1975-08-25 SPM295 A Special Meeting of the Town Board of the Town of Wappinger was held on August 25, 1975 at the Town Hall, Mill Street, Village of Wappingers Falls, New York. Notice of said meeting was_n fled to each Board member on August 19, 1975, calling the meeting for August 25, 1975 at 8:15 P.M. at Town Hall for the purpose of authorizing the Engineer to the Town to evaluate Test Borings regarding the Landfill at Parkers Outdoor World Property, and any other business that may properly come before the Board. Supervisor Diehl called the meeting to order at 8:45 P.M. Present: Louis Diehl, Supervisor Louis Clausen, Councilman Leif Jensen, Councilman Stephen Saland, Councilman Frank Versace, Councilman Elaine H. Snowden, Town Clerk Others Present: Rudolph Lapar, Engineer to the Town Allan Rappleyea, Attorney to the Town MR. DIEHL moved to authorize Mr. Lapar to advertise for bids for Contracts for Ardmore Water District, with a clause that this is conditional upon approval from New York. State Department of Audit and Control, and further, that the Attorney, Mr. Rappleyea compose a letter to all residents of this district explaining to them that contratts are going out for bid, subject to approval from Audit and Control and the Town Clerk mail this letter to each resident. Seconded by Mr. Jensen Roll Call Vote: 5 Ayes 0 Nays MR. DIEHL moved that Mr. Lapar be authorized to bid on contracts for Wappinger Park Storm Drainage with a stipulation that this project be completed before December 31, 1975 and that Mr. Rappleyea be directed to negotiate with Mr. Henry Kowolski to obtain and finalize the easement necessary for this project. Seconded by Mr. Clausen Roll Call Vote: 5 Ayes 0 Nays The next subject the Board discussed was the proposed landfill site at Parker's Outdoor World property in the Town of Wappinger. MR. DIEHL moved that, since the Town of Wappinger is on record as being in opposition to any proposed landfill site in the Town of Wappinger, as well as on Parkers Outdoor World Property, the Engineer to the Town, therefore, be authorized and directed to represent and advise the Town Board by preparing an independent engineering evaluation report of the County's Test Borings and Maps in regard to the proposed County Landfill site on Parkers Lands; and, further, that Allan E. Rappleyea, Attorney to the Town, be empowered and directed to move under the Freedom of Information Law to obtain all of the information necessary for tt {e compilation of a comprehensive Engineering report if the County of Dutchess will not release said Test Borings and Maps by this weeks' end. Seconded by Mr. Jensen Roll Call Vote: 5 Ayes 0 Nays Mr. Rappleyea reported that verbal communciation has been received that the Town of Wappinger has a right to appear on the Agenda at the County Board of Legislators at their September 8th meeting, at 4:00 P.M. for the purpose of discussing drainage (Myers Corners Road and New Hackensack Road). Mr. Jensenmentioned that he hada call from rMr. "Lapar' si office: t_ 3 concerning a, small ,water ,leak at 39 Tor. Road. Discussion then followed on where the responsibility lies regarding the water lines -- is the responsibility of the homeowners from the main or curb box. He is still of the opinion that from the main to the curb box should be the Town's responsibility. Should the problems be handled on an individual basis or should they abide by the position they now have-- 297 that from the main line to the owner's house is the homeowner's responsibility to take care of leaks, etc. Mr. Clausen's reaction was that the Town should assume responsibility from the main only to the property line to avoid problems of trespass. MR. JENSEN moved to direct the Highway Superintendent, the Engineer to the Town and the operator to check the leak at 39 Tor Road, ascertain if the leak is in the service line between the curb box and the main line and if so, to repair said leak. Seconded by Mr. Clausen. Roll Call Vote: 5 Ayes 0 Nays Mr. Jensen asked Mr. Rappleyea's opinion on a proposed ordinance to limit tonnage or a load limit of trucks using Robinson Lane. Mr. Rappleyea said you could not limit this to one road in the Town, there were, no doubt, others that could not take this weight. MR. JENSEN moved to direct the Highway Superintendent to review all Town roads to determine which ones he would deem necessary to have a load limit established for, and report back to the Town Board. Seconded by Mr. Clausen. Roll Call Vote: 5 Ayes 0 Nays MR. CLAUSEN moved to hold an executive meeting on Thursday, August 28, 1975 to discuss rates for the water and sewer districts, with the Town Board, Assessor, Engineer and Town Attorney, and further, request the Supervisor to call Mrs. Laffin, Acting Comptroller, back from vacation and request her to be present at this meeting. Seconded by Mr. Saland Roll Call Vote: 5 Ayes 0 Nays Mr. Jensen reminded the Board there would be a meeting in Albany, September 4, 1975 on Tri -Municipal for those wishing to attend. 29$ MR.
