ADJOURNMENT 299 The Regular Monthly Meeting of the Town Board of the Town of Wappinger was held on September 8, 1975 at 8:00 P.M. at the Town Hall, Mill Street, Wappingers Falls, New York. Supervisor Diehl called the meeting to order at 8:03 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: William Horton, Superintendent of Highways Allan Rappleyea, Attorney to the Town Rudolph Lapar, Engineer to the Town The Minutes of the Regular Monthly Meetings of June 9, 1975, July 19, 1975 and August 11, 1975 and Special Meetings of April 17, 1975 April 30, 1975, May 19, 1975, June 3,•1975, June 24, 1975, July 8, 1975 and August 4, 1975, having been previously sent to the Town Board Members, were now placed, before themfor their approval. MR. CLAUSEN moved the minutes of the Regular Monthly Meetings of June 11, July 14, and August 11, 1975 and Special Meetings of April 17, April 30, May 19, June 3, June 24, July 8 and August 4, 1975, as submitted by the Town Clerk be and they are hereby approved. Seconded by Mr. Jensen. Motion Unanimously Carried Reports for the month of August were received from the Supervisor, Town Justices, Building Inspector and Zoning Administrator. MR. CLAUSEN moved the August Reports from the. Supervisor, Town Justices, Building Inspector and Zoning Administrator be accepted and placed on file. Seconded by Mr. Jensen. Motion Unanimously Carried OL do 69 An application for a Peddling & Hawking License was received from Nicholas D'Onofrio. The application had been referred to the Dutchess County Sheriffs Department, and returned indicating no criminal record on file. MR. SALAND moved to approve the application and grant Nicholas D'Onofrio a license for Hawking and Peddling in the Town of Wappinger. Seconded by Mr. Versace. Motion Unanimously Carried A letter was received from Richard R. and Nancy L. Long, Lydia Drive, calling the Town Board's attention to their concern over the possibil- ity of blasting in the area .of their home in connection with the construction of sewer lines. It is their intent to hold the Town responsible if they suffer damages to either home or property due to blasting. A copy of a letter was also received from Mr. J. Paggi, Jr. (from Mr. Lapar's Office) to Mr. Lombardi, the contractor in this area, regarding this matter and suggesting they put their insurance company on notice prior to start of construction. MR. JENSEN moved to receive Mr. & Mrs. Long's letter and place it on file. Seconded by Mr. Clausen. Motion Unanimously Carried A letter of resignation was received from Nancy Moreau, as a member of the Town of Wappinger Conservation Advisory Council, MR. CLAUSEN moved to receive Mrs. Moreau's resignation with regret, and a letter of appreciation be sent to her. Seconded by M. Saland. Motion Unanimously Carried The resignation of Patricia Reydel as an Election Inspector (d) was received, and it was so noted that both Eileen Faye (D) and Lois Galarise (D) ware unable to act as Inspectors also. The Democratic Committee Chairman's recommendation these three Inspectors be replaced by Carolyn Lane, Rose Wells, and Ann Byrum 301 respectively. MR. CLAUSEN moved that Carolyn Lane be appointed as an Election Inspector (D) for District 11; Rose Wells be appointed as an Election Inspector (D) for District 18' and Ann Byrum be appointed as an Election Inspector (D) for District 20. Seconded by Mr. Versace. Motion Unanimously Carried The Town Clerk informed the Board that she had been served with the following Tax Reviews: Benderson Development Co. Inc.; Brack Construction Corp; Leemults Petroleum; D.W.S. Holdings Inc; WVC Reality Corp; DWS Holdings Corp; Land Properties Co.; Land Properties and City of New York. It was further noted by the Clerk that service of a Tax Review from EJA Holding Corp. was served on Gladys Timbo, the Clerk to the Assessor. Another proceeding, John Plantanga vs. the Town of Wappinger et al was served on the Town Clerk (this was a proceeding to acquire clear title on a piece of property in Pough- keepsie which had at one time belonged to the school district). MR. CLAUSEN moved that Allan Rappleyea, Attorney, be appointed to answer and defend these Tax Reviews, and the proceeding of John Plantinga on behalf of the Town of Wappinger. Seconded by Mr. Jensen. Motion Unanimously Carried Requests to attend conferences were received from Judge Francese, Annual Magistrates Conference, Grand Island, New York, September 21 to 24, 1975; Bruno Hermans, N.Y.S. Building Officials School, Fallsview, Ellenville, New York, September 17 to 19, 1975; Town of Wappinger Planning Board and Zoning Board members, Planning Federation, Gros - singers, October 19 to 