ADJOURNMENT The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on October 14, 1975 at 8:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:14 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Frank Versace, Councilman Elaine Snowden, Town Clerk Absent: Stephen Saland, Councilman (due to illness) Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town The Minutes of the September 8, 1975 Regular Monthly Meeting, having previously sent to the Town Board members, were now placed before them for their approval. MR. CLAUSEN moved the Minutes of the September 8., 1975 Regular Monthly Meeting, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Jensen Roll Call Vote: 4 Ayes 0 Nays The September monthly reports were received from the Supervisor, Town Justices, Building Inspector and Zoning Administrator, and the following letter from Judge Bulger: October 10, 1975 Town Board Town of Wappinger Wappingers Falls, N.Y. Gentlemen: On Friday, October 3, 1975, at approximately 7:30 P.M. while court was in session, I was visited by Mr. Fedelli Galioto, the Village of Wappingers Falls Fire Inspector. At the time of his visit, the courtroom was crowded and the crowd overflow was in the hall, on the stairs and down to the street. Mr. Galioto felt that the number of persons present violated safety codes and indicated he would have this matter officially called to the attention of Supervisor Diehl. Mr. Galioto's comments buttress the appeals we have made over the past years for larger quarters. Respectfully, s/ William J. Bulger Town Justice MR. CLAUSEN moved to accept the September reports from the Super- visor, Town Justices, Building Inspector and Zoning Administrator and Judge Bulger's letter of October 10, 1975 and place them on file, and further that the Justices be allowed to ask for more help, and/or do whatever they feel is necessary to alleviate a bad situation should the need arise. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Mr. Diehl, with reference to Judge Bulger's communication, indicated that the Board was still searching for larger quarters for Justice Court, and recommended the services of another peace officer be utilized in an effort to keep the hall clear. Mr. Clausen com- mented that to his knowledge, this was not the problem nor the solution, they just needed larger quarters. He believed the Board should receive Judge Bulger's comment, and again, act toward an expeditious end to their plight. A letter was received from Mr. Terrance Fisher, Brothers Road, informing the Board that during the course of the installation of water lines on Brothers Road by Lombardi, a loading machine ran over their well leaving a hold approximately 3 feet in diameter, and 4 feet deep. Repairs had been promised immediately, but not accom- plished as of the date of Mr. Fisher's letter (9/8/75). A sub- sequent letter from Frank Lombardi (dated 10/6/75) indicated that his Supervisor, Robert Sherman, informed him the repairs had' been made, and were satisfactory to Mrs. Fisher. 8 32 MR. DIEHL mdved that the Town Clerk respond to Mrs. Fishers' complaint by forwarding a copy of the contractor's letter to him. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Notice was received from the Environmental Conservation Department indicating they had received an application for a permit to remove gravel and silt from two separate sections of Sprout Creek from Parkers Outdoor World. MR. CLAUSEN moved that the Attorney and Engineer to the Town, and any officer of the Town, be empowered to attend such Public Hearing in behalf of the Town and voice our position. Seconded by Mr. Versace Roll Call Vote: 4 Ayes 0 Nays The following reports were received: Sept. 22, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Temporary Drainage Solution Valvo and Neighbors Robert Lane Oakwood Knolls Subdivision Gentlemen: More detailed surveys of the above captioned area indicates that the proposed original 500 foot trench across the back line of Mr. Valvo and his neighbors would probably not solve the problem. This is due principally to the filling in of a lot owned by Mr. & Mrs. MacKechnie. We would, therefore, now propose to carry the water collected in the ditch by pipe down Roberts Lane, through an easement between lots 37 & 38, to the stream. The cost of this system would be approximately $40,000. Again, we would like to state that unless a solution is permanently decided at Myers Corners Road we may just be transferring this water problem from one area to another. By this I mean that without a permanent solution and renovation of the drainage system at Myers Corners Road, we may not really be solving the problem at all. Very truly yours s/ Rudolph E. Lapar, P.E. October 6, 1975 Memo To: Town Board, Town of Wappinger County Representatives: Dr. Daniel J. Hannigan, John