A Special Meeting of the Town Board of the Town of Wappinger was
held on June 20, 1977 at 7:30 P.M. at the Town Hall, Mill Street
Wappingers Falls, New York.
Notice of said meeting was mailed to each Board member on June
17, 1977 calling the meeting for 7:30 P.M. on June 20, 1977 for
the 'purpose of considering the applications to the EDA for Central
Wappinger Water Improvement Fire Hydrants; Expansion and renova-
tion to the Oakwood Knolls Sewage Treatment Plant, Phase II; and
Ardmore Hills Water Improvement Projects; and also to consider
the introduction of, and -.set a:Public Hearing on, a Local Law
for the "dver 65" tax exemptions.
Notices were also given of said meeting to the Beacon Evening
News, Poughkeepsie Journal, Southern Dutchess News WW&SD News)
and Radio Stations WHPN, WEOK, WBNR & WKIP on June 17, 1977 and
a notice was posted on the Town Clerk's Bulletin Board on June
17, 1977.
Supervisor Diehl called the meeting to order at 7:45 P.M.

Mr. Diehl stated that the purpose of tonight's meeting was to
specify to the Federal Government the priorities in.regard .to
the grant of $284,000. Before the Board is.a list, showing EDA
Locator Numbers, along with the description of the projects and
amount of funds requested.
MR. JENSEN moved that the priorities as presented, and being:
EDA Locator #NY -1239-0, Town of Wappinger Central Wappinger Water
Improvement - Contract #10, Installation of approximately 52 Fire
Hydrants to upgrade system to AWWA Specifications @ $125,840;
#NY -1241-0, Town of Wappinger Expansion and Renovation of the
Oakwood Knolls Sewage Treatment Plant, Phase II Installation of
Mechanical Mixed Media Filters ® $120,000; and, #NY 1240-0 Town
of Wappinger, Ardmore' frills Water Improvement. The Water :'improve-
ment Area will serve approximately 67 single family homes and
275 apartments. This area is now served by wells which are
failing rapidly, @ $38,160, be approved as submitted. tonight.:

MR. JENSEN moved the introduction of the following Local Law
Amending Local Law #1 of 1967 which provides for a partial tax
exemption of real property owned by certain persons with limited
income who are 65 years of age or over.
A Local Law amending Local Law No. 1 of 1967.
Be It Enacted by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
Section 1. Section 2 of Local Law No. 1 of 1967 is hereby
amended to read as follows:
Section 2. Real property owned by one or more persons,
each of whom is sixty-five (65) years of age or over, or real
property owned by husband and wife, one of whom is sixty-five
(65) years of age or over, shall be exempt from town taxes to
the extent of Fifty (50%) Percentum of the assessed valuation
thereof, subject to the following conditions:
(a) The owner or all of the owners of such real property
must file an application annually in the assessor's office at
least ninety (90) days before the date for filing the final
assessment roll or such other time or date as may be hereafter _
fixed -by law. r
(b) *The income of the owner or the combined income of the
owners of the property shall not and may not exceed the sum of
Seven Thousand Two Hundred ($7,200,00) Dollars for the income
tax year immediately preceding the date of making the application
for exemption. The income tax year shall mean the twelve month
period for which the owner or owners file a federal personal
income tax return, or if no such return is filed, the calendar
year. Where title is vested in either the husband or the wife,
their combined income may not exceed such income. Such income
shall include social security and retirement benefits, interest,
dividends, net rental income, salary or earnings, and net income
from self-employment, but shall not include a return of capital
gifts or inheritances.
(c) The title to such real property
in the owner or all of such real property
(24) consecutive months prior to the date
for exemption.

(d) The real property shall be used exclusively for
residential purposes.
(e) The real property shall be the legal residence of and
shall be occupied in whole or in part by the owner or by all
of the owners of the same.
(f) Applications for such exemption shall be made by the
owner, or all of the owners, of the property, upon forms pre-
scribed by the state board to be furnished by the assessing
authority, and applicants shall furnish such information and
shall execute the application in the manner prescribed in such
forms.
Section 2. This Local Law shall take effect immediately
upon adoption.
The following Resolution was offered by COUNCILMAN JENSEN who
moved its adoption:
WHEREAS, there has been duly presented and introduced at a
meeting of this Town Board held June 20, 1977, a proposed Local
Law #1 of 1967, and
WHEREAS, the provisions of Municipal Home Rule Law require
that no local law shall be passed by the legislative body of
the Town until a public hearing thereon has been held before
such body,
NOW, THEREFORE, be it resolved as follows:
1. That a Public Hearing

least once in the official newspaper of the Town of Wappinger.

There being no other business to come before the Board, Supervisor
Diehl entertained a motion to close.
MR. VERSACE moved the meeting be adjourned, seconded by Mr.