21, 1975; and Thomas Logan, Assessor requested permission to attend Society of Real Property Appraisers Course 201, at the Unviersity of Massachusetts, Amherst, Mass. Oct. 27 thru Nov. 7, 1975. MR. CLAUSEN moved that all the requests for attendance at either conferences or school be granted, and that their legitimate expense be Town charges. Seconded by Mr. Jensen. Motion Unanimously Carried The matter of the annual appointment of Dog Enumerator/s was placed before the Board. MR. CLAUSEN moved that Janet Dean be appointed as Dog Enumerator for the Town of Wappinger for this year. Seconded by Mr. Jensen. Motion Unanimously Carried Letters had been received from Mr. Charles Bannett, and Albert Roberts, his attorney indicating their attempts to secure a meeting with the Town Board relative to Mr. Bannett's and Mr. John Pirrungs' application for a PUD (cluster zoning) rezoning of their property on Robinson Lane. They are contemplating a Senior Citizens Complex of either condominiums or co-operative apartments. Both letters respectfully requested an executive meeting between the Town Board and themselves for discussion. MR. CLAUSEN moved that an executive meeting be held on September 22, 1975 at 8:00 P.M. Town Hall to meet with Mr. Bannett and his attorney Mr. Roberts, and have available the proposal and maps at this meeting; along with information on setting up the legalities forwarded to Mr. Rappleyea before this meeting with reference to condominiums or associations. Seconded by Mr. Jensen. Motion Unanimously Carried Mr. Versace requested being excused from the meeting since he has twice met with Mr. Bannett and already voiced his opinion regarding this proposal (Mr. Saland will be away on vacation and unable to attend). 30 The following letter was received: August 26, 1975 Town Board Town of Wappinger Gentlemen: Please consider this an official request for an ordinance governing garage sales. I feel strongly some legislation is necessary such as; permit and control of signs. There does seem to be a proliferation of sales and signs. Some garage sales are held as often as once a month as the same address. It seems to me that this could be considered a business in the home. The signs are continuously left up to become a worn out eyesore. Your aid regarding this matter will be greatly appreciated. Yours truly, s/ Sylvia Anderson Some discussion followed such as how would it be patrolled, what penalties, what fees, exemptions. Mr. Saland construed the request as pertaining to the signs only as being an eyesore to which he concurred. It was recommended that Mrs. Anderson clarify her request and perhaps submit a rough draft of an Ordinance if she has any example ordinances from other municipalities that she can draw from, and if she so desires, contact Mr. Rappleyea to ask for assist- ance, so she may have something before the Board next month. The following letter was received: August 26, 1975 Memo: Town Board Re: Penalty policy -water and sewer rents. Gentlemen: Occasionally we run into a situation where an individual will refuse to pay a penalty on the water and/or sewer rent because -- the bill was never received or, the bill had been sent to the previous owner, or, payment was mailed but must have gotten lost in the mails, or any number of other explanations. In the past I have always enforced the penalty and collected same unless I was directed otherwise by the "water and sewer department" As of now, I believe neither the water and sewer department nor myself have any authority to relieve a penalty from a billing. Therefore, I would appreciate a specific directive from the Town Board. s/ Amelia Crosby �3O4 Mr. Jensen asked Mr. Rappleyea if it were not true that it was the responsibility of property owners for all taxes due, regardless of whether they get their bills or not. Mr. Rappleyea stated that was correct. He added it was an affirmative duty to examine the records to determine whatever charges are due. One thing he would like to do would be to circulate a letter to the Dutchess County Board of Realtors and to the Dutchess County Bar Association, and perhaps to the area banks, indicating that it would be a good idea, upon the transfer of title, a determination be made at the Town Offices to determine if there were outstanding sewer or water bills as the Town is now actively engaged in that business. He would find it hard to make a policy speaking of exceptions for relief of penalties. MR. JENSEN moved that it be reaffirmed that it is an automatic process as all taxes, if there are penalties due they must be paid, and further, a letter be directed to the Dutchess County Board of Realtors and the