Armstrong and G. Donald Finnan Gentlemen: On September 30, 1975 Town of Wappinger Councilman Frank Versace, and I met with Mr. James Spratt, Superintendent of Public Works, County of Dutchess. We investigated the three (3) problem areas in the Town of Wappinger; namely, the two (2) locations on Myers Corners Road (one near Kent Road and the other near Losee Road), and the location on New Hackensack Road wherein the Town has requested the County to solve drainage problems that have persisted for many years in the Town. At the Kent Road site, Mr. Spratt indicated to Mr. Versace and to me that the culvert would be cleaned and that a new design of that culvert would be effectuated this winter by his engineering depart- ment. At the second culvert it was indicated that the County would approach the present land owner and attempt to dig a ditch from the existing ditch coming out of Oakwood Knolls to the two 42" culverts going under Myers Corners Road. It was decided at that time, since the Town of Wappinger is doing the detailed drainage study, that my office would suggest to Mr. Spratt what could be done in that area and, if other than what he had suggested, then the County would try to do whatever they could to support their part of the proposed improvement within the County right-of-way. At the third location - ditch coming out of Wildwood Subdivision and going into New Hackensack Road, no problems were foreseen. The design was dated 1968 and there appeared to be no obvious problems to the installation of a larger culvert at that point. One added point I would like to make to the County Representatives is that Mr. Spratt indicated to me that these items can be done. However, if they are cut out of the Dutchess County Budget then, of course, the Town of Wappinger would be back in the same boat. I would hope this would not happen. Very truly yours, s/ Rudolph E. STP Vandalism Report Present on Site: Michael Morris 334 1. Broken florescent light 2. Thermometer was missing 3. Three pronged rake is missing 4. 2-20 gallon garbage pailes missing 5. 1-55 gallon chlorine drum empty missing 6. The lock was broken off the door 7. The gas meter destroyed - a hole in front of it due apparently to a rock being thrown against it 8. Hoes in the well of the building which appeared to be due to rocks 9. The shingles are being broken off 10. One of the sludge lines was found to be open and messed up on plant operation for a few days. MR. JENSEN moved to place Mr. Morris' report from Camo on file. Seconded by Mr. Clausen Roll Call Vote: 4 Ayes 0 Nays The following letter was received: Oct. 2, 1975 Town of Wappingers N.Y. Gentlemen, I here by give notice to the Town of Wappingers that you will have full responsibility, for any property damage or personal injury to anyone, by debre from partially demolished building on my property, on Old Hopewell Road in the Town of Wappingers. The removal of all permits has made it necessary for me to take these steps to protect myself and property. In as much as permits have been withdrawn I cannot complete building or the demolishing of buildings. Respectfully Yours, s/ Michael A. Schwall MR. JENSEN moved to refer Mr. Schwall's letter to the Attorney to the Town to review. Seconded by Mr. Clausen. Roll Call Vote: 4 Ayes 0 Nays A letter was received from H. J. Maurer, Chairman of the Recreation Commission recommending a return of monthly executive meetings with ,y s the Town Board and Department Heads, as he believes they would greatly improve communications. Mr. Diehl agreed with Mr. Maurer and indicated the Board would get together and set a definite date and month for this purpose. Mr. Jensen also agreed and suggested a short memo to H. J. Maurer acknowledging receipt of his letter and shortly the Board would schedule regular Department Head meetings once a month. Mr. Versace also approved of such meetings and stated he would support a specific meeting night once a month. A letter of apology was received from Gary A. Fretsch (Howard Kelly Jr. Assoc) expressing regret in his interpreting the notification of an executive meeting with the Town Board for Cranberry Hills Development (Water Supply and Sewage Disposal). They expressed the hope of another meeting being scheduled for discussion of the water and sewer facilities for this development. Supervisor Diehl directed this matter be tabled to the November meeting. The folllowing report was read: October 8, 1975 Town Board, Town of Wappinger Mill Street Wappingers Falls, N.Y. Re: Load Limit -Town Roads Gentlemen: Due to the current expansion in the Town of Wappinger I feel a load limit on Town Roads would be discriminatory against new homeowners, in that most moving vans would normally exceed the limit. Additionally, tank trucks bringing in water to fill swiming pools, dump trucks