ADJOURNMENT The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 2, 1976 at 7:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 7:07 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Nicholas Johnson, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Others Present: Allan Rappleyea, Attorney to the Town Matthew Ryan, Comptroller Supervisor Diehl opened the meeting by introducing Nicholas Johnson, and welcoming him to the Board. He then addressed the floor stating that a Special Meeting had been conducted earlier in the afternoon to consider only those Resolutions dealing with salaries and some appointments, in order to give the Comptroller authorization to issue the payroll. He further declared that all those Resolutions would be re -read for the benefit of those now present. The first item on the Agenda was the designations by the Supervisor, Town Clerk and Highway Superintendent of their appointments. Supervisor Diehl announced the appointment of Louis Clausen as Deputy Supervisor; John Doyla as his Bookkeeper, and William Egan as his Confidential Secretary. Town Clerk Elaine Snowden announced the appointment of Gladys Ruit and Ethel Relyea as her two Deputies. Highway Superintendent William Horton designated Kenneth Croshier as his Deputy Superintendent of Highways. The Town Clerk then read the Resolutions that had been adopted by the Town Board at the Special Meeting held earlier in the afternoon of this day. The titles of those Resolutions, having been duly adopted at the Special Meeting January 2, 1976 at 3:30 P.M. are as follows: I. Authorizing Issuance and Payment for 1st Payday of 1976 II. Appointing Personnel to Various Town Offices and Positions of Employment III. Establishing the Salaries of Certain Classified Civil Service Positions in the Town. IV. Appointing Comproller in Town of Wappinger V. Appointing Receiver of Taxes in Town of Wappinger VI. Appointing Personnel to Comptroller's Office and Postitions of Employment VII. Setting Salary for Clerk to Building Inspector VIII. Setting Salary for Secretary to Town Justices X. Appointing Clerk to the Supervisor XI. Establishing Salaries of Certain Classified Civil Service Position in the Town (Clerk to Assessor) XII. Setting Salary for Secretary to Highway Superintendent Supervisor Diehl called for a roll call vote, upon the completion of the reading of the above noted Resolutions, as confirmation of their accuracy: Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye The following Resolution was introduced by COUNCILMAN JENSEN, who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING A PART TIME BOOKKEEPER TO THE COMPTROLLER OF THE TOWN OF WAPPINGER RESOLVED, that Marlene Ziegler be and she hereby is appointed to serve as Part-time Bookkeeper to the Comtroller of the Town of Wappinger, Dutchess County, New York, and it is further RESOLVED, that the salary for the Bookkeeper to the Comptroller of the Town of Wappinger be and the same hereby is fixed and established at an hourly rate of $2.95, to be paid every other Friday throughout the year 1976, with 27, pay periods during such year, with the first payday to be January 2, 1976. Seconded by: Councilman Johnson Roll Call Vote: Councilman Clausen Nay Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Nay Supervisor Diehl Nay Resolution Defeated SUPERVISOR DIEHL moved to offer the names of Lois English and Bridget Gannon to be considered by the Comptroller for the posi- tion of Part-time Bookkeeper to the Comptroller for him to review their applications, and, in his best judgement, be authorized to appoint the best qualified of these two persons to the position of P/T Bookkeepr for the Comptroller, and further, authority is given to the Comptroller to terminate the employment of the appointee if performance is not satisfactory, subject to Town Board approval if the reasons indicateperformance is not satis- factory. Seconded by Councilman Clausen Roll Call Vote: Councilman Clausen Aye Councilman Jensen Nay Councilman Johnson Nay Councilman Versace Aye Supervisor Diehl Aye The following Resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES AND POSITIONS OF EMPLOYMENT RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity throughout the year 1976, unless their services shall be sooner terminated, at the pleasure of the Supervisor: NAME OFFICE John Doyle William Egan Supervisor's Bookkeeper Supervisor's Confidential Secretary AND IT IS FURTHER RESOLVED, that the salaries otherwise fixed for the above designated offices and ppsitions shall be paid to the holders of such offices and positions, payable every other Friday throughout the year 1976, with 27 pay periods during such year with an adjustment after the last pay period in June, with the first payday to be January 2, 1976. Councilman Versace Aye Councilman Jensen Aye Supervisor Diehl Aye Councilman Johnson Aye STT TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT The following resolution was offered by COUNCILMAN VERSACE who moved its adoption: RESOLVED, that the pay scale for the following