Dutchess County Bar Association stating that the Town be con- tacted when transfers of title do take place to ascertain if there are outstanding water and/or sewer bills, and also inform the Town of new ownership. Seconded by Mr. Versace. Motion Unanimously Carried The following letter was received: August 20, 1975 Town Board Town of Wappinger Town Hall Wappingers Falls, N.Y. Re: Cranberry Hills Development Water Supply and Sewage Disposal Gentlemen: Pursuant to condition No. 2 of the tentative approval granted by your Planning Board on 4 August 1975, we met with the Dutchess County Department of Health to discuss alternate nethods of water supply and sewage disposal. C After a presentation of all the proposed alternates as noted in our development report dated 19 May 1975, the Health Department stated that it would be much more desirable to utilize existing water and sewer facilities within the Wappinger Water and Sewer Improvement areas rather than develop new ones. It is therefore, requested that the developments' water and sewage needs, which are estimated at approximately 102,000 gallons per day for Stage One and 92,800 gallons per day for Stage 2 be accommodated by the Central Wappinger Water Improvement District and the Wappinger Sewer Improvement District #1 respectively. It should be noted, that it is the intent of the developer to participate in the funding of any necessary upgrading or expansion requirements. We would appreciate receiving comments from the Town Board and the Town Engineer with respect to the aforementioned proposal. Very truly yours, s/ Gary A. Tretsch MR. CLAUSEN moved that an executive meeting be scheduled with the principals of Cranberry Hills Development along with the Engineer and Attorney to the Town and Town Board for September 30, 1975 at 8:00 P.M. at Town Hall. Seconded by Mr. Jensen. Motion Unanimously Carried The following letter was received: August 26, 1975 Town Board Town of Wappinger New York Gentlemen: I have been informed by Mr. Lapar, the Town Engineer, that the Moccasin Hill Water Mains have been accepted. According to our agreement at the time that the District was formed, we will now bill the District through the Master Meter. This will be done for the next quarter beginning October 1, 1975, ending December 31, 1975. We would also like to turn over the individual meter reading at the same time. The first responsibility of the District for billing the consumers would occur in January. You may have your representative call my office and we will make arrangements to turn over the meter book and other pertinent records. I have enclosed a copy of a letter from Mr. Lapar which outlines the terms of the operating agreement which we have with the District. 2O5 Very truly yours, s/ Seymour M. Arkawy /4i , 506. MR. CLAUSEN moved that, subject to the regulations of the Engineer and Attorney, the meter rates be collected as of January 1, 1976 in the Watch Hills Water Improvement. Seconded by Mr. Versace. Motion Unanimously Carried A memo was received from R. E. Lapar regarding, to the best of his recollection, the history of the downstream drainage charge. He indicated the desire to meet with the Board to determine an official policy. Discussion followed with Mr. Steinhaus as to the proceedures the Planning Board follows, together with the recol- lections of what the Board has done in the past. Mr. Steinhaus recommended a fee schedule be established, that would be equitable, and set forth in the Subdivision Regulations. It was finally agreed to meet in executive session, to discuss this matter in more detail, on September 30th, after the Board meets with the D.W.S. principals. The following letters were read: August 28, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Downstream Drainage Charge Jack Davis Site Plan Gentlemen: As per your request, my office has made the following calculation of a proposed downstream drainage charge for the above captioned site plan based on a charge to the Kent -Sussex Project which is in the same drainage basin. Since the 34.4 acres of Kent -Sussex was charged $40,000, it is proposed to charge the Jack Davis Site of 3.39 acres -$3,942. Very truly yours, s/ Rudolph E. Lapar, P.E. September 5, 1975 Town of Wappinger Planning Board Wappingers Falls, New York Gentlemen: 307 We have been advised by the Town of Wappinger Supervisor that one of the conditions necessary to obtaining a. building permit for the construction of a bank on the corner of Middlebush Road and Route 9 is a contribution to the Town of Wappinger Drainage Fund. The figure of $3,942 was mentioned as my acres I own. Sincerely yours, s/ Jack Davis Mr. Diehl asked