bringing in top soil, regular oil delivery trucks, and, of course, our own Town equipment would all exceed a reasonable load limit. I do feel a load limit should be imposed on all county bridges leading into the town, rather than the town setting a limit. Very truly yours, s/ William P. Horton 9ES 336 MR. Roll Call Vote: 4 Ayes 0 Nays The following report was received: October 9, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Installation of Replacement Water Meters Town of Wappinger Gentlemen: On September 26, 1975 I received a letter from Mr. Robert Cacchio, a copy of which was sent to the Town Board, indicating defective meters and places for which meters should be purchased. My recent letter to you indicated that these meters, in most cases, should be replaced and I assume that the Board has designa- ted that this is an O&M charge and I would hope that authorization would be given to Mr. Bruno Hermans to purchase said meters so that these problems can be resolved. CLAUSEN moved that the Building Inspector be empowered to purchase replacement water meters, following the bidding proceedures for the purchase of paid meters. Seconded by Mr. Versace. Roll Call Vote: 4 Ayes 0 Nays The following report was received: Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Gentlemen: October 9, 1975 Central Wappinger Water Improvement Booster Stations on Top O'Hill Road and on Dogwood Hills Road At the September 30th meeting of the Town Board of the Town of Wappinger, my office was authorized to inform the contractors to place these two booster stations in service for some seven or eight residents who have below minimum pressure standards. The contracts were originally let without these booster stations being included because of the alternate that was asked by my office of the Town Board, whether we should put in the booster stations or put in individual house systems. On the date of September 30th the Board did make the decision to put in the booster stations. Subsequently, on October 6, 1975 we received a letter from the State of New York Department of Health stating that the require- ments for a booster station of the type indicated have been increased. I see no opportunity at this time to place the booster station that we designed some two or three years ago in operation, with the changing rules. I recommend at this time that we forego this installation and find out just exactly what the acceptable minimum requirements are that would still allow us to adequately serve the public. According to the new rules of the New York State Department of Health, the possibility of an inconvenience to the people on top of Top O'Hill Road and Dogwood Hills Road might be minimized by the fact that there is probably minimum adequate pressure, and that is something they will have to live with until we get straightened around and rebid this as a subsequent project. I will be happy to discuss this with you further at some Town Board meeting but, as I understand it, right now we have no choice but to wait and see what we must do with the pumping station and then solicit bids for the installation, hopefully in early 1976. DIEHL moved that the Engineer, Rudolph Lapar, be empowered to ascertain what pressure is there, what is needed so that at the next Town Board meeting the Board can make a direct attempt to solve the problem, and possibly sits. with Mr. Lapar to go over the new New York State Department of Health ruling is, to get a better understand- ing of what they are saying. 3 S8 Seconded by Jr. Jensen Roll Call Vote: 4 Ayes 0 Nays The following report and recommendation was received: October 10, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Rockingham Sewer District Contract #1 Dear Board Members: On September 18, 1975 bids were received for the above referenced facility. The only bid received was that by Lafko Associates, Inc. for the amount of $24,676.00. Since this amount was more than was estimated; this office re- commends one of the following courses of action. (1) a. Award Items 1, 2 & 3 to Lafko Associates, Inc. for $18,594.00 b. Have Items 4 & 5 done by Town forces in which material should not exceed $200.00 c. Have Items 62, 6b & 6c done by Signal Central Security Systems for $1, 197.00 (See quotation attached) d. Have Item 7 done by Town forces. The material cost for this item is $731.00 (See quotation attached) The total cost for this alternative would be approximately $20,722.00 (2) The second alternative would be to rebid the Contract, since there was only one bidder. JENSEN moved that Change Order #2 for Wappinger Sewer Improve- ment Area Contract #2 be approved. Seconded by Mr. Clausen. Roll Call Vote: 4 Ayes 0 Nays The following report was received: October 10, 1975 Town Board Town of Wappinger Town Hall -Mill Street Wappingers Falls, N.Y. Gentlemen: In accordance with your direction at the September 30th meeting of the Town Board, we authorized New England Pipe Cleaning Co. to seal the manhole and line between Manhole #178 and Cider Mill Loop on All Angels Hill Road. This area is just north of Cider Mill Loop wherein our letter of August 22nd indicated that the line had failed the test. The contractor agreed to do the job for $500 and the work was completed on October 6, 1975. We find the work, as done, is in order and are providing the contractor with a voucher. JENSEN moved that Mr. Lapar's report concerning the sealing of manhole #178 be received and placed on file with a copy of same forwarded to Mr. Jack Hill of the Dutchess County Department of Health. Roll Call Vote: 4 Ayes 0 Nays Under Committee Reports, Mr. Versace advised the Board that he attended the Tri -Municipal Committee Meeting held October 2nd in the County Office Building, and proceeded to give a report on it. He pointed out the areas of concern of Audit and Control with regard to Tri -Municipal, his conderns ❑n the three phases of the project and the time table for receipt of Federal and State Grants, and funds the Town would have to lay out. He believed the Town Board should hold another informational meeting with the Town residents and make them aware of the position the Town is really in at this point. The only decisions he would make in the future would be after meeting again with the public and hearing their feelings. Mr. Jensen enlarged somewhat on the Tri -Municipal Com- mittee meeting. He believed that when and if Audit and Control grants approval to Tri -Municipal that would be the time to assess what the next step would be. Discussion followed prompted by questions from the floor by Mr. Incoronato, Mrs. Morley, Mr. Hirkala and Mr. Jensen, Mr. Versace and Mr. Clausen. MR. CLAUSEN moved that the Town Board hold an informational meeting for discussion on Tri -Municipal, on October 28, 1975 at the Wappinger Junior High School. Seconded by Mr. Versace. Roll Call Vote: Councilman Clausen Aye Councilman Jensen Nay Councilman Saland Absent Councilman Versace Aye Supervisor Diehl Aye Mr. Jensen indicated a nay vote was based on the fact that, first the Budget had not as yet been finalized, and to put another burden 1115 41 on the Board at this time was too much to ask, and he firmly believes they should wait until approval from Audit & Control has been received. Mr. Versace requested that the Comptroller to the Town be -asked to get together with the Engineer to prepare cost figures to be presented at this meeting. There were further questions from the floor from Mrs. Morley, Mr. Fulton and Mr. Hirkala, regarding Tri -Municipal Funding. Supervisor Diehl called a recess at 10:00 P.M. Supervisor Diehl called the meeting back to order at 10:15 P.M. with all Board members being present, with the exception of Mr. Saland. Before continuing with the Agenda, Mr. Diehl requested that Mr. Jensen forward to the Town Board copies of any past minutes that have been taken at Tri -Municipal meetings, and, in the future, to continue present copies of the minutes to the Board. Mr. Jensen agreed to so keep the Town Board informed. Connie Smith Co -Chairperson of the Town of Wappinger Centennial had requested to be placed on the agenda for the purpose of extend- ing thanks to the Board for their efforts and participation in the projects undertaken by the Centennial Committee. She was not present however, but Mr. Clausen took this opportunity to officially thank the Chairpersons of the Centennial Parade for their tremendous efforts and hard work, this encompassed any and all of those who worked for the projects. All the Board concurred, and it was recom- mended that the TownClerk extend these sentiments in the form of letters to all those who participated. A vacancy still existed on the Town Planning Board, therefore the matter was placed before the Board for their consideration. 342 The following resolution was offered by COUNCILMAN VERSACE who moved its adoption: RESOLVED, that Virginia Keeler be and she hereby is appointed to fill the vacancy on the Planning Board of the Town of Wappinger which has occurred by reason of the resignation of Allan B. Cook, and it is further RESOLVED, that the said Virginia Keeler be and she hereby is appointed to fill such vacancy for the remainder of the term which shall expire on January 4, 1980. The following resolution was offered by COUNCILMAN CLAUSEN, who moved its adoption: RESOLVED, that Regis Fields be and he hereby is appointed to fill the vacancy on the Board of Assessment Review of the Town of Wappinger which has occurred by reason of the expiration of the term, and it is further RESOLVED, that the said Regis Fields is hereby appointed to the said Town of Wappinger Board of Assessment