categories of employees hired by the Town of Wappinger Highway Department be and the same hereby is fixed and established at the following minimum to maximum hourly rates: Heavy Operator Light Operator Laborer Foreman $5.01 to 5.20 per hour 4.96 to 5.05 per hour 3.74 to 4.93 per hour 5,53 per hour AND BE IT FURTHER RESOLVED, that all of such Highway Depart- ment employees engaged on an hourly basis shall be paid every other Friday throughout the year 1976, with the first payday to be January 2, 1976. Seconded by: Councilman Clausen Roll Call Vote: Councilman Clausen Councilman Jensen Councilman Johnson Councilman Versace Supervisor Diehl Aye Aye Aye Aye Aye TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK ESTABLISHING THE PAY SCALE FOR PART TIME CLERICAL EMPLOYEES ENGAGED TO SERVE THE TOWN BOARD AND ITS OFFICERS, OFFICIALS AND AGENCIES The following resolution was offered by SUPERVISOR DIEHL who moved its adoption: RESOLVED, that the pay scale for all extra part time clerical employees engaged to perform services for Board of this Town and/or its officers, officials, be and the same hereby is fixed and established at hourly rate of $3.10 per hour, and it is further the Town and agencies a maximum RESOLVED, that all of such extra part time clerical employees engaged on an hourly basis shall be paid every other Friday throughout the year 1976, with the first payday to be on Friday, January 2, 1976. Seconded by: Councilman Clausen L11 Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye A Resolution for the appointment of a Part -Time Clerk to the Zoning Administrator was read by the Clerk. Mr. Jensen, on this particular appointment, questioned the need for a part-time Clerk in the Zoning Administrator office. He believes since the Building and Zoning climates have diminished greatly over the last year, and doesn't believe there will be much of an upturn in 1976, therefore, he recommended the Board either table this particular appointment at this particular time or until the Board can get a better clarification from the Zoning Administrator for the need of said help. Mr. Johnson concurred with Mr. Jensen, and added that, having been a member of the Zoning Board of Appeals did not see the work load which would justify a parttime clerk. He would also like to have some additional information that shows the need. Mr. Diehl recommended, at this time, that the Miscell- aneous Committee, Messrs. Clausen and Johnson, look into the situation and report back to the Board so the Board can weigh their findings, and at this time hold up on the Eppointment. Mr. Clausen took the tack that, first this particular matter should have been investigated and resolved before the meeting, secondly, perhaps all departments should be re-evaluated as to the needs of employees, and thirdly, he would prefer considering the resolution for the appointment of a part time clerk for the Zoning Administrator with the stipulation that the Zoning Administrator supply the necessary information, evaluate it and if, then necessary, rescind the appointment. Mr. Versace concurred with Mr. Clausen. MR. JENSEN moved to table the Resolution appointing a part time clerk to the Zoning Administrator. Seconded by Mr. Johnson. Rappleyea be and he hereby is employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such legal advice and services as may be required and he shall receive compensation therefor in accordance with a proposal submitted to this Board. Lapar be and he hereby is employed and retained for the purpose of furnishing to the Town Board, its officers and agencies, such engineering advice and services as may be required and he shall receive compensation therefor in accordance with a proposal submitted to this Board. Snowden be and she hereby be appointed to serve as Registrar of Vital Statistics to the Town of Wappinger, Dutchess County, New York, for a term of four years commencing January 1, 1976 and ending December 31, 1979, pursuant to Section 4123, Public Health Law, and it is further RESOLVED, that said Registrar of Vital Statistics to the Town of Wappinger shall receive no salary or compensation, however, she shall be entitled to receive for the performance of the duties of this respective office the fees fixed by applicable statute. The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: RESOLVED, that monthly meetings of the Town Board of the Town of Wappinger shall be held at 8:00 P.M., at the Town Hall, Mill Street, in the Village of Wappingers Falls, Town of Wappinger, Dutchess County, New York, in the evening of the 2nd Monday of each month, or at such other place or places within the Town of Wappinger as the Town Board shall from time to time designate. SUPERVISOR DIEHL moved to table this resolution until the need for such accountant is verified now that the Town has established the office of Comptroller. Seconded by Councilman Johnson Roll Call Vote: 5 Ayes TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK PERMITTING THE TOWN CLERK TO ESTABLISH A PETTY CASH FUND The following resolution was