Mr. Lapar if it would be reasonable to revise the fee as requested by Mr. Davis. Mr. Lapar indicated that although the site plan was for a small portion of the property, Mr. Davis has disturbed the entire parcel. MR. VERSACE moved that Mr. Jack Davis's request for permission to pay in installments on his downstream drainage fee be denied, due to the fact that the entire parcel has been disturbed, and that he, therefore, be required to pay the entire fee as recommended by Mr. Lapar, and further, that a Hold Harmless Bond be required as part iime of the approval. Seconded by Mr. Clausen. The following report was received: Motion Unanimously Carried August 22, 1975 August 22, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Exfiltration Test - Rockingham Farms Sewer District Line Between M.H. #178 and Dead End Manhole North of Cider Mill Loop along All Angels Hill Road Gentlemen: My office has inspected the above captioned test and we find that it has failed. We have suggested that possibly an air test and fixing of the lines is now in order. My inspector's report is enclosed for your perusal. Very truly yours, s/ Rudolph E. Lapar, P.E. Subject: Exfiltration Test in Rockingham Farms Sewer District Date: August 12, 1975 By: Robert J. Church An exfiltration test was performed on the sanitary sewer line between manhole #178 and the dead end manhole north of Cider Mill Loop, along All Angels Hill Road, on August 12, 1975. Camo Pollution Control, Inc. performed the above test and results showed that the line would not hold water long enough to pass with an allowable rate of exfiltration. However, a test was performed for one minute and the water level dropped 5 inches in the dead end manhole. Camo believes that the water exfiltrates in the northern section of the line and infiltrates directly into manhole #178. A possible solution to the problem would be to put an air exfiltration test on the entire line in sections in order to accurately pin point the leaks. Once found, it would be possible to seal the leaks through various methods. MR. JENSEN moved that the Engineer to the Town be directed to con- tact either Penetryn or one of the other contractors to fix the exfiltration problem in the Rockingham Farms Sewer District line between N.H. #178 and dead end M.H. north of Cider Mill Loop along All Angels Hill Road for a cost not to exceed $500.00. Seconded by Mr. Clausen. Motion Unanimously Carried 309 The following letter was received: August 29, 1975 Town Board Town of Wappinger Town Hall - Mill Street Wappingers Falls, N.Y. Re: Agreement for Engineering Services relative to Ardmore Hills Water Improvement= and- Engineering Services relative to various sewer and water districts and/or improvements where major construction has been completed and the original contract is terminated as a result thereof Gentlemen: Several months ago the above captioned agreements were sent to Mr. Allan E. Rappleyea for his approval and I assume that they have met all the legal requirements. I would, therefore, appreciate that the authorization for contracts be forthcoming since, in some cases, the Town has been billed by my organization on the basis of these contracts and I would, at this time, like to formalize them. Seconded by Mr. Clausen. Motion Unanimously Carried Under Committee Reports, Mr. Jensen first reported on the meeting in Albany with the Town Board and Audit and Control in reference to the Wappinger Sewer Improvement #2 (Tri -Municipal). He, Mr. Diehl, the Engineer and Attorney to the Town had a lengthy meeting with Mrs. Sheila Gordon in reference to both Sewer Improvement #1 and #2. A resolution will be presented tonight indicating to Audit and Control the intent of the Town to lease the Spook Hill Line on a fee basis to Sewer Improvement #2. This would serve as antici- pated revenue for the residents in Sewer Improvement #1, to help lower the cost of the benefit unit charge to those residents in Sewer Improvement #1. Dagney Morley being recognized by the Chiar, had several questions regarding the leasing of this line. Further, on Committee Reports, Mr. Jensen stated the Board met last week with the Recreation Commission, at which a presentation was made to the Town Board on a joint comprehensive planning with the County. There are funds available to the Town and if the Town goes in jointly with the County, 50% of the expenditures for speci- fically funded programs is returnable. A resolution will be pre- sented later tonight on this topic for consideration. Mr. Saland reported on the County Landfill Committee hearing held out at Parkers Outdoor World which he, Mr. Diehl and Mr. Jensen attended. He remarked