Review for a term which shall expire on the 30th day of September 1980. Supervisor Diehl directed the matter be tabled. October 3, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Meter Test Bench for the Central Wappinger Water Improvement Area and all other Water Improvements to the districts in the Town of Wappinger Gentlemen: Some months ago it was requested that my office investigate the possibility of putting in test benches and possibly repairing of meters. Subsequent discussions with Camo Pollution Control, various manufacturers, and other people in the field, by members of my organization, have indicated that at a price of $35.00 or $40.00 a meter it is uneconomical to spend the man-hours and the labor to repair meters when anything other than a very minor problem exists. It is, therefore, our recommendation that a test bench, to test the accuracy of the meter and to make possible minor repairs, be set up in the appropriate area, possibly the Oakwood Knolls Treat- ment Plant building. VERSACE moved to accept Mr. Lapar's recommendation concerning a test bench, and that if this is to be situated at the Oakwood Knolls Treatment Plant Building, rental should be charged to what- ever water district or improvement area these meters will come from and that this rental be applied to the operation and maintenance of the Oakwood Water Plant. The Engineer and Comptroller to decide a fair and equitable charge. Seconded by Mr. Clausen. Roll Call Vote: 4 Ayes 0 Nays The following report was received: X44 October 3, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Central Wappinger Water Improvement Computer System Readouts Gentlemen: It is my understanding that, at present, various homeowners are placing meters in their homes and the tape readout that will eventually be put on the computer is not being installed for the obvious reason that we have not actually gone into that phase of meter reading. Some homeowners are aware of the situation and have asked who will be responsible for this readout when a system is eventually installed. If the Board will take this question under consideration and provide us with an answer, we would be most appreciative. Very truly yours, s/ Rudolph E. Lapar, P.E. MR. JENSEN moved to direct to the Building Inspector who inspects these connections, tht the readouts, when they are provided with said meters, be installed at the same time as part of the inspection. DIEHL moved that a Special Meeting be held on Thursday, October 16, 1975 at 9 P.M. at the Town Hall for the purpose of setting a date for the Public Hearing for the Town of Wappinger Budget for the year 1976, and secondly, to review and consider awarding the bid for repairing the retaining wall in the parking area in the rear of the Town Office Building. Seconded by Mr. Jensen. Roll Call Vote: 4 Ayes 0 Nays Mr. Versace questioned Mr. Horton as to the Town's position as to the roads in Ye Olde Apple Orchard. Mr. Horton indicated they have not been accepted as yet as they have not met the specifications. Mr. Versace's second concern reflected the concern of the Recreation 345 • Commission regarding the extension of the runway and that some trees in the Quiet Acres Recreation site would be either taken down or topped. Mr. Maurer had stated that since there is going to be some moneys allowed for the taking down of these trees by the homeowners, he would like to know if the Recreation Commission or the Town is entitled to such moneys too. He asked that Mr. Rappleyea be directed to check into this. Mr. Clausen questioned whether this was still to be done. Mr. Huber, being recognized by the Chair offered information he had gathered, which indicated these trees were to be removed or topped, no matter what. The tactics used in attempting to obtain permission were not ethical in the strict sense, approaching each person with the "line" that they were the only hold out to sign, that everyone else had - when, in fact, no one had - it seems to him that the County Public Works Department was_getting a little bit too powerful, when they go in and try to coerce people to sign papers, especially without giving all the facts. MR. DIEHL moved that the Attorney to the Town be instructed to draft a letter with the Town Clerk to Mr. Spratt of the Dutchess County Department of Public Works informing him of the information received at this meeting and it appears that false information and X,1 truths are being passed out in regard to the airport and trimming the trees and that he should certainly immediately instruct any officials of his Department, or persons hired by his Department, in making this survey, to present the facts truthfully and honestly, and further, to direct the Attorney to the Town to stand by and assist the residents of Quiet Acres in any way they feel necessary.