offered by COUNCILMAN JENSEN who moved its adoption: WHEREAS, the Town Clerk of the Town of Wappinger has numerous requests for the expenditure of small amounts of cash for postage, supplies, and miscellaneous items, for various departments of the Town of Wappinger, NOW, THEREFORE, BE IT RESOLVED, that the Town Clerk is hereby authorized and directed to establish a petty cash fund in the sum of $50.00 for the use of said Town Clerk. Seconded by: Councilman Johnson Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING THE SUBMISSION OF THE SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE COMPTROLIE R The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: WHEREAS, Subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year, an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company where town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certi- fied copy of such report to be published in the official news- paper. WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of the Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Councilman Versace Roll Call Vote: Councilman Clausen Aye Councilman Jensen Ave Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Ave TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK RELATIVE TO TEMPORARY DEPOSIT AND INVESTMENT OF TOWN FUNDS The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: WHEREAS, it has come to the attention of this Town Board of the Town of Wappinger that there are now or may be in the future funds and monies, except proceeds of loans and monies the investment or which is otherwise provided for by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, in, or certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligations of the United States of America and/or the State of New York, and WHEREAS, it appears that the temporary deposit and/or investment of such excess and surplus funds may be beneficial and profitable to the Town of Wappinger, NOW THEREFORE, it is hereby RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger be and he hereby is authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section II of the General Municipal Law of the State of New York, and it is further RESOLVED, that such temporary deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section II of the General Municipal Law of the State of New York, and it is further RESOLVED, that the aforesaid Supervisor of this Town be and he hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this resolution. 0 g 22 Seconded by: Councilman Jensen Roll Call Vote: Councilman Clausen Aye Councilman Jensen Aye Councilman Johnson Aye Councilman Versace Aye Supervisor Diehl Aye TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING THE USE OF A MECHANICAL CHECK -SIGNING DEVICE FOR THE SIGNING OF CHECKS WITH A FACSIMILE SIGNATURE OF THE SUPERVISOR OF THE TOWN OF WAPPINGER The following resolution was offered by COUNCILMAN CLAUSEN who moved its adoption: RESOLVED, that voucher -order checks of the Town of Wappin- ger may be signed with a facsimile signature of the Supervisor of the Town of Wappinger as reproduced by a mechanical check - signing device or machine provided that the safeguards specified by the manufacturer and inherent in the operations of such device are properly observed, and it is further RESOLVED, that a certified copy of this resolution be filed with all banking institutions which are depositaries of the monies and funds of the Town of Wappinger, for the purpose of indicating authority for the use of such facsimile signature, and it is RESOLVED, that the Supervisor of the Town of Wappinger be and he is hereby authorized and empowered to take all steps which may be necessary and proper to acquire a mechanical checksigning device for use in conformity with this resolution. The following Resolution was offered by COUNCILMAN JENSEN who moved its adoption: RESOLVED, that Donald Keller be and he hereby is appointed to fill the vacancy on the Planning Board of the Town of Wappinger which has occurred by reason of the expiration of the term of office, and it is further RESOLVED, that the said Donald Keller is hereby appointed to the said Town Planning Board for a term which shall expire on the 4th day of January 1983. Diehl Town Supervisor Mill Street Wappingers Falls, New York Dear Diehl: This hospital is contemplating the construction of a chain link fence around the entire hospital grounds, in order to have security for patients, visitors and employees. Recently, a patient, who had been missing for four days, was found dead in the dense woods adjoining our grounds. In view of this tragic development, our hospital has made the building of a chain link security fence as its number one priority con- struction project for the coming fiscal year. In order to expedite this project, we are asking our neighbors to permit us to clear small brush from about five feet of land beyond our property line, so that we can perform regular main- tenance on the new fence and more efficiently search our property when patients are reported missing.