that he would have to believe that the imput that the residents of the Town of Wappinger delivered at that time had some bearing on the subsequent withdrawal of support by the County Executive on the favorability of this site for a landfill, however, this should not be grounds for the Town to relax, and he further believes a public hearing by the County shall he held and well attended if it is held. Mr. Lynn Huber, being recognized by the Chair, indicated that he had heard a rumor that Mr. Gubitosi had filed with the County Health Department for permission to open a private landfill site. He felt the Board should be apprised of this possibility. Mr. Diehl remarked, upon identifying Dennis Truett in the audience, that he had spoken with Mr. Truett today in regard to the problem of drainage on his property, and his offer to participate to the amount of $2,000 in correcting the drainage problem. Mr. Diehl informed Mr. Truett that this was discussed earlier, and the deci- sion arrived at was that the Board is of the feeling that they are not responsible for the problem and will make no attempt to accept Mr. Truett's offer on the drainage problem. The following Resolution was offered by SUPERVISOR DIEHL who moved its adoption: RESOLVED, that the Town Board has reached the decision not to cooperate or participate or accept the offer of $2,000 from Dennis Truett to ward the correction of the drainage problem that has been discussed with him on various occasions. Seconded by Mr. Saland. Motion Unanimously Carried The matter of the vacancy on the Planning Board was placed before the Board. Mr. Diehl stated that there appeared to be no intent to propose names for consideration tonight to fill this vacancy. The matter of the Amendments to the Central Hudson Street Lighting Contracts was placed before the Board for their consideration. Supervisor. Diehl directed the matter be tabled for further discussion at the executive meeting on September 30, 1975. The following Resolution was offered by COUNCILMAN JENSEN who moved its adoption: WHEREAS, the Town Board of the Town of Wappinger has made an application to the New York State Comptroller for the approval of Wappinger Sewer Improvement No. 2, and WHEREAS, Wappinger Sewer Improvement No. 2 is a proposed sewer improvement area related to the construction, operation and maintenance of Tri -Municipal Sewer Improvement Project, and WHEREAS, in the event the Wappinger Sewer Improvement No. 2 becomes a reality and is constructed in accordance with the plans and specifications, the Spook Hill sewer trunk line located in the Town of Wappinger will become an integral part of said Wappinger Sewer Improvement No. 2, NOW, THEREFORE, be it resolved that upon the construction, operation and maintenance of Wappinger Sewer Improvement No. 2, the Town Board of the Town of Wappinger will make an appropriate charge to Wappinger Sewer Improvement No. 2 on behalf of Wappinger Sewer Improvement No. 1, for the use of the Spook Hill sewer line so as to pay and recover on behalf of Wappinger Sewer Improvement No. 1 the cost of construction and maintenance of said trunk line, which charge shall be at least equal to the annual service charge for the debt incurred to construct such line together with any other charges the Town Board shall elect to enforce. The following Resolution was introduced by COUNCILMAN JENSEN who moved its adoption: The Town Assessor is hereby authorized and directed to prepare an assessment roll for the Wappinger Sewer Improvement No. 1 in accordance with the following standards: 1. All property within the benefit area shall be assessed. 2. The formula for such assessment shall be as follows: a. A single family house on a lot of less than two acres" - one benefit unit. Where acreage over two acres - .2 benefit unit for each acre or part thereof over two acres. b. Vacant residential land less than two acres - .8 benefit unit. c. Residential acreage in excess of two acres - .8 benefit unit for the first two acres, .2 benefit unit for each acre in excess of two acres. d. Multi -family residential units - .75 benefit units per residential dwelling unit. e. Individual, commercial institutional and exempt properties shall be assessed by a computation whereby the assessed valuation shall be computed in relation to the assessed valuation of all property within the benefited area, and a benefit unit assigned in accordance with the ratio which the subject property bears to the total assessed valuation within the benefited area. f. The Pond View Development and the Kent Road development which have received Planning Board approval, and which can be served shall be placed upon the assessment roll. g. The lands which can not be served in the judgment of the Assessor shall be assessed at one-third of the full benefit units, which would normally be assigned if the property could be served. Seconded by: Mr. Saland Roll Call Vote: 5 Ayes 0 Nays RESOLUTION DIRECTING ASSESSOR TO COMPLETE ASSESSMENT ROLL FOR CENTRAL WAPPINGER WATER IMPROVEMENT AREA. The following Resolution was introduced by COUNCILMAN JENSEN who moved its adoption: The Town Assessor is hereby authorized and directed to prepare an assessment roll for the Central Wappinger Water Improvement Area in accordance with the following standards: 1. All property within the benefit area shall be assessed. 