting, the miscellaneous
committee was directed to investigate the need for a part time
clerk to the Zoning Administration.
In conducting my investigation, I interviewed the Zoning Adminis-
trator, the Building Inspector, the clerk to the Building Inspector,
the secretary to the Zoning and Planning boards, and others working
in the town hall. I also received a memo from the Zoning Adminis-
trator and one from the Supervisor.
All the informfttion indicates that the position of part time clerk
to the Zoning Administrator was instituted at a time when the
building in the town was at a high point. It was also brought
out that this clerk would aid as a floater, filling in for anyone
who would be out or overloaded.
CONCLUSION:
1. The position of part time clerk to the Zoning Administrator
is not needed at this time.
2. The person working at that position did an excellent job.
3. The need for covering vacationing personell should be
handled without creating permanent jobs.
4. All positions in the Town government should be investigated
to determine if they could be eliminated or needing up -grading.
Mr. Clausen along with Mr. Johnson had been assigned to investigate
the need for a clerk to the Zoning Administrator and reported that:
Councilman Johnson and myself were directed at our last regular
meeting to ascertain if the position of clerk to the Zoning Admin-
istrator was warranted at the present time, due to the present
economic conditions. I have discussed this problem with various
Town Employee's familiar with the position, and report the
following:
Mrs. Ann Marie Albrecht worked as clerk to the Zoning
Administrator on an hourly basis, and was considered part time.
Mrs. Albrecht, along with her duties as clerk to the Zoning
Administrator, fulfilled the duties of the Secretary to the
Planning -Board, Secretary to the Building Inspector, and worked
in the Supervisors Office when the need warranted it, such as
vacation time for regular employees, or during accident and
sickness. Everyone I spoke to had the greatest admiration for
Mrs. Albrecht as an individual and praised her for her ability
and performance. There is no question in my mind that the Town
benefited from her knowledge and dedication. To employ an
individual knowledgable and capable to assume various Town
responsibilities on an hourly basis seems to be an efficient
method of retaining personnel.
I would recommend that the title of Clerk of the Zoning
Administrator be changed to the title of Clerk to the Town to
better utilize the position when various departments need tempor-
ary extra help. I further recommend that the Town Board retain
Mrs. Albrecht as the Clerk to the Town
Mr. Clausen concluded that both he and Mr. Johnson had similar
reports and possibly the title and/or position as Clerk to the
Zoning Administrator could somewhat be better served as a clerk
to the Town and as it is an hourly and part time job that, upon
agreement of the Town Board if such a person is retained or em-
ployed by the Town, that possibly the office through which this
service should be raddered should be the Com`ptroller's Office.
When a department wishes to have extra help they would notify the
Comptroller as to what the need is, and upon his recommendation
and departmental budgets allow and keep records of the time and
jobs done so the Town can get better service from the employees.
Mr. Johnson agreed that part of the problem was probably the title,
but before the Board takes on the responsibility of part time

employees, he thinks the Board should define what this part time
position would entail who would be the supervisor and how we would
go about it. Mr. Clausen indicated he had spoken to Mrs. Albrecht,
she seems - recepti've' to act at the Town's request when the need for
extra help should arise in various departments. Since the Board
has not accepted her resignation, that this be left open and any
requests from various departments be sent to the Comptroller to
keep track of and allocate slots. At a later date an executive
meeting could be set up to work out the guidelines.
MR. JENSEN moved to receive Mr. Clausen and Mr. Johnson's reports
regarding a part time clerk and place them on file.

The catch basin has been provided by the County to drain this
area, and a paved ditch has been constructed to transport the
water to the catch basin. The problem lies in the fact that
the ditch has a very flat or shallow grade and, with cold
weather, the water has a tendency to freeze and construct the
flow rather than continue to the catch basis -
We are aware of this problem and, if it means continual mainten-
ance on our behalf, we will make anadditional effort and keep
the complaints from users to a minimum.

3. Mailbox was set at a height of approximately 42 inches,
our wings are approximately 32 inches, therefore, the wing could
easily pass under the mailbox without stricking it.
4. Damage to the mailbox is on the front. There is nothing
on our trucks, wings, or plows that could cause this under normal
snow plowing procedures.
Enclosed for your informartion is an opinion letter from past
County Commissioner Edgar Petrovits, which I feel is self-explana-
tory.

MR. CLAUSEN moved that Mrs. Cerbino be notified that the Town
Board's position is as stated by Mr. Horton's letter to the Toirr
Board, that we do not take the responsibility of damage by tfe
Town of the mailbox and a copy of Mr. Horton's letter be sent to
Mrs. Cerbino.

Mr. Versace questioned Mr. Horton as to other mailboxes in the
area, and if he accepted responsibility of having hit them.
Mr. Horton explained that several had been hit by the plow and
others were done by persons or things unknown. When a mailbox
is down, men on trucks radio information in and log is kept, if
Town is responsible, restitution is made.
Mr. Lynn Huber, being recognized by the Chair, indicated that
his request for an audit of the Mid -Point sewer funds had not
been received from the Comptroller's office. He just wanted to
remind the Board he would still like this information. The Board
indicated that the information was being compiled.
Mr. Clausen indicated the presence of County Representative John
Armstrong, and gave him the courtesy of asking if he wished to
discuss anything with the Board or make any reports. The Board
did remind him that they would appreciate him keeping after the
drainage problem on Myers Corners Road in vicinity of Losee Road,
and also the culvert problem on New Hackensack Road. Mr. Armstrong
did report on the landfill problems, explaining the problems faced
by the County in trying to solve it. Mr. Clausen thanked Mr.
Armstrong for speaking and sharing the County concerns and views.
MR. VERSACE moved to adjourn, seconded by Mr. Johnson and
unanimously carried.