2. The formula for such assessment shall be as follows: a. A single family house on a lot of less than two acres - one benefit unit. (Where acreage over two acres - .2 benefit unit for each acre or part thereof over 2 acres). b. Vacant residential land less than two acres - .8 benefit unit. c. Residential acreage in excess of two acres - .8 benefit unit for the first two acres, .2 benefit unit for each acre in excess of two aCres. d. Multi -family residential units - .75 benefit units per residential dwelling unit. e. Individual, commercial, institutional and exempt properties shall be assessed by a computation whereby the assessed valuation shall be computed in relation to the assessed valuation of all property within the benefited area, and a benefit unit assigned in accordance with the ratio which the subject property bears to the total assessed valuation within the benefited area. f. The Pond View Development and the Kent Road development which have received Planning Board approval, and which can be served shall be placed upon the assessment roll. g. The lands which can not be served in the judgment of the Assessor shall be assessed at one-third of the full benefit units, which would normally be assigned if the property could be served. Seconded by: Mr. Saland Roll Call Vote: 5 Ayes 0 Nays RESOLUTION ESTABLISHING ASSESSMENT ROLL FOR OAKWOOD KNOLLS WATER DISTRICT The following Resolution was introduced by COUNCILMAN JENSEN who moved its adoption: The Assessor is hereby authorized and directed to establish an assessment roll for the Oakwood Knolls Water District providing as follows: One benefit unit for each single-family dwelling unit, or part thereof. One benefit unit for each five acres or part thereof of vacant land. Seconded by: Mr. Diehl Roll Call Vote: 5 Ayes 0 Nays The following Resolution was introduced by COUNCILMAN JENSEN who moved its adoption: The Assessor is hereby authorized and directed to prepare an assessment roll for the Fleetwood Water and Sewer District providing that siggle-family dwellings shall be assigned one benefit unit for each single-family residences and multi -family dwelling units shall be assigned .75 benefit units for each dwelling unit. Seconded by: Mr. Saland Roll Call Vote: 5 Ayes 0 Nays The following Resolution was offered by COUNCILMAN VERSACE who moved its adoption: WHEREAS, the Town of Wappinger desires to apply to the Dutchess County Youth Board for inclusion in the Comprehensive Plan for youth services and recreation in Dutchess County and therefore be eligible for reimbursement from the New York State Division for Youth, NOW, THEREFORE, BE IT RESOLVED that said Town of Wappinger will comply with the rules and regulations as set forth by the State Division for Youth in "Guidelines for Comprehensive Youth Services Planning. Clausen Roll Call Vote: 5 Ayes 0 Nays The following Resolution was introduced by COUNCILMAN VERSACE who moved its adoption: The Deputy Comptroller and the Supervisor are hereby authorized and directed to pay the sum of $1,927.32 to the owners of the lots in the original Oakwood Knolls Sewer District (as the same may be determined by the records of the Assessor on September 2, 1975), in equal proportion and provided said lots were served by said system. Seconded by: Councilman Clausen Roll Call Vote: 5 Ayes 0 Nays Dagney Morley, being recognized by the Chair, questioned whether those residents who qualify for the over 65 tax exemptions would also be able to have the Benefit Unit charges reduced by one half. Mr. Rappleyea answered no. A short discussion followed on the legislature affecting tax reductions and the proceedures to change it. Mr. Diehl suggested that Mr. Rappleyea investigate Mrs. Morley's question. Mr. Clausen asked Mr. Horton if he had a report on the drainage system on Fenmore Drive. Mr. Horton reported the project was completed satisfactorily. Mr. Clausen commended Mr. Horton for his speedy action on placing the drainage pipe in this